    FARMERS MARKET

    RULES AND REGULATIONS

    OPERATIONS

    1.

    The Homegrown Alabama Market Manager, or a designated member, has the right of supervisionand general control of all market operations and shall collect all fees.

    2. Vendors will be notified by April 1 of the start and end dates of the market.3. The market will operate from 3:00 P.M. to 6:00 P.M on Thursdays.4. No sales may occur before 3:00 P.M.5. The designated space for market activities is bounded by the rectangular area of the Canterbury

    Episcopal Chapel lawn located on Hackberry Lane between Ninth Street and University

    Boulevard.

    Vehicular access to the lawn by the sidewalk cut on 9th St. and will be restricted to vendors andHomegrown Alabama market staff only.

    7. Vendors may arrive at Canterbury Chapel no earlier than 1:45 P.M. and no later than 2:30 P.M.8. Vendors may not leave prior to 6:00 P.M.9. Vendors shall not move their vehicles in or out of the market area during times when such

    movement poses a danger to others.

    10. In cases of emergency, vendors may only leave early after consulting the market manager andonly if it is clear their movement will not pose a danger to others.

    11.No person shall sell or offer for sale at the market any item until a selling fee has been paid.12.Payment methods are: $10.00 per space, paid weekly, upon arrival at the market to the season's

    market managerOR$200.00 per space, paid annually, prior to first market to the season's market

    manager.

    13.Vendors wishing to attend select market dates may reserve one tent, space permitting, for aweekly fee of $10.00.

    14.New vendors may be added throughout the season, space permitting, if determined by the marketmanager the addition will benefit the overall market or fulfill the mission of Homegrown

    Alabama.

    15.Guest vendors are approved at the discretion of the market manager and are subject to all marketrules.

    16.Homegrown Alabama requests all members of the market staff and all market vendors wear shirtsthat represent Homegrown Alabama, Alabama Farmers Market Authority, or individual vendors

    of the farmers market. Up to two (2) Homegrown Alabama t-shirts will be provided to vendors

    free of charge as requested on the vendor agreement form. T-shirts will also be available for sale

    at the Homegrown Alabama information tent during the market season.

    17.As guests of Canterbury Chapel, all vendors, market customers, and members of HomegrownAlabama must respect it as a place of work, study, and worship.

    18.Market activities will never interfere with Canterbury's scheduled service of Holy Eucharist at6:00 P.M. on Thursdays.

    19. It is expected that the Canterbury Chapel front and left lawn be clear for parishioner parking,music will be turned down, and all due consideration be given by market vendors and attendees.

    ATTENDANCE

    20.Vendors must attend every market they have committed to. Confirmation letters will be sent outafter April 1 detailing each vendor's commitment.

    21. If unable to attend a market, it is the vendor's responsibility to contact the market manager assoon as possible.

    22. If a vendor fails to notify the market manager of an absence, the weekly fee is still considered thevendor's responsibility. The past week's fee must be paid to the market manager in addition to the

    current week's fee before the start of the next market the vendor attends.

    23. If the vendor does not attend the market on a committed day, they will receive one strike againstthem. After receiving three strikes, the vendor will not be allowed to attend the Homegrown

    Alabama market as a vendor for the rest of the season. The vendor will be invited back to the

    market the following season at the market managers discretion.

    24. It is the responsibility of the vendor to contact the market manager by phone if running late.25.Vendors with limited availability of market goods or those wishing to attend only select dates

    during the market season may reserve a guest vendor space. Guest vendors must contact the

    market manager no later than two weeks before the market they wish to attend and go through the

    application process prior to vending.

    26.The market will be held rain or shine, but will close early at the discretion of the market managerwith safety being the first priority.

    27.The market will be canceled if the National Weather Service issues a severe weather warningduring the hours of operation.

    SET UP AND PRESENTATION

    28.All vendors are required to bring a tent, tables, tableclothes, chairs, scales, and any othernecessary items for the presentation and selling of products.

    29. In order to maintain a coordinated appearance, vendors are requested to use 10' x 10' tents,preferably white in color.

    30.Tents can be rented from Homegrown Alabama for an annual fee of $40.00.31.Homegrown Alabama requests that sellers give the presentation of produce consideration as we

    aim to give the consumer a unique and enjoyable shopping experience.

    32.Prices must be posted for all items sold.33.Special certifications and permits must be posted.34. If a seller needs assistance in setting up their area, student volunteers will be on hand to help.35.Homegrown Alabama reserves the right to request changes in set up in order to improve

    appearance.

    36.Vendors may only occupy space(s) assigned by the market manager and are expected to relocateif deemed necessary by market manager.

    37.Displays must be confined to the assigned space including any vehicle used to transport goods.38.Each vendor is responsible for cleaning up the area around their selling space.39.All walk space must be kept free and clear at all times.40. If a vehicle, trailer, or display is obstructing vehicular or pedestrian traffic, or is judged by the

    market manager to be a safety hazard, it must be moved.

    41.Vendors shall not commit any act or use any language intended to insult, intimidate, or endangeranother vendor, market costumer, member of Homegrown Alabama, or member of Canterbury

    Episocal Chapel. Violators will be immediately expelled from the grounds by the market

    manager.

    42.All vendors, market customers, and members of Homegrown Alabama are guests of CanterburyChapel and should respect the market grounds.

    ITEMS TO BE SOLD

    42.Vendors must be the original producer of all items being sold.43.No buying and reselling of produce or other products is allowed.44.Vendors must reside in the state of Alabama.45.All items being sold must be grown or produced in the state of Alabama.46.A grower's permit must be completed by each vendor before selling at the market. Permits are

    available at no charge from the County Extension Agent and allow the producer and the customer

    to be exempt from state and local taxes for goods sold.

    47.Vendors must present a copy of their grower's permit to the season's market manager prior to thefirst market. Homegrown Alabama will keep copies of all permits on file.

    48. If you are selling products that do not allow you to be classified as a grower you are required tohave a business license from the City of Tuscaloosa, Tuscaloosa County and the State of Alabama

    and are responsible for all related sales taxes.

    49.Vendors must present a copy of their business license to the season's market manager prior to thefirst market. Homegrown Alabama will keep copies of all lincenses on file.

    50.All items marketed to be USDA certified organic must meet the requirements of the NationalOrganic Program.

    51.Organic growers must present a copy of their organic certification to the market manager prior tothe first market. Homegrown Alabama will keep copies of all certifications on file.

    52.Dairy products must be processed, packaged, and labeled at a facility permitted and inspected bythe Alabama Department of Public Health's Milk and Food Processing Branch.

    The following items are allowed to be sold at the market:

    Any vegetable or plant grown by the seller from seeds, sets, or seedlings Any fruits, nuts or berries grown by the seller from trees, bushes, or vines on the sellers property Bulbs propagated by the seller Eggs produced by the seller's poultry Honey produced by the seller's bees Fresh cut or dried flowers grown by the seller Firewood cut by the seller Dairy products originating from the seller's livestock Raw, frozen meats originating from the seller's livestock that are processed, packaged, and

    labeled at an inspected facility or are otherwise exempted from inspection Homemade relishes, jams, jellies, marmalades

    Homemade baked breads, cookies, cakes, brownies, fudge Spices or herbs Mushrooms gathered or inoculated on seller's property Ready-to-eat food as outlined in the Prepared Food Rules Arts and crafts as outlined in the Arts and Crafts Rules Other items deemed appropriate by the market manager

    The following items are prohibited from the market:

    Home-processed vegetables Items that do not originate on the vendor's farm Other items deemed inappropriate by the market manager or the FMA

    PREPARED FOOD VENDORS

    53.There will be one prepared food vendor per market.54.The frequency with which each vendor attends the market will be determined on an individual

    basis between each vendor and the market manager or designated representative of Homegrown

    Alabama.

    55.Prepared food vendors are required to follow all relevant market rules.56.Food items not prepared at the market must be prepared in a certified kitchen.57.A prepared food vendor includes one who sells ready-to-eat food prepared by the vendor either at

    the market or at the vendors certified kitchen.

    58.Hot and/or cold ready-to-eat food may be sold.59.All food must be labeled with price and any common allergens contained in the dish.60.Prepared food vendors are encouraged to prepare seasonal and local items using ingredients

    grown in Alabama.

    61.Should the vendor purchase ingredients produced in Alabama, Homegrown Alabama will providea sign to indicate this for use on the vendors table.

    62.One beverage vendor selling coffee/tea may be present at every market and will be subject to allmarket rules.

    63.Vendors may display promotional material for their business or other entities they deem proper,unless otherwise noted by the market manager.

    ARTS AND CRAFTS

    64.Arts and cratfs vendors will be treated as guest vendors to the market. Up to four (4) arts andcrafts vendors will be invited to the market once per month.

    65.Vendors who wish to sell crafts or artwork at the market must fill out the crafts/artworkapplication and submit it to the craft manager for approval.

    66. If not already representing a business, guest vendors are required to obtain a transient businesslicense valid for Tuscaloosa County.

    67.Vendors must sign a Vendor Agreement before being allowed to sell any merchandise.68.All items being offered for sale MUST be pre-approved with the Market Manager or Craft

    Manager before the vendor may sell at market. If the vendor adds any item that has not been pre-

    approved, the vendor must inform a manager before 2:30 p.m. on market day so the product can

    be evaluated.

    69.All vendors are required to supply tables, tablecloths, chairs, and other necessary items for thepresentation and selling of products.

    a. Tents can be rented from Homegrown Alabama for a daily rate of $5.b. At the vendors request, Homegrown Alabama can provide a 4 wide by 8 long table

    plus tent for a weekly cost of $10. The money will be collected at the beginning of each

    market.

    70.Prices must be posted for all items sold.71.All crafts offered for sale at the market must be handmade.72.Any craft or artwork sold must be the work of the market vendor.73.Prohibited materials

    2011 VENDOR AGREEMENT

    We, the undersigned, hereby declare that we have read and understand the Rules of the

    Homegrown Alabama Farmers Market. We agree to abide by all market rules and will cooperate with the

    Market Manager along with all other members of Homegrown Alabama and the staff of Canterbury

    Chapel. I agree to the inspection of my farm by market staff to verify that I am not in violation of these

    rules. I understand that violation of these rules may result in loss of selling privileges at the

    market. Homegrown Alabama reserves the right to refuse space to any vendor.
