COMMENTS FROM COMMITTEE

Mr. Ravitz spoke regarding the recent influx of reports of children ‘swerving’ their bikes into traffic. He further stated that the schools recently held assemblies for both the middle school children as well as the elementary schools educating them about the dangers of this practice. Notices were also sent home with students informing parents to speak to their children about this dangerous trend. Mr. Ravitz informed the public that the Voorhees Township Police Department will be strongly enforcing all laws regarding the safe operation of bicycles. Mr. Ravitz also spoke regarding the car break ins at Connolly Park. Mr. Ravitz expressed his appreciation to the Voorhees Township Police Department and reassured the public that they are working diligently to address the situation.

Ms. Nocito reiterated Mr. Ravitz’s statement regarding bicycle safety and stated that tickets will be issued to anyone found to be operating a bicycle in a dangerous manner.

ORDINANCE NO.

AN ORDINANCE OF THE TOWNSHIP OF VOORHEES AMENDING CHAPTER 152: ZONING DISTRICTS TO ADD SECTION 152.161 ENTITLED AFFORDABLE HOUSING DISTRICT (AH) OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF

VOORHEES

BE IT HEREBY ORDAINED by the Township Committee of the Township of Voorhees that

Chapter 152.161 entitled Affordable Housing District be added to the Chapter 152-Zoning Districts of the

Township of Voorhees Uniform Land Development Ordinance. Said addition shall be included as

follows:

Ҥ152-161 Purpose and Intent

The purpose and intent of the AH District is to provide for the development of a 100% affordable project not to exceed 81 multi-family units.

§152-162 Permitted Uses

A. Principal Uses: Multi-family dwellings, townhouses, stacked townhouses.

B. Accessory uses: (i) Recreational facilities including club house, outdoor recreation, tot lot, playground. (ii) Off-street parking facilities.(iii) Utility structures.

§152-163 Conditional Uses

None

§152-164 Area and Bulk Requirements

A. Ownership and control. The tract shall be under one ownership or control by the applicant for purposes of obtaining all required development approvals and committing the tract to the regulations of the AH District.

B. Maximum tract density: 10.125 dwelling units per gross acre (prior to any required dedication of lands) but not to exceed a total of 81 residential units.

C. Minimum tract area: 8 acres (prior to any required dedication of lands).

D. Minimum tract frontage: 500 linear feet.

E. Setback Requirements:

Front yard setback (Haddonfield Berlin Road) = 40 feet.

Side yard setback = 35 feet

Rear yard setback = 40 feet

F. Minimum buffer of 20 feet within the setback area shall be maintained along the side and rear yard of the property.

G. Maximum Distance between buildings:

From side face to side face: 20 feet

From rear face to rear face: 40 feet

H. Maximum number of units per building: Maximum of 10 units per building.

I. Minimum Height: two and half stories but not to exceed 35 feet.

J. Maximum Impervious Coverage: 70 % of the entire tract area.

K. Minimum Open Space requirement: A minimum of 20% of gross tract shall be open space, this may include but not be limited to, passive recreation areas, active recreation areas, natural or planted buffer and any other similar pervious areas. Open space on the tract may be maintained by the owner, a tenant association, or condominium association.

L. Minimum parking requirements. Parking spaces shall be provided in accordance with the requirements of the New Jersey Residential Site Improvement Standards (RSIS). Garden apartment ratios shall be utilized in determining the minimum required number of off-street parking spaces. Off-street parking spaces may be provided in surface parking lots or as garages.

M. Relationships to other sections of this chapter. Where the regulations of the AH Zone conflict with any other regulations of this chapter, the regulations contained in this section for the AH Zone shall apply.

§152-165 Zone specific design standards

A. Lighting.  No light fixture, whether pole or wall mounted, shall be greater than 18 feet in height.

B. Landscaping.  All public street frontages and project entrance drives shall be planted with approved street trees spaced a maximum of 50 feet apart.

C.  Building façades.  The façade of the structures shall be varied in such a manner than no more than two townhouses and no more than four garden apartments shall share the same façade at the building line.  Façades shall be uniform architecturally and shall not consist of disparate materials.  Individual dwellings shall be distinguished from each other only by landscaping, lighting and variation in the building line.

D. Signage:  A sign identifying a multi-family residential development shall not exceed 32 square feet and shall be limited to one sign per street frontage.

E. Laundry Facilities.  Adequate laundering and drying facilities for clothing shall be provided within each structure sufficient to serve its occupants, unless such facilities are individually provided for each dwelling unit.

F. Storage: Each unit should have a minimum of 25-50 square feet of storage space included within each unit’s floor plan.

G. Pedestrian circulation. A pedestrian circulation system shall be provided which connects parking areas, dwellings and recreational facilities in a coherent and comprehensive pattern.  The pedestrian walkway shall be adequately illuminated at night and be surfaced with a durable, dustless, all-weather material a minimum width of five feet.

H. Trash enclosures.  Trash enclosures shall be provided such that no disposal area is greater than 350 feet from the entrance of any dwelling unit unless individual trash storage areas are provided for each dwelling unit.  Trash and recycling pick-up may only occur on weekdays between the hours of 7:00 a.m. and 10:00 p.m. unless otherwise regulated by any State or Federal regulations. Trash enclosures shall be visually screened with evergreen plantings or solid fence enclosure.

I. Utilities.  All utilities servicing the development shall be located underground.”

BE IT FURTHER ORDAINED, that if any section, paragraph, subsection, clause or provision of

this Ordinance shall be adjudged by the courts to be invalid, such adjudication shall apply only to the

section, paragraph, subsection, clause or provision so adjudicated, and the remainder of the Ordinance

shall be deemed valid and effective; and

Be It Further Ordained, that any ordinances or parts thereof in conflict with the provisions of

this Ordinance are repealed to the extent of such conflict; and

BE IT FURTHER ORDAINED, that this Ordinance shall take effect upon passage and

publication in accordance with applicable law.

WHEREAS, the New Jersey Transportation Trust Fund Authority Act provides federal-

aid highway funds for a wide variety of projects and activities that support and encourage

residents to walk and bicycle to public transit station; and

WHEREAS, improvements to Evesham Road (CR 544) Sidewalk have been identified

as a potentially eligible project;

NOW, THEREFORE, BE IT RESOLVED by the Voorhees Township Committee that

the Mayor and Township Clerk are hereby authorized to submit an electronic grant application

identified as Evesham Road Sidewalk Improvements, Phase II, Application SST-2020-Evesham

Road Sidewalk Improvements -00027, to the New Jersey Department of Transportation on

behalf of the Township of Voorhees.

BE IF FURTHER RESOLVED that the Mayor and Township Clerk are hereby

authorized to sign the grant agreement on behalf of the Township of Voorhees and that their

signature constitutes acceptance of the terms and conditions of the grant agreement and approves

the execution of the grant agreement.

BE IF FURTHER RESOLVED by the Voorhees Township Committee, that

Environmental Resolutions, Inc. be authorized to complete the electronic grant application and

Improvemenets-00236 to the New Jersey Department of Transportation on behalf of Voorhees

WHEREAS, the New Jersey Transportation Trust Fund Authority Act provides that each

county receive an annual state aid allotment for roads and bridge projects; and

WHEREAS, improvements to Voorhees Township Bicycle Network been identified as a

potentially eligible project;

NOW, THEREFORE, BE IT RESOLVED by the Voorhees Township Committee that

the Mayor and Township Clerk are hereby authorized to submit an electronic grant application

identified as Voorhees Township Bicycle Network Extension, Application BIKE-2020-

Haddonfield Berlin Road Bike Path-00021 to the New Jersey Department of Transportation on

behalf of the Township of Voorhees.

BE IF FURTHER RESOLVED that the Mayor and Township Clerk are hereby

authorized to sign the grant agreement on behalf of the Township of Voorhees and that their

signature constitutes acceptance of the terms and conditions of the grant agreement and approves

the execution of the grant agreement.

BE IF FURTHER RESOLVED by the Voorhees Township Committee, that

Environmental Resolutions, Inc. be authorized to complete the electronic grant application and

WHEREAS, N.J.S.A. 40A: 4-87 provides that the Director of the Division of Local Government

WHEREAS, the Township of Voorhees (“Voorhees” and/or “Township”) desires to participate in

the Educational Services Commission of New Jersey (“ESCNJ”) Cooperative Pricing System, to purchase six

(6) Police Sport Utility Vehicles; and

WHEREAS, the Township is permitted to participate in Cooperative Pricing Systems pursuant to

N.J.S.A. 40A:11-11(5) and became a member of the ESCNJ Cooperative Pricing System on May 13, 2019;

and

WHEREAS, the Township published a Notice of Intent to Award Contract to Mall Chevrolet

pursuant to their proposal submitted in response to the Competitive Request for Bid; and

WHEREAS, the Township so desires to purchase six (6) Police Sport Utility Vehicles under

Contract #65MCESCCPS under the ESCNJ Cooperative Pricing System from Mall Chevrolet in an amount

of $217,346.00.

NOW, THEREFORE BE IT RESOLVED by the Mayor and Township Committee of the

Township of Voorhees as follows:

1. The provisions of the WHEREAS clauses set forth above are incorporated herein by reference and made a part hereof.

2. The purchase of six (6) Police Sport Utility Vehicles under Contract #65MCESCCPS under the ESCNJ Cooperative Pricing System from Mall Chevrolet in an amount of $217,346.00 is hereby authorized.

1AUTHORIZING THE AWARD OF A NON-FAIR AND OPEN CONTRACT FOR REAL ESTATE FINANCIAL ADVISORY SERVICES REGARDING A PROPOSED

FINANCIAL AGREEMENT FOR THE VOORHEES TOWN CENTER PHASE 2 REDEVELOPMENT PROJECT

WHEREAS, the property identified as Block 150.01, Lots 1, 2, 5 and 5.01 and located at

the Voorhees Town Center (“the Subject Property”) has been designated as a Condemnation

Redevelopment Area and is governed by a Redevelopment Study, dated December 12, 2017; and

WHEREAS, by virtue of Resolution No. 141-18, the Mayor and Township Committee

of the Township of Voorhees designated the Subject Property as a Condemnation Area in Need

of Redevelopment on May 14, 2018; and

WHEREAS, by virtue of Resolution No. 222-18, adopted on September 17, 2018, the

Township appointed Brandywine Acquisition and Development, LLC (“Brandywine”) as

conditional Redeveloper for the Voorhees Town Center – Phase 2 Redevelopment Project

(“Redevelopment Project”); and

WHEREAS, Brandywine has submitted an application dated May 28, 2019 to enter into

Financial Agreements for both the commercial and residential portions of the Redevelopment

Project; and

WHEREAS, in order to evaluate the requested Financial Agreements, the Township has

received a proposal from Nassau Capital Advisors, LLC (“NCA”), dated May 14, 2019 attached

hereto and made a part hereof as Exhibit “A” (“Proposal”); and

WHEREAS, NCA provides real estate financial advisory services on a professional

basis; and

WHEREAS, the Township has the need to acquire the professional services from NCA

to be provided hereunder as a non-fair and open contract pursuant to the provisions of N.J.S.A.

19:44A-20.4 or 20.5; and

WHEREAS, it is not expected that the value of the services will exceed $17,500 in one

(1) year; and

WHEREAS, NCA has or will complete a Business Entity Disclosure Certification which

certifies that they have not made any reportable contributions to a political or candidate

committee in the Township of Voorhees in the previous one (1) year and that the contract will

prohibit NCA from making any reportable contributions through the term of the contract; and

WHEREAS, NCA’s services shall be reimbursed to the Township out of a

Redevelopment Escrow Agreement between the Township and Brandywine.

NOW THEREFORE, BE IT RESOLVED that the Mayor and Township Committee of

the Township of Voorhees, County of Camden and State of New Jersey hereby authorizes and

approves the Proposal with NCA, dated May 14, 2019 to provide professional services in the

nature of real estate financial advisory services to review and evaluate the proposed Financial

Agreements between the Township and Brandywine for the Voorhees Town Center Phase 2

Redevelopment Project upon the submission of a completed Business Entity Disclosure

Certification. This appointment is made without competitive bidding as a professional service

under the provisions of the Local Public Contracts Law, as provided in N.J.S.A. 40A:11-5

APPROVING AND AUTHORIZING A DEVELOPER’S AGREEMENT BETWEEN THE TOWNSHIP OF VOORHEES AND VOORHEES HOUSING ASSOCIATES, LLC FOR A

PROPOSED 81 UNIT AFFORDABLE HOUSING RENTAL DEVELOPMENT PROJECT TO BE LOCATED ON BLOCK 263, LOT 11

WHEREAS, the Township filed a Declaratory Judgment Action captioned In the Matter of the

Township of Voorhees, Camden County, pending in the Superior Court of New Jersey, Law Division,

Camden County, bearing Docket No. CAM-L-2533-15; (the “Mount Laurel Litigation”) on or about July

6, 2015, following the New Jersey Supreme Court’s decision in the matter of In re Adoption of N.J.A.C.

5:96 and 5:97 By New Jersey Council On Affordable Housing, wherein the Supreme Court directed that

municipalities which were before the Council on Affordable Housing, such as the Township of Voorhees,

were required to file Declaratory Judgment Actions in the Superior Court to evaluate compliance with

their Mount Laurel obligations in order to maintain immunity from builders’ remedy litigation;

WHEREAS, the Township and Fair Share Housing Center (“FSHC”) have preliminarily agreed

to a Township Third Round obligation of 520 units which includes a 100% affordable housing project

consisting of 80 family rental affordable units with one manager’s unit (“Project”) on property located at

1223 Berlin Road (Block 263, Lot 11) in Voorhees, New Jersey (“Property”);

WHEREAS, the owner of the Property has authorized Voorhees Housing Associates, LLC

(“Developer”) to be the developer on the Project;

WHEREAS, the Township and Developer now seek to implement and approve a Developer’s

Agreement to memorialize the Developer’s obligation to construct the Project; and

WHEREAS, the Mayor and Township Committee believe it is in the best interests of the

Township to ensure the Developer complies with its obligations so that the Township obtains affordable

housing credits for this Project.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Township Committee of the

Township of Voorhees, Camden County, New Jersey, that it hereby authorizes and approves a

Developer’s Agreement by and between the Township of Voorhees and Voorhees Housing Associates,

LLC attached hereto and made a part hereof as Exhibit “A”.

BY IT FURTHER RESOLVED that the Mayor and other Township Officials are hereby

authorized to execute the Developer’s Agreement and take any other action necessary to implement same.

WHEREAS, Voorhees Housing Associates LLC (hereinafter referred to as the

“Sponsor”) proposes to construct a 81 unit affordable housing development for families (80

family rental units and one onsite manager unit) (hereinafter referred to as the “Project”)

pursuant to the provisions of the New Jersey Housing and Mortgage Finance Agency Law of

1983, as amended (N.J.S.A. 55:14K-1 et seq.), the rules promulgated thereunder at N.J.A.C.

5:80-1.1 et seq., and all applicable guidelines promulgated thereunder (the foregoing hereinafter

collectively referred to as the “HMFA Requirement”) within the Township of Voorhees

(hereinafter referred to as the “Municipality”) on a site described as Block 263, Lot 11, as shown

on the Official Tax Map of the Township of Voorhees, Camden County; and

WHEREAS, the Project will be subject to HMFA Requirements and the mortgage and

other loan documents executed between the Sponsor and the New Jersey Housing and Mortgage

Finance Agency (hereinafter referred to as the “Agency”); and

WHEREAS, pursuant to the HMFA Requirements, the Township Committee of the

Township of Voorhees hereby determines that there is a need for this housing project in

Voorhees.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Committee of

the Township of Voorhees, Camden County, New Jersey, that:

1. The Mayor and Township Committee finds and determines that the 81 unit

affordable housing development for families proposed by the Sponsor meets or will meet an

existing housing need; and

2. The Mayor and Township Committee does hereby adopt the within Resolution

and makes the determination and findings herein contained by virtue of, pursuant to, and in

conformity with the provisions of HMFA Law to enable the Agency to process the Sponsor’s

APPROVING AND AUTHORIZING A TAX ABATEMENT AGREEMENT FOR A PROPOSED 81 UNIT AFFORDABLE HOUSING RENTAL DEVELOPMENT PROJECT

TO BE LOCATED ON BLOCK 263, LOT 11

WHEREAS, Voorhees Housing Associates, LLC (hereinafter referred to as the

"Sponsor") proposes to construct an affordable housing rental development for families

consisting of 81 units (80 family units and one manager unit) (hereinafter referred to as the

"Project") pursuant to the provisions of the New Jersey Housing and Mortgage Finance Agency

Law of 1983, as amended (N.J.S.A. 55:14K-1 et seq.), the rules promulgated thereunder at

N.J.A.C. 5:80-1 et seq., and all applicable guidelines (the foregoing hereinafter referred to as the

"HMFA Requirements") within the Township of Voorhees (hereinafter referred to as the

"Township") on a site described as Block 263, Lot 11 as shown on the Official Tax Map of the

Township of Voorhees, Camden County, New Jersey; and

WHEREAS, the Project will be subject to HMFA Requirements and the mortgage and

other loan documents executed between the Sponsor and the New Jersey Housing and Mortgage

Finance Agency (hereinafter referred to as the "Agency"); and

WHEREAS, the Project will be subject to requirements of the New Jersey Department of

Community Affairs (hereinafter referred to as the "Department of Community Affairs"),

Neighborhood Preservation Balanced Housing Program in accordance with N.J.S.A. 52:27D-320

and applicable rules promulgated thereunder at N.J.A.C. 5:43-1.1 et seq., and the mortgage and

other loan documents executed between the Sponsor and the Commissioner of the Department of

Community Affairs; and

WHEREAS, pursuant to HMFA Requirements, the governing body of the Township of

Voorhees hereby determines that there is a need for this housing project in Voorhees; and

WHEREAS, the Sponsor has presented to the Mayor and Township Committee a

revenue projection for the Project which sets forth the anticipated revenue to be received by the

Sponsor from the operation of the Project as estimated by the Sponsor and the Agency.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Committee of

the Township of Voorhees, in the County of Camden, and State of New Jersey, that:

1. The Mayor and Township Committee finds and determines that the proposed

Project will meet or meets an existing housing need;

2. The Mayor and Township Committee does hereby adopt the within Resolution

and makes the determination and findings herein contained by virtue of, pursuant to, and in

conformity with the provisions of HMFA Requirements with the intent and purpose that the

Agency shall rely thereon in making a mortgage loan to the Sponsor, which shall construct, own

and operate the Project;

3. The Mayor and Township Committee does hereby adopt the within Resolution

with the further intent and purpose that from the date of execution of the Agency mortgage, the

proposed Project, including both the land and improvements thereon, will be exempt from real

the Township of Voorhees to execute, on behalf of the Township, an Agreement for Payments in

Lieu of Taxes in substantially the form annexed hereto as Exhibit “A”; and

5. The Mayor and Township Committee understands and agrees that the revenue

projections are estimates and that the actual payments in lieu of taxes to be paid by the Sponsor

to Voorhees shall be determined pursuant to the Agreement for Payments in Lieu of Taxes

executed between the Sponsor and Voorhees.

RESOLUTION NO. 170-19

AUTHORIZING THE RELEASE OF RECAPTURED SEWER CONTRIBUTION FUNDS COLLECTED BY THE TOWNSHIP OF VOORHEES PURSUANT TO A DEVELOPER’S

AGREEMENT FOR SEWER IMPROVEMENTS WITH VIRTUA WEST JERSEY HEALTH SYSTEMS INC., AND THE TOWNSHIP OF VOORHEES

WHEREAS, the Township of Voorhees (“Township”) entered into a Developer’s Agreement for

Sewer Improvements with Virtua West Jersey Health Systems, Inc., (‘Virtua”) for Block 233, Lots 1

through 12, 2.01, and 6.01 and Block 228, Lots 7 through 11 and 11.01, 13 through 18; and

WHEREAS, the Township has adopted certain amendments to its Zoning Ordinance creating a

Medical Campus Overlay Zoning District affecting property situated in the Township; and

WHEREAS Virtua is a provider of medical services and acquired certain lands within Voorhees

Township and has developed said lands and construct thereon a mixed-use medical campus facility in

accordance with the regulations set forth in the Ordinance; and

WHEREAS, Virtua received General Development Plan (GDP) approval for the Project (“GDP

Approval”), pursuant to the New Jersey Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq., on October

10, 2007 and Preliminary and Final Major Site Plan Approval for Phase I-A of the Project on November

7, 2007 (“Site Plan Approval”); and

WHEREAS, the Project was constructed in a portion of the Township that was previously served

by a pumping station, which accepted sanitary sewer flow from sewer service drainage areas DA-14, DA-

15 and DA-16 (the “Sewer Service Area”) as shown on the Township’s prior “Sanitary Sewer System

Plan”, undated, prepared by Churchill Engineers; and

WHEREAS, the Township prepared a planning document for future sewer service in the area of

the Project, dated January, 1998 and revised May 21, 1999, and prepared various grant application plans

and specifications for improvements to the Township’s sewer collection system in the vicinity of the

Project, including Contract 1998-1 for a new pumping station, dated January, 1999 and Contract 1998-2

for a new force main, gravity interceptors and sewers, dated January, 1999; and

WHEREAS, development of the Project required the construction of a new pumping station and

a force main to convey sanitary wastewater from the Project to a point of connection to the Township’s

sanitary sewer system on Centennial Boulevard at the manhole to which the prior Cooper Road Force

Main discharged, identified as the Dutchtown Road Pumping Station and Force Main; and

WHEREAS, the Township’s Conceptual Study concluded that the Dutchtown Road Pumping

Station and Force Main be designed and constructed to convey the sanitary sewer flow from the Sewer

Service Area in its entirety; and

WHEREAS, in order to proceed with development of the Project, Virtua agreed to design and

construct, at its expense, a new pumping station and force main having a maximum peak flow capacity of

approximately 2,500 gallons per minute (“gpm”) which yields an estimated overall average daily flow

capacity of 1,440,000 gallons per day (“gpd”) (the Dutchtown Road Pumping Station and Force Main)

which conveys all sanitary wastewater generated from the Sewer Service Area, including all wastewater

from the Project, to a point of connection to the Township’s sanitary sewer system on Centennial

Boulevard, and Virtua also designed and constructed (at Township expense) the Dutchtown Road Gravity

Interceptor between the Cooper Road Pumping Station and the Dutchtown Road Pumping Station (all of

which collectively are referred to as the “Developer Sewer Improvements”); and

WHEREAS, Virtua agreed and actually designed and constructed at Virtua’s expense (subject to

a maximum limitation set forth in the Agreement) a gravity interceptor between the Cooper Road

Pumping Station and the Dutchtown Road Pumping Station (the “Dutchtown Road Gravity Interceptor”);

and

WHEREAS, the Developer Sewer Improvements has benefitted other development projects in

addition to the Project, so that, in accordance with the terms of the subject Agreement and pursuant to

applicable law, Virtua is contractually entitled to permissible reimbursement from the developers of such

other projects based upon a formula identified in the Developer’s Agreement for Sewer Improvements;

and

WHEREAS, the Township has collected said reimbursement which shall be transferred to Virtua

as a part of the recapture obligations set forth in the Agreement and amendments thereto.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Committee of the

Township of Voorhees, County of Camden, and State of New Jersey that in accordance with the above-

referenced Developer’s Agreement for Sewer Improvements and amendments thereto hereby authorize the

payment of recapture funds collected by the Township in the amount of $161,550.78.

TURNING OVER REMAINING COLLECTED BOND DEFAULT FUNDS TO THE WOODLAND GLEN HOMEOWNERS ASSOCIATION IN THE TOWNSHIP OF VOORHEES

UNDER EQUITY BANK IRREVOCABLE LETTER OF CREDIT NUMBER 0311753780, AND PAID BY SUSQUEHANNA BANK, SUCCESSOR IN OWNERSHIP

WHEREAS, certain improvements were required to be constructed and installed by Steliga Homes

of Voorhees, L.L.C. for residential site improvements at the Woodland Glen subdivision, as a condition of

approval of a major subdivision and certain related performance improvements and obligations at certain land

known as Block 213.04, Lots 147-161 in the Township of Voorhees; and

WHEREAS, Steliga Homes of Voorhees, L.L.C., posted with the Township of Voorhees a

Irrevocable Letter of Credit Number 0311753780, dated March 15, 2000 from the Equity Bank N.A.; and

WHEREAS, Steliga Homes of Voorhees, L.L.C. did not properly perform or complete said

performance improvements and obligations, as required as a condition of the aforesaid approval and as set

forth in reports prepared by Environmental Resolutions Inc., dated May 14, 2009, November 6, 2009, and

December 4, 2009; and

WHEREAS, certain performance improvements and obligations were never properly installed,

maintained and completed; and

WHEREAS, the Principal, Steliga Homes of Voorhees, L.L.C., failed to perform the work in

accordance with the schedule of improvements and was previously declared violation of the terms of the

subject performance guaranty.

WHEREAS, the Township of Voorhees declared a default, filed suit and ultimately collected the

sum of $71,007.30 from Susquehanna Bank and completed the above-referenced improvements; and

WHEREAS, a balance in the amount of $1,600.50 remains in an account held by the Township of

Voorhees held for the benefit of the Woodland Glen Homeowners Association to assist with any common

area maintenance issues.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Committee of the

Township of Voorhees as follows:

1. The WHEREAS clauses set forth above shall be incorporated herein as if set forth in full and made part of this Resolution.

2. The Administrator, Chief Financial, Clerk and/or any elected official are hereby authorized to take any and all action to transfer the remaining bond proceeds in the sum of $1,600.50 to the Woodland Glen Homeowners Association.

3. Nothing herein shall require the Township of Voorhees to take any further action in connection with this matter.

PRESENTATION – MS CITY TO SHORE BIKE EVENT

Mr. Craighead and the MS City to Shore Bike Planning Team presented the Voorhees Township Committee with a plaque. They further thanked the Voorhees Township Committee and the Voorhees Township Police Department for their support and for assisting in keeping the bike riders safe. Mr. Craighead expressed how this support is critical to the program.

Mayor Mignogna stated that the Township Committee is thrilled to be a part of such a great cause. Mr. Mignogna informed Mr. Craighead that as long as there are riders, there will be support from the Voorhees Township Committee.
