1.0 INTRODUCTION 3C Waste Limited (a subsidiary of FCC Environment) proposes to continue operations at Arpley Landfill Site which will involve landfilling and subsequent restoration within Boundary Phase and the restoration of Arpley Phase. Landfilling would cease no later than October 2018 with the restoration of Arpley Phase being undertaken within 2018-2019. The proposed development would result in disturbance and loss of both aquatic and terrestrial habitat, and therefore a full great crested newt Triturus cristatus survey was undertaken. Initially a Habitat Suitability Index (HSI) assessment was conducted to assess the suitability of the ponds to support great crested newts and assess their potential value for newts, followed by a full set of surveys. 1.1 Site context Arpley Landfill Site covers approximately 500 acres. This land includes active operational landfill areas, over 150 acres of restored grassland and woodland, the 200 acre Moore Nature Reserve, and vegetated dredging grounds. The areas subject to disturbance by the proposed development are recently restored areas, current operational areas and dredging grounds. Water bodies are present in all of these areas.

2.0 METHODOLOGY

2.1 Great Crested Newt

Ordnance Survey maps and site survey drawings were used to identify all water bodies within a 500m radius of the proposed development areas within the application boundary. Due to the presence of the River Mersey no water bodies further north were assessed, with the river considered to present a physical boundary to great crested newt migration. HSI Survey The Habitat Suitability Index (HSI) (Oldham etal.2000), is an assessment tool that has been devised to quantify the overall suitability of ponds for this GCN. Whilst the HSI will provide a score on the habitat suitability of a water-body it is not a substitute for newt surveys and will not on its own prove presence or absence of this species.

Presence / likely absence Survey Surveys were undertaken by Paul Cassidy, Ecologist with FCC Environment, Class Licence WML-CL08 (Great Crested Newt Class 1) number CLS00563, and Sarah Carver, Ecology and Conservation Manager CLS001343 In compliance with best practice guidelines (Gent & Gibson, 1998; Foster, 2001), a combination of the survey techniques described below was employed to assess the great crested newt status of ponds assessed as following the HSI assessment. Four survey sessions were undertaken between mid-March and mid-June (see Table 2 for survey dates) to establish presence or absence of great crested newts. A further two survey sessions were undertaken within the ponds that had GCN recorded to determine the population size of the colony. Two surveys were conducted between mid-April and mid-May, and where great crested newts were recorded a further survey was undertaken in this time period.

Torchlight Counts - The surveyors walked slowly around the perimeter of each pond after dark and scanned the water’s edge with a powerful Clulight torch, recording the number of great crested newts and other amphibians as they went.

Bottle Trapping - Newt traps were deployed (where possible) approximately every two metres around the water’s edge in early evening. The traps were then removed early the following morning; the number of GCN and other amphibians in each trap were recorded.

Egg Searching - The surveyors checked the leaves of water plants around the edge of each pond for great crested newt eggs (which can be easily distinguished from the eggs of other newt species by their size and colour).

2.1 Limitations Limitations and constraints affecting survey techniques were encountered at many of the water bodies, and these will be detailed in Table 1. General issues affecting all ponds included high water levels – high levels of rainfall in the months preceding the survey season had led to raised water levels in all the water bodies. This created issues with access to the water bodies as the shore profiles were impossible to distinguish – to ensure the health and safety of the surveyors some areas on the perimeters of water bodies were not accessed.

4.0 LEGISLATION & POLICY Great Crested Newt Legislation and Policy Great Crested Newts are classed as European Protected Species listed on Annexes ll and lV of the European Union Directive on Natural Habitats and Wild Fauna and Flora (Council Directive 92/43/EEC). This is implemented in the UK by The Conservation of Habitats and Species Regulations 2010. They are also protected under section 9 and listed on schedule 5 of the Wildlife and Countryside Act 1981 (as amended by the Countryside and Rights of Way Act 2000 (CRoW Act) which further extends their protection). They are on Schedule 2 of the Habitats Regulations (as amended) which provide full protection under Regulation 40(1). The legislation is relevant to all life stages of the Great Crested Newt including eggs, larvae, juveniles and adults. Under this aforementioned legislation it is an offence to intentionally or recklessly:-

Kill, injure or take an individual of such a species;

Possess any part of such species either alive or dead;

Damage, destroy or obstruct access to any place or structure used by such species for shelter, rest, protection or breeding;

Disturb such a species whilst using any place of shelter or protection;

Sell or attempt to sell any such species. The Great Crested Newt is a UK Biodiversity Action Plan species for which objectives and targets to protect and restore newt habitats and create new sites through habitat management and re-creation are set. Section 41 in England and Section 42 in Wales of the Natural Environment and Rural Communities Act 2006 (NERC Act) provide lists of habitats and species of principal importance for the conservation of biological diversity. The Great Crested Newt is included on these lists. In order to undertake surveys for Great Crested Newt, a surveyor must hold an appropriate licence issued by Natural England, Natural Resources Wales or Scottish Natural Heritage accordingly.

5.0 DISCUSSION & RECOMMENDATIONS Great Crested Newts Great crested newts were found to be present in 5 of the 21 ponds surveyed. The population is present around the ponds to the north east of Lapwing Lane in Moore Nature Reserve. Evidence of breeding was found in ponds 15 and 17. Both ponds were previously known to support breeding populations of great crested newts. The pond in closest proximity to the proposed development area is pond 15, which lies approximately 435m from the perimeter of the proposed development on Boundary Phase and restoration of Walton Phase of Arpley Landfill Site. No evidence of the presence of great crested newts was found in any of the ponds in within the proposed development areas (ponds 1, 2, 3, 4, 5, 6 in Arpley Phase and Boundary Phase and pond 7 in Walton Phase). The results from the great crested newt Habitat Suitability Index assessment indicate that these ponds are sub-optimal habitat for great crested newts. The ponds are situated in a busy operational area of the landfill site and are subject to fluctuating water levels and intensive use by wildfowl and gulls. The area is subject to regular disturbance of terrestrial areas from vehicle movements along the haul road and access tracks. Due to the presence of smooth newts, common toads and common frogs in the ponds in Arpley Phase, Boundary Phase and Walton Phase measures will be taken to minimise potential of harm to these species. A method statement will be prepared to include measures such as draining the ponds using a pump fitted with filters, lowering water levels to a minimum and allowing amphibians to exit the area overnight, and conducting hand searches and relocations. Results of the survey indicate that the site has potential to support amphibian populations, and the restoration plan for the area proposes permanent conservation grassland areas which in conjunction with the water bodies at the eastern end of Moore Nature Reserve (ponds 8, 9, 10, 11 and 12) will provide sufficient habitat for amphibians and other wetland species. The results indicate that a medium sized great crested newt population is present in ponds 15 and 17, with a small population present in pond 16, with single great crested newts being recorded in both ponds 18 and 20 in Moore Nature Reserve. However it is assumed that a single meta-population of great crested newts is using all of the ponds and associated terrestrial habitat around ponds 15, 16, 17, 18, 19 and 20 as the greatest distance between any two of the ponds is less than 140m. The mosaic of grassland, woodland and wetland immediately surrounding these ponds and further to the south and west provides optimal terrestrial habitat for great crested newts. Areas of the restored landfill site immediately to the north provide potential habitat but regular mowing of the grassland flanks and vehicle movements along the wide access tracks may act to restrict amphibian migration and dispersal in this direction. The development of Boundary Phase is approximately 435m away from the breeding ponds and so the use of these terrestrial areas by great crested newts, although unlikely, must be considered. The development will affect largely disturbed areas which are bare and devoid of vegetative cover – including some areas of very sparse vegetation cover and will be restored to grassland and woodland following the cessation of proposed operations. Therefore a temporary disturbance and temporary loss of potential (sub-optimal) great crested newt terrestrial habitat will occur, eventually being restored to more suitable habitat with increased connectivity to existing habitats. A Natural England Rapid Risk Assessment will be conducted to determine the risk of an offence being committed in relation to the proposed works and therefore assess the need for a European protected species licence along with the need for any mitigation, protection and compensation measures. An assessment of the impacts of the proposals on gcn and their habitat will be made. Based on the result of the Rapid Risk Assessment any necessary measures prescribed will be implemented to ensure that no offence is committed and that potential disturbance to great crested newts and their associated habitat is minimised or mitigated for. Due to the passage of time and in order to review current ecological status, repeat ecological survey work is recommended in development areas prior to disturbance. A habitat management plan for the great crested newt ponds and the immediate terrestrial areas within Moore Nature Reserve will be prepared and implemented to enhance habitats and sustain the population on the site over the long term.

Crassula helmsii Section 14 of the Wildlife and Countryside Act 1981 states that anybody planting or causing to grow in the wild any plant listed on Part II of Schedule 9 will be guilty of an offence. New Zealand Pigmyweed Crassula helmsii, listed on Schedule 9, is found in and around water bodies in and adjacent to the development area, and therefore measures to prevent the spread of the plant must be implemented. A method statement detailing biosecurity measures will be prepared and must be circulated and adhered to by all staff and contractors working on the development. Relevant measures to control the spread of the plant would include direct herbicide application to the plant in situ 3-4 weeks prior to commencement of the development, cleaning of all machinery, tools and footwear with an approved herbicide or cleaning product on leaving the affected area, and visual checks.
