HOLDERS OF KNIGHT'S PEES IN KENTAT THE KNIGHTING OF THE KING'SSON, ANNO 38 HENRY III. (A.D. 1253-4.)

EDITED BY JAMES GREENSTBEET.

SINCE the publication, in 1876, of the Kent Assess-ments on the occasion of Knighting the BlackPrince, it has been my good fortune to discover arecord connected with the levying, in that county, ofthe much earlier Aid of 38 Henry III. The docu-ment in question comprises the entire contents of athin folio volume, of twelve parchment leaves, markedA-^g-, which is preserved among the miscellaneousChapter House books, at the Public Record Office.*These leaves have evidently formed part of anotherManuscript; but whether the whole of that Manu-script related to the same or to kindred subjects can-

not, of course, now be ascertained. Three distinctpaginations exist at the present time. The earliestcommenced, by way of folios, with " ccxxj " on theface of the first leaf; as is apparent from the circum-stance that " ccxxij" remains on the face of thesecond leaf, and so on to " ccxxxij " on that of thetwelfth, with which terminates the portion taken upby the record. There is a later series of folios inArabic numerals from 101 (equal page 1) to 112(equal page 23) inclusive. The pagination by modernnumbers from 1 to 23, which I have given in mytext, is evidently that of the Record Office authorities, who have neatly mounted the Manuscript on freshparchment margins. On the back of the last leaf iswritten, in what appears to be a comparativelymodern hand, the following descriptive title of thecontents, viz., " Feoda Militaria Kane1."

Very superficial examination of this record led meto incline strongly to the belief that it is the onealluded to by Philipot, at page 258 of his VillareCantianum, where he says " Ore, in the Hundred ofEaversham, was, as the Book called Feoda Militumkept in the Exchequer informs me, in the 38th yearof Henry III the inheritance of Reginald de Cornhill"(see the 205th entry of this Aid).

Hasted, in his later History of the county, refersboth to a Book and to a Eoll of Knight's Pees of thetime of Edward I, kept in the Exchequer (vide vol. ii,737, 740, 746, 747, 795, ; vol. iii, 424-5; etc.) Pos-sibly he really meant only one authority. In otherplaces, however, he speaks of them as of the reign ofEdward II (ii, 798, 807, 809). And at vol. iv, p. 2(note) he quotes Madox to the effect that in the reignsof Henry III and Edward I, so much perplexity had

ANNO 38 HENRY III. 199

arisen through the splitting up of the fees (wherebyeach entire one was frequently accounted for bya number of persons) that the authorities in theExchequer found it necessary to provide themselveswith extracts, from earlier documents, giving informa-tion as to the former tenants. In this way, I sur-mise, he seeks to account for the existence of suchlists of the holders of fees; taking it for granted thatthey none of them belong exclusively to any particularperiod. This may be the case with respect to some ofthese collections; but I think it can hardly be takento apply generally. For instance, the account of theholders of Fees in Kent in the time of Henry III,*recorded in, what we are accustomed to style, theTesta, de Nevill ,\ is referred to by Philipot as of thedate of 20 Hen. 111;$ and, as I imagine, without

* This account is given twice over; the first version beginningon p. 205, the second at p. 210a. They appear to vary little; andare, I should say, of the same or nearly identical dates.

t The printed volume entitled Testa de Nevill contains only, here and there, extracts from an earlier work of that name.

t Philipot says distinctly, at p. 263 of the Village Cantianwn, that the Testa de Nevill (he seems to allude to the Kent portionspecially) is an account of the holders of the fees at the marriage ofthe king's sister, Ao. 20 Hen. III. And he cites the entry whereWilliam de Valoigns (it should be Peter de Otham) is recorded ashaving, on that occasion as he says, paid Aid for those lands inOtham which subsequently went with the sole daughter and heiressof said Peter (" de Otteham," or "Hotteham") into the family ofValoigns (vide Testa de JVevill, pages 209b and 214a). And if(as Philipot evidently considered it to be) the Kent portion of therecord in question is as completely contemporary in character as theAids of 38 Hen. Ill and 20 Bdw. Ill, it must of necessity be earlierin date than the first of those Aids, because a list of the feesappertaining to "Warine de Monchensi is included, and he deceasedin the year when it was levied. Philipot's definite assignation ofdate is to my mind very strongly supported by the fact of the

200 HOLDERS OP PEES IN KENT

the slightest doubt that the whole of the entrieswere of that date. The accounts of the holders inother counties in the volume refer, however, to dif-ferent occasions and periods temp. Henry III andEdward I.

Of course the strictly contemporary nature of arecord, and of every entry in it, can only he prored"by a careful analysis of the whole, and by corrobo-ration of such contemporary character from entirelyindependent sources. But this is very difficult ofattainment with respect to many early documents;and would he, I dare say, in the majority of cases nextto hopeless. For, in addition to the paucity of mate-rials for so testing their contents, there is also thecircumstance that the representatives of the generalityof early families bore precisely the same Christiannames during many successive generations, thus ren-dering the distinction between individuals often im-

mention in the record under Kent of the " heirs of Hamo deValoigns," in respect of the possessions of that family in the county. Now there was a Hamo de Valoigns, a celebrated Irish justiciary inthe reign of John, who apparently had a son of the same Christianname distinguished from his father by the addition " Junior" (seeHardy's Botvli de Oblatis et JPinibus); and in the twenty-sixth yearof Henry III it is recorded (Abbreviatio Rotulorwm Originaliutn, pages 4 and 5) that Bertram de Criol was made custodian of thelands which formerly belonged to Hamo de Valoigns. This HamoI take to be the son of the Irish Judge, and the same person who isreferred to in the pages of the Testa de Nevill as being dead andhaving left heirs under age. Again, the " heirs of Eoger Malmains"are entered in connection with the Malmains' estates in Kent; andwe learn that in the twenty-seventh year of Henry III the heir ofEoger Malmains (evidently Henry of that name, afterwards sheriffof Kent) was already aged nineteen, and in the custody of sameBertram de Criol (Excerpta e Rotulis Mniwm, vol. i, p. 388); sothe expression, " heirs of Eoger Malmains " could not well havebeen used in the Testa de Nevill subsequently to Ao. 29 Hen. III.

possible, and confusion of one with another a matterof constant occurrence.

I will proceed to adduce one or two corrobora-tions which tend to shew that the document I nowpublish is a transcript of a contemporary return ofsome particular date, and moreover that there isevery reasonable possibility of that particular datebeing the one to which Philipot, probably on verysufficient evidence, ascribed it.

Warine de Monchensi figures throughout therecord. He died in the 38th year of Henry III.William de Longespe'e, the last lineal descendant ofthe great Earls of Salisbury, appears twice in connec-tion with certain holdings (vide Nos. 23 and 26).His father (also named William, and son and heir ofWilliam third and last of the Longespe"es Earls ofSalisbury) was deprived of his possessions by HenryIII, and slain at the Siege of Massoura in 1250 (Ao.34 Hen. III). The person mentioned in the recordwas apparently reinstated in those possessions afterthe decease of his father, but died in 1256 (Ao. 40Hen. Ill), without male issue (see Courthope's His-toric Peerage). Hamo de Crevequer, likewise namedin many entries as superior lord, died Ao. 47 Hen. III.Thus much with respect to persons of distinction. But pretty close evidence as to the date of the originaldocument is afforded by entries containing mentionof the local celebrities of the period. It is my inten-tion to deal with them at length in a series of Notesupon the Aid, and I shall therefore only anticipatethem here by perhaps the most important one. Inthe beginning of the record, the heir of E/obert deSeptvans is spoken of (vide Nos. 33 and 48); inanother place (No. 383) he is more clearly indicated

202 HOLDERS OF FEES IN KENT

as Robert son of Robert de Septvans. Now Robert, the third of that name of the Septvans family, accord-ing to Mr. Planche" (History of Ash-next-SandwicK),died Ao. 33 Hen. Ill (1249), his son and heir beingnearly forty years of age. Robert IV survived hisfather only four years, dying Ao. 37 Hen. Ill, whenit was found by Inquisition that he left a wife, Isabella, and a son and heir, Robert, aged only nine. ThisRobert, the fifth of that Christian name, attained hismajority in due course (Ao. 49 Hen. Ill)—greatlydistinguished himself in the wars, received the honourof knighthood—and dying in the same year as hisgallant sovereign (Ao. 34 Edw. I), was succeeded inthe estates of the Septvans by his son and heirWilliam.

Owing to want of knowledge on the part of thetranscribers as to the topography of the district andother particulars, the text of the transcript nowprinted will be found to be more or less corrupt inmany places. But I have inserted (between paren-theses, and in italics) here and there, where I thoughtit essential, or advisable, what I deem to have beenthe original reading of names of persons and localities. For facility of reference every entry has been num-bered, and I purpose making the series of Notes, already referred to, correspond with this numeration.

January, 1877. JAMES GREENSTREET.
