THE NATIONAL INSURANCE (AMENDMENT) BILL, 2004

Explanatory Note

(These notes form no part of the Bill, but are intended only toindicate its general purport)

The purpose of this Bill is to amend the National InsuranceAct, Chap. 32:01 to improve the operations of the NationalInsurance System by removing obsolete provision and ambiguities,closing loopholes and promoting administrative efficiency for theNational Insurance Board and employers.

Clauses 1 and 2 provide for the short title and interpretation.

Clause 3 would amend section 2 by changing the definitions of“paid apprentice” and “unpaid apprentice”.

Clauses 4, 5, 10 and 12 would amend sections 21(b), 22(1)(d),32(5) and 39A to remove ambiguities.

Clause 6 would amend section 28 to change the definition of“domestic worker”.

Clause 7 would amend section 29 to empower the Board toregister a person over the age of sixteen years.

Clause 8 would amend section 30 to provide for administrativeefficiency and would also place a duty on both domestic and casualagricultural workers to make an application for registration and toinform their employer of the National Insurance RegistrationNumber.

Clause 9 would amend section 30A to give the Board thediscretion to determine the contents of the form.

Clause 11 would amend section 38(1) to provide for new Tablesdealing with contribution.

Clause 13 would amend section 41 to provide for the effectivedates of the rates of contribution listed in the new Tables A1, A2and A3.

Clause 14 would repeal section 45 and substitute a new sectionwhich would empower the Board to determine who is an employerfor the purposes of the Act and also give the Board the duty to placethe employed person in the appropriate class.

Clause 15 would amend section 45A(1) to include penalty inthe demand for payment and also that the interest on the entiresum would be calculated according to section 39B.

Clause 16 would amend section 46 to change from periodicalpayments to a lump sum payment with respect to maternitybenefit; to change the criteria for the granting of survivor’s benefitand employment injury benefit.

Clause 17 would amend section 54 to provide for the new rateslisted in the Tables dealing with benefits.

Clause 18 would amend section 54A to provide for the newrates listed in the Tables dealing with benefits and increments.

Clause 19 would amend the Second Schedule to insert newTables dealing with contribution rates and conversion.

Clause 20 would amend the Third Schedule to insert newTables dealing with benefit rates.

Clause 21 would revoke the National Insurance (Rates ofBenefit) Order, 2003.

BILLAN ACT to amend the National Insurance Act,

Chap. 32:01

[ , 2004]

ENACTED by the Parliament of Trinidad and Tobago asfollows:—

1. This Act may be cited as the National Insurance(Amendment) Act, 2004.

2. In this Act “the Act” means the National InsuranceAct.

3. Section 2 of the Act is amended—(a) in the definition of “paid apprentice”, by

deleting the word “eighty” and substitutingthe words “one hundred”; and

(b) in the definition of “unpaid apprentice”, bydeleting the word “eighty” and substitutingthe words “one hundred”.

4. Section 21(b) of the Act is amended by deleting thewords “fines and interest on dues;” and substituting thewords “penalties, fines, interest on dues and any othersums due to the Board;”.

5. Section 22(1)(d) of the Act is amended by insertingafter the words “which are properly chargeable to”, thewords “the Board’s”.

6. Section 28 of the Act is amended by deleting thedefinition of “domestic worker” and substituting thefollowing definition:

“ “domestic worker” means a person employedotherwise than for the purpose of a trade orbusiness who performs services for thecomfort or convenience of a household or inor about a dwelling-house or such otherpremises occupied by or under the control ofthe employer and includes such employedpersons as may be prescribed.”.

7. Section 29 of the Act is amended—(a) in subsection (2)(a), by deleting the word

“eighty” and substituting the words “onehundred”;

(b) in subsection (3), by deleting the words“2nd May, 1999”, “3rd May, 1999” and“eighty” and substituting the words“1st February, 2004”, “2nd February, 2004”and “one hundred”, respectively; and

(c) by inserting after subsection (3), thefollowing subsection:

“ (4) Notwithstanding any provisionof this Act or any other written law tothe contrary, the Board may register aperson over sixteen years of age whereit deems it necessary to do so.”.

8. Section 30 of the Act is amended—(a) in subsection (1)—

(i) by deleting the words “prescribedform” and substituting the words“form determined by the Board”;and

(ii) in paragraph (b), by insertingafter the words “each employedperson”, the words “, except adomestic worker or casualagricultural worker,”;

(b) in subsection (4), by deleting the words “onthe prescribed form” and substituting thewords “in the form determined by theBoard”; and

(c) by repealing subsection (5) and substitutingthe following subsection:

“ (5) A domestic worker or a casualagricultural worker shall—

(a) within seven days from thedate of his first employment,make an application forregistration in the formdetermined by the Board;

(b) within fourteen days from thedate of any employment,inform his employer ofhis National InsuranceRegistration Number; and

(c) notify the Board of any changein employer or employment.”.

9. Section 30A of the Act is repealed and thefollowing section substituted:

30A. Every employed person or unpaidapprentice upon registration shall beissued with a National InsuranceRegistration Card, in such form andcontaining such information, as the Boardmay determine.”.

10. Section 32(5) of the Act is amended by—(a) deleting the words “hinders or” and

substituting the words “threatens,hinders,”;

(b) inserting a comma before the word “unless”and after the words “to do so”; and

(c) deleting the words “or pursuant to”.

11. Section 38(1) of the Act is amended by deleting thewords “Table A” and substituting the words “Tables A1,A2 and A3”.

12. Section 39A of the Act is amended by deleting thewords “as a contribution under this Act and deducted bythe employer from the salary or wages of his employees”and substituting the words “that is deducted from hissalary or wages and from an employer as a contributionunder this Act”.

13. Section 41 of the Act is amended by—(a) renumbering section 41 as section 41(1);

(b) deleting the words “Table A” and substitutingthe words “Tables A1, A2 and A3”; and

(c) inserting after subsection (1), the followingsubsection:

“ (2) The rates of contributionlisted—

(a) in Table A1 are effective from2nd February, 2004 to 2ndJanuary, 2005;

(b) in Table A2 are effective from3rd January, 2005 to 1stJanuary, 2006; and

(c) in Table A3 are effective from2nd January, 2006.”.

14. Section 45 of the Act is repealed and the followingsection substituted:

45. Where an employed person isemployed by more than one person orwhere his earnings are paid jointly by morethan one person during any contributionyear in which a contribution is payable orwhere such employed person works underthe control and management of someperson other than his immediate employer,the Board shall, total all contributions paidfor the employed person in that year andplace the employed person in the highestclass that such total contribution wouldpermit for the number of weeks worked.”.

15. Section 45A(1) of the Act is amended by deletingparagraph (b) and substituting the followingparagraph:

“(b) the amount of the debt due to the Board,including penalty and interest on theentire sum at the rate as specified in sec-tion 39B.”.

16. Section 46 of the Act is amended—(a) in subsection (1)(b), by deleting the words

“periodical payments” and substituting thewords “a lump sum payment”;

(b) in subsection (2)—(i) by deleting the words “survivor

benefit” and substituting thewords “survivor’s benefit”;

(ii) by deleting paragraphs (a), (b) and(c) and substituting the followingparagraphs:

“(a) widow’s pension payableto the widow of thedeceased for life or untilshe remarries, whicheveris sooner, and where thewidow remarries, a grantis payable on the termi-nation of the benefit, byreason of the widow’sremarriage; and

(b) widower ’s pens ionpayable to the widower ofthe deceased for life oruntil he remarries,whichever is sooner, andwhere the widowerremarries, a grant ispayable on the termina-tion of the benefit, byreason of the widower’sremarriage;”;

(iii) in paragraph (e), by deleting thewords “the deceased” whereverthey occur and substituting ineach place, the words “twodeceased insured parents”; and

(iv) in paragraph (f), by deleting thewords “a parent” and “suchparents was” and substituting thewords “parents” and “such parentwere”, respectively; and

(c) in subsection (3)(c)—(i) by deleting subparagraphs (i) and

( i i ) and subst i tu t ing thefollowing subparagraphs:

“ (i) widow’s pension pay-able as from the date ofdeath of the insuredperson to his widowfor life or until sheremarries, whichever issooner, and where thewidow remarries, agrant is payable on thetermination of the bene-fit, by reason of thewidow’s remarriage;

(ii) widower’s pension pay-able as from the date ofdeath of the insuredperson to her widowerfor life or until heremarries, whichever issooner, and where thewidower remarries, agrant is payable on thetermination of the bene-fit, by reason of thewidower’s remarriage;”;

(ii) in subparagraph (iv), by deletingthe words “a parent” and “suchparent was” and substituting thewords “parents” and “suchparents were”, respectively.

17. Section 54 of the Act is amended in subsection (1)by—

(a) inserting after the words “subsection (2)”,the words “and section 54A”; and

(b) deleting the words “A1, B1, C1, D1” andsubstituting the words “A3, B3, C3 and D3”.

18. Section 54A of the Act is amended—(a) by repealing subsection (1) and substituting

the following subsection:“ (1) An insured person who iseligible to receive or is in receipt ofsickness or maternity benefit duringthe period 3rd May, 1999 to1st February, 2004 and continuesto receive benefit on or after2nd February, 2004, shall be paid atthe rate of benefit in accordance withTable A1 in the Third Schedule.”;

(b) by repealing subsection (2) and substitutingthe following subsections:

“ (2) Where an insured person qualifiesfor retirement pension, invaliditypension or survivor’s benefit on or after2nd February, 2004 and payment is tocommence on or after that day, therate of contribution which is to beused to determine the average rate inaccordance with section 54(2) of the Actshall—

(i) where contributions werepaid prior to 11th August,1980 be converted to rates ineffect on 2nd February, 2004in accordance with Table C1of the Second Schedule;

(ii) where contributions werepaid on or after 11th August,1980 to 2nd May, 1999, beconverted to rates in effect on2nd February, 2004 i naccordance with Table C2 ofthe Second Schedule;

(iii) where contributions werepaid on or after 3rd May, 1999to 1st February, 2004, beconverted to rates in effect on2nd February, 2004 inaccordance with Table C3 ofthe Second Schedule; and

(iv) where contributions are paidon or after 2nd February,2004, to 2nd January, 2005,be converted to rates in effecton 3rd January, 2005 inaccordance with Table A2 ofthe Second Schedule;

(v) where contributions are paidon or after 3rd January, 2005to 1st January, 2006, be con-verted to rates in effect on2nd January, 2006 inaccordance with Table A3 ofthe Second Schedule.

(2A) Where an insured personqualifies for sickness benefit ormaternity benefit on or after 2ndFebruary, 2004 and payment is to com-mence on or after that day, the rate ofcontribution which is to be used todetermine the average rate inaccordance with section 54(2) of theAct shall—

(i) where contributions were paidprior to 2nd February, 2004, beconverted in accordance withthe rates shown in Table C4of the Second Schedule;

(ii) where contributions were paidon or after 2nd February, 2004to 2nd January, 2005, beconverted to rates in effect on3rd January, 2005 inaccordance with Table C5 ofthe Second Schedule; and

(iii) where contributions were paidon or after 3rd January, 2005to 1st January, 2006, beconverted to rates in effect on2nd January, 2006 inaccordance with Table C6 ofthe Second Schedule.”;

(c) by inserting after subsection (4), thefollowing subsections:

“ (4A) Persons who qualified for thereceipt of retirement pension,invalidity pension or survivor’s benefiton or after 2nd February, 2004—

(a) shall be paid such benefit inaccordance with Part I ofTables B3 and C3 of theThird Schedule, with effectfrom 2nd February, 2004; and

(b) shall be paid the incrementsto those benefits and suchincrements shall be calculatedat the increased rates inaccordance with Part II of theTables in paragraph (a).

(4B) Notwithstanding the benefitrates in respect of retirement pensionshown in Parts I and II of Table B3 ofthe Third Schedule of the Act, the

Board shall pay with effect from2nd February, 2004, the sum of onethousand dollars monthly, as a pensionto each person qualifying for aretirement pension of less than onethousand dollars under the Act.

(4C) Subsection (4B) applies only toinsured persons who have paid sevenhundred and fifty or more contribu-tions in Trinidad and Tobago.”; and

(d) by inserting after subsection (5), thefollowing subsections:

“ (5A) Persons who qualified for thereceipt of disablement pension ordeath benefit prior to 2nd February,2004 and continue to be eligible toreceive such benefit on or after2nd February, 2004 shall be paidincreased benefit in accordance withTable D3 from 2nd February, 2004.

(5B) Persons who qualified foremployment injury benefit includingdisablement grants, medical expensesand constant care and attentionallowance prior to 2nd February, 2004and continue to be eligible to receivesuch benefits on or after 2nd February,2004, shall be paid such benefits inaccordance with Table D1 and theNational Insurance (EmploymentInjury) Payment of Medical Expenses(Amendment) Order, 1999.

(5C) Persons who qualify for thereceipt of injury, death or disablementbenefit on or after 2nd February, 2004,shall be paid increased benefits inaccordance with Table D3.

(6) Notwithstanding the rates ofbenefit with respect to a survivingchild shown in Tables C1, C2(A),C2(B), C3, D1, D2 and D3 of theThird Schedule, with effect from 2ndFebruary, 2004, the Board shall payto a child qualifying for death orsurvivor’s benefit which is less thanthree hundred and twenty dollarsmonthly, death or survivor’s benefit, asthe case may be, in the sum of threehundred and twenty dollars monthly.

(7) Notwithstanding the rates ofbenefit with respect to an orphanshown in Tables C1, C2(A), C2(B) andC3 of the Third Schedule, with effectfrom 2nd February, 2004, the Boardshall pay to an orphan qualifying forsurvivor’s benefit which is less than sixhundred and forty dollars monthly,survivor’s benefit in the sum of sixhundred and forty dollars monthly.

19. The Second Schedule to the Act is amended byinserting the following Tables:
