I, the undersigned Director of Regulatory Agencies of the State of Hawaii, send Greetings:

WHEREAS, JOHN M. FUJIOKA, HERBERT M. KOBAYASHI, MASAICHI OISHI, and HARRY H. MORIKAWA, majority of whom are residents of the State of Hawaii, have filed with me as Director of Regulatory Agencies a verified petition to grant to them and their associates a Charter of Incorporation as a non-profit corporation, in accordance with the provisions of Section 416-20, Hawaii Revised Statutes;

IThe name of the corporation shall be HAWAII DENTAL ASSOCIATION

IIThe location of the principal office of the corporation shall be in Honolulu, City and County of Honolulu, and the specific address

of its office shall be 1000 Bishop Street, Suite 805, City and County of Honolulu, State of Hawaii.

IIIThe purposes of the corporation are:

A. To promote high professional standards in the practice of dentistry: to encourage and promote the improvement of the health of the public and to promote the art and science of dentistry as a profession;

B. To sue and be sued, plead and be impleaded in any and all courts; C. To make and use the corporate seal and alter the same at its pleasure; D. To hold, purchase, convey, rent, lease, receive gifts, and otherwise acquire and dispose of such real, personal or mixed

property as the purpose of the corporation may require and to mortgage, hypothecate or pledge the same to secure any debt of the corporation; and to borrow money and give security for the same; provided, however, that no real property may be conveyed, mortgaged or encumbered without a prior resolution by the House of Delegates authorizing such act;

E. To raise funds by private or public entertainment; F. To obtain capital and revenue for fulfillment of its object through donations, subscriptions, assessments, dues or otherwise; G. To make Bylaws, not inconsistent with any existing law for the management of its property, the election and removal

of its officers, the regulations of its affairs and the transfer of its property; H. To do any and all things necessary, suitable or proper for the accomplishment of any of the purposes or for the attainment

of any of the objects or for the exercise of any of the powers herein set forth; I. The enumeration herein of the purposes of this corporation shall be construed as objects and powers as well as purposes

and shall be liberally construed both as to purposes and powers and shall not be deemed to exclude by inference any powers, objects and purposes which this corporation is empowered to exercise, whether expressly by force of the laws of the State of Hawaii now or hereafter in effect, or implied by the reasonable construction of said laws.

IVThe officers shall consist of: President, President-elect, Secretary, and Treasurer. There may also be such additional and

subordinate officers as the activities of the corporation may require. The officers and the subordinate officers shall have such duties and shall be elected or appointed, hold office and be removed in such manner as may be prescribed by the Bylaws.

VThere shall be a Board of Directors to be called the House of Delegates consisting of not less than three (3) members.

Chapter I Association Section 1. Description. The Hawaii Dental Association, a

non-profit corporation, is organized and chartered in the State of Hawaii. It is the sole constituent association of the American Dental Association (ADA) in Hawaii.

Section 2. Mission Statement. The Association is dedicated to serving the profession of dentistry and the public of the State of Hawaii. The Association preserves the integrity of the dental profession, strengthens the doctor/patient relationship and promotes the Principles of Ethics and Code of Professional Conduct of the ADA.

Section 3. Officers. The officers of the Association will be President, President-elect, Vice-President, Secretary, Treasurer, and Speaker of the House of Delegates.

Section 4. Meetings. Each year, the Association will hold a minimum of four meetings of the Board of Trustees and the annual meeting of the House of Delegates.

Section 5. Code of Ethics. The Principles of Ethics and Code of Professional Conduct of the ADA will be the code of ethics of the Association.

Section 6. Charter and Bylaws. The Association will adopt and maintain a Charter and Bylaws that will not be in conflict with the Constitution and Bylaws of the ADA.

Section 7. Privilege of Representation. The Association will maintain a Delegation to the ADA 14th District caucuses and the ADA House of Delegates.

Section 8. Powers. It will have the power to organize its members into Component societies, to discipline its members, and to collect membership dues for the ADA, the Association, and its Components.

Section 9. Programs. The Association may establish programs, defined as a long-term, planned and coordinated groups of activities and procedures for specific purposes.

Section 10. Task Forces. The Association may establish task forces, defined as temporary groupings of individuals and resources for specific short-term objectives.

Section 11. Conflict of Interest. It is the policy of the Association that individuals who represent the Association do so without conflict of interest to the Association.

Section 12. Rules of Order. All questions not provided for in the Charter and Bylaws will be governed by the most recent edition of The Standard Code of Parliamentary Procedure by Alice Sturgis.

Chapter II Membership Section 1. Tripartite Organization. This tripartite (three-part)

organization consists of the ADA, the Association, and one of our four Component Dental Societies

(Component). Membership requires belonging to all three parts.

Section 2. Member Classification. Qualifications, privileges, dues and special assessments for each member of the Association will mirror current ADA Bylaws.

Section 3. In Good Standing. Any member of the Association is in good standing within the meaning of these Bylaws provided:A. Dues and assessments for the current year have

been paid or have been partially or fully exempted by the tripartite organization.

B. Member is not currently under suspension per current ADA Bylaws.

C. Member’s license to practice in Hawaii or any other state has not been revoked or suspended, or has been restored on appeal.

Section 4. Discipline of Members. Any member found in violation of these Bylaws or the ADA Principles of Ethics and Code of Professional Conduct, or found guilty of a felony or of violating the Hawaii Revised Statutes, Chapter 448; Dentistry and/or Hawaii Administrative Rules, Title 16, Chapter 79, Dentists and Dental Hygienists, may be disciplined by the Association following the guidelines in the current ADA Bylaws.

Section 5. Dues. The annual dues invoice includes the ADA, the Association, and the Component dues plus any special assessments.

Chapter III Component Dental Societies

Section 1. Composition and Names. Component Dental Societies are designated as follows: Hawaii County Dental Society, Honolulu County Dental Society, Kauai County Dental Society and Maui County Dental Society.

Section 2. Organization. Components consist of members in good standing of the Association and the ADA who reside or practice within the geographic area of that Component.

Section 3. Code of Ethics. The Principles of Ethics and Code of Professional Conduct of the ADA will be the code of ethics of the Component.

§448-1 Dentistry defined; exempted practices. A person practices dentistry, within the meaning of this chapter, who represents oneself as being able to diagnose, treat, operate or prescribe for any disease, pain, injury, deficiency, deformity, or physical condition of the human teeth, alveolar process, gums, or jaw, or who offers or undertakes by any means or methods to diagnose, treat, operate or prescribe for any disease, pain, injury, deficiency, deformity, or physical condition of the same, or to take impressions of the teeth or jaws; or who owns, maintains, or operates an office for the practice of dentistry; or who engages in any of the practices included in the curricula of recognized and approved dental schools or colleges. Dentistry includes that part of health care concerned with the diagnosis, prevention, and treatment of diseases of the teeth, oral cavity, and associated structures including the restoration of defective or missing teeth. The fact that a person uses any dental degree, or designation, or any card, device, directory, poster, sign, or other media whereby one represents oneself to be a dentist, shall be prima facie evidence that the person is engaged in the practice of dentistry.

The following practices, acts, and operations, however, are exempt from the operation of this chapter:

(1) The rendering of dental relief in emergency cases in the practice of one’s profession by a physician or surgeon, licensed as such and registered under the laws of this State, unless one undertakes to reproduce or reproduces lost parts of the human teeth in the mouth or to restore or replace in the human mouth lost or missing teeth;

(2) The practice of dentistry in the discharge of their official duties by dentists in the United States Army, the United States Navy, the United States Air Force, the United States Public Health Service, or the United States Veterans Administration;

(3) The practice of dentistry by licensed dentists of other states or countries at meetings of the Hawaii Dental Association or component parts thereof, alumni meetings of dental colleges, or any other like dental organizations, while appearing as clinicians;

(4) The use of roentgen and other rays for making radiograms or similar records of dental or oral tissues;

(5) The making of artificial restorations, substitutes, appliances, or materials for the correction of disease, loss, deformity, malposition, dislocation, fracture, injury to the jaws, teeth, lips, gums, cheeks, palate, or associated tissues, or parts, upon orders, prescription, casts, models, or from impressions furnished by a Hawaii licensed dentist; and

(6) The ownership and management of a dental practice by the executor or administrator of a dentist’s estate or the legal guardian or authorized representative of a dentist, where the licensed dentist has died or is incapacitated, for the purpose of winding down, transferring, or selling the practice, for a period not to exceed one year from the time of death or from the date the dentist is declared incapacitated; provided that all other aspects of the practice of dentistry are performed by one or more licensed dentists.

[§448-1.5] Lead apron during x-ray; required. (a) A dentist shall cover a patient’s torso from the neck to the pelvis including the genital area with a lead apron while conducting an x-ray procedure on the patient.

(b) The board of dental examiners, by rule adopted pursuant to chapter 91, shall establish minimum specifications for the lead apron; provided that the lead apron shall protect the patient’s body from unnecessary exposure to x-rays yet not unduly discomfort the patient.

(c) Any violation of this section shall be considered an improper conduct in the practice of dentistry for the purpose of section 448-17.

§448-2 Practice without license prohibited. No person shall practice dentistry or dental surgery in the State, either gratuitously or for pay, or shall offer to so practice or shall advertise or announce oneself, either publicly or privately, as prepared or qualified to so practice, or append the letters “D.D.S.”, “D.M.D.”, “Dr.”, “L.D.S.”, or any other dental degree to the person’s name with intent thereby to imply that the person is a practitioner of dentistry or a dental surgeon, without having a valid unrevoked license from the board of dental examiners.

§448-3 Practice by unlicensed employee prohibited; penalty. (a) Except as provided in section 447-3, no person who manages or conducts as manager, proprietor, conductor, or otherwise a place where dental operations are performed, shall employ any person as operator in dental surgery or as a practitioner, or cause to permit any person to so act, who is not duly licensed to practice dentistry; provided that nothing in this chapter shall prohibit any unlicensed person from performing merely mechanical work upon inert matter in a dental laboratory.

(b) A duly licensed and registered dentist may employ auxiliary personnel, other than registered dental hygienists, to assist the dentist in the practice of dentistry. These employees shall be known as dental assistants and shall perform all duties assigned to them under the supervision, direction and responsibility of the dentist. Duties of the

§447-1 Who may become dental hygienists; fees. (a) Any person:

(1) Eighteen years of age or over;(2) Who has a diploma or proper certificate of graduation from a

dental hygiene school accredited by the American Dental Association Commission on Dental Accreditation that requires at least a two year course and is recognized by the board of dental examiners;

(3) Who has been officially certified in the administration of intra-oral infiltration local anesthesia and intra-oral block anesthesia by an accredited dental hygiene school or by a certification program previously approved by the board; and

(4) Who has passed the National Board Dental Hygiene Examination; upon written application made to and filed with the board may be examined for qualification as a dental hygienist.

An application shall be accompanied by the applicant’s certificate of graduation from an accredited dental hygiene school, documentary proof of the applicant’s certification in the administration of intra-oral infiltration local anesthesia and intra-oral block anesthesia, and documentary proof of the applicant’s passage of the National Board Dental Hygiene Examination. At the time of filing the application, the applicant shall pay to the board an application fee, which together with all other fees or charges in this chapter, shall be as provided in rules adopted by the director of commerce and consumer affairs pursuant to chapter 91, and shall be deposited to the credit of the compliance resolution fund established pursuant to section 26-9(o).

(b) The board shall require an applicant to take and pass the State’s examination or one of the following four regional clinical examinations given after Feb. 1, 2005, by the:

(1) Western Regional Examining Board;(2) Central Regional Dental Testing Service, Inc.;(3) Southern Regional Testing Agency, Inc.; or(4) North East Regional Board of Dental Examiners, Inc.(c) In addition to the requirements of subsection (a), an applicant

shall take and pass a national clinical examination once a national clinical examination becomes available and neither the state examination nor any regional examination shall be accepted; provided that an applicant who has taken and passed the state or a regional examination after February 1, 2005, but prior to the availability of a national examination shall be deemed to have met the board’s examination requirement.

(d) If an applicant successfully passes the examination required by subsections (b) and (c), the applicant shall be licensed to practice as a dental hygienist in the State. Every licensed dental hygienist, before entering practice, shall pay the board a license fee. On or before December 31 of each odd-numbered year, every licensed dental hygienist beginning or continuing to practice in the State shall pay to the board a fee for biennial licensure. The failure, neglect, or refusal of any duly licensed dental hygienist to pay the biennial

licensure fee shall constitute a forfeiture of the license; provided that the license may be restored upon written application and payment to the board of a restoration fee.

(e) An applicant’s or licensed dental hygienist’s competence to administer intra-oral infiltration local anesthesia shall be demonstrated by certification in the administration of intra-oral infiltration local anesthesia by an accredited dental hygiene school or by a certification program previously approved by the board. An applicant’s or licensed dental hygienist’s competence to administer intra-oral block anesthesia shall be demonstrated by proof of successful completion of a course of study in accordance with standards provided for in this chapter and the issuance of a certificate or other program documentation listing the intra-oral block anesthesia categories in which the applicant or licensed dental hygienist has acquired knowledge and proficiency.

The applicant or licensed dental hygienist shall submit documentation of course content when submitting certification in the administration of intra-oral infiltration local anesthesia and intra-oral block anesthesia as required by subsection (a). The board shall certify that the applicant or licensed dental hygienist has met the requirements of this chapter.

(f) No person shall practice dental hygiene, either gratuitously or for pay, or shall offer or attempt so to practice, or shall advertise or announce publicly or privately as being prepared or qualified so to practice without having a license as provided in this section. The original or a copy of the certificate of licensure shall be prominently displayed at all times in the workplace where the dental hygienist is employed or practices. A dental hygienist’s pocket identification card shall be readily available for viewing upon request to ensure the license is current. A licensed dental hygienist shall practice only under the supervision of a licensed dentist as provided in this chapter; provided that a licensed dental hygienist shall administer under the direct supervision of a licensed dentist only those categories of intra-oral block anesthesia listed in the course content submitted to the board pursuant to subsection (a).

[§447-1.5] Community service license. (a) The board of dental examiners may issue, without examination, a community service license to practice dental hygiene in the employment of a federally qualified health center, Native Hawaiian health care system, or post-secondary dental auxiliary training program accredited by the American Dental Association Commission on Dental Accreditation. Community service licensees under this section shall abide by the requirements and conditions placed upon those fully licensed under this chapter.

Eligible candidates shall:(1) Provide copies of documentation and credentials that include

but are not limited to:(A) A diploma or certificate of graduation from a dental

hygiene college accredited by the American Dental Association Commission on Dental Accreditation, recognized and approved by the board; and
