O Health Insurance Portability and

Accountability Act (HIPAA) of 1996

O National standard for all health care

organizations

O Goal is to protect health information while

allowing for adequate flow of that

information to necessary health care

personnel

O What is PHI?

O PHI=protected health information

O Any information that can be used to identify

an individual

O E.g. name, date of birth, social security

number, diagnoses

O Can be electronic, paper, or oral

Electronic communicationO Increasing use of mobile devices is of concern

O Administrative Simplification provisionsO Part of HIPAA requires the Secretary of the DHHS

to publicize standards for exchange, privacy, and security of health information in the electronic format.

O HITECH Act

O ConcernsO Personal information should be shared on a

“need to know basis”

O Information will fall into the wrong handsO E.g. computer hackers

Breaches

O Occur when a health care

professional, support staff, or organization

is out of compliance

O Can result in fiscal fines, jail time, or

termination of employment

O E.g. Case of UCLA Hospital staff reading

celebrity records (Fox News, 2008)

Could your PHI be in jeopardy?

O On a piece of paper write down the

following about yourself:

O Full name

O Date of birth

O Height & weight

O Social security number

O Address

O One personal piece of information you

would only share with your doctor

O Now, hand in that piece of paper…….

O It will now be placed on a bulletin board at your current work office or announced over the loud speaker

O This would be an example of a HIPAA violation

O (Papers will now be shredded in front of you to ensure no violation has occurred)

feel?

O Mad, angry, embarrassed?

O What would be the consequences?

O Would you lose your job?

O Would it tarnish your reputation?

O How would you view your health care

provider who shared the information?
