Statement of Legal Basis for Variance Application:

The applicant is seeking to construct building additions and internal renovations to interior habitable space for an existing single family residence. The proposed construction will require 3 variances. The first variance is for the

maximum habitable floor area, 2,251 square feet permitted, 1,820 square feet existing, 2,830 square feet proposed;

exacerbating a pre existing non confirming condition. The second variance is for the minimum front yard setback, 30

feet required, 14.1 feet existing, 9.3 feet proposed, exacerbating a pre existing non-conforming condition. The third

variance is for the minimum required single side yard setback, 10 feet permitted, 9.2 feet existing, 6. 7 feet requested.

The applicant feels justified in requesting variance relief for several reasons. First, the building additions that are increasing the maximum habitable floor area and minimum side yard setback proposed will be built on and over the

existing first floor habitable area and will not increase the apparent bulk of the house. Second, the lot is greatly

undersized with multiple pre existing non-confirming conditions. Because of these factors, the applicant feels that the

proposed project would not negatively impact the public good nor the zoning plan, but would greatly increase the

applicant's functional use of the property.
