INTRODUCTION This introduction is not part of the licence and does not purport to be a legal interpretation of the licence.

The installation comprises an outdoor waste bale storage area. The accepted waste types include baled refuse derived fuel, mixed municipal waste and waste from mechanical treatment. All waste received is baled prior to being accepted at the installation. This licence authorises the acceptance of 99,000 tonnes of waste per annum. Baled waste leaving the installation is authorised by the National Transfrontier Shipment Oftice as it is being directed to a vessel for expoi-t.

For the purposes of the E U Industrial Emissions Directive (2010/75/EU), this installation falls within the scope of the following Annex I categories:

Category 5.3 (b) Recovery, or a mix of recovery and disposal, of non-hazardous waste with a capacity exceeding 75 tonnes per day involving,one or more of the following activities, and excluding activities covered by Directive 9 1/271/EEC: (ii) pre-treatment of waste for inc,ineration' or co-incineration;

Decision & Reasons for the Decision

Tlie Environmental Protection Agency is satisfied, on tlie basis of tlie illformation available, that subject to compliance with the conditions of this licence, any emissions from the activity will comply with antl will not contravene any of the requirements of Section -S3(5) of the Environmental Protection Agency Act 1992 as amended.

. The Agency also considers that the activity will not adversely affect the integrity of any European Site, and lias decided to impose conditions for tlie purposes of ensuring it does not do sd. I t has determined that the activity, if managed, operated and controlled in'accordance with tlie licence, will not have any adverse effect on the integrity of a n y of those sites.

I n this context, particular attentio;! was paid to the European Sites at Carlingforcl Shore SAC (Site Code: 002306) a n d Carlingford Lough SPA (Site Code: 00407s).

The activity is not directly connected with or necessary to tlie management of any European Site and tlie Age!icy considered, for the reasons set out below, that it 'cannot be excluded, on the basis of objective information, that tlie activity, individually or in cohibination with other plans or projects, will have a 'significant effect on any European Site and accordingly determined that an Appropriate Assessinent of the activity was required, antl for this reason determinecl to require the applicant to submit a, Natura Impact Statement.

macle certain, based on best, scientific knowledge in the field. ancl in accortlance with the European Communities (Birds ancl Natural Habitats) Regulations 201 1 a.s- a;nencled, pursuant to Article 6(3) of the Habitats Directive, that the activity: individually or in combination with other plans or projects, w i l l not adversely affect the integrity o f any European Site, i n particular Carlingfortl Shore SAC (Site Code: 002306) and Carlingford Lough SPA (Site Code: 00407S), having regard to their conservation ob.jectives, and wi l l not affect the preservation o f these sites at favourable conservation status if carried out in accordance with this licence and the conditions attached hereto for the following reasons:.

Therefore the risk o f contaminated storm water having a signi,Gcant environmental impact on the conservation objectives o f the Eui;opean Sites i s low.

The licence requires the licensee to propose means o f minimising contamina,tion i n the discharged storm ,\vater.

The licence specifies a number o f measures to l imit the installation's impact on the European Sites, including the following:

Condition 5.12.4 requires that waste i s not storecl within ?m o f the storm drain.

Schedule B.2 proposes emission l imit values which w i l l ensure that minimal leachate contamination i s present in the storm, water arising within the instal lation.

Schedule C.2.1 prescribes weekly monitoring o f storm water emissions for the parameters listed in Schedule B.2. I t also prescribes monitoring for conductivity ,ant1 other .paran!eters and a daily visual inspection.

Condition 6.12.1 requires a twice daily inspeciion o f the licensed area for evidence o f leachate emissions.

Condition 6.13.3 requires imlnediate collection o f leachate emissions using a

Condition 6.13.4 requires that the yard is swept using a mechanical road sweeper (or equivalent) upon bales being lifted and prior to the deposit of any more bales. .,

Condition S. I I .4 requires the rejection o f any bales that are not in good con$ition upon arrival at the installation.

Condition 6.12 requires repair o f damaged bales or removing thein to the quarantine area.

Conclition S . 11 .S requires that any waste, deemecl unsuitable for storage at the installation shall be immediately separated ancl removed from the instal1,ation. The condition further requires that temporary storage o f such waste shall be in a designated Waste Quarantine Area under appropriate conclitions to avoid odour generation.

Condition 6.20 requires inspection o f tl?e installation ancl i ts immecliate surrouncls for various nuisances, including litter, birds and vermin.

For the purposes of this licence, the installation is the area of land outlined in red on Drawing No. lBM0481-006 (Rev. C) dated 15/01/2015 of the application. Any reference in this licen'ce to "installation" shall niean the area thus outlined i n red. The licensed activity shall be,carried on only within the area out1,ined.

1.6 This licence is for the purpose of IE licensing under the EPA Act 1992 as amended only ancl nothing in this licence shall be construed as negating the licensee's statutory obligations or requirements under any other enactments or regulations.

1.7 Waste Acceptance Hours

Waste shall be accepted at the installation only between the hours of S am ancl 6 pin Monday to Friday inclusive and S am to 2 pm on Saturdays, unless otherwise agreed in advance by the Agency.

Condition 2. Management of the Installation

2. I Installation Manageinent

2. I . 1 The licensee shall employ a suitably qualified and experienced installation manager who shall be designated as the person in charge. The installation manager or a nominated, suitably qualified and experiencecl deputy shall be present on the installation at all times during its operation or as otherwise required by the Agency.

2.1.2 The licensee shall ensure that personnel performing specifically assigned tasks shall be qualified on the basis of appropriate education, training ancl experience as required and shall be aware of the recpirements of this licence.

2.2 Environmental Management System (EMS)

The licensee shall establish, maintain ancl implement an Environmental Management System (EMS), which shall incorporate energy efficiency management, within six months of the clate of grant of this licence. The EMS shall'be reviewed for suitability, adequacy and effectiveness antl Lipclatecl on an annual basis.

The EMS shall include, as a minimum, the following elements:

The licensee shall prepare, maintain and implement a Schedule of Environmental Objectives and Targets. The schedule shall, as a minimum, provide for a review of all operations and processes, including a n evaluation of practicable options, for energy and resource efficiency, the use of cleaner technology, cleaner production ancl the prevention, recluction and ininimisation of waste and shall include waste and eniissions reduction targets. The schetlule shall include time frames for the achievement of set targets and shall address a five-year period as a minimum. The schedule shall be reviewed annually and amendments thereto notified to the Agkncy for agreement as part of the Annual Environmental Report (AER).

The E M P shall be reviewed annually and amendments thereto notified to the Agency for agreement as part of the Annual Environmental Report (AER).

A report on the programme, including the success i n meeting agreed targets, shall be prepared ancl submitted to the Agency as part ofthe AER. Such reports shall be retained on-site for a period of not less than seven years and shall be available for inspection by authorised persons of the Agency.

( i i ) The licensee shall issue a copy of this licence to all relevant personnel whose duties relate to any condition of this licence.

2.2.2.6 Corrective and Preventative Action

(i) The licensee shall establish, maintain ancl implement procedures to ensure that corrective and preventative action is taken should the specified requirements of this licence not be fulfilled. The responsibility and authority for persons initiating

further investigation and conective ancl preventative action in the event of a reported non-conformity with this licence shall be defined.

(ii) Where a breach of one or more of the conditions of this licence occurs, the licensee shall without delay take measures to restore compliance with the ,conclitions 'of this licence i n the shortest possible time and initiate any feasible preventative actions, to prevent recurrence of tlie breach.

(iii) All cop-ective and preventative actions shall be documented.

Internal Audits

The licensee shall establish, maintain and implement a programme for internal audits of the EMS. Such audits shall be carried out at least once every three years. The audit programme shall determine whether or not the EMS is being implemented ancl maintained properly, and i n accordance with the requirements of the licence. Audit reports and records of the resultant corrective and preventative actions shall be maintained as part of the EMS in accordance with condition 2.2.2.5.

Awareness and Training

The licensee shall establish, maintain ancl implement procedures for identifying training needs, and for providing appropriate training, for all personnel whose work can have a significant effect upon the environment. Appropriate records of trainitig shall be maintained.

Communications Programme

The ,licensee shall establish, maintain and implement a Public Awareness and Communications Programme to ensure that members of the public are informed, and can obtain information at the facility, at a l l reasonable times, concerning the environmental perforiniance of the facility.

Maintenance Programme

The licensee shall establish, maintain and implement a programme for ma i ntenanc,e, inclusive of a preventative maintenance programme, of a l l plant ancl equipment based on the instructions issued by the inanufacturer/suppIier or installer of tlie equipment. Appropriate record keeping and diagnostic testing shall support this ma i n tena lice progra in me. The I i cen see s ha I I c lea 1.1 y a I I oca t e responsibility for the planning, management and execution of all aspects of this programme to appropriate personnel (see Condition 2.1 above). The maintenance programme shall use appropriate techniques ancl measures' to ensure the optimisation of energy efficiency i n plant and equipment.

Efficient Process Control

The licensee shall establish, maintain and implement a programme to ensure there is adequate control of processes under all modes of operation. The programme shall identify tlie key indicator parameters for process control performance, as well as identifying methods for measuring and controlling these parameters. Abnormal process operating coliclitions shall be documented, ancl analysed to identify any necessary corrective action.

Condition 3. Infrastructure and Operation

Tlie licensee shall establish ancl maintain, for each component of the installation, all infrastructure referred to in this licence i n advance of tlie commencement of the licensed activities in that component, or as required by the conditions of this licence. Infrastructure specified in the application that relates to tlie environmental perfoi-mance of the installation ancl is not specified in the licence, shall be installed in accordance with the schedule subinitted in tlie application.

I ns ta I I a t i on Notice Board

3.2.1 Tlie licensee shall, within one month of tlie date of grant of this licence, provide an Installation Notice Board on tlie installation so that it is legible to persons outside tlie main entrance to the installation. Tlie minimum dimensions of the board shall be 1200 mm by 750 min. The,notice board shall be maintained thereafter.

Tlie board shall clearly show: 3.2.2

, (i) the name and telephone number of the installation; (ii) tlie normal hours of opening; (iii) tlie name of tlie licence holder; (iv) a n emergency out of hours contact telephone number;

(v) the licence reference number; ancl (vi) where environmental information relating to tlie installation can be

obtained. A plan of the installation clearly iclentifying,the location of each storage ancl treatment area shall be clisplayed as close as is. possible to tlie entrance to the installation. The plan shall be displayed on a durable material such that is legible at all times. Tlie plan shall be replaced as material changes to tlie installation are macle.

3.2.3

Tlie licensee shall install on all emission points sitch sampling points or equipment, including any clata-logging or other electronic communication equipment, as inay be required by the Agency. All such equipment shall be consistent with tlie safe operation of all sampling ancl monitoring systems.

In the case of composite sampling .of aqueous emissions from the operation of the installation, a separate composite sample or homogeneous sub-sample (of sufficient volume as aclvised) shall be refrigerated immediately after collection and retained as required for EPA use.

Tlie licensee shall clearly label and provide safe ant1 permanent access to all on-site sampling and monitoring points and to off-site points as required by the Agency. Tlie requirement with regard to off-site points is subject to tlie prior agreement of tlie I a t i downer( s) concerned,

Tank, Container ancl Drum Storage Areas

All tank and clrum storage areas shall, as a minimum, be bundecl, either locally or remotely, to a volume not less than the greater of the following:

3.6.3 All drainage from buntled areas shall be treated as contaminated unless it can be demonstrated'to be otherwise. All drainage from buncled areas shall be diverted for collection and safe disposal, unless it can be deemed uncontaminated.

All inlets, outlets, vent pipes; valves and gauges shall be within the buncled area.

All tanks, containers ancl drums shall be labelled to clearly indicate their contents.

3.7. . The licensee. shall have in storage an adequate supply .of. containment booms and/or suitable absorbent material to contain ancl absorb any spillage at the installation. Once used, the absorbent material shall be disposed of at a n appropriate facility.

Silt Traps and Oil Separators

, The licensee shall install and maintain silt traps and,oil separators at the installation:

,Silt traps to ensure that all storm.ivater discharges, other than from roofs, from the installation pass through a silt trap in advance of discharge;

An oil separator on the storm water clischarge from yard areas. The separator shall be a Class I full retention separator.

(ii)

The silt traps and separator shall be-in accordance with 1.S. EN-S5S-2: 2003 (separator systems for light liquids).

. . 3.9 Fire-water Retention

3.9.1 The'licensee shall carry out a riik assessment to determine if the activity should have a fire-water retention facility. The licensee shall submit the assessment and a report to the Agency on the findings antl recommendations of the assessment within six months of the clate of grant of this licence.

In the event that a significant risk exists for the release of contamiiiatetl fire- water, the licensee shall, based on the findings.of the risk assessment, prepare and implement, with the agreement of the Agency, a suitable risk management programme. The risk manage men t programme sha I I be ful I y implemented within three months of date of notification by the Agency.

3.9.2

3,9.3 I n the eiient of a fire or a spillage to storm 'water;the site storm water shall be tlivei-tecl for collection. The licensee shall examine, as part of the response programme i n Condition 3.9.2 above, the provision of automatic diversion of storm water for collection. The licenses shall have regard to any guidelines issued by the Agency with regard to firewater retention.

The licensee shall have regard to the Environmental Protection Agency Draft Guidance Note to Industry on the Requirements for Fire-Water Retention Facilities when implementing Conditions 3.9.1 and 3.9.2 above.

3.9.4

3.10 AI1 pump sumps, stofage tanks or other treatment plant chambers from which spillage of environmentally significant materials ;night occur in such quantities as are likely to breach local or remote containment or separators, shall be fitted with high liquid level alarms (or oil detectors as appropriate).

The provision of a catchment system to collect .any leaks from flanges an t l valves of all over-ground pipes used to transport material other than water shall be examined. This shall be incorporated into a Schedule of Environmental Objectives and Targets set out in Conclition 2 of this licence for the reduction in fugitive emissions.

The licensee shall, within three months of the date of grant of this licence, install a n d maintain i n a prominent location on the site a wincl sock, or other wind direction indicator, which shall be visible from the public roadway outside the site.

The licensee shall, if so instructed by the Agency, take steps to prevent the contamination of storm water at and/or the discharge o f contaminated storm water from the installation. The licensee shall as part of the Schedule of Environmental Objectives and Targets set out in Condition 2 of this licence esaniine and propose options and/or engineered solutions for'the reduction in the emission of pollutants to surface water.

Specified Engineering Works

3.14.1 The licensee shall submit proposals for all Specified Engineering, Works, as defined in Schediile D: Spec//;ec/ E17gitieeri1g W O I ~ Y , of this licence, to the Agency for its agreement at least two months in advance of the intended date of commencement of any such works. No such works shall be carried out without the prior agreement of the Agency.

All specified engineering wo'rks shall be supervised by a competent person(s) and that person, or persons, shall be present at all times cluring which relevant works are being undertaken..

Following the coinpletion of a l l specified engineering works, the licensee shall complete a construction quality assurance validation. The validation report shall be made available to the Agency on request. The report shall, as appropriate, include the following information:

(i) A description of the works; (ii) As-built tlrawings of the works; and (iii) Any other information requested in writing by the Agency.

3.15.1 Security fencing'or walls and gates shall be maintained at an appropriate location to limit access to the installation., Subject to the implementation of the restoration and aftercare plan and to the agreement of the Agency, the requirement for such site security may be removed.

3.15.2 ' The licensee shall install a CCTV system which records all truck movement into antl out of the installation and monitors the waste storage areas on a 24-hour basis. ,The CCTV system shall be operated at all times and copies of recordings kept on site and made available to the Agency on request.

Gates shall be locked shut when the installation is unsupervised.

The licensee shall remedy any defect in the gates, fencing and walls as follows:

Installation Roads and Site Surfaces '

3.16.1 Effective site roads shall be provided and maintained to ensure the safe antl nuisance-free movement of vehicles within the installation.

The licensee shall maintain an impermeable concrete surface in all areas of the installation. The surfaces shall tie concreted and constructed to British Standard S I I O or an alternative as agreed by the Agency. The licensee shall remedy any defect in concrete surfaces within five working days.

The licensee shall, Jvithin six months of the date of grant of this licence, repair cracks and f i l l all expansion gaps with impermeable material.

The licensee- shall provide a t id . maintain wheel cleaners. or wheel cleaning equipment at the installation.

The wheel cleaners shall be used by all vehicles leaving tlie facility as required to ensure that no trade effluent/storm water or waste is can-iecl off-site. All water from the wheel cleaning area shall be collected for safe disposal.

The wheel-wash shall be inspected on a daily basis and drained as required. Silt, stones and other accumulated material shall. be removed as required from the wheel-wash antl disposed of appropriately.

Waste handling, ventilation and processing plant

3.20.1 I t e m of plant deemed critical to tlie efficient and adequate processing of waste at tlie installation (including ititer cilia waste-loading vehicles and ejector trailers) shall be provided on tlie following basis:

3.20.2 Within three months from- the date of grant of. this licence, tlie licensee shall maintain a n inventory detailing tlie duty and standby capacity in tonnes per clay of all waste halidling equipment to be used, at the installation. These capacities shall be based on the licensed waste intake, as per Schetliile A: Liirii~itiom, of this licence.

The quantity of waste to be accepted a t the installation on a daily basis shall not exceed the duty capacity of the equipment at the installation. Any exceedaiice of this intake shall be treated as an inciclent.

3.20.3

Waste Inspection and Quarantine Areas

3.21. I A Waste Inspection Area ant1 a Waste Quarantine Area shall be providecl and maintained at the installation.

These areas shall be constructed andniaintainecl in a manner suitable, and be of a size appropriate, for tlie inspection of waste and subsequent quarantine if required. The waste inspection area ,and tlie waste quarantine area shall be clearly identified and segregated from each other.

The licensee shall have regard to tlie following when choosing aiid/or.clesigning any new plant/infi-astructure: (i) energy efficiency; ,and, (ii) the environmental impact of eventual decommissioning.

DudOdour Control

The licensee shall install ,and provide adequate measures for the coiltrol of oclours and dust emissions, incluciing fugitive dust emissions, from the installation.

Such pi-ocedures shall be assessed for their suitability for the test matrix and performance characteristics shall be determined.

Such procedures shall be subject to a programme of Analytical Quality Control using control staylards with evaluation of test responses.

Where any analysis is sub-contractecl it shall be to a competent laboratory.

All automatic monitors and samplers shall be functioning at all times (except during maintenance .ancl calibration) when the activity is being carried on unless alternative sampling or monitoring has been agreed in writing by the Agency for a limited period. In the event of the malfunction of any continuous moi?itor, the licensee shall contact the Agency as soon as practicable, and alternative sampling and monitoring facilities shall be put in place. The use of alternative equipment, other than in emergency situations, shall be as agreed by the Agency.

Tlie integrity and water tightness of all underground pipes, tanks, bunding structures and containers and their resistance to penetration by water or other materials can-iecl or stored therein shall be tested antl clemonstratecl by the liceiisee within six months of the date of grant of this licence. This testing sl ial l be carried out by the licensee at least once every three years thereafter antl reported to the Agency on each occasion. This testing shall be carried out in accordance with any guidance publishetl by tlie Agency. A written record of all integrity tests a n d a n y maintenance or remedial work arising from them shall be maintained by the licensee.

The storm water drainage system (i.e., gullies, manholes, any visible drainage conduits and such other aspects as may be agreed) shall be visually .inspected 'weekly, and desludgecl as necessary. Bunds, silt traps ancl oil separators shall be inspected weekly and desludged as necessary. All sluclge and drainage from these operations shall be collected for safe disposal. The drainage system, bunds, silt traps and oil interceptors shall be properly maintained at all times. Tlie licensee shall maintain a clrainage map on site. The licensee shall maintain or have access to bale wrapping equipment at the installation. The licensee shall use this equipment if necessary to ensure that clainagetl bales are repaired to a satisfactory condition.

Only intact bales, free of any damage to wrapping, shall be moved from tlie installation to the quayside for export.

The licensee shall carry out a noise survey of the site operations as required by the . Agency. The survey programme shall be undertaken in accordance with the methodology

specified in the 'Guidance Note for Noise: Licence . Applications, Surveys aiid Assessments in Relation to Scheduled Activities (NG4)' as published by the Agency.

Pollutant Release and Transfer Register (PRTR)

The licensee shall prepare and report a PRTR for the site. The substance and/or wastes to be included in the PRTR shall be determined by reference to EC Regulations No. 166/2006 concerning the establishment of the European Pollutant Release antl Transfer Register. The PRTR shall be prepared in accordance witli any relevant guidelines issuecl by the Agency and shall be submitted electronically in specified format and as pait o f the AER.

The licensee shall, within six months of the.date of grant of this licence, develop and establish a Data Management System for collation, archiving, assessing and graphically presenting the monitoring data generated as a result of this licence.

6.17 Litter Control

6.17.1 All loose litter or other waste placed on o r ' h the vicinity ofthe installation, other than in accordance with the requirements of this licence, shall be removed, subject to the agreement of the landowners, immediately and in any event by 10.00 am of the next working day after such waste is discovered.

6.17.2 The licensee shall ensure that all vehicles delivering waste to and removing waste and materials froin the installation are appropriately covered.

The licensee shall undertake, as required by the Agency, an odour assessment which shall include as a minimum the identification aiid quantification of all significant odour sources ancl an assessment of the suitability and adequacy of the odour abatement system(s) to deal with these emissions. Any recommendations arising from such an odour assessment shall be implemented.

No chemicals shall be used to mask odour emissions from the installation except where this is satisfactory to the Agency.

The licensee shall ensure that waste generated in the carrying on of the activity shall be prepared for re-use, recycling or recovery or, where that is not technically or economically possible, disposecl of i n a manner which will prevent or minimise any impact on the environment.

Disposal or recovery of waste on-site shall only. take place in accordance with the conditions of this licence ancl i n accordance with the appropriate National and European legislation and protocols.

Waste sent off-site for recovery or disposal shall be transported only by an authorised waste contractor. The waste shall be transported from the site of the activity to the site of recovery/disposal only in a manner that will riot adversely affect the environment and in accordance with the appropriate National ancl European legislation and protocols.

The licensee shall ensure that, in advance of transfer to another person, waste shall be classified, packaged and labelled in accorclance with National, European ancl any other standards which are in force in relation to such labelling.

The loading and unloading of materials shall be carrieh out in designatecl areas protected against spillage and leachate run-off.

Waste shall be stored in designated areas, protected as may be appropriate against spillage ancl leachate run-off. The waste shall be clearly labelled and appropriately segregated.

5.12.1 Unless otherwise agreed by the Agency, a maximum of 4,000 tonnes of waste, or as inay be restricted by the Waste Storage Plan, and in any event no more than the equivalent of one shipload o f waste, shall be stored at the installation at any one time.

To the extent possible, bales of waste shall be dispatched from the installation in order of the date of first production of the bale as labelled i n accordance with Condition S. 1 1.3 of this licence.

Unless otherwise agreed by the Agency, no waste shall be stored at the installation for longer than 21 clays from its date of arrival at the installation, or as may be restricted by the Waste Storage Plan.

Waste bales shall be stored at a distance o f at least 2 meters from the s'torni water drain.

S.13.l The licensee shall, within three months of date of grant of licence, establish, maintain and implement a Waste Storage Plan for all waste stored antl held a t the installation.

The Waste Storage Plan shall be at all times to the satisfaction ofthe Agency.

Condition 9. Accident Prevention and Emergency Response

9.1 The licensee shall, within six months of clate of grant of this licence, ensure that a documented Accident Prevention Procedure is in place that addresses the hazards on-site, pal-ticularly i n relation to the prevention of accidents with a possible impact on the environment. This procedure shall be reviewecl aiinually and updated as necessary.

The licensee shall, within six months of date of grant of this licence, ensure that a documeiitecl Emergency Response Procedure is in place tha t addresses a n y emergency situation which may originate on-site. Such a breakdown event sha l l be treated as a n emergency and rectified as soon as possible.

All significant spillages occurring at the installation shall be treated as a n emergency antl immediately cleaned up and dealt with so as to alleviate their effects.

Marine institute (MI), Sea Fisheries Protection Authority (SFPA), Food Safety Authority of Ireland (FSAI) and an -Bard lascaigh Mhara (BIM) in the case of discharges to or likely to impact a shellfish water.

The licensee shall make a record of any notification made under Condition 11.2. This record shall include details of the nature, extent, and impact of, antI'circuinstances giving rise to, the incident or accident. The record shall include all corrective actions taken to manage the incident or accident, minimise wastes generated and the effect on tlie.environment, and avoid recurrence. The licensee shall, as soon as practicable following notification, submit to the Agency the record.

The licensee shall record a l l complaints of an environmental nature related to the operation of the activity. Each such record shall give details of the date antl time of the complaint, the name of the complainant (if provided), and give details of the nature of the complaint. A record shall also be kept of the response made in the case of each complaint.

The licensee shall record all sampling, analyses, measurements, examinations, calibrations antl maintenance carried out i n accordance with the requirements of this licence ancl all other such monitoring which relates to the environmental performance of the installation.

The licensee shall as a minimum ensure that the following documents are accessible at the site:

(i) the licences relating to the installation; (ii) the current EMS for the installation including all associated procedures, reports,

records ancl other documents; (iii) the previous year's A E R for the installation; (iv) records of all inspections, sampling, ana.lyses, measurements, examinations,

calibrations antl maintenance carried out in accordance with the requirements of this licence antl all other such monitoring which relates to the environmental performance of the installation;

Condition 12. Financial Charges and Provisions

12.1 Agency Charges

12.1.1 The licensee shall pay to tlie Agency a n annual contribution of €6,513, or such sum as tlie Agency from time to time determines, having regard to variations i n the extent of reporting, auditing, inspection, sampling and analysis or other functions carried out by tlie Agency, towards tlie cost of monitoring tlie activity as tlie Agency considers' necessary for the performance of its functions under tlie Environmental Protection Agency Act 1992 as amendecl. The first payment shall be a pro-rata amount for the period from the date of grant of this licence to tlie 31" clay of December, ancl shall be paid to the Agency within one month from the clate of grant of the licence. In subsequent years the licensee shall pay to the Agency such revised annua l contribution a s the Agency shall from time to time consider necessary to enable performance by the Agency of its relevant functions under the Environmental Protection Agency Act 1992 as ainenclecl and all such payments shall be macle within one month of the date upon which deinanded by the Agency.

In tlie event that the frequency or extent of monitoring or other functions carried out by the Agency needs to be increased, the licensee shall contribute such sums as deterininecl by the Agency to defray its costs i n regard to items not covered by tlie said annual contribution.

The licensee shall as part of the AER, provide an annual statement as to the measures taken or adopted at the site i n relation io the prevention of environmental damage, and the financial provisions in place i n relation to the underwriting of costs for remedi a I actions fol I ow i i i g anticipated events (including c I os ure) or accideiits/incitleiits, as inay be associated with the carrying on of the activity.

The licensee shall arrange for the completion, by an independent and appropriately qualified consultant, of a comprehensive and fully costed Environmental Liabilities Risk Assessment (ELRA) which addresses the liabilities fiom past and present activities. The assessment shall include those liabilities and costs identified in Condition I O for execution of the DMP. A report 011 this assessinent shall be submitted to the Agency for agreement within three months o f date of grant o f this licence. The ELRA shall be reviewed as necessary to reflect any significant change on site, antl i n any case every three years following initial agreement. Review results are to be notified as part of the AER.

The licensee shall, to the satisfaction of the Agency and prior to annual waste acceptance exceeding 50,000 tonnes and in any event within six months o f the date o f grant o f this licence, make financial provision to cover any liabilities associated with the operation (including closure). The amount of indemnity held shall be reviewed and revised as necessary, but at least annually. Proof of renewal or revision of such financial indemnity' shall be included in the annual 'Statement of Measures' report identified in Condition 12.2.1. .

The licensee shall revise the cost o f closure annually and any adjustments shall be retlectetl i n the tinancial provision macle under Condition 12.2.3.
