RULE II – AUTHORITY AND SCOPE OF THE ELECTION COMMITTEE (EleCom) Section 1. Legal Bases. The authority/legal bases for these Election Rules are provided in the following provisions of the law, rules, and PHILFECO By-laws: a.) Article 43. Committees of Cooperatives, sub-paragraph (2) of Republic Act No. 9520 otherwise known as the Philippine Cooperative Code of 2008, or “THE CODE”, states, thus: “(2) The By-laws shall provide for the creation of an audit, election, mediation and conciliation, ethics and such other committees as may be necessary for the conduct of the affairs of the cooperative. The members of both the audit and election committees shall be elected by the General Assembly and the rest shall be appointed by the Board. xxx” b.) Rule 7, Section 4.4 Election Committee of the Implementing Rules and Regulations (IRR) of RA 9520, provides for the functions of the Election Committee, as follows: a. Formulate election rules and guidelines and recommend to the General / Representative Assembly for approval; b. Implement election rules and guidelines duly approved by the General / Representative Assembly; c. Recommend necessary amendments to the election rules and guidelines, in consultation with the Board of Directors, for the General / Representative Assembly; d. Supervise the conduct, manner and procedure of election and other election-related activities and act on the changes thereto;

e. Canvass and certify the results of the election;

f. Proclaim the winning candidates;

g. Decide election and other election related cases except those involving the Election Committee or its Members; and

h. Perform such other functions as prescribed in the By-laws or authorized by the General / Representative Assembly.
