Be sure to go to planning and ask the following questions in the beginning stages of your business launch.

Question #1 – I want to open a certain type of business. What is my first step? Answer – Contact the Planning Department to determine what areas of town are correctly zoned for the business. Locate a potential site and once a site is selected and a basic idea of what the prospective business owners wants to do, a “pre-submittal conference” needs to be requested with the Planning Department. Based on the outcome of this meeting, the prospective business owner will have a decent blueprint on how to proceed. Question #2 – Are licensed contractors and/or licensed architects required?Answer – The first step you need to take is check with the Planning Department, who will refer you to the Codes Department and Publics Works Department to determine what requirements are applicable.

Question #3 – What is the process for opening a business in an existing building?Answer - Unless the proposed business is in the same classification as the business that previously occupied the space/building or if the space/building was specifically built for that use, significant improvements to the property may be required because of certain Federal, State or local regulations. In this case, an architect or other design professional should be consulted. Please check with the Planning Department first for a Use and Occupancy Inspection. This will allow the prospective business to get their business license for the next steps.

Question #4 – Is my business required to have a business license? Answer - Any business in the City limits of Hendersonville with gross sales of $3,000 annually or more requires both a City of Hendersonville business license and a Sumner County business license regardless of whether you work from home or commercial location. There are a limited number of exceptions, including those who pay professional privilege tax to the State. Go to hville.org and sumnertn.org for more information on applying for a business license.

Question #5 – What type of business entity should I form?Answer - Seek the guidance of a legal or tax professional to determine the best business entity fit for you.

Question #6 – What is the cost of the business license and how long will it take to process?Answer - The cost is $15.00 for the City business license and $15.00 for the County, plus any additional fees. For a commercial location you may be required to obtain a Use and Occupancy Permit for the cost of $25.00. If you work from home, the city requires a Minor Home Occupation Permit at no charge. The Planning Department must sign the bottom of the application showing approval. Once the application is submitted with the necessary approvals, the license can be issued in a matter of minutes.

Question #7 – Can I apply for both the City and County business licenses at City Hall?Answer - No. You can only apply for the City business license at City Hall. You may apply for the County license on the County website (www.sumnertn.org), in person at the County Clerk’s office, or by mail.

Question #8 – Are there other requirements at the state level? Answer - For more information regarding opening a business in the State of Tennessee, you may visit https://sos.tn.gov/.

Question #9 – How do I obtain a Federal Employer Identification Number?Answer - The FEIN is free by visiting www.irs.gov or seek a legal professional or tax professional for assistance.

Question #10 – How do I obtain a beer permit or liquor license?Answer – You must go online to https://www.tn.gov/abc/ and fill out your applications online. They no longer accept paper applications and checks.

Question #11 – What will be expected to be checked by the Fire Prevention Bureau? Answer – The Fire Prevention Bureau reviews and inspects all new construction and remodeling of commercial buildings in conjunction with the City’s Building and Codes Department. Expect that they will review fire and sprinkler plans for compliance, existing structures, and all flammable and combustible storage tanks.For more information or to request an inspection,go online to hvilletn.org/departments/fire.
