CHAPTER 79

Zinc and articles thereof

Note.

I.- In this Chapter the following expressions have the meanings herebyassigned to them:

(a) Bars and rods

Rolled, extruded, drawn or forged products, not in coils, which have auniform solid cross-section along their whole length in the shape ofcircles, ovals, rectangles (including squares), equilateral triangles orregular convex polygons (including "flattened circles" and "modifiedrectangles", of which two opposite sides are convex arcs, the other twosides being straight, of equal length and parallel). Products with arectangular (including square), triangular or polygonal cross-sectionmay have corners rounded along their whole length. The thickness ofsuch products which have a rectangular (including "modified rectangu-lar") cross-section exceeds one-tenth of the width. The expression alsocovers cast or sintered products, of the same forms and dimensions,which have been subsequently worked after production (otherwise thanby simple trimming or de-scaling), provided that they have not therebyassumed the character of articles or products of other headings.

(b) Profiles

Rolled, extruded, drawn, forged or formed products, coiled or not,-of auniform cross-section along their whole length, which do not conform toany of the definitions of bars, rods, wire, plates, sheets, strip, foil, tubesor pipes. (c) Wire

Heading No. 79.05 applies, inter alia, to plates, sheets, strip and foilwith patterns (for example, grooves, ribs, chequers, tears, buttons,lozenges) and to such products which have been perforated, corrugated,polished or coated, provided that they do not thereby assume thecharacter of articles or products of other headings.

(e) Tubes and pipes

Hollow products, coiled or not, which have a uniform cross-section withonly one enclosed void along their whole length in the shape of circles,ovals, rectangles (including squares), equilateral triangles or regularconvex polygons, and which have a uniform wall thickness. Productswith a rectangular (including square), equilateral triangular or regularconvex polygonal cross-section, which may have corners rounded alongtheir whole length, are also to be considered as tubes and pipes providedthe inner and outer cross-sections are concentric and have the sameform and orientation. Tubes and pipes of the foregoing cross-sectionsmay be polished, coated, bent, threaded, drilled, waisted, expanded,cone-shaped or fitted with flanges, collars or rings.

Subheading Note.

1.- In this Chapter the following expressions have the meanings herebyassigned to them:

(a) Zinc , not alloyed

Metal containing by weight at least 97.5% of zinc.

(b) Zinc alloys

Metallic substances in which zinc predominates by weight over each ofthe other elements , provided that the total content by weight of suchother elements exceeds 2.5%.

(c) Zinc dust

Dust obtained by condensation of zinc vapour, consisting of sphericalparticles which are finer than zinc powders. At least 80% by weight ofthe particles pass through a sieve with 63 micrometres (microns) mesh.It must contain at least 85% by weight of metallic zinc.

1.- Apart from blow lamps, portable forges, grinding wheels with frameworks,manicure or pedicure sets, and goods of heading No. 82.09, this Chaptercovers only articles with a blade, working edge, working surface or otherworking part of

(a) Base metal;

(b) Metal carbides or cermets;

(c) Precious or semi-precious stones (natural, synthetic or reconstructed) ona support of base metal, metal carbide or cermet; or

1.- This Chapter does not cover:

2.- Subject to the operation of Note 3 to Section XVI, a machine or appliancewhich answers to a description in one or more of the headings Nos. 84.01 to84.24 and at the same time to a description in one or other of the headingsNos. 84.25 to 84.80 is to be classified under the appropriate heading of theformer group and not the latter.

Heading No. 84.19 does not, however, cover:

(a) Germination plant, incubators or brooders (heading No. 84.36);

(b) Grain dampening machines (heading No. 84.37);

(c) Diffusing apparatus for sugar juice extraction (heading No. 84.38),-

(d) Machinery for the heat-treatment of textile yarns, fabrics or made uptextile articles (heading No. 84.51); or

4.- Heading No. 84 . 57 applies only to machine- tools for working metal (otherthan lathes) which can carry out different types of machining operationseither:

(a) by automatic tool change from a magazine or the like in conformitywith a machining programme (machining centres),

(b) by the automatic use, simultaneously or sequentially, of different unitheads working on a fixed position workpiece (unit constructionmachines , single station), or

(c) by the automatic transfer of the workpiece to different unit heads( multi -station transfer machines).

5.- (A) For the purposes of heading No. 84 . 71, the expression "automatic dataprocessing machines" means:

(a) Digital machines , capable of ( 1) storing the processing program orprograms and at least the data immediately necessary for theexecution of the program ; (2) being freely programmed in accor-dance with the requirements of the user ; ( 3) performing arithmeticalcomputations specified by the user; and, (4 ) executing , withouthuman intervention, a processing program which requires them tomodify their execution , by logical decision during the processingrun;

(b) Analogue machines capable of simulating mathematical models andcomprising at least : analogue elements , control elements andprogramming elements;

(c) Hybrid machines consisting of either a digital machine withanalogue elements or an analogue machine with digital elements.

(B) Automatic data processing machines may be in the form of systemsconsisting of a variable number of separately - housed units . A unit is tobe regarded as being a part of the complete system if it meets all thefollowing conditions:

(a) it is connectable to the central processing unit either directly orthrough one or more other units;

(b) it is specifically designed as part of such a system ( it must, inparticular , unless it is a power supply unit, be able to accept ordeliver data in a form ( code or signals) which can be used by thesystem).

Such units presented separately are also to be classified inheading No. 84.71.

Heading No. 84.71 does not cover machines incorporating or workingin conjunction with an automatic data processing machine and performinga specified function . Such machines are classified in the headingsappropriate to their respective functions or. failing that, in residualheadings.

6.- Heading No. 84.82 applies, inter alia , to polished steel balls, the maximumand minimum diameters of which do not differ from the nominal diameter

Electrical machinery and equipment and parts thereof;sound recorders and reproducers,

I.- This Chapter does not cover:

(a) Electrically warmed blankets, bed pads, foot-muffs or the like;electrically warmed clothing, footwear or ear pads or other electricallywarmed articles worn on or about the person;

(b) Articles of glass of heading No. 70.1 1; or

(c) Electrically heated furniture of Chapter 94.

2.- Headings Nos. 85.01 to 85.04 do not apply to goods described in headingNo. 85.11, 85.12, 85.40, 85.41 or 85.42.

However, metal tank mercury arc rectifiers remain classified inheading No. 85.04.

3.- Heading No. 85.09 covers only the following electro-mechanical machinesof the kind commonly used for domestic purposes:

(a) Vacuum cleaners, floor polishers, food grinders and mixers, and fruit orvegetable juice extractors, of any weight;

(b) Other machines provided the weight of such machines does not exceed20 kg.

The heading does not, however, apply to fans or ventilating orrecycling hoods incorporating a fan, whether or not fitted with filters(heading No. 84.14), centrifugal clothes-dryers (heading No. 84.21), dishwashing machines (heading No. 84.22), household washing machines(heading No. 84.50), roller or other ironing machines (heading No. 84.20 or84.51), sewing machines (heading No. 84.52), electric scissors (heading No.85.08) or to electro-thermic appliances (heading No. 85.16).

4.- For the purposes of heading No. 85.34 "printed circuits" are circuitsobtained by forming on an insulating base, by any printing process (forexample, embossing, plating-up, etching) or by the "film circuit" technique,conductor elements , contacts or other printed components (for example,inductances, resistors, capacitors) alone or interconnected according to apre-established pattern, other than elements which can produce, rectify,modulate or amplify an electrical signal (for example, semiconductorelements).

The term "printed circuits" does not cover circuits combined withelements other than those obtained during the printing process. Printedcircuits may, however, be fitted with non-printed connecting elements.

5.- For the purposes of headings Nos. 85.41 and 85.42:

(A) "Diodes, transistors and similar semiconductor devices" are semicon-ductor devices the operation of which depends on variations inresistivity on the application of an electric field;

(B) "Electronic integrated circuits and microassemblies" are:

(a) Monolithic integrated circuits in which the circuit elements(diodes, transistors, resistors, capacitors, interconnections, etc.) arecreated in the mass (essentially) and on the surface of asemiconductor material (doped silicon, for example) and areinseparably associated;

(b) Hybrid integrated circuits in which passive elements (resistors,capacitors, interconnections, etc.), obtained by thin- or thick-filmtechnology, and active elements (diodes, transistors, monolithicintegrated circuits, etc.), obtained by semiconductor technology,are combined to all intents and purposes indivisibly, on a singleinsulating substrate (glass, ceramic, etc.). These circuits may alsoinclude discrete components;

(c) Microassemblies of the moulded module, micromodule or similartypes, consisting of discrete, active or both active and passivecomponents which are combined and interconnected.

Works of art, collectors ' pieces and antiques

L- This Chapter does not cover:

(a) Unused postage or revenue stamps, postal stationery (stamped paper) orthe like, of current or new issue in the country to which they are destined(Chapter 49);

(b) Theatrical scenery, studio back-cloths or the like, of painted canvas(heading No. 59.07) except if they may be classified in heading No.97.06; or

(c) Pearls, natural or cultured , or precious or semi-precious stones( headings Nos. 71.0 1 to 71.03).

2.- For the purposes of heading No. 97.02, the expression "original engravings,prints and lithographs" means impressions produced directly, in black andwhite or in colour, of one or of several plates wholly executed by hand bythe artist, irrespective of the process or of the material employed by him,but not including any mechanical or photomechanical process.

PROTOCOL

OF AMENDMENT TOTHE INTERNATIONAL CONVENTION ON THE HARMONIZED

COMMODITY DESCRIPTION AND CODING SYSTEM

(done at Brussels on 24 June 1986)

The Contracting Parties to the Convention establishing a CustomsCo-operation Council signed in Brussels on 15 December 19501 and theEuropean Economic Community,

Considering that it is desirable to bring the International Convention on theHarmonized Commodity Description and Coding System (done at Brussels on14 June 1983) into force on 1 January 1988,

Considering that , unless Article 13 of the said Convention is amended, theentry into force of the Convention on that date will remain uncertain,

Have agreed as follows:

ARTICLE I

Paragraph I of Article 13 of the International Convention on theHarmonized Commodity Description and Coding System done at Brussels on14 June 1983 (hereinafter referred to as " the Convention ") shall be replaced bythe following text:

1. This convention shall enter into force on the earliest first of January whichfalls at least three months after a minimum of seventeen States or Customsor Economic Unions referred to in Article 11 above have signed it withoutreservation of ratification or have deposited their instruments of ratificationor accession , but not before l January 1988."

ARTICLE 2

A. The present Protocol shall enter into force simultaneously with theConvention provided that a minimum of seventeen States or Customs orEconomic Unions referred to in Article 11 of the convention have depositedtheir instruments of acceptance of the Protocol with the Secretary Generalof the Customs Co-operation Council . However, no State or Customs orEconomic Union may deposit its instrument of acceptance of the presentProtocol unless it has previously signed or signs at the same time theConvention without reservation of ratification or has previously depositedor deposits at the same time its instrument of ratification of, or of accessionto the Convention.

B. Any state or Customs or Economic Union becoming a Contracting Party tothe Convention after the entry into force of the present Protocol underparagraph A above shall be a Contracting Party to the Convention asamended by the Protocol.
