Dear Mr. Rankin,

This is a request under the Texas Open Records Act and any other applicablelaws providing for public access to government information.

I request that I be sent copies of the following documents or, if there are a largenumber, be permitted to inspect the following documents and receive copies of the ones I would like:

1. The contract and any correspondence, memoranda or other documentsrelated to the Harris County Housing Authority’s purchase of 91 acres of

land for the first phase of its planned development known as Patriots onthe Lake.2. The contract to purchase 69 additional acres for a second phase of this

development. This contract was on the board’s agenda for its meeting of June 18, 2009, and was discussed in executive session. After resuming itspublic session, the board voted to cancel the contract.

3. Contracts with the housing authority’s general counsel, Michael Fleming,and his immediate predecessor, whose name is not known to me.

4. Copies of any documents such as board meeting minutes, memoranda or correspondence explaining why the agency decided to replace its generalcounsel.

If you have any questions about the nature or scope of this request, please call meat the phone number listed below. If you determine that all or some portion of theinformation requested is excepted from required disclosure, I request that youprovide me with the portions of the requested information that are public andreasonably segrable from that which you believe is excepted. If any records are inactive use or in storage, please certify this fact in writing and set a date and hour within a reasonable time when the records will be available, as required by section552.221 of the Act.

If you determine that all or some portion of the information requested is excepted

from required public disclosure under a particular exception, I request that youadvise me as to which exceptions you believe apply. If you rely on previousdetermination, please advise me of the applicable court decision or AttorneyGeneral's opinion. If there is no such determination, please advise me of the requestfor such an opinion, as required under section 552.301 of the Act, and a dated copyof your letter to the Attorney General. I call your attention to section 522.353 of theAct, which provides penalties for a failure to release public records.
