1. Crimes of Genocide and Collective Punishments against Sunni Civilians

Iraqi Ministry of Defense and without any legal form controls, announced the

government's decision to pay bonuses financial anyone who kills or arrest aterrorist!!! Many local sides describe this new decision as a green light to Shiite

militias for the liquidation of Sunni citizens and tearing the Iraqi fabric and spread the

culture of revenge, without recourse to the law (1) .Washington Post was confirmed

that Shiaa militia was fighting with government forces in Anbar, especially in

Fallujah (34). After this procedure, Maliki government released one of the militias

leaders accused of the sectarian killings crimes, after a month and a half of his arrest.

The Secretary-General of Iraqi Hezbollah, Mr. Wathiq Battat (the leader of the

Mukhtar militia which responsible for the liquidation by pistols Occlusive sound,bombings and attacks on neighboring countries).

On the outskirts of the capital Baghdad, another crime happens in the area of Latifiya

(Arab Qragol behind the shrine Syed Muhammad). On day 22 of the January (2014)Wednesday, was blown up a number of improvised explosive devices on the home of

Mr. Hani Ahmed Qaraghouli, an employee of the Department of Electricity session,

and resulted in this bombing his death and the death of his wife and two children (As

in below photo, Ahmed 17 years old, and Osama four years old). Also injured his

neighbor and his son were injured, it was announced the spokesman in the Iraqi

Interior Ministry, Brigadier General Saad Maan, at the time that al-Qaeda isresponsible for the attack, but witnesses confirmed that the victim received a threat by

Shi'ite militia, asking him to leave the house or murder a week before the crime, so he

notify the police so, but Associate Director of police Mr. Falah Hussein al-Kaabi said

to him, if I was in your place I will leave the house (2) .Al-Sader, senior Shiite clericsin Iraq (in an interview with the magazine guidance (Al-Huda) issued by his office)describe the war of Maliki government in Anbar province saying:(what is happening

in Fallujah and Anbar are sectarian war policy) (3).

The sectarian genocide news in other provinces, we succeed to get some cases from

Diyala province. Since the outbreak of the war in Anbar on December 25, 2013 and

so far, Shiaa militias and government forces killed in Diyala, and Baghdad belt areas,

297 Sunni civilian, including 43 of a boy under the age of 16 years and 22 women. As

well as they arrested 1475 Sunni, including an elderly and among them 65 died under

torture and handed over 54 bodies to their relatives and other unknown even pa -determination. It has been too, the kidnapping of 87 young people of Sunni. About

200 families displaced from Baghdad belt area and 850 families displaced fromDiyala cities and inhabited and replaced in their places by Shiite families who

working their sons in the army and militias. The mosques were bombed torpedo and

damaged by improvised explosive devices about 100 Sunni mosques in the Baghdad

belt area, and more than 300 in Diyala province. In addition, 12 Sunni mosques were

transferred to control of Shiite Endowments, and bombing other 9 mosques in Diyala

and Baghdad belt area (2).

People of Rawa city, west Anbar province came out of protest against the assault

forces on one woman refused the army arrest her son. The witnesses said army troopsfired indiscriminately on demonstrators in an attempt to disperse them, killing a child

at the age of ten years and four injuries of civilians (32). There are a lot of crimes and

victims which was impossible to reach them for documenting their cases, but we will

present here some cases which we could confirm it.

2. Statistics Regarding the Victims of Shelling in Residential Areas

As example of daily government attack on Fallujah city, our team make calculation

(on 14 Feb. 2014) to the shells fall on Fallujah city, and they found there Fall of 58

shell of government indiscriminate shelling on civilian area in the city just from 9a.m. to 12 a.m.!! International Committee of Red Cross Organization estimated the

fall of 4300 rockets and tank cannon on the city of Fallujah, until the 14 Feb. 2014,

according to the Iraqi media (2). Al-Jazeera report on 12 Feb. 2014, released the

declaration of PM Maliki about targeting any civilian house or hospital, withoutgiving any evidences justifies these crimes. Maliki's confession in his weekly address

that the tribal rebel led by former Iraqi army officers is a recognition of the lack offoreign fighters and its national revolution (4). The continuation of indiscriminate

shelling by government forces on the city of Fallujah (19 Feb. 2014) led to the rise in

the numbers of civilian casualties (5).

2. 1. Eye-Witness Accounts of the Indiscriminate Shelling

An old woman (She have 10 children and young) was hit with his children by gunfire

of government forces in the area Alsger in Fallujah on 8 Feb. 2014, she injured withbullets in chest and some broken bones (7). Mother of one the injured children explain

how government bombing her residential neighborhoods in Fallujah on 9 Feb. 2014,without to be any rebels near in her place, but just mass punishment to all civilians

(6). A girl called Shifa Jassem (19 years old) was wounded as a result of the shooting

by the military government in the area Aljfah in Fallujah on 9 Feb. 2014 (8). In the

same day (9 Feb.), government army attacking Al-Bouloan and Saglauia villages near

Fallujah, and it was resulted in wounded some civilians (37, 9). Because of

indiscriminate shelling on 10 Feb. 2014, some children were wounded (11), and also

to two women (36,10). The casualties indiscriminate shelling of the city on February

19, 2014, was confirmed by the media spokesman for the Fallujah hospital (12). Manycivilian families killed in the city of Saqlawiyah Albuakash near north of Fallujah

because of the indiscriminate government shelling on civilian areas on February 19,2014, as you will see in these photos (13).

Married and pregnant girl (nineteen-year-old), wounded her leg and amputated at

Fallujah General Hospital, because of the indiscriminate shelling of government on

her home north of Fallujah on 14 Feb. 2014 (22). In the same date, there is one of the

children of civilians injured as a result of indiscriminate shelling on the city of

Fallujah (25). Media spokesman for the hospital in Fallujah Dr. Wissam Essawi

confirmed that many martyrs and wounded in Fallujah, on 8 Feb. were 10 wounded

and two killed by indiscriminate shelling, but on 9 Feb. there were 8 wounded and 3killed. (19). Tuesday 11 Feb. 2014 until the afternoon, arrived to the lobby of

emergency, only four wounded, and a kid girl of four years old, who had been shot inthe head (snipping) (35). The casualties of 12 Feb. 2014 were six wounded people,

including two children and five martyrs (including an one child killed by shrapnel in

the head) (30). Child named Mustafa (12 years old) cutted his hand because of the

explosion of a shell near him, while his relatives were killed two (Ammar Hamad

Taha and Rafee Hamad Taha) and their father have dangerous wounded during the

bombing in Alqragol Ibrahim ben Ali village near Fallujah (31). The child was the

main victims from this horror war against civilians, although they show more courage

in front of this disaster like this child raising the slogan of victory and to lead

challenge the government army, which they hit him in Ramadi city in 13 Feb. 2014(27).

In the date 20 Feb. 2014, indiscriminate shelling by sectarian government on civilian

houses in Khaleidia area, west Fallujah and many civilians were wounded (14). The

total casualties now since the beginning to Friday 23 Feb. 2014, were 610 wounded

are 105 martyrs killed (15). While other sources confirmed that the number of victims

has reached 117 killed martyrs, mostly women and children, and 694 injured. Most of

them were children and women and elders.

2. 2. The Crimes of Bombing Medical Centers and their Cadres

On 11 February 2014, government forces deliberately bombing Fallujah General

Hospital for more than once (33). In the weekly speech (12 Feb. 2014), Maliki said

any house or government office in Fallujah from which fire on the civilians and the

military will turn into a military goal. This maen is not sorry to attack Fallujah'

hospital and will continue. He does not give any prove to justify by film of attacking

time there were evidences about military action in hospital. All what the government

said till now its just allegations. Which mean its a war crime with official confirm

(29).Media spokesman for the hospital in Fallujah Dr. Wissam Essawi confirmed that alot

of ambulances were prevented to enter Fallujah because the targeting policy of

govern. Army (19). Monday 10 Feb, 2014, government army attacked again thehospital of Fallujah, for 6 times and without any condemn to war crimes and without

any justifies from Iraqi government (20). Where the shell falls during a government

bombardment in front of the lobby resuscitation of and injured some patients in

Fallujah hospital, forcing the hospital administration to transfer lounge recovery to the

second floor, in order to protect patients and medical staff.

February 10, 2014 government army targeting Fallujah hospital and four times on the

day of, wounding four of the hospital staff, including Dr. Ahmed Al-Shami (chief of

resident doctors in the hospital)(23).

Fallujah hospital spokesman confirmed that "Our medical staff in continues riskbecause of the ongoing targeting by government forces" (21). The new targeting to

hospital was on 13 Feb. 2014 by Iraqi government army (28). On 14 Feb. Cannon

shell of the government army landed in front in the lobby of emergency in Fallujah

hospital, which led to the crash of glass and material damage, and government forces

targeting ambulances brought the wounded civilians from the city of Karmah near

Fallujah (26). In 13 Feb. 2014, the crimes of indiscriminate shelling of thegovernment forces on hospital, causes horror and fear from killing to foreign

employees after some of them wounded. This crime let the foreign employees in

Fallujah hospital crying and asking to leave Iraq for save their lives. Some photos ofthem in below (24).

In 20 Feb. 2014, the spokesperson of the military operations command in Anbar

province, (Branch from the Iraqi army and under the direct supervision of the PMs

Maliki), announced on television a direct threatening to Fallujah hospital staff and its

director, justified the constant bombardment them under the pretext that they aretreating the revolutionist tribesmen in the hospital of Fallujah, in order to justify

hitting the hospital and medical cadres as they did previously and will do in the future

(15).

By corresponding with UNAMI mission in Iraq, they told us that they warning the

Maliki government that the Fallujah hospital and other medical sites are under the

protection of international law and have no right to be targeted were not as long as a

base for militants. For this moment, and after more than 8 times of attacking Fallujah

hospital, Maliki government failed to give one evidence confirm the reason to this

attacking which it is a war crime and violation to Geneva conventions. Some photos

2. 3. Attacking the Mosques:

The city of Fallujah contain more than 200 collector and a mosque, and is considered

one of the cities that social role of the mosque and a great humanist in its life. For this

importance, its considering the aggressive shelling on mosques with a negative

psychological impact on the people in the city.

Al-Hussein mosque in Fallujah was destroying by indiscriminate shelling of

government forces which caused injuring to the reader person and one worshiper (16).The mosque of Sheikh Abdul Aziz, south of Fallujah was bombed by government

forces on 22 Feb. 2014 (17).

In response to the bombing of mosques in Fallujah, some youth of Fallujah started on

18 Feb. 2014, a campaign to plant flowers in the mosques in response to the

indiscriminate shelling by government forces (18).

3. The civilians stayed in the city:

Indiscriminate shelling was the only reason of the displacement of the civilians in the

city. Poor families were divided into two parts, the first of which went to his relative

in the country and villages near Fallujah, where most amusing point of rural areas far

from the battles, and they return to their homes whenever the bombing stopped

relatively. The second section, they do not have a relative or second place out of the

city and without money to rent out, forcing them to remain under the mercy of

indiscriminate shelling, preferring to die with dignity in their homes, instead of living

in a humiliating question others to help them (38).

I received a film from one of the family stayed inside Fallujah to show you that even

children start be a common with army attacking each day and they continues their

games although you can hear the shells falls in some place near (39).

Government policy in the shelling of the city was the criminal target of the civilians

too, and not only targeting armed rebels, because the indiscriminate shelling was

aimed to be terror in the hearts of civilians in order to get them out of the city, to

promote that who has remained in the city is only insurgents, who are responsible for

the displacement of civilians from the city. To confirm this, you can see some

testimonies of victims under this crime of mass punishment, like this old age piercing

tremble in fear of indiscriminate shelling, which affects the city (40). In 22 February

2014, demonstration for the people and children of Fallujah started to denounce theaggressive and indiscriminate bombardment that continuing on civilian homes in the

city (41).

The indiscriminate bombing on displaced civilians constant both in areas outside

Fallujah or upon their return to the city, which confirms the policy of genocide for

them, especially nor can the poor to go to safer areas due to poverty (42).

4. Forced Displacement of Civilians & The humanitarian crisis:

Government army closed many times the roads to Saqlawiyah north of Fallujah andNaeymia, south Fallujah, as well to close the road with Ramadi city, to prevent entry

and exit, while parents warned of a humanitarian catastrophe in the event of continued

blockade. This blocking the road has been a big effect to stop any humanitarian helpsor aids to enter the city or go to displacement civilians around or near the Fallujah.

The problem of a major humanitarian and human stuck still in front of the

international community and the government in Baghdad, which has been unable to

secure the needs of the displaced people who caused their displacement from the

province. Says the official government reports, which are the amounts of which it wasunable to reduce the moment to secure 10% of aid displaced. Official source

confirmed that even displaced civilian out the city were attcked by inscriminateshelling (19).

Sheikh Abdel-Moneim al-Qubaisi and a cadre of burial in the cemetery of the martyrs

of Fallujah, released in last days 20 Feb, that the coefficient material of concrete in

the city have been stalled since the outbreak of the crisis, what caused the scarcity ofmaterial "blocks" used to bury the dead. The oldest burial and benevolent staff on the

use of wood material after it has been purchased and that the amount has not been

completed yet.

On 13 Feb. 2014, news spoke on how the government army action increases the siege

of the city tourist Hbanah and cut off water, food and medicine for 30 000 displacedfamilies in it. On 14 Feb. Humanitarian situation is very bad for the displaced people

of Fallujah and Ramadi in the Habbaniyah city (CC) due to the presence of the relief

Commission-led by awakening group (following government), while governmentartillery bombardment continue on the island of Khalidiya area and using modern

U.S. artillery. Call coming from many palces to do not delivery of humanitarian aid

and relief urgent to any Iraqi politician and especially politicians in Anbar province,

they began to exploit the question of the distribution of humanitarian aid as spam

election put signs in their name and photograph delivery displaced families arehumiliating and inhumane as well as the lack of integrity of those politicians Iraqis

who stole money in broad daylight.

5. Torturing the displaced civilian:

A displaced man from the Fallujah city was show with talking about his arresting byMaliki's forces and tortured by them (43).

6. Recommendations

1. Urgent international action to stop the military operations in the province ofAnbar, which could be considered an operation of mass punishment that reach

the genocide level, in order to protect civilians and to make it possible for the

knowing the truth, especially the catastrophic humanitarian crisis taking place

right now.

2. The creation of an international investigation committee on behalf of the UNSecurity Council or the UN Human Rights Council. Although all of theinformation available indicates an international crime within the jurisdiction of

the International Criminal Court, which requires the action from the

Prosecutor to investigate all available information.

3. A review of the mechanisms used by the UNAMI in Iraq, which have becomea burden on the people, giving these transgressions political legitimacy. And it

became necessary to return the position of the Special Rapporteur for Human

Rights in Iraq.

4. Stopping any military aid to the Maliki regimes government in Iraq until theinvestigations surrounding the crimes that have been committed are done.

5. The urgent entrance of international aid organizations in order to alleviate the

poor living conditions of the refugees, who number more than 200 thousand

from the city of Fallujah and its nearby villages, in addition to 100 thousand

within the city.

6. The need to adopt solutions based on justice and transparency in knowing thefacts and to hold the perpetrators, whatever their positions, and stay away from

political solutions that represent the agendas of some political parties,domestic or international , which not only bring us more of the devastation and

suffering over the past ten years.

7. The need urgent action by the International Red Cross in the verification ofwar crimes in violation of the Geneva Conventions, especially with all the

evidence documented in this report . And the need to bring the perpetrators ofthe war against international forums as stipulated in their responsibility, which

gave her the international community.

8. The need for international pressure to force the Iraqi government to sign and

ratify the Convention on the International Criminal Court to halt the series ofgenocide in Iraq.
