member to the Homeowners Association? $25 a year is a small
investment to make into your community. Your paid membership can
help support community activities such as a dumpster day or
neighborhood picnic. As of right now, the HOA does not have any
extra funds (due to lack of membership) to offer any community

the new preferred trash provider for Acres Green. Pro Disposal
currently services over 494 homes already in the neighborhood.
Because of this high utilization, they were open to the idea of
offering a tiered discount program to Acres Green neighbors based
on increasing the percentage of customers. See below for the
breakout of discounts provided. Your Board felt comfortable working
with Pro Disposal, as we have had nothing but positive reviews from
neighbors. They offer fair pricing; great service, and even bring
your bins up to your garage door. They pick up on Friday with
recycling pick up every other week. Pro Disposal does not offer
trash or recycling bins (we just use some bought from the store and
an old providers bin). They will also offer a 10% discount for Roll
off containers and additional discounts for annual billing. Be sure

By Jean HenkeAs you have probably noticed by now we have made
some big changes in the publishing and delivery of the Greenleaf
newsletter. The first thing you may have noticed is that it was in
your mailbox, which we havent been able to do for many years. It is
our hope that having the newsletter delivered in this manner, more
of you will read it and get involved in the community.What may not
be as obvious to you is that we are now using a new publishing
company who is also printing the newsletter. That company is
Porchlink. They publish several newsletters around us and we have
had very good reports on their work. While the Greenleaf is not
printed in green ink, you will notice full color on the front and
back pages and may even see color on some ads inside in the future.
We will still be posting the newsletter on Nextdoor and the website
and sending out a pdf to those on our e-mail list. Another change
will be the publishing of an August issue of the Greenleaf this
year. We havent published an August issue for some time. In spite
of publishing this issue, we will not be having a home owners
meeting that month. Jean will still be editing the Greenleaf and
submitting articles for publication, but the formatting, printing
and distribution will be done by Porchlink. We hope that you enjoy
the newsletter with these changes and we would love to hear from
you on them.

Be careful who you deal withBy Pat PerlingerThis is a cautionary
tale about a bad experience I had that might affect you.
You may have read in the papers that the Emerald Ash Borer
(EAB), has migrated very slowly from the east and has infested
Boulder County. The EAB is very deadly to ash trees and has
destroyed millions of trees in the eastern and central U.S.
Last March I was in touch with a company called FitTurf. Their
representative told me that it was important that I have the ash
tree in our front yard treated for the EAB. He disagreed with what
I had been told by our County Agent that the EAB was limited to
Boulder County and that treatment in our area would be useless.
I told the Rep. that I would get the tree treated if I could get
confirmation from CSU entomologist Dr. Whitney Cranshaw that the
tree should be treated. The Rep. said it was too early to treat the
tree anyway and that he would wait till I contacted him. Lo and
behold, only a day or two later I discovered a Danger
...Insecticide sign in my front yard, and there were injection
nipples around the outside of the ash tree!
I immediately complained to FitTurf, but their Rep. insisted
that we had made a deal and that I must pay for the service.
I called Dr. Cranshaw and he told me not only was it too early
to treat the tree, there are no EABs in this area and the treatment
was a total waste. Dr. Cranshaw also told me there would be an
article in the Denver Post warning folks to be aware of
unscrupulous tree care companies conning people into believing they
needed costly treatment on ash trees outside the Boulder area when
in fact treatment was useless. Sure enough, a little while later
the article appeared in the Post.
Believe it or not, FitTurf started billing me for the treatment.
Three attempts to stop the billings over the rest of the year were
fruitless, and on December 31 my account was sent to a collection
agency. Needless to say, I did not pay the bill, and finally after
I told the collection agency the real story, FitTurf canceled the
bill.
Further on-line research on the company shows they have an F
rating with the Better Business Bureau, and terrible ratings at
Yelp, a business rating company.
Whats the point of all of this? I believe companies like FitTurf
should be exposed for what they are. Some, (certainly not all, and
maybe only a few) companies twist the truth, and use intimidation
and fear to relieve you of your money.
Good companies simply dont use those tactics. Learn from my
mistake. Check out companies youre interested in dealing with
before you work with them. The Better Business Bureau and Yelp are
a good place to start.

Paying Your Annual AGHOA Dues
Through PayPal.Annual AGHOA dues for 2015 are due now. To use

paying for ($25.00- Family, $15.00-Individual and $5.00-Senior) and

The last Acres Green Home Owners Association meeting took place
on Feb. 19th at the South Metro Fire Station on Maximus Dr.
R J Foos, the owner of Pro Disposal spoke at this meeting. He
provided information on how having them as a preferred provider
will benefit our residents. At the time of this meeting, Acres
Green was at 47% of residents who have Pro Disposal as their trash
company. Prices vary depending on the number of residents who
participate. See the story in this newsletter regarding Pro
Disposal.
There are several benefits for going with Pro Disposal as a
preferred provider. First, those who go on the annual billing cycle
pay for 11 months and get the 12th month free. Second, those who
refer a neighbor, and they take the service; receive a free month
of service. Third, they offer a senior discount (age 55). Fourth,
they move the cans or bins back to the house. Fifth, existing
customers will keep their lower rate unless it goes down. Sixth,
there is a 10% discount for roll-offs to residents.
One question was raised regarding the larger bins people have
purchased. The trucks do have an attachment on their trucks for
containers. They offer recycling. Having a preferred provider will
lower the number of trucks on the streets, which will reduce the
wear and tear on our streets. Following this presentation, we
agreed to promote Pro Disposal as a preferred provider for Acres
Green.
There was some talk about having a roll-off day for the
community in conjunction with a membership drive. That will be a
future discussion.
The next order of business was a discussion of moving to a new
publisher for the newsletter. Jean looked into two companies for
publishing, printing and distributing the Greenleaf. Both services
would mail the newsletter. Both companies provide similar services;
one uses colored paper, one is able to produce full color on the
front and back pages and one charged $100 just for setup. We will
sign a one year contract to start and we will be adding an
additional issue in August. The association will still only pay for
mailing the newsletter. Advertising pays for the printing of the
newsletter. Advertisers will now be working directly with the new
publisher.
After much discussion we agreed to go with Porchlink Media as
the new publisher of the Greenleaf after a couple of questions are
answered. We are looking forward to this new direction for the
newsletter.
The next order of business was a discussion on all the work on
the roads and easements in the neighborhood. We received a couple
of calls regarding digging in peoples yards in the easements. See
Rons article in this newsletter regarding easements.
Sandy provided the treasurers report. We had $296 in deposits
and charges of $46.04 since the last meeting. One CD is due to
renew in April.
Membership was only up to about 67, partly due to not all the
newsletters being distributed. We will be posting the names of
members again in the April newsletter to spur membership.
The Annual Neighborhood Garage Sale will be on Friday and
Saturday, June 5 and 6. Applications for the matching funds program
for South Suburban are due in March. We are not participating this
year.
For the Welcome Committee, Jim reported only 12 new home owners
in the community. A couple of people wanted to get the welcome
package to deliver to their new neighbors. Jim asked if anyone has
thought of changing the month of the meetings to avoid Dec. One
issue would be the schedule we are contracting for with the
publisher.
Karen announced that Margie Griffith is the SAC Rep. at Acres
Green Elementary School. They are only meeting four to six times a
year. She will try to see what is going on and send it out over
Nextdoor.
We were pleased to have a Boy Scout (Joe) at our meeting who was
working on a communication badge. Joe was asked a couple of
questions regarding what was going on in the meeting and what badge
he was working on.
Matt reported that Pat has resigned from the Public Safety
Advisory Committee (PSAC) and Matt has stepped up to take over that
position. Matt is on the Membership Committee and Liaison on the
Patrol committee. Matt will be going on a ride along.
Jean reported on who is responsible for snow removal. Basically,
the property owner is responsible for removing snow on the
sidewalks around their property within 24 hours of the end of
snowfall. Property owners include Douglas County Schools, South
Suburban Parks and Rec. and home owners in the community. There is
a Douglas County Ordinance on snow removal. The county is the point
of contact for issues on snow removal.

Did you know. Setbacks and Easements

Im sure that over the past few months there has been a lot of
activity by utility companies in the neighborhood. The most recent
has been electrical cabling. Ive seen the contractor cabling guys
between Acres Green and Lone Tree as well as the contractors
working on Acres Green Drive recently. On Nextdoor there were some
complaints about activity in some backyards by contractors and the
homeowner wasnt aware of who or why.
First, Acres Green is a very old neighborhood and as such the
rules today versus what they were back in 1979 are totally
different. Now there is an easement of 15 feet between your house
and your neighbors. But in Acres Green, depending upon where you
live, it is either 5 feet or 8 feet. This is called the property
easement. Now in the backyard you have something different a
utility easement. This is usually 10 feet. Bottom line, pull out
your property document or contact the county to get your property
plat. This will show what the easement is for your specific
property. The other is a setback. The setback is usually 25 feet
from your house to the street. Where do you measure it though?
Check with Douglas County for how to do the true measurement or
have your property surveyed and it will mark exact locations for
you.
Why do you care? The recent activity by the contractors. The
utility easement is exactly that it is where most telephone, TV
cabling, electrical cabling etc. is done in a residential
community. Douglas County has nothing to do with this. The downside
is the utility and cabling companies have the right of way. If they
do work they are supposed to contact you the homeowner. If they
havent it is up to you to decide what action to take. Id first
start by finding out who the contractors are working for and then
contact the utility directly, i.e. Excel Energy. Keep in mind that
if they have to take down a portion of a fence or dig through some
nice landscaping there is no requirement, believe it or not, for
them to restore it! So beware if you put in a shed and they have to
move it or tear it down, you are probably out of luck getting them
to fix it. With that said, I contacted Douglas County Building and
Zoning and they told me they have never heard of this occurring but
you could be the first one so be careful with what you put
there.
Now to those side easements. There have been questions about
putting a shed next to the fence. According to Douglas County,
technically any structure, permanent or not, you should get a
permit. Especially if you plan to put in a more permanent structure
that has concrete footings and a concrete slab. Keep in mind that
you would need to get a permit as well as a variance before having
the work done. A variance basically says that yes this is in the
easement but we are allowing you to do it.
Spring is coming and if you are planning upgrades or
modifications to your home, give me a call and we can talk before
you go down the wrong road.
