    Adopting rules for the One Hundred Eleventh Congress.

    IN THE HOUSE OF REPRESENTATIVES

    RESOLUTION

    Adopting rules for the One Hundred Eleventh Congress.

    Resolved, That the Rules of the House of Representa-1

    tives of the One Hundred Tenth Congress, including appli-2

    cable provisions of law or concurrent resolution that con-3

    stituted rules of the House at the end of the One Hundred4

    Tenth Congress, are adopted as the Rules of the House5

    of Representatives of the One Hundred Eleventh Con-6

    gress, with amendments to the standing rules as provided7

    in section 2, and with other orders as provided in sections8

    3, 4, and 5.9

    SEC. 2. CHANGES TO THE STANDING RULES.10

    (a) INSPECTOR GENERAL AUDITS.Amend clause11

    6(c)(1) of rule II to read as follows:12

    (1) provide audit, investigative, and advi-1

    sory services to the House and joint entities in2

    a manner consistent with government-wide3

    standards;.4

    (b) HOMELAND SECURITY.In clause 3(g) of rule X,5

    designate the existing text as subparagraph (1) and add6

    thereafter the following new subparagraph:7

    (2) In addition, the committee shall review8

    and study on a primary and continuing basis all9

    Government activities, programs, and organizations10

    related to homeland security that fall within its pri-11

    mary legislative jurisdiction..12

    (c) ADDITIONAL FUNCTIONS OF THE COMMITTEE ON13

    HOUSE ADMINISTRATION.In clause 4(d)(1) of rule X14

    (1) redesignate subdivisions (B) and (C) as15

    subdivisions (C) and (D) and insert after subdivision16

    (A) the following new subdivision:17

    (B) oversee the management of serv-18

    ices provided to the House by the Architect19

    of the Capitol, except those services that20

    lie within the jurisdiction of the Committee21

    on Transportation and Infrastructure22

    under clause 1(r);; and23

    (2) in subdivision (D) (as redesignated) strike24

    (B) and insert (C).25

    (d) TERMS OF COMMITTEE CHAIRMEN.In clause 51

    of rule X2

    (1) amend paragraph (a)(2)(C) to read as fol-3

    (f) POSTPONEMENTAUTHORITY.In clause 1 of rule5

    XIX, add the following new paragraph:6

    (c) Notwithstanding paragraph (a), when the7

    previous question is operating to adoption or pas-8

    sage of a measure pursuant to a special order of9

    business, the Chair may postpone further consider-10

    ation of such measure in the House to such time as11

    may be designated by the Speaker..12

    (g) INSTRUCTIONS IN THE MOTION TO RECOMMIT.13

    In clause 2(b) of rule XIX14

    (1) designate the existing sentence as subpara-15

    graph (1);16

    (2) in subparagraph (1) (as so designated)17

    report of a committee of either House on such1

    bill or on a companion measure; or2

    (2) a statement that the proposition con-3

    tains no congressional earmarks, limited tax4

    benefits, or limited tariff benefits.; and5

    (2) in paragraph (c) (as redesignated)6

    have the net effect of increasing the deficit or reducing22

    the surplus for either the period comprising23

    concurrent resolution on the budget, and the1

    four fiscal years following that budget year; or2

    (B) the current fiscal year, the budget3

    year set forth in the most recently completed4

    concurrent resolution on the budget, and the5

    nine fiscal years following that budget year.6

    (2) The effect of such measure on the deficit7

    or surplus shall be determined on the basis of esti-8

    mates made by the Committee on the Budget rel-9

    ative to baseline estimates supplied by the Congres-10

    sional Budget Office consistent with section 257 of11

    the Balanced Budget and Emergency Deficit Control12

    Act of 1985.13

    (b) If a bill, joint resolution, or amendment is con-14

    sidered pursuant to a special order of the House directing15

    the Clerk to add as new matter at the end of such measure16

    the provisions of a separate measure as passed by the17

    House, the provisions of such separate measure as passed18

    by the House shall be included in the evaluation under19

    paragraph (a) of the bill, joint resolution, or amendment.20

    (c)(1) Except as provided in subparagraph (2), the21

    evaluation under paragraph (a) shall exclude a provision22

    expressly designated as an emergency for purposes of pay-23

    as-you-go principles in the case of a point of order under24

    this clause against consideration of25

    (A) a bill or joint resolution;1

    text by a special order of business;3

    (C) a conference report; or4

    (D) an amendment between the Houses.5

    (2) In the case of an amendment (other than one6

    specified in subparagraph (1)) to a bill or joint resolution,7

    the evaluation under paragraph (a) shall give no cog-8

    nizance to any designation of emergency.9

    (3) If a bill, a joint resolution, an amendment made10

    in order as original text by a special order of business,11

    a conference report, or an amendment between the Houses12

    includes a provision expressly designated as an emergency13

    for purposes of pay-as-you-go principles, the Chair shall14

    put the question of consideration with respect thereto..15

    (2) In clause 7 of rule XXI, strike the period16

    on, that establishes prospectively for a Federal office2

    or position a specified or minimum level of com-3

    pensation to be funded by annual discretionary ap-4

    propriations shall not be considered as providing5

    new entitlement authority within the meaning of the6

    Congressional Budget Act of 1974.7

    (4)(A) During the One Hundred Eleventh Con-8

    gress, except as provided in subsection (C), a motion9

    that the Committee of the Whole rise and report a10

    bill to the House shall not be in order if the bill, as11

    amended, exceeds an applicable allocation of new12

    budget authority under section 302(b) of the Con-13

    gressional Budget Act of 1974, as estimated by the14

    Committee on the Budget.15

    (B) If a point of order under subsection (A) is16

    sustained, the Chair shall put the question: Shall17

    the Committee of the Whole rise and report the bill18

    to the House with such amendments as may have19

    been adopted notwithstanding that the bill exceeds20

    (c) EXERCISE F ACILITIES FOR FORMER MEM-8

    BERS.During the One Hundred Eleventh Congress9

    (1) The House of Representatives may not pro-10

    vide access to any exercise facility which is made11

    available exclusively to Members and former Mem-12

    bers, officers and former officers of the House of13

    Representatives, and their spouses to any former14

    Member, former officer, or spouse who is a lobbyist15

    registered under the Lobbying Disclosure Act of16

    1995 or any successor statute or agent of a foreign17

    principal as defined in clause 5 of rule XXV. For18

    purposes of this section, the term Member in-19

    cludes a Delegate or Resident Commissioner to the20

    Congress.21

    (2) The Committee on House Administration22

    shall promulgate regulations to carry out this sub-23

    section.24

    Eleventh Congress, the first 10 numbers for bills (H.R.2

    1 through H.R. 10) shall be reserved for assignment by3

    the Speaker.4

    (e) MEDICARE COST CONTAINMENT.Section 803 of5

    the Medicare Prescription Drug, Improvement, and Mod-6

    ernization Act of 2003 shall not apply during the One7

    Hundred Eleventh Congress.8

    SEC. 4. COMMITTEES, COMMISSIONS, AND HOUSE OFFICES.9

    (a) SELECT COMMITTEE ON ENERGY INDEPEND-10

    ENCE AND GLOBALWARMING.11

    (1) ESTABLISHMENT; COMPOSITION.12

    (A) ESTABLISHMENT.There is hereby es-13

    tablished a Select Committee on Energy Inde-14

    pendence and Global Warming (hereinafter in15

    this section referred to as the select com-16

    mittee).17

    (B) COMPOSITION.The select committee18

    shall be composed of 15 members appointed by19

    the Speaker, of whom 6 shall be appointed on20

    the recommendation of the Minority Leader.21

    The Speaker shall designate one member of the22

    select committee as its chair. A vacancy in the23

    (2) JURISDICTION; FUNCTIONS.3

    (A) LEGISLATIVE JURISDICTION.The se-4

    lect committee shall not have legislative juris-5

    diction and shall have no authority to take leg-6

    islative action on any bill or resolution.7

    (B) INVESTIGATIVE JURISDICTION.The8

    sole authority of the select committee shall be9

    to investigate, study, make findings, and de-10

    velop recommendations on policies, strategies,11

    technologies and other innovations, intended to12

    reduce the dependence of the United States on13

    foreign sources of energy and achieve substan-14

    tial and permanent reductions in emissions and15

    other activities that contribute to climate16

    change and global warming.17

    (3) PROCEDURE.(A) Except as specified in18

    paragraph (2), the select committee shall have the19

    authorities and responsibilities of, and shall be sub-20

    ject to the same limitations and restrictions as, a21

    standing committee of the House, and shall be22

    deemed a committee of the House for all purposes23

    of law or rule.24

    (B)(i) Rules X and XI shall apply to the select1

    committee where not inconsistent with this resolu-2

    tion.3

    (ii) Service on the select committee shall not4

    count against the limitations in clause 5(b)(2) of5

    (4) FUNDING.To enable the select committee7

    to carry out the purposes of this section8

    (A) the select committee may use the serv-9

    ices of staff of the House; and10

    its investigations and studies, together with such de-16

    tailed findings and recommendations as it may deem17

    advisable. All such reports shall be submitted to the18

    House Resolution 24, One Hundred Tenth Congress, shall21
