FOREWORD

Development is a complex term that takes in many different ideas. But most simply,

development, when we are talking about any Region, means reaching an acceptable

standard of living for all people in that region and physical planning is one of the most

important attributes of such Development. Physical Planning is manifold process to

achieve the goal of planned growth of the Region through tools of planning and regulation

of development. The regulation of development is an extremely daunting task to be

undertaken which is more than often exposed to the allegations of adhocism, favoritism

and misuse of powers. The complexity of the process of giving development permission

increases due to the requirements imposed by different laws and authorities, each

functioning independently of the other which results in delays and the process appears as

a hindrance in development.

As the land values have soared to a level higher than or at least equal to those

which prevail in some of the most advanced Cities of the developed countries it gives an

abnormally high value for every square meter of built-up space which leads to the tendency

to exploit every square meter of land. This situation imposes an extraordinary responsibility

on the Authorities regulating the development whose goal is to ensure that the city

develops in an orderly manner. The working of such Authorities is comparable to a highly

complicated machine or engine, whose internal relationship between several parts, their

interdependence, as also mutual exclusiveness, are not known to the outsiders who are

interested only in the final quick result on demand.

Hence the need for codification and simplification of the process of issuing

development permission is felt strongly, not only for the benefit of the Officers working in

this Authority but also for the Architects and Engineers who applies for the development

permission. This will serve a purpose of bringing about transparency in the function of the

Authority and act as guide for both who administer the statutory duty refuting all allegations

and for general public unaware of details involved in such regulatory processes.

This Handbook is an effort to represent the complex building permission process in

a simpler form so that it acts as a guide throughout the whole process of obtaining building

permission. The Handbook presents requirements of a building proposal and the

processes through which it has to pass before the final outcome. I have no doubt that this

Handbook will help to eliminate delay and promote better understanding in the minds of the

people at large and ensure conformity with regulations that are required to be understood

by all.

simple readable manner which will go in a long way to serve the purpose.

PRELIMINARY

The Mumbai Metropolitan Region Authority (MMRDA) has been appointed as the

Special Planning Authority for the Planning and Development of the specific areas under

the section 40 of MR & TP Act 1966. Currently MMRDA is working as a Special Planning

Authority for the notified areas of Bandra kurla Complex (BKC), Oshiware District Centre

(ODC), Back Bay Reclamation Scheme (BBRS), Wadala Truck Terminal (WTT), Gorai

Manori Uttan Area (GMU), 27 villages deleted from Kalyan Dombivali Municipal

Corporation, 51 villages surrounding Bhiwandi Nizampur City Municipal Corporation,

Ambernath Kulgaon Badlapur and surrounding villages, Mumbai International Airport Ltd.

The expanse of the area under MMRDA as Special Planning Authority is vast with varied

characteristics. The primary concept behind exercise of power by MMRDA for planning

and regulating the development is not properly appreciated or understood resulting in

adoption of erroneous approach by almost all section of society.

The regulation of development and issuance of necessary permissions for the

proposals from different Special Planning Authority Areas has become complex as it is to

be done in compliance with various statutes. Number of statutes have also multiplied so is

the procedure. This has resulted in the complex procedures particularly for issuing

development permissions. The statutes and rules, laws and regulations specially building

regulations are not properly understood by major portion of the population affected by

them. It is also not viewed or interpreted by our Judicial System in a manner that would

view it from its original intentions.

The concerned Officers of MMRDA at all levels try to perform their functions in the

best manner to their capacity within the given constraints. Not aware of complexities of the

issues involved in the process of issuing development permission, the general public is

unable to understand the time required at various stages. In order to avoid any such

possibility and also to adopt result oriented approach the need for simplification of the

procedure was felt.

In such a background Town and Country Planning Division of MMRDA under the

able guidance of the Metropolitan Commissioner, has tried to simplify the procedure for

issue of development Permissions. This Handbook is prepared with a view to regulate and

guide the functioning of process for development permission and to provide guidance to

the staff, practicing architects and general public. This will serve in simplification of

procedures and also make general public aware of the functions of this division and explain

the procedure as to how the development permission is granted. It will also give guidance

to the Architects specially new entrants or out of the city Architects. With the above in view,

the Handbook is made as simple as possible so any person can follow the same.

This Handbook describes the regulatory functions performed by Town and Country

Planning Division, MMRDA, along with the administrative set up created to sub-serve the

purposes. It comprises of the representation of the procedure in graphical form giving

guidelines to the general public as well as concerned professionals and the members of

the staff in the Town and Country Planning Division and includes the relevant

comprehensive information at one point in the form of Handbook which could be referred in

the process of granting development permission and would serve as a guidelines to all

concerned for the expeditious disposal.

This will not only assist the general public but also help to solve problems of the

staff in evaluation of the submission any development permission. This will facilitate

general public, architects and concerned persons to approach in right and complete

manner so as to avoid delays and ambiguity in process for obtaining development

permissions.

INSTRUCTIONS FOR USE OF THE HANDBOOK

This Handbook may be used as a guide for the building permission for the proposal

from all the Special Planning Authority (SPA) areas within MMRDA’s jurisdiction.

For the SPA areas within jurisdiction of MCGM, like BKC, ODC, BBRS etc. common

instruction given in Hand Book. For the SPA areas within jurisdiction of MCGM, the

Development Control Regulations 1991 of Municipal Corporation of Greater Mumbai

are applicable along with the sanctioned development control regulation for the

particular SPA area, unless specified otherwise.

The SPA areas of 27 villages excluded from Kalyan Dombivali Municipal Corporation,

51 villages outside Bhiwandi Nizampur City Municipal Corporation, Kulgaon Badlapur

Ambernath and surrounding villages etc. falls in jurisdiction of Local Authorities other

than MCGM. For such SPA areas the sanctioned prevailing Development Control

Regulations for the concerned area are applicable unless specified otherwise.

In case where the sanctioned development control regulations are not available, the

provisions of development control regulations of Mumbai Metropolitan Region are

applicable.

The Architects/ Licensed Surveyor submitting the proposal for building permission to

MMRDA shall mention the number and provision of the relevant development control

regulations applicable for the concerned area, where MCGM’s DCR 1991 are not

applicable for the proposal.

For the development on the land affected Coastal Regulation Zone Notification 1991,

the applicability of D. C. regulations subject to the conditions mentioned in the MoEF’s

Coastal Regulation Zone Notification dated 19th Feb 1991.

GENERAL GUIDELINES

MAKING AN APPLICATION:

1. Any person desirous of undertaking the development can apply & such person may be;

Owner of the premises.

Constituted Attorney of Owner/authorized Signatory.

Tenant or member/occupant with permission of Owner/Society.

Association of tenants/NOC Holder under MHADA ACT for Repairs/Reconstruction

of existing building.

2. Persons desirous of making any application in case of New building/additions/

Alternations/change of user/misc. work etc will have to :-

Appoint a registered Architect /Licensed Surveyor to undertake the work.

Furnish relevant data/documents to the appointed professional.

Appoint Structural Engineer.

Appoint Licensed supervisor on the work to ensure quality of work executed.

Appoint Licensed Plumber.

Submit the building proposals through registered Architect, Licensed Surveyor in

the prescribed format

Submit all the forms/ Indemnity bonds/undertakings/affidavits/plans/duly signed.

Submit all the required NOC’s/ clearances from the competent Authority.

Pay requisite fees to MMRDA.

PROCEDURE :

The complete application form for development permission with all required

documents shall be received at MMRDA’s concerned Division.

A demand letters for scrutiny fees and development charge shall be issued after

scrutiny.

In case of permissions for miscellaneous proposals demand notes for requisite fees

and deposits shall be issued after preliminary scrutiny.

The first deficiency letter w.r.t. documents and conditions shall be issued after the

preliminary scrutiny of the proposal.

Deficiency letter w.r.t. the building plans submitted shall be issued after complete

scrutiny of the proposal.

Demand letters for the payment of premiums/ fees, as applicable shall be issued

after complete scrutiny of the proposal.

After the compliance to all the requirements mentioned in deficiency letters, the

proposal shall be processed for issuance of development permission.

PRE-REQUISITES FOR SUBMISSION OF THE PROPOSAL IN GENERAL.

The application shall be in the prescribed format mentioned in this Handbook.

Appointment letters for the Architect/ Licensed Surveyors/ Structural Engineer/

Plumber etc. shall be as per the format mentioned in Handbook with a copy to

MMRDA.

Supervision memo by the Architect/ Licensed Surveyors/ Structural Engineer/

Plumber etc. shall be as per the format mentioned in Handbook with a copy to

MMRDA.

Indemnity bond, Undertaking, Affidavit as applicable shall be addressed to the

Metropolitan Commissioner, MMRDA and shall be submitted in original.

All other documents shall be submitted in original or duly attested as the case may

be.

7/12 extracts, PR cards, NOCs, Clearances submitted with proposal shall be

updated till latest date.

All the forms shall be completely filled in and duly signed. Building plans submitted

shall be duly signed by Owner and Architect.

ADDITIONAL INFORMATION REQUIRED ON PLANS.

Location plan of Septic Tanks/Soak pits/Suction tank/Pump House and Electric Sub

Station as per norms wherever applicable.

Proposal for clearance of encumbered set back or D.P.Road providing for

alternative accommodation for the occupants.

Plans showing all existing structures proposed to be retained/demolished including

portion in the reservations, if any.

Detailed Plans showing the position of nalla/ water course, if trained or untrained if

plot abuts/affected by Nalla/ water course.

Plan showing all existing trees on site duly numbered.

If the plot on which building is proposed is a part of layout, then copy of approved

layout or reference of layout proposal if submitted separately.

4) If I/We do any work departmentally by our supply and purchase of the materials, I/We shall be solely responsible for use of proper materials and workmanship and you shall have all the rights given to an architect under the building contract, on the work.

5) A separate letter is issued to you stating the Professional Fees payable. Mode of payment shall be in accordance with the norms of PEATA/Council of Architecture.

6) The fees do not include obtaining any N.O.C./s from other departments or authorities, preparing perspective, models etc.

7) You will not have right to alter/amend the design/drawings without our approval in writing which entrails any financial implications, save and except those required for statutory compliance.

8) A thirty days clear notice in writing is required by either of the parties to terminate the agreement, during the pendancy of which your services shall be continued to be rendered. However, on termination of the agreement the fees shall be paid to the extent of service rendered as per stage of work/payment.

9) I/We may terminate this agreement by giving one month’s notice in writing and further, I/We can appoint any other Architect/Licensed Surveyor only on obtaining your N. O. C. We will not carry out any further work till the New Architect/Licensed Surveyor is appointed and is accepted’ by the Authorities. In this event, your N.O. Load Tests on completed Structures or parts of Structural etc. Also preparation of Bar-bending Schedules and fabrication drawings do not form scope of your work.

7) You will not have right to alter/amend the design/drawings without our approval in writing which entails any financial load save and except those required for incorporating structural provision due to changes in design/drawings by Architect/Licensed Surveyor.

2. In case, it is necessary to remove a small portion of waterproofing layer for structural reasons, the disturbed portion will be grouted with cement mortar immediately and made leak proof.

3. Covering over the staircase wall shall not be removed unless adequate precautions are taken to prevent any likely hardships by its removal to the lower floor tenants.

4. Works under item No. 1,2 & 3 above shall not be carried out from 15 th June to 15th October.

5. Independent storage tank with pumping arrangement shall be provided for the construction work so that workers will not be inclined to draw water from the existing overhead tanks.

6. Materials for construction work and debris shall be neatly stacked on site so that no inconvenience is caused to the existing occupants.

7. Proper screening arrangement shall be made to prevent nuisance of dust etc. to occupants of lower floors.

8. The existing drainage and water supply shall be maintained in perfect order.

9. The Occupants on all floors shall be informed in writing well in advance before starting the work with a copy to MMRDA about such intimation.

10. If any materials are to be transported by trucks where no carriage entrance is existing, prior permission of ward officer shall be obtained for temporary access and stipulated deposit shall be paid.

11. Before Building Completion Certificate or applications for occupation is submitted, all debris all materials for construction purpose shall be removed from site which are likely to cause nuisance to old and new occupants.

E. TEMPORARY STRUCTURE/SHED/GODOWN/SITE OFFICE.

1. That I have submitted the proposal for temporary site-office-cum-godown-cum-Alternate accommodation for the proposed development on the said plot under reference.

2. That I will not use the said Temporary Shed-site office-cum-Godown for any other use accept for which it is intended to use.
