Guide on Green Public Procurement
This guide is based on the criteria of the Blue Angel environmental label for sanitary papers (RAL-UZ 5), version of July 2014.
Despite the thorough examination of all information provided in the guide, errors cannot be excluded with absolute certain-ty. 1. Introduction
Sanitary papers are normally used only once and are subsequently lost to the paper chain, since they are disposed of via the sewersoraswaste.Therefore,onlysanitarypapers made of recycled paper and, if possible, from lower and medium grade secondaryfibresshouldbeused.Theseare waste papers of low to medium quality which constitute the majority of the waste paper amount.
In the ecological comparison of systems, paper products made of waste paper perform better than paper products made ofprimaryfibresthatusewoodasrawmaterialforfibresregardingtheaspectsof resource consumption, waste water pollution, water and energy consumption while the performance characteristics of the products remain similar.
2. How to use this guide
Thisguideitselfcontainsthemaininfor-mation and recommendations relevant for the contracting authority for including environmental aspects in the tender and contractual documents.
Thetendererquestionnaireregardingthe green public procurement of sanitary papers, which is provided as annex of the present guide and is separately published under www.beschaffung-info.de as Word document, is intended as an appendix tothespecifications.Withrespecttotheenvironmental requirements to the subject matter of the contract, thus, only a ref-erenceinthespecificationsisnecessaryin order to comply with the provision of the public procurement law according to which the performance is to be described unambiguouslyandcomprehensively.Thetenderer questionnaire is also to be used forverificationmanagement.Anappropri-ate formulation in the tender documents could be:
The [sanitary papers] shall comply with the minimum criteria indicated in the attached “Tenderer questionnaire on the green pro-curement of sanitary papers” in order to be taken into consideration when the decision on the award of the contract is made. For verification purposes, the filled-in tenderer questionnaire is to be provided with the respective verifications required therein for each offered product. If the product is labelled with the Blue Angel RAL-UZ 5 envi-ronmental label, the individual verifications (except for the verification of the whiteness of the final product) may be omitted. This shall also apply if the product is marked with an equivalent label which requires the compliance with all minimum criteria indi-cated in the tenderer questionnaire (except for the criterion of whiteness). The require-ment for whiteness shall be verified sepa-rately in that case, unless the requirement is certified by the label.

3. Scope
Thisguideshallapplyforsanitarypaperproducts, e.g. paper towels, toilet paper, cleaning papers, handkerchiefs, cosmetic
tissues, napkins, kitchen towels and cover papers (e.g. paper couch covers).
4. Definitions
• “Waste paper” is the generic term for all types of paper and cardboard that accumulate after use or processing and areregisteredassuch.Thespecificationof the types of waste paper is estab-lished in the European list of standard grades of paper and board for recycling (DIN EN 643).
• “Bisphenol A” is a chemical com-pound that is used in stable plastics (polycarbonate and epoxy resins) or thermalpaper.Testshaveshownthatthe substance is found in the envi-ronment and that it has an impact on the hormonal system of humans and environmental organisms, even at very low concentrations. Under certain con-ditions, the chemical may be released from objects of use and enter the hu-man body through food or through the skin, for example from thermal paper.1
• “Chloropropanols”: In the paper in-dustry, epichlorohydrin resins are used as wet strength or retention agents for the production of paper and cardboard. Thismayleadtotheformationofchlo-
ropropanolsinthefinalproductwhichare capable of migrating. Of these, 3-monochloropropanediol (3MCPD) and 1,3-dichloropropanediol (1,3DCP) are relevant for health since they are water-soluble and 3MCPD has been classifiedasmutagenicand1,3DCPascarcinogenic and genotoxic.2
• “Glyoxal” is a chemical bond of the dialdehydes (bivalent aldehydes) and refers to a chemical substance which is used as auxiliary processing substance for paper production.
• “Migration of colourants” refers to the transition of single colourant com-ponents (e.g. glyoxal, azo dyes) from the print colours into the produced san-itarypaper.Thetransitionisenabledbythefibrematerialwhichtransportsthecolourantsintothesanitarypaper.Themigration of single substances can be problematic if these are potentially or verifiablyhazardoustohealthortotheenvironment.

• “Technical Rules for Hazardous Substances (TRGS)”definethestateof technology, occupational medicine and occupational hygiene as well as othersubstantiatedscientificfindingsfor handling hazardous substances,
includingclassificationandlabelling.Theseareestablishedandadaptedtothe up-to-date state of developments by the German Hazardous Substances Committee (AGS).
5. Verification management
Public procurement bodies may specify in the tender that the tenderer shall verify the compliance with the performance require-mentsbyprovidingcertificatesissuedbya conformity assessment body (as per § 33 Regulation on the Award of Public Con-tracts (Vergabeverordnung, VgV)2016)orby labels (as per § 34 VgV2016;§24Ordi-nance for the procurement of goods and services below the EU thresholds (Unter-schwellenvergabeordnung (UVgO)20173).
5.1 Verification through certif-icates by conformity as-sessment bodies
Theverificationthatthetechnicalrequire-mentsarecompliedwithmaybeeffectedviaacertificateissuedbyaconformityassessment body4(e.g.TÜV,VDE,certifiedtestlaboratory)oracertificationissuedbythem (as per § 33 VgV2016).
If the public procurement body demands acertificatefromaspecificconformity
assessment body, they must also recognize certificatesfromequivalentotherconform-ity assessment bodies as per § 33 sec. 1 sentence 2 VgV2016).Thepublicprocure-ment body shall also admit other forms of verification,forinstancethetechnicalfileof the manufacturer (as per § 33 sec. 2 VgV 2016). As a precondition, the tenderer:
• hadnoaccesstotherequiredcertifi-cates issued by a conformity assess-mentbodyortotheverificationsprovid-ed by an equivalent body or
• is not responsible for not being able toobtaintheverificationsfromtheconformity assessment body before the submission deadline for the tender.
In the two versions indicated above, the tendererbearstheburdenofproof;thismeans that, if they are unable to verify thattheirofferedperformancecomplieswith the technical requirements, they are excluded from the award procedure.
3 As a Rule of Procedure, UVgOisputintoeffectwiththenewrevisionoftheGeneralAdministrativeRegulationon§ 55 of the Federal Budget Regulations or with respective state-law regulations for the states. At national level, UVgOwasputintoeffectonSeptember2,2017(circularletteroftheFederalMinistryofFinancefromJanuary9,2017–IIA3-H1012-6/16/10003:003).ForimplementationofUVgO, the budgetary provisions of the states are to be updated in the coming months.
4 Aconformityassessmentistheexaminationandcertificationofthecompliancewithstipulatedrequirementsforproductsandservices.Theconformityassessmentbodiesimplementingtheseactivitiesareaccredited.Thismeansthatthecompetenceoftheconformityassessmentbodyhasbeenverifiedbyanindependentauthority.

5.2 Verification by labelsThepublicprocurementbodymayrequireaspecificlabelforverifyingthecompliancewiththetechnicalspecification,suchasthe Blue Angel environmental label (VgV 2016).Insuchcasetheymustalsoacceptlabels which post equivalent requirements on the performance (§ 34 sec. 4 VgV2016;§ 24 sec. 4 UVgO2017);inparticular,thisapplies to labels of other EU member states.
If the performance does not have to meet all requirements of a label, the public pro-curement body shall indicate the respective requirements of the label (§ 34 sec. 3 VgV 2016;§24sec.3UVgO2017).
If the tenderer is unable to provide the de-manded label or an equivalent label within an adequate period, and if they are not re-sponsible for this circumstance, the public procurement body shall also accept other suitableverificationoptions,e.g.technicalfilesortestreportsofacknowledgedbodies(§ 34 sec. 5 VgV2016;§24sec.5UvGO 2017).Thetendererbearstheburdenofproofthattheymeetthespecificrequire-ments of the label with their alternative verificationoption.
5.3 Recommendations for veri-fication requirements
Exclusiveverificationofcompliancewiththeperformancespecificationsbyalabel,such as the Blue Angel environmental label, can only be recommended if there is asufficientnumberofproductsfromdiffer-ent manufacturers that bear the label. Only then, a competition amongst the tenderers can be guaranteed.
Inthefieldofsanitarypapers,thereisarange of products labelled with the Blue Angel for sanitary papers made of waste paper (RAL-UZ 5)5.
Thetendererquestionnaireintheannextothisguideconsidersallthreeverificationoptions (environmental label, equivalent label,individualverifications).

6. Environmental requirements for the subject matter of the contract
6.1 Pulp
Criterion: Minimum
Verifications: Blue Angel environmen-tal label for sanitary papers (RAL-UZ 5, version of July 2014), equivalent label or verification report of a recognised authority6 or declaration by the manu-facturer
Thepaperfibresmustbemadeof100%waste paper.
Crepe toilet papers
Crepe toilet papers must be completely made of waste paper of lower, medium andspecialgrades(groups1,2–withtheexceptionofthegroups2.14–and5)(according to the European list of standard grades of recovered paper and board DIN EN 643).
Crepe paper towels
Crepe paper towels must be completely made of waste paper of lower, medium and kraft grades (groups 1, 2, 4 and 5, with the exceptionoftheindividualkinds2.14,4.01and4.07)(accordingtotheEuropeanlistof standard grades of recovered paper and board DIN EN 643).
Other sanitary papers
Any other sanitary papers must be made of atleast65%wastepaperoflower,mediumand kraft grades as well as special grades (groups 1, 2, 4 and 5, with the exception of theindividualkinds2.14and4.07).
6.2 Whiteness of the final product
Criterion: Minimum
Verifications: Declaration of the man-ufacturer or product documentation, presentation of a product sample
Theproductsmustnotexceedamaximumdegreeofwhitenessof80%(includingUVpercentage)accordingtoDINISO2470.
6.3 Fabrication additives6.3.1 Wet and dry strength agents
and other auxiliary processing substances

Only auxiliary processing substances listed in the XXXVIth recommendation7 of the Ger-man Federal Institute for Risk Assessment (BfR)maybeused.Themaximumquanti-tiesand/orconcentrationvaluesspecifiedtherein must be complied with.
Neither wet or dry strength agents nor any other auxiliary processing substances containing glyoxal may be used for the production of the sanitary papers.
6.3.2 Chloropropanols and antimi-crobial constituents in the final product
Criterion: Minimum
Verification: Blue Angel environmental label for sanitary papers (RAL-UZ 5, version of July 2014), equivalent label or verification report of an independent testing authority
Theconcentrationofchloropropanolsinthe water extract of the products which are produced using wet strength agents must notexceedthevaluesspecifiedintheXXX-VIth recommendation7 of the BfR.8
When testing dry sanitary papers for the presence of antimicrobial constituents, no growthinhibitionofcertaindefinedbacte-ria may be observable when the “Hemmhof Test”isappliedaccordingtoDINEN1104.Excluded from the above are paper towels and cosmetic tissues.
6.3.3 Use of preservatives
Criterion: Minimum
Verification: Blue Angel environmental label for sanitary papers (RAL-UZ 5, version of July 2014), equivalent label or declaration by the manufacturer as well as information on the amount of muci-lage prevention agents and preserva-tives used per kg product according to IUPAC name.
Only such substances may be used as mucilage prevention agents and preserv-atives for manufacturing of the products, which have been approved as per the GermanBiocidesOrdinanceVO528/2012or which are still registered as existing ac-tive substances and are examined as such within the scope of the EU existing active substances programme for the respectively applicable type of biocide product.
Only such substances must be used as biocide products that have been approved for the respective purpose. Products con-taining existing active substances that are still subject to the EU examination proce-dure, may be continued to be used without approval until a decision is taken.9
Moreover, the products must not contain any active substances that are intended forsubstitutionaccordingtoart.10oftheGermanBiocideOrdinanceVO528/2012.

Prior to the respective approval obligation for biocide products containing existing activesubstancesbecomingeffective,onlysuch substances are permitted that are ad-ditionally listed in the XXXVIth recommen-dationoftheBfR.Thefollowingsubstancesmust not be used:

6.3.4 Restrictions on dyes and pigments
Criterion: Minimum

er or subcontractor for dyes/pigments, surface-finishing products, auxiliary and coating substances
Azo dyes and pigments that are capable of splittingoffoneoftheaminesspecifiedinthe respective current version of Directive 2002/61/EECorinTRGS61410 must not be used for this purpose.
Colourants (i.e. dyes and/or pigments) containing mercury, lead, cadmium or chromium(VI) compounds as constituent components must not be used.
Dyes/pigments,surface-finishingproducts,auxiliary and coating substances that
• are marked with one of the H-Phrases listed in the table below as per EC regu-lation1272/200811 or meet the criteria for such marking, must not be used.

6.3.5 Prohibition of lotions, fragranc-es and bacterial suspensions for the production of sanitary papers
Criterion: Minimum

Lotions, fragrances and bacterial suspen-sions must not be used for the production of sanitary papers.
6.4 Migration of colourants in dyed or printed products
Criterion: Minimum
Verification: Blue Angel environmental label for sanitary papers (RAL-UZ 5, version of July 2014), equivalent label or verification report of an independent testing authority
When tested for colourant migration according to DIN 646 (short process), dyed or printed products are required to reach at least level 4 of the grey scale.13
Napkins and kitchen towels must reach level 5 of the grey scale. When testing the migration of optical brighteners according toDIN648:2003,kitchentowelsandnap-kins must reach level 5.

6.5 Processing of waste paperCriterion: Minimum
Verification: Blue Angel environmental label for sanitary papers (RAL-UZ 5, version of July 2014), equivalent label or declaration by the manufacturer
For processing of waste paper, chlorine, halogenated bleaching chemicals and hardly or non-biodegradable complexing agents, such as ehtylenediamine tetraacet-icacid(EDTA)anddiethylenetriaminepentaaceticacid(DTPA)mustbecompletelyavoided.
Optical brighteners must not be added.
6.6 Regulations of the Food-stuffs and Consumer Prod-ucts Act
Criterion: Minimum
Verifications: Blue Angel environmen-tal label for sanitary papers (RAL-UZ 5, version of July 2014), equivalent label or declaration by the manufacturer
Sanitary papers must comply with the regulationsoftheFoodstuffs,ConsumerProductsandFeedstuffsAct.
7. Tender evaluation
In the framework of the tender evaluation, thecriteriajustifiedbytheobjectofthetender, among others the environmental characteristics, may be taken into consid-eration.14
Theconsiderationofallenvironmentalproperties indicated in section 6 is recom-mended as minimum criteria for sanitary papers.Thismeansthatonlytenderswhichfulfilallcriteriacanbetakenintoconsider-ation.Theofferisthenevaluatedunderthecost aspect exclusively (price).

In this case, the questionnaire shall only be filled out for criterion number 2 and the verification required for this criterion shall be provided.

Only auxiliary processing substances listed in the XXXVIth recommendation7 of the German Federal Institute for Risk Assessment (BfR) may be used. The maximum quantities and/or concentration val-ues specified therein must be complied with.
Neither wet or dry strength agents nor any other auxiliary processing substances containing glyox-al may be used for the production of the sanitary papers.

3.2 Chloropropanols and antimicrobial constituents in the final product
The concentration of chloropropanols in the water extract of the products which are produced using wet strength agents must not exceed the values specified in the XXXVIth recommendation17 of the BfR.18
When testing dry sanitary papers for the presence of antimicrobial ingredients, no growth inhibition of certain defined bacteria may be observable when the “Hemmhof Test” is applied according to DIN EN 1104. Excluded from the above are paper towels and cosmetic tissues.

Only such substances may be used as mucilage prevention agents and preservatives for manufac-turing of the products, which have been ap-proved as per the German Biocides Ordinance VO 528/2012 or which are still registered as existing active substances and are examined as such with-in the scope of the EU existing active substances programme for the respectively applicable type of biocide product.
Only such substances must be used as biocide products that have been approved for the respec-tive purpose. Products containing existing active substances that are still subject to the EU exam-ination procedure, may be continued to be used without approval until a decision is taken.19

3.4 Restrictions on dyes and pigments
Azo dyes and pigments that are capable of split-ting off one of the amines specified in the respec-tive current version of Directive 2002/61/EEC or in TRGS 61420 must not be used for this purpose.
Colourants (i.e. dyes and/or pigments) containing mercury, lead, cadmium or chromium(VI) com-pounds as constituent components must not be used.

4. Migration of colourants in dyed or printed products
When tested for colourant migration according to DIN 646:2000 (short process), dyed or printed products are required to reach at least level 4 of the grey scale.23 Napkins and kitchen towels must reach level 5 of the grey scale. When testing the migration of optical brighteners according to DIN 648:2003, kitchen towels and napkins must reach level 5.

5. Processing of waste paper
For processing of waste paper, chlorine, hal-ogenated bleaching chemicals and hardly or non-biodegradable complexing agents, such as ehtylenediamine tetraacetic acid (EDTA) and diethylenetriamine pentaacetic acid (DTPA) must be completely avoided.
Optical brighteners must not be added.
