  • The new European Directive about public procurement October 2014

    The Directive 2014/24/EU on Public Procurement provides a rationalized sequential mapping and definition for all public competitions. In particular, it rules procedures, techniques for procedures, preparation, transparency and choice/award of participants. Following to this general section, the Directive concentrates on particular procurement regimes among which there are Design Con-tests, provided specifically for architecture and planning.     The Directive 2014/24/EU states the existence of 7 types of competition: 1. Open procedure (art. 27) - any interested economic operator may submit a tender in respon-se to a call for competition, accompanied by the information for qualitative selection that is re-quested by the contracting authority. 2. Restricted procedure (art. 28) - any economic operator invited may submit a request to participate in response to a call for competition. 3. Competitive procedure with negotiation (art.29) - any economic operator may submit a request to participate in response to a call for competition by providing the information for qua-litative selection that is requested by the contracting authority. The information provided shall be sufficiently precise to enable economic operators to identify the nature and scope of the procurement and decide whether to request to participate in the procedure. 4. Competitive dialogue (art.30) - it is rarely used in most EU countries. Contracting authori-ties shall open, with the participants selected to participate to tenders, a dialogue the aim of which shall be to identify and define the means best suited to satisfying their needs. 5. Innovation Partnership (art. 31) - it is a new procedure introduced in 2014. In the procure-ment documents, the contracting authority shall identify the need for an innovative product, service or works that cannot be met by purchasing products, services or works already available on the market. The contracting authority may decide to set up the innovation partnership with one partner or with several partners conducting separate research and development activities. 6. Use of negotiated procedure without prior publication (art. 32) - it is rarely used. It may be used for public works contracts, public supply contracts and public service contracts where no tenders or no suitable tenders or no requests to participate or have been submitted, where the works, supplies or services can be supplied only by a particular economic operator, or for reasons of extreme urgency. 7. Procedures in design contests (art. 79) - Contracting authorities that intend to carry out a design contest shall make known their intention by means of a contest notice. The jury shall be composed exclusively of natural persons who are independent of participants in the con-test.Where a particular professional qualification is required from participants in a contest, at least a third of the members of the jury shall have that qualification or an equivalent qualifica-tion.
