O R D E R
WHEREAS it has been brought to the notice of this Ministry that the
content of the reality show Big Boss Season-IV being aired on Colors TV
channel offends against good taste and decency. It was also brought to the
notice of the Ministry that the content of the show is objectionable and not suitable
for children and unrestricted public exhibition. The participants are often shown
quarrelling in the programme and using abusive language.
WHEREAS the matter was placed before the Inter Ministerial Committee
(IMC), constituted by this Ministry to look into the complaints against violation of
the Programme and Advertising Codes in its meeting held on 15.11.2010. IMC
previewed the clippings of the reality show Bigg Boss Season IV. IMC
observed that the programme is not suitable for unrestricted public exhibition
especially at prime time when a large number of children are watching television.
IMC, therefore, recommended that the channel should be directed to shift the
programme to anytime after 11.00 p.m. and modify the content in accordance with
the programme code. IMC also recommended that the channel should be directedto run a scroll on the Television screen to the effect that the programme is not
suitable for children. It was further recommended by IMC that the channel should
be directed to ensure that there are no transmissions/retransmissions of the
programme between 5.00 a.m. to 11.00 p.m. The channel should also ensure that
no clippings of the programme are provided by the channel to any other
News/Non News channel for telecast at anytime during the restricted time zone
from 5.00 am to 11.00 pm.
WHEREAS the competent authority after carefully considering all the
facts and circumstances of the case and the observations of the IMC has come
to the conclusion that the content of aforesaid reality show being telecast on
Colors Channel violates provisions of the Programme Code prescribed under the
Cable Television Network (Regulation) Act, 1995 and rules framed thereunder.
WHEREAS Section 5 of the Cable Television Networks (Regulation) Act,
1995, (hereinafter referred to as the Act) read with Rules 6 (1) (a), (o) & 6(5) of
the Cable Television Networks Rules, 1994 (hereinafter referred to as the Rules),
as amended from time to time, no programme can be transmitted/re-transmitted

on any Cable Service which - offends against good taste or decency orit is
not suitable for children and unrestricted public exhibition.
AND WHEREAS, broadcasters are governed by the provisions of Cable
Television Networks (Regulation) Act, 1995, and that Colors channel while
applying for the uplinking permission had agreed to abide by the Programme and
Advertising Codes and that as per the terms and conditions of Uplinking
Guidelines, read with the permission granted to Colors Channel, certain penaltieshave been prescribed for violation of the Programme and Advertising Codes.
NOW, THEREFORE, the Ministry of Information and Broadcasting,
in exercise of powers under the Uplinking Guidelines issued by it, the terms of
permission granted to uplink the TV channel and under Section 20 of the Cable
Television Networks (Regulation) Act, 1995, hereby directs Colors channel to shift
the programme to anytime after 11.00 p.m. and modify the content in accordance
with the programme code with effect from 17.11.2010. The Channel is also
directed to run a scroll on the Television screen to the effect that the programmeis not suitable for children. The Channel is further directed to ensure that there are
no transmissions/retransmissions of the programme between 5.00 a.m. to 11.00
p.m. The channel should also ensure that no clippings of the programme are
provided by the channel to any other News/Non News channel for telecast at
anytime during the restricted time zone from 5.00 am to 11.00 pm.
Strict compliance to the above direction should be ensured by Colors
channel. Any further violation of the Programme Code may entail more stringent
action in future including suspension or prohibition of broadcast.
