GUIDANCE ON THE APPLICATION OF MERCHANT SHIPPING AND FISHING VESSELS (PROVISION AND USE OF WORK EQUIPMENT) REGULATIONS 2006 AND THE MERCHANT SHIPPING AND FISHING VESSELS (LIFTING OPERATIONS AND LIFTING EQUIPMENT REGULATIONS) 2006 TO FISHING VESSELS

This guidance is issued by the Maritime and Coastguard Agency. Following the guidance is not compulsory and you are free to take other action. But if you do follow the guidance you will normally be doing enough to comply with the law. The FISG Health & Safety Sub Group was consulted in the preparation of this guidance. Any queries on this guidance should be directed to the local MCA Marine Office.

This is intended to provide employers and the self employed with guidance on the application of the MS & FV (Provision and Use of Work Equipment) Regulations 2006 (PUWER) and the MS & FV (Lifting Operations and Lifting Equipment) Regulations 2006 (LOLER) to typical work equipment found on Fishing Vessels.

All tools, machinery and equipment used at work (‘work equipment’) are covered by the requirements of PUWER. This includes everything from a trawl winch to a gutting knife. Equipment not owned by the fisherman but being used by him for a work activity, for example a borrowed pot hauler, is also covered and it is the responsibility of the user to ensure that it complies with all legal requirements.

Work equipment which is also lifting equipment will additionally be subject to the requirements of LOLER.

The provision of both PUWER and LOLER are applicable to self-employed persons on fishing vessels in respect of their own activities or any equipment supplied by them for use of other persons.

Fishing Vessels themselves are not work equipment, but where parts of the vessel are a part of, or support lifting equipment, LOLER will apply to them in as much as their suitability to support the lifting equipment and its load must be assessed.

PUWER requires that work equipment is suitable for the work to be carried out, or is properly adapted for that purpose, and may be used by workers without impairment to their health or safety. Modern equipment which is ‘CE marked’ should be accompanied by an instruction manual which contains information on the normal conditions of use of the equipment. Advice should always be sought from manufacturers and/or suppliers where work equipment is to be used for tasks for which it was not designed and tested.

For LOLER to apply the principal function of the work equipment should be ‘to lift a load’. Winches or similar equipment used only for hauling loads “horizontally “would not attract the application of LOLER but would be subject to PUWER. If such winches etc are also used for lifting then LOLER will also apply.

PERIODIC INSPECTIONS AND THOROUGH EXAMINATIONS

Risk assessments carried out to meet the requirements of the Merchant Shipping and Fishing Vessels (Health and Safety at Work) Regulations 1997 should, if carried out properly, identify any significant risks from the use of the work equipment, including that used for lifting.

Where regular inspection or thorough examination of the equipment would address such risks, eg failure of a component through wear, PUWER or LOLER (as appropriate) requires periodic inspections and/or thorough examinations.

PUWER requires that work equipment exposed to conditions causing deterioration liable to result in dangerous situations is inspected at suitable intervals to ensure that its integrity is maintained and any deterioration detected and remedied in good time. These inspections could be integrated into regular maintenance routines such as greasing etc.

Risk assessment should determine whether the work equipment could deteriorate in such a way as to pose a potential risk to operators or other persons.

The scope of the PUWER inspection and the level of competence required of the person, who will carry it out, will depend on the findings of that assessment. LOLER requires that, where the safety of lifting equipment depends on the installation conditions, it is inspected by a competent person— (a) after installation and before being put into service for the first time; or

(b) after assembly at a new site or in a new location, to ensure that it has been installed correctly, in accordance with any manufacturer's instructions, and is both safe to operate and capable of operating safely. In this context "inspection" means such visual or more rigorous inspection by a competent person and may include testing should this be considered appropriate by the competent person. LOLER also requires that lifting equipment be thoroughly examined by a competent person:

(1) in the case of lifting equipment for lifting persons or an accessory for lifting at least every 6 months;

(2) in the case of other lifting equipment, at least every 12 months; or

(3) in either case, in accordance with a scheme of examination laid down by a competent person.

Additionally a thorough examination is required if the lifting equipment is exposed to ‘exceptional circumstances’ which are liable to jeopardize the safety of the equipment. In this context “exceptional circumstances” includes modification work, accidents, natural phenomena and prolonged periods of inactivity.

1. Introduction

The objective of this report is firstly to assess the general stability of the fishing vessel ‘Stella Maris’ against the requirements of the 1975 Fishing Vessel Regulations and secondly to assess the level of statical stability in the accident condition.

Section 2 explains the means by which the hull and compartments were defined for the analysis and Section 3 states the principal dimensions. Section 4 illustrates the relationship between KN and righting lever values and outlines the assumptions made in the computation of this data. Section 5 details the stability and freeboard requirements in the 1975 Fishing Vessel Regulations. At less than 12 metres registered length, Stella Maris did not have to comply but many vessels of this size have been checked against the regulation criteria over the years – for example, compliance was a prerequisite when Sea Fish Industry Authority grants were available for construction. Section 6 lists eight loading conditions which would have been included in a stability information booklet had it been required and tabulates the related trim and stability data whilst Section 7 examines the stability in the moments immediately prior and during the accident. The report conclusions form Section 8.

2. Hull and compartment definition

The shape of the vessel’s hull and its compartments and tanks were defined by measurements taken from the lines plan and the hull. Half breadth and height dimensions for 11 transverse hull sections were digitised from the lines plan to create a coordinate model of the hull shape, adjusted where necessary to match check measurements taken from the hull. An additional 22 sections were then interpolated automatically from the input data to refine the model. Diagram 1 below is a section view of the model and Appendix 1 is comprised of section, plan, profile and isometric views.

The centreline keel was modelled as a part of the hull form whilst other significant appendages (bilge keels and rudder) were modelled as separate entities. The hydrostatic and KN data comprising Appendices 2 and 3 include these appendages.

For the purposes of this report, all longitudinal dimensions are taken about a Forward Perpendicular (FP) located at the intersection of the datum waterline and the stem (Station 1 on the Lines Plan); dimensions are positive aft and negative forward of the FP. All vertical dimensions are about a Base Line passing through the underside of the keel at midships on the LBP; dimensions are positive above the Base Line, negative below. Transverse dimensions are about the centreline and are positive to Port, negative to Starboard. These axes are shown on the General Arrangement below.

The cross-connect linking the aft ends of the port and starboard fuel oil tanks was open when the accident occurred. The tank contents were thus free to move from port to starboard and vice versa, albeit with a restricted flow rate through the 45mm diameter pipework. The data for the combined tanks has also been included as item 3 in table 1 to illustrate the very significant increase in free surface moment that results from an open cross-connection.

Further details on the principal tanks with detailed calibration data and including longitudinal and vertical centres of gravity and free surface moments are to be found in Appendix 4.

The KN data used for the calculation of the stability data discussed in Section 6 of this report includes the volume of the hull below the weather decks and excludes the volume of the wheelhouse as shown in diagram 4 at the head of the next page. This is normal practice in compiling a fishing vessel stability booklet for submission to the MCA as this space cannot be considered watertight.

5. Criteria used for assessment of stability and freeboards

The Fishing Vessel Safety Provisions Rules introduced in 1975 do not apply to a vessel such as the Stella Maris with a registered length of less than 12 metres. These were superseded in 2001 by the Fishing Vessels (Code of Practice for the Safety of Small Fishing Vessels) Regulations 2001 and in 2002 by the Fishing Vessels 15 to 24 metres regulations. With regard to stability, the provisions of the 1975 rules were identical to the 2002 regulations for vessels of 15 metres in length or greater, with no stability requirements for vessels of less than 15 metres. Merchant Shipping Notice (MSN) 1770(F) draws attention to the provisions of the 2002 regulations and paragraph 3.1.2 states that any fishing vessel of 15 metres in length or greater must comply with the following stability requirements:

I) The area under the righting lever curve (GZ curve) shall not be less than:

(a) 0.055 metre.radians up to an angle of 30 degrees; (b) 0.09 metre.radians up to an angle of 40 degrees or such lesser angle of heel at

which the lower edges of any opening in the hull, superstructure, deckhouses, or companionways being openings which cannot be closed weathertight are immersed;

(c) 0.030 metre.radians between the angles of heel of 30 degrees and 40 degrees or such lesser angle as defined in (b) above;

II) The righting lever (GZ) shall be at least 0.20 metres at an angle of heel equal to or greater than 30 degrees;

III) The maximum righting lever (GZ) shall occur at an angle of heel not less than 25 degrees;

IV) In the upright position the transverse metacentric height (GM) shall not be less than 350 millimetres;

More recently, in February 2014 the MCA published ‘The Code of Practice for the Safety of Small Fishing Vessels’ (MGN 502 (F)). In terms of stability, this document addresses vessels of between 12 metres registered length and 15 metres length overall. The criteria recommended in paragraph 3.32 are identical to those stated above.

Minimum freeboard requirements for fishing vessels with a registered length greater than 12 metres were included in Rule 15(1) of the 1975 Safety Provisions Rules (Merchant Shipping Notice M975 issued in 1981 explained the freeboard requirements in greater detail). With a registered length of less than 12 metres Stella Maris did not have to comply with these, but had it been obligatory, the minimum freeboards at the forward and aft ends of the registered length would have been respectively 1.060 metres (HD = 0.8+7L/240) and 0.597 metres (HDA

= 0.3+L/30). M975 did not include a requirement for a minimum at the point where the lowest freeboard occurred.

Freeboard requirements were updated in 2002 by the introduction of the Code of Practice for Fishing Vessels 15 to 24 metres regulations (MSN 1770(F)). Paragraph 3.2.1 of this document specifies that fishing vessels of over 15 metres length shall be designed, constructed and operated so as to maintain adequate freeboards in all foreseeable operating conditions – paragraphs 3.2.2 to 3.2.7 define these minima which are applied at FP, AP and the point where the minimum freeboard occurs. If these requirements had been applicable to Stella Maris, the minimum freeboards would have been 1.316 metres forward (Hfmin = 0.75+6.6xLBP/240+0.315(bulwark height correction)), 0.484 metres aft (Hamin = 0.24+LBP/37.5) and 0.229 metres (Hmin = LBP/40) at the lowest point of the deck.

In 2010, the MCA published a Marine Guidance Notice (MGN 427(F)) entitled ‘Stability Guidance for Fishing Vessels of under 15m Overall Length’. This document summarises a number of approaches to assessing the safety of small fishing boats, including simplified methods easily usable by all Skippers. The use of minimum freeboards to reduce capsize risk is also discussed – in the context of this report, the Wolfson method outlined in Annex 5 of MGN 427 (F) is of particular relevance.

6. Assessment of standard loading conditions

A fishing vessel is judged to comply with the requirements if its stability and freeboard characteristics exceed the criteria stated in Section 5 in ‘all foreseeable operating conditions’. It is usual practice for any stability submission to the MCA relating to a fishing vessel to include an assessment of these characteristics in a sequence of standard loading conditions loosely representative of a voyage profile.

The following eight loading conditions were compiled for this report to assess the Stella Maris’ stability and freeboard characteristics in relation to the requirements:

The data in the first part of table 2 indicates that in all conditions the Stella Maris would comply with the forward and minimum freeboard requirements but not with the aft freeboard requirement. The second part of the table indicates that the boat would not comply with any of the stability criteria with the exception of the GM in all conditions and the area under the righting lever curve up to 30 degrees in the lightship condition only.

Lack of sufficient freeboard aft has a direct bearing on the low angle of maximum righting lever (GZ) apparent in all conditions, the curve tending to peak not long after deck edge immersion has occurred. It also, therefore, has an indirect bearing on the magnitude of righting levers at heel angles greater than deck edge immersion.

Attention is also drawn to the low downflooding angles. This is the angle at which the first downflooding point, in this instance the air vents to the machinery space, are immersed. The vents are located outboard, athwartships of the winch and just below the top of the bulwark to port and starboard. The regulations require that the righting lever curve be truncated at the downflooding angle (see para. 1b in Section 5 at the head of page 7); consequently, there is effectively no area under the curve beyond that angle. Because downflooding occurs at less than 30 degrees all the required areas are reduced accordingly, those between 30 and 40 degrees reducing to zero. Had the vents been located higher and/or further inboard all the areas stated in the table would have increased. However, this would have made no difference to compliance; in all loading conditions, the angle of maximum righting lever was less than the 24 degree minimum requirement and less than, and therefore not influenced by the downflooding angle.

7. Assessment of the capsize condition

Appendix 6 is comprised of data for the two accident conditions. A summary of this data is located in the right hand column of table 2 above.

When fishing, a relatively heavy object had become lodged in the cod end of the net. Capsize was initiated shortly after the cod end had been raised above water level by the gilson winch which was capable of lifting weights in excess of 2 tonnes. When suspended below water level, the weight in the cod end had been reduced to something less than that required to capsize the vessel by its displaced volume. The weight in air of the cod end was also significantly increased by entrained water.

The deadweight table for the vessel in the first of the accident conditions (page 64 in Appendix 6) details the weights and the disposition of the weights immediately prior to the accident. In particular, it will be seen that the weight of the cod end was suspended from the gilson block more than 8 metres above the Base Line, thus raising the overall vertical centre of gravity by more than 0.4 metre in comparison with, for example, the Arrival Grounds condition (see page 45). This was sufficient to move the vessel from a stable (albeit not compliant with the requirements) to an unstable regime; capsize was imminent.

The reason that this did not occur immediately as the cod end was raised above water level was that the bulwarks provided a very temporary increase in righting levers, reducing rapidly as seawater came in through the freeing ports. As the danger of the situation became apparent, the cod end was lowered but caught on the starboard transom guide horn (see GA on page 13). This prevented the cod end from being lowered back into the water, but also stopped it from swinging outboard thus reducing the effective height at which the cod end was suspended by about 4 metres, as shown in the deadweight table for the second capsize condition (see page 67). This brought the vessel back into a minimally stable condition (see righting lever curve on page 68); the heel by this time would have been around 8 degrees.

In these circumstances, small changes in the disposition of weights on the boat are sufficient to overcome such small righting levers; for example, the free surface moment on the cross­connected fuel tanks (see table on page 35) is more than sufficient, particularly as increasing heel would hasten the flow of fuel through the connecting pipework. Also, it is understood that the greater part of the cod end was substantially above the guide horn when it caught and that it had been at least partially lifted off this obstruction before the capsize. As heel increased, it is therefore likely that the cod end came free from the horn and swung out, thereby moving the point of action of the weight back up to the gilson block and accelerating the capsize.

8. Conclusions

The summary of standard loading condition data constituting Table 2 indicates that the Stella Maris did not comply with the stability requirements for fishing vessels of greater than 15 metres length by a considerable margin in any of the conditions assessed. This made the boat particularly vulnerable in the accident condition when its centre of gravity was raised significantly by a load in the cod end of at least 1.8 tonnes (including entrained water) hanging from a point more than 8 metres above the Base Line. Positive righting levers, already small, turned negative as the load came on the gilson block and capsize then became almost inevitable.

Given the calm sea conditions prevailing at the time, lowering the cod end back into the sea to reduce the load by its displaced volume plus the weight of entrained water would probably have reinstituted small positive righting levers. However, the cod end caught on the starboard guide horn as it was lowered. On the one hand, if it had not caught and the cod end had dropped into the water before the boat heeled to the angle of vanishing stability (approximately 17 degrees in the second capsize condition - see page 68), the boat might not have capsized. On the other hand, the fact that the cod end was effectively tethered by the horn prevented it, albeit temporarily, from swinging out in a manner which would only have accelerated the rate of capsize.

Nevertheless, throughout the time the boat was heeled to starboard (ie since the haul had commenced) fuel oil was flowing through the cross-connect from the Port to the Starboard tank thereby increasing heel and with it the fuel flow transfer rate and the resultant heeling moment. Seawater was also flooding onto the deck through the Starboard freeing ports and over the top of the bulwarks, reducing the small additional contribution to righting moments that the bulwarks offered. The combination was sufficient to overcome any residual positive righting levers and complete the capsize.

Narrative

At around 0910 BST on 28 July 2014 the 9.9m trawler Stella Maris capsized and sank whileattempting to lift a heavy cod end of fish and debris. The two crew successfully abandoned the boat without injury and were rescued about 7 hours later from their liferaft.

The investigation found that Stella Maris capsized as a result of insufficient stability due to an overweight cod end being lifted from a high ‘A’ frame gantry by an excessively powerful gilson winch.

Almost 1 year before its loss, Stella Maris had been significantly modified with the aid of financial assistance administered by the Marine Management Organisation. This modernisation had included the fitting of the “A” frame gantry and gilson winch. No calculations had been required or carried out regarding the effects of this work on the boat’s stability or on the weight that could be safely lifted from the new gantry.

In the UK there is no stability requirement for fishing boats under 15m length overall (LOA) so skippers and owners need to take steps to assess and ensure the safety of working practices, lifting operations or possible modifications.

During the investigation, the stability of a very close sister vessel to Stella Maris was assessed using the simplified methods of Roll Test, Small Commercial Vessel Heel Test and Wolfson Guidance mark. These all indicated that the vessel had a reasonable measure of stability. However, when the vessel’s stability was assessed by inclining, it did not comply with the intact stability criteria for vessels over 15m LOA.

Stella Maris was equipped with both traditional and constant wear lifejackets. However, it capsized so quickly that the crew did not have time to put either of these on. The boat was also equipped with a liferaft, which they were able to launch and safely board as the vessel capsized.

Stella Maris capsized very quickly; there was not enough time for the crew to transmit a distress alert and the vessel was not equipped with an EPIRB.

Safety Lessons

• Simplified methods of assessing stability can be used to give an indication of a fishing vessel’s stability but they should not be relied on to provide definitive assurance that the vessel has the reserves of intact stability currently required by, for example, fishing vessels over 15m LOA. A full inclining experiment will provide such assurance.

• Unless a vessel has been supplied with accurate, up to date stability data, it will be impossible to determine how much fish it can safely carry or what weights can be safely hauled by its lifting appliances.

• Stella Maris did not need to be fitted with a liferaft. However, its use undoubtedly saved the lives of the boat’s crew as they did not have time to retrieve and don their lifejackets before the vessel capsized.

• It took 7 hours for the crew to be rescued because there was no time to send a distress message before the fishing boat was abandoned. During this time the crew used all but one of their flares to try to attract the attention of passing vessels to no avail. Had the vessel been fitted with a GPS enabled EPIRB, it is likely that it would have been activated and the coastguard alerted within minutes of the vessel’s capsize, which would have significantly reduced the time taken to rescue the crew.
