IN THE MATTER OF The Planning Act, R.S.O., 1990, c.P. 13, as amended and of the Zoning By-Law No. 05-200, as amended, of the City of Hamilton (formerly Flamborough), Sections 10 and 34.

AND IN THE MATTER OF AN APPLICATION by the agent GSP Group (c/o Kendra Murphy) on behalf of the owner John Sidler, for relief from the provisions of the Zoning By- Law No. 05-200, as amended, under Section 45 of The Planning Act, R.S.O. 1990, c. AND IN THE MATTER OF AN APPLICATION by the agent Andy Tran on behalf of the owners Han Wang & Yanan Cao, for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit the conversion of the existing single family dwelling to contain a total of two (2) dwelling units notwithstanding that;

1. A minimum lot area of 250.0m2 shall be permitted instead of the minimum 270.0m2 lot area required; and,

2. No onsite manoeuvring shall be provided for the two (2) required parking spaces instead of the requirement that a manoeuvring space abutting and accessory to each required parking space shall be provided and maintained on the lot.

Notes: The Zoning By-law requires that each dwelling maintain a minimum floor area of 65.0m2. No details were provided to confirm compliance; as such, further variances may be required.

Please note that not less than 50.0% of the gross area of the front yard shall be used for a landscaped area, excluding concrete, asphalt, gravel, pavers or other similar materials. No details were provided in order to confirm compliance; as such, further variances may be required.

The rear accessory building (concrete block shed) shall maintain a minimum setback of0.45m from the easterly side lot line. Please note, it appears that the accessory building may be too close to the said lot line; however, no setback dimension was provided. Therefore, further variances may be required.

IN THE MATTER OF The Planning Act, R.S.O., 1990, c.P. 13, as amended and of the Zoning By-Law No. 6593, of the City of Hamilton, Sections 14, 18A and 19B.

AND IN THE MATTER OF the Premises known as Municipal number 652 Lawrence Road in the City of Hamilton and in an "H/S-187" (Community Shopping and Commercial) (Amending By-law 71-105) district;

AND IN THE MATTER OF AN APPLICATION by the agent Antech Eng. c/o Candice Micucci on behalf of the owner Sovereign Asset Management, for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit the development of the lands through the construction of a 93.8m2 restaurant with a drive thru as per Site Plan Application DA-17-028 notwithstanding that;

1. Site Plan drawing dated March 13, 2013, submitted with this application shall replace the special requirements shown on annexed Schedule B for Block 1 and Block 2 of Schedule A of amending By-law 71-105;

2. A minimum front yard depth of 0.0m shall be permitted instead of the minimum 12.0m front yard depth required;

3. A minimum lot area of 1195.0m2 shall be permitted instead of the minimum 1205.23m2 lot area required;

4. A required planting strip and landscaped area may be obstructed by a ground illuminated pylon sign and may be obstructed by a ground illuminated directional sign whereas the By-law does not permit a required planting strip and a required landscaped area to be obstructed;

5. A minimum planting strip area of 90.0m2 shall be permitted instead of the minimum 105.9m2 planting strip area required;

6. The access driveway providing access to or egress from the non-residential use shall be located a distance of not less than 1.5m from both the adjacent easterly and westerly residentially zoned lots instead of the minimum 3.0m setback required;

7. The driveway used in conjunction with the restaurant shall be permitted to be located as close as 1.5m from the easterly and westerly residential districts and as close as 10.0m from the northerly residential district instead of the minimum 12.0m distance required between the said driveway and the adjoining residential districts;

8. A landscaped area having a minimum width of 1.0m shall be provided for the portion of the landscaped area in front of the building for a distance of no more than 10.0m along the Lawrence Road lot line instead of the minimum 1.5m wide landscaped area required; and,

9. Points of ingress or egress associated with a restaurant shall be permitted to be located as close as 1,5m from the easterly and westerly residential districts and as close as 10.0m from the northerly residential district instead of the minimum 30.0m distance required.

IN THE MATTER OF The Planning Act, R.S.O., 1990, c.P. 13, as amended and of the Zoning By-Law No. 6593, of the City of Hamilton, Sections 13C, 14A and 18A, Amending By-Law Number 79-331.

AND IN THE MATTER OF the Premises known as Municipal number 724 Queenston Road, in the City of Hamilton and in an "HH and G-3/S-682" (Restricted Community Shopping and Commercial District and Public Parking Lots) district;

AND IN THE MATTER OF AN APPLICATION by the agent Nicholas Caragianis Architect Inc. on behalf of the owner Joe Caiella, for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit the construction of a one storey 245.0m2 restaurant with a drive thru facility as per Site Plan SPA-16-069 notwithstanding that;

1. A minimum front yard depth of 8.2m shall be permitted instead of the minimum 12.0m front yard depth required;

2. A minimum easterly side yard width of 0.0m shall be permitted instead of the minimum 3.6m side yard width previously approved by Committee Decision HM/A- 16:373;

3. A landscaped area having a minimum average width of 1.7m but no less than 1,0m shall be permitted along the Queenston Road street line instead of the minimum landscaped area having an average width of 2.0m but no less than 1.0m required;

4. A minimum parking space size having a width of 2.5m shall be permitted for parallel parking spaces instead of the minimum 2.7m width required; and,

5. A one-way access driveway having a minimum width of 2.6m shall be permitted for the drive thru facility instead of the minimum 3.0m access driveway width required.

Notes: These variances are necessary to facilitate Site Plan Control application SPA-16- 069.

The submitted site plan differs from the original site plan submitted at Site Plan Control phase. Therefore, the variances have been written exactly as requested by the applicant and further variances may be required.

Required landscaped areas and planting strips shall be clearly labelled and dimensioned on the Site Plan and shall not be obstructed.

AND IN THE MATTER OF the Premises known as Municipal number 258 Locke St. S., in the City of Hamilton and in an "H" (Community Shopping and Commercial) district;

AND IN THE MATTER OF AN APPLICATION by the owner 258 Locke St. Inc., for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit the establishment of nineteen (19) additional seats for a total of forty-nine (49) seats within the existing restaurant notwithstanding that;

1. A planting strip having a minimum width of 1.4m shall be provided for a distance of no less than 4.8m along the southerly side lot line and no planting strip shall be provided for the remainder of the said southerly side lot line abutting the residential district instead of the minimum 1.5m wide planting strip required along every side lot line and rear lot line for a commercial property abutting a residential district or use and between a parking area containing five or more parking spaces adjoining a residential district;

2. A planting strip having a minimum width of 0.9m shall be provided for a distance of no less than 10.7m along the westerly lot line and no planting strip shall be provided for the remainder of the said westerly lot line abutting the residential district instead of the minimum 1.5m wide planting strip required along every side lot line and rear lot line for a commercial property abutting a residential district or use and between a parking area containing five or more parking spaces adjoining a residential district;

3. A minimum of five (5) parking spaces shall be provided instead of the minimum nine (9) parking spaces required;

4. No onsite manoeuvring shall be provided for the parking space having direct access via the alleyway instead of the requirement that a manoeuvring space abutting and accessory to each required parking space shall be provided and maintained on the lot;

5. A minimum parking space size of 2.6m x 5.5m shall be provided for the four parking spaces along the westerly lot line and a minimum parking space size of 2.5m x 5.5m shall be provided for the parking space having direct access via the alley way instead of the minimum 2.7m x 6.0m parking space size required;

6. The driveway, the parking area and manoeuvring used in conjunction with the restaurant shall be permitted to be located as close as 3.0m from the northerly residential district and as close as 0.9m from the westerly residential district instead of the minimum 12.0m distance required from the northerly residential district and the minimum 1.5m distance approved from the westerly residential district per previous Committee Decision HM/A-10:104; and,

7. Points of ingress at the lot line to or from the lot on which parking for a restaurant is located shall be permitted to be located as close as 6.0m from the northerly residential district, as close as 15.0m from the southerly residential district and as close as 6.0m from the westerly residential district instead of the minimum 30.0m distance required from the northerly residential district, the minimum 16.1m distance approved from the southerly residential district and the minimum 7.5m distance approved from the westerly residential district per previous Committee Decision HM/A-10:104.

Notes: The applicant shall ensure that the parking area is properly graded, drained and paved with concrete or asphalt. Otherwise, additional variances shall be required.

The By-law requires a visual barrier along the westerly and southerly boundaries of the lot abutting a residential district for a parking area having five or more spaces. No details have been provided to confirm compliance. Therefore, further variances may be required.

A minimum of nine (9) parking spaces are required based on a total of forty-nine (49) seats at a parking ratio of one space per each six (6) seats.

The applicant shall ensure that the requested distances mentioned in variances # 6 and #7 are correct. Otherwise, further variance may be required.

3. The accessory building (private garage) shall be permitted to be located in the front yard and as close as 11.00m to the front lot line whereas the Zoning By-law does not permit accessory buildings to be located in a front yard; and,

4. The accessory building (private garage) shall be permitted to be located within the required northerly side yard and as close as 1.19m from the side lot line whereas the Zoning By-law does not permit accessory buildings to be located within a required side yard.

Notes:

A minimum front yard of 6.0m shall be maintained. No setback dimension was shown from the front lot line to the principle building in order to confirm compliance.

A minimum access driveway width of 2.8m shall be maintained. The access driveway was not clearly delineated and dimensioned. Therefore, compliance could not be determined and further variances may be required.

Based on the plans provided, it appears that more than one parking space is proposed in the driveway, confirmation shall be provided, as further variances may be required.

A minimum of 50.0% of the gross area of the front yard shall be maintained as landscaping. Insufficient details were provided to confirm compliance; as such, further variances may be required.

A maximum height of 4.0m is permitted for an accessory building. No height dimension was provided in order to confirm compliance. Therefore, further variances may be required.

Please note, an eave and gutter shall not project onto the adjacent private property; otherwise, an Encroachment Agreement and a Maintenance Easement shall be required to be entered into and properly registered on title for both the lot upon which the eave and gutter is encroaching onto and the subject lot.

A building may be erected on a lot subject to two zones provided the use is permitted within each of the zones. The least stringent lot width and area of the two zones shall be applied and the most restrictive regulations of the two zones shall be applied for all other zoning requirements. As such, the requested variances for a reduced lot width and a reduced lot area are not required as the proposed lots comply with least stringent requirements.

2. The variances have been written as requested by the applicant as details regarding the proposed development have not been provided. Further variances will be required if compliance with all other applicable zoning requirements cannot be complied with.

3. The subject lots are being created through land severance applications HM/B- 17:29 and HM/B-17:30.
