Whereas it appears to the Governor that additional land is likely to be needed for the public purpose, not being a purpose of the Union, namely for the construction of Hydel Project by S.P.D.C Ltd. through Sneha Kinetic Power Project at Lindok block, East District, it is hereby notified that pieces of cadastral Plot nos.66 & 67 measuring area more or less .2160 hectare bounded.

NORTH : Dhananja, Bishnu Bhakta SOUTH : Sabitri is likely to be needed for the aforesaid public purpose at the public expenses within the aforesaid block of Lindok, East Sikkim. This notification is made, under the provision of Section 4(1) of L.A.Act, 1894 (Act I of 1894) to all whom it may concern. A plan of land may be inspected in the Office of the District Collector, East. In exercise of the powers conferred by the aforesaid Section, the Governor is further pleased to authorize the Officers for the time being engaged in the undertaking, with their servants and workmen, to enter upon and survey the land and do all other acts required or permitted by that section. NOTIFICATION

In exercise of the powers conferred by section 117 of the Sikkim Cooperative

Societies Act, 1978 (12 of 1978), the State Government hereby makes the following

rules further to amend the Sikkim Cooperative Societies Rules, 1981, namely :-

Short title, 1. (1) These rules may be called the Sikkim Cooperative

extent and Societies (Amendment) Rules, 2010.

commencement (2) They shall extend to the whole of Sikkim.

(3) They shall come into force on the date of their publication

in the Official Gazette.

2. In the Sikkim Cooperative Societies Rules, 1981, in rule

9(1), in sub-rules (1A),-

(i) in clause (a), the words and figure “and such cooperative

society shall also be entitled to 15% rate preference” shall

be omitted;

(ii) in clause (c), the words and figure “and shall be eligible to

get 15% rate preference”, shall be omitted;

(1) in sub-rule (1B), the words and figure “and shall be

eligible to 15% rate preference”, shall be omitted;

(2) in sub-rule (1C), the words and figure “and such

cooperative societies shall be entitled to 15% rate

preference”, shall be omitted.

I. The functions of the Board shall be as under: (1) To ensure that the provision for the Prevention of Cruelty to Animals Act, 1960 as enforced in Sikkim are implemented by the government properly and to undertake study of problems if any faced for effective implementation of such law from time to time; (2) To advice the Central Government in framing rules under the Prevention of Cruelty to Animals Act, 1960 (59 of 1960), with a view to preventing unnecessary pain or suffering to animals generally and more particularly when they are being transported from one place to another or when they are used as performing animals or when they are kept in captivity or confinement; (3) The Board shall suggest and formulate appropriate regulations on transportation and marketing of animals, pet animals and birds etc., on breeding and maintenance of laboratory, sports and performing animals, on controlling stray dog population and rabies, meat shops etc; (4) To advise the Government or any local authority or other person on improvements in the design of vehicles so as to lessen the burden on draught animals. (5) To take all such steps as the Board may think fit, for amelioration of animals by encouraging, or providing for, the construction of sheds, water-troughs and the like and by providing for Veterinary assistance to animals;

(6) To advise the Government or any local authority or other person in the design of slaughter-houses or in connection with slaughter of animals so that unnecessary pain or suffering, whether physical or mental, is eliminated in the pre-slaughter stages as far as possible, and animals are killed, wherever necessary, in as humane a manner as possible; (7) To take all such steps as the Board may think fit to ensure that unwanted animals are destroyed by local authorities, whenever it is necessary to do so, either instantaneously or after being rendered insensible to pain or suffering; (8) To encourage, by the grant of financial assistance or otherwise, the formation or establishment of pinjarapoles, rescue homes, animal shelters, sanctuaries and the like where animals and birds may find a shelter when they become old and useless or when they need protection; (9) To co-operate with, and co-ordinate the work of association or bodies established for the purpose of preventing unnecessary pain or suffering to animals or for the protection of animals and birds; (10) To give financial and other assistance to animal welfare organizations functioning in any local area or to encourage the formation of animal welfare organizations in local area, which shall work under the general supervision and guidance of the Board; (11) To advise the Government on matters relating to the medical care and attention which may be provided in animal hospitals and to give financial and other assistance to animal hospitals whenever the Board thinks it necessary to do so; (12) To impart education in relation to the humane treatment of animals and to encourage the formation of public opinion against the infliction of unnecessary pain or suffering to animals and for the promotion of animal welfare by means of lectures, books, posters, cinematographic exhibitions and the links; (13) To advise the Government on any matter connected with animal welfare or the prevention of infliction of unnecessary pain or suffering on animals. II. Office of the Board, Term of office, etc. (1) The Office of the Board shall be located in the Office of the SARAH Division. (2) The term of the Board shall be three years from the date of its constitution. (3) The term of Office of the Ex-Officio Member shall continue so long as he holds the Office by virtue of which he is such a member. (4) The non-official members of the Board shall be entitled to TA/DA for attending the Board's meeting as admissible to Grade 1 Officers of the Government. By Order and in the name of the Governor. N O T I F I C A T I O N The Governor of Sikkim is pleased to sanction the following relief and ex-

gratia payment, in addition to usual pay and allowances, to the police

personnel deployed for duty in the Bomb Detection and Disposal Squad (BDDS)

due to involvement of high personal risk as compared to assignments in other

units of the force:-

(1) 25% of basic pay as Risk Allowance.

(2) Insurance of Rs 10 lakhs to the family in the event of death of a

member of BDDS while performing active duty of search, detection,

disposal and diffusion of a Bomb and/or Improvised Explosive

Device.

(3) Twice the rate of Ex-gratia payment entitled to police personnel

under the existing Notification shall be paid to the family members

of the BDDS in case of death or permanent physical disability

while performing active duty of search, detection, disposal and

diffusion of Bombs and/or Improvised Explosive Devices.

Further, a member of the BDDS shall ordinarily be demobilized on his

attaining the age of 45 years or in the event of his being unsuitable/rendered

incapable of performing his duties as a member of the BDDS due to physical

disability.

The expenditure will be met from budget head “2055-00.104-64-

64.00.01-Salaries (NP)”.

NOTIFICATION

In partial modification of Notification No. 66/Home/95 dated 22nd November, 1995 as amended vide Notification No. 57/Home/96 dated 27th September, 1996 the State Government hereby makes the following amendments with immediate effect: (1) In the said Notification No. 66/Home/95 dated 22nd November, 1995 after the

words “Gram Panchayat” wherever they occur the words “or the Nagar Panchayat/Municipality” shall be inserted.

(2) After item 4 the following shall be inserted, namely:

“4A. A person whose father/husband is/was eligible for grant of the Certificate of Identification under any of the categories listed under items 1 to 4 above, or”

(3) After item 5 the following shall be inserted, namely:

“Provided that no such Certificate shall be issued or deemed to have been validly issued for further issue of COI:- (a) On the basis of relationship of father unless the applicant is or at the relevant

time was the natural legal descendant of such person. (b) On the basis of relationship of husband unless the applicant has established

beyond all reasonable doubt that she is or at the relevant time was a citizen of India.

(c) On the basis of relationship of paternal grandfather/brother from the same father unless the applicant has established beyond all reasonable doubt that he/she is or at the relevant time was a citizen of India and has/had been a resident of the State.”

(4) After the last paragraph the following shall be inserted namely: “The issuing authority is also authorized to cancel the Certificate of Identification of a person if it is reasonably established that the Certificate has been obtained by him/her or on his/her behalf by misrepresentation or suppression of any material fact. Any person aggrieved by the refusal to grant or cancellation of his/her Certificate of Identification by the Issuing Authority may apply within one month of such refusal or cancellation to the Secretary, Land Revenue & Disaster Management Department for redress.”

NOTIFICATION

The State Government is hereby pleased to authorize the District Collectors and the Additional District Collectors within their respective jurisdiction to issue Residential Certificates to persons falling in the different categories as indicated below on the recommendations of the Gram Panchayat or the Nagar Panchayat/Municipality and being duly satisfied with such recommendation after proper police verification: 1. A person who has established beyond all reasonable doubt that he/she was a

resident of the State of Sikkim as on 26th April, 1975 and has been residing therein since then, or

2. A person who has established beyond all reasonable doubt that he/she is the

natural legal descendant of the person referred to in category 1 above and has been a resident of the State since birth, or

3. A person who has established beyond all reasonable doubt that he/she is the

natural legal descendant of a Sikkimese woman holding/eligible for a Certificate of Identification in terms of the State Government Notification on the subject and is a resident of the State since birth, or

4. A person who has established beyond all reasonable doubt that he/she is/was a

regular employee under the Government of Sikkim and is settled therein, or 5. A person who has established beyond all reasonable doubt that he/she is the

natural legal descendant of the person referred to in category 4 above and is a resident of the State since birth.

6. A person whose spouse is eligible for grant of a Residential Certificate under any of the above mentioned categories and is a citizen of India and a resident of the State.

Application for a Residential Certificate shall be submitted in the form prescribed to the respective District Collectors along with relevant documents. The District Collector may issue the Residential Certificate after due verification from the Gram panchayat/Nagar Panchayat/Municipality and the police.

The issuing authority is also authorised to cancel the Residential Certificate of a

person if it is reasonably established that the Certificate has been obtained by him/her or on his/her behalf by misrepresentation or suppression of any material fact.

Any person aggrieved by the refusal to grant or cancellation of his/her Residential

NOTIFICATION

The Government has felt it necessary to verify the efficacy of various medicines procured through different Pharmaceutical Companies for the Central Health Stores Organization. Accordingly, the Department of Health Care, Human Services & Family Welfare has approved the following standard operational procedure for CHSO.

1. No drug will be received by the Central Health Stores Organization (CHSO) without authentic Drug Testing Certificate submitted by the concerned+ manufacturer for all the different batches of medicines supplied by them.

2. Immediately after receipt, Deputy Drug Controller shall lift a sample from each batch of the drug received by the CHSO and forward it to the Regional Drug Testing Laboratory, Guwahati, Assam for confirmation of the drug test certificate submitted by the concerned manufacturer.

3. Office of the Deputy Drug Controller will also follow up the test result of the drug samples forwarded by them to the Regional Drug Testing Laboratory, Guwahati and will bring result as early as possible.

4. Any variations in the test result will have to be reported to the Commissioner-cum-Secretary immediately.

5. Non-compliance will attract Disciplinary Proceeding as per the Government of Sikkim Service Rules.

(i.)Sikkim Government Gazettes are published by the Home Department every year in large volumes, over and above the number required for distribution among the subscribers and offices. The excess numbers of Gazettes were printed to meet requisitions from various Government offices and members of the public on payment basis. However, this system has not only impinged on storage space in offices, but also led to high expenditure on printing and wastage of paper. Keeping the above in view the State Government has been pleased to decide as follows: -

(ii.)Henceforth, Gazette Notifications shall be classified as under:-

1. PART I - EXTRAORDINARY (1) State Acts/ Ordinances;

(2) Statutory rules and regulations; (3) Orders issued under the statute or statutory rules, regulations and

notifications; (4) Constitutional and statutory appointments; (5) Constitution of commissions and statutory committees. (6) Republication of Central Acts/Ordinances/ rules/ regulations and

notifications. (7) Policy decisions of the Government.

2. PART II - ORDINARY • Orders of appointment; • Orders of transfer; • Orders of promotion; • Orders of suspension, revocation, reinstatement, deputation,

superannuation, etc; 3. The Gazette Notifications shall be regularly and promptly updated on the Government website-(http://www.sikkim.gov.in) by the Department of Information Technology and shall be available on the website as per above classification. The Gazettes will be retrievable from the website as per following parameters: -

(a) Number of the Gazette (b) Date of publication (c) Department of the Government (d) Subject of the Gazette notification.

No.08 /TD Date: 30/10/2010 In view of the large number of adventure sports activities being conducted in the State of Sikkim and the manifold increase in the number of people participating in such activities the State Government has deemed it appropriate to prescribe with immediate effect the following ‘Basic Minimum Standards’ (BMS) and guidelines to regulate all such activities and a ‘Standing Operating Procedure’ for Search and Rescue in case of any mishap or accident:- A. BASIC MINIMUM STANDARDS/GUIDELINES Permission to a person for undertaking any land based, air based or water based adventure sports activity in the State shall be given by the Tourism department subject to the laws, rules and orders of the Government including in respect of royalty/fees and the person(s)/operators fulfilling the Basic Minimum Standards as outlined in the paragraphs below. In the case of foreigners and entry into restricted/protected permission will be given only after approval of the competent authority prescribed in regard to same. 1. LAND BASED ACTIVITIES (i) Climbing of Peaks/Mountain Expeditions (a) Application - These guidelines apply to climbers and specifically to commercial operators who offer to guide or accompany climbers above Base Camp for climbing peaks above 5000mtrs or comparable peaks and also operators who offer limited facilities. It also concerns operators who supply transport, High Altitude porters and other services to Base Camp.

(b) Information to Clients - A variety of operators or organizations offer to take clients to peaks above 5000 mts or comparable peaks. They vary from those who provide a full service to the summit or nearly to the summit, to those who offer minimal support for clients above Base Camp. At present it is difficult for clients to deduce from their brochures exactly what is offered in terms of guidance and support and whether it corresponds to their needs. These guidelines will, therefore, also help the climbers in making an informed choice. Prior permission from the Indian Mountaineering Foundation, New Delhi is necessary for climbing peaks above 20,000 ft. (c) List of peaks of altitude around 6000 mtrs and below opened for Alpine expedition and their grading and other parameters is given at Annexure - I. (d) Danger Awareness - Mountaineers climbing at very high altitude, especially above 5000 mtrs, are at considerable stress to their mental and physical powers and may not be capable of assisting others. This fact is of particular importance to mountaineers of limited experience who rely on professional guides to bring them safely up and down. They should be made aware that the risk involved in climbing at high altitudes is such that a degree of self-reliance is necessary. (e) The Leader or Chief Guide and as many as possible of the guides should have high altitude experience appropriate to the altitude of the peak to be climbed. He/She must have been a member of at least three climbing expeditions above 5000 mtrs and must have completed Basic Mountaineering Course and qualified on first aid. (f) All members of the mountaineering expedition should be adequately qualified for taking part in sport. Basic course certificate issued by Sonam Gyatso Mountaineering Institute at Gangtok or any recognized Mountaineering Institute should be considered adequate for this purpose. (g) The guides and porters and the material available must be adequate for the aims of the party and stated level of services offered. The guides and porters must be well taken care of especially beyond the first Base Camp. (h) An experienced doctor in the party is very desirable but at the very least advance arrangements must be made for medical help. Advance arrangements must also be made for evacuation assistance in case of emergency. (i) The minimum safety equipment available must be walkie-talkie radios and recommended medical supplies. (j) Advertising by tour operators/organizers must give a true picture of the difficulties and dangers involved and avoid promising the impossible. Biographical information about the guiding team should be included.

(k) Information to be supplied in advance should include a clear statement of the guiding, porterage and equipment which will be supplied by the organizer together with details of the clothing and equipment to be supplied by the client. (l) All equipment on which life is dependent must be UIAA or CE certified. (m) Before commencement of the expedition, the Liaison Officer and Team Leader, as the case may be, must compulsorily declare the biodegradable as well as non-biodegradable waste material being carried by the team at the Entry Check Point (ECP) in West Sikkim and at Lachen TIC in North Sikkim. They must bring back all the waste to the ECP/TIC. Photo evidence is to be included in the expedition report. Discovery of non-compliance would invite suitable punitive action. (ii) Rock Climbing Expedition (a) The Leader/ Chief Instructor and as many as possible of the instructors should be trained and certified by Sonam Gyatso Mountaineering Institute at Gangtok or any recognized Mountaineering Institute. (b) Rock Climbing may be done only in areas designated for the activity. It should be ensured that the instructor/ leader is familiar with the climbing area. (c) Ropes and associated climbing equipment designed specifically for Rock Climbing should be used and it should be re-inspected by the instructor prior to the climb. (d) A first aid kit should be available on site as also suitable means for transporting an injured climber. (e) Design an emergency action plan and communicate it to all involved in the programme. Clearly outline the safety procedure to all. (g) Garbage should be suitably disposed at the designated sites failing which suitable punitive action may be taken. (iii) Trekking Expedition (a) The Leader or Chief Guide and as many as possible of the guides should be certified by a recognized institution and should have experience appropriate to the difficulty of the route being attempted. He/ She must be qualified on first aid. (b) The guides, porters and staff for the trek and the materials supplied must be adequate for the aims of the party and stated level of service offered. The expedition must make provisions for the accommodation of the porters as well. (c) Camping must be done in the designated camping spots as notified by the Forest, Wildlife & Environment Department/Tourism Department.

(d) Trekking must be done in the designated trekking trails as identified by the Forest, Wildlife & Environment Department/ Tourism Department, Government of Sikkim/ MHA, Government of India. (e) Adequate arrangements must be made in advance for medical help. Advance arrangements must also be made for evacuation assistance in case of emergency. Minimum first aid medical supplies must be carried on the trip. (f) Information provided to clients must give a true picture of all the difficulties and dangers involved and avoid promising the impossible. Biographical information about the guiding team should be included. (g) The client must truthfully reveal his experience, medical history etc to the organizer so that the organizer can make an informed choice about the potential client. Information supplied in advance should include a clear statement of the guiding, porterage and equipment which will be supplied by the organizer, together with details of the clothing and equipment to be supplied by the client. (h) Garbage should be suitably disposed at the designated sites failing which suitable punitive action may be taken. (iv) Mountain Biking Expedition (a) Adequate arrangements must be made in advance for medical help. Advance arrangements must also be made for evacuation assistance in case of emergency. Minimum first aid medical supplies must be carried on the trip. (b) The client must truthfully reveal his experience, medical history etc to the organizer so that the organizer can make an informed choice about the potential client. (c) Insurance of all the expedition members is a must. (d) Garbage should be suitably disposed at the designated sites failing which suitable punitive action may be taken.

(v) Skiing (a) The Leader/ Chief Instructor and as many as possible of the instructors should be trained and certified by any recognized Mountaineering Institute. (b) All necessary equipment must be available at all times (c) Provision for first aid must be available at all times. (d) Skiing must be done in the designated areas identified by the Forest/ Tourism Departments. (e) Garbage should be suitably disposed at the designated sites failing which suitable punitive action may be taken.

(vi) Camping (a) The Camp should be at designated sites (b) The Camp should be around 150 mtrs away from rivers, streams and lakes. (c) Cook only on LPG or kerosene stove. There should be no camp fires in the mountains. (d) Toilet tents should be pitched at least 50 mtrs away from meadows and streams. (e) Garbage should be suitably disposed at the designated sites failing which suitable punitive action may be taken. 2. WATER BASED ACTIVITIES (i) River Running (a) All trips on white water for tourists will be conducted with at least one qualified guide on each raft. (b) Guides should be at least 18 years of age, be able to swim, hold a valid Red Cross first aid certificate or equivalent and have a current Red Cross cardio-pulmory resuscitation (CPR) certification or equivalent. (c) Guide trainees should complete a course (or equivalent training) that equips them with the necessary skills and knowledge to safely and competently guide a raft. A guide training course must have had topics on skills in rafting techniques, crew training and management, emergency and rescue techniques and knowledge of rafting equipment, safety and emergency procedures, rapid theory, leadership, signals etc. (d) Guides should have guided a raft under the supervision of and to the satisfaction of a Trip Leader and been on at least ten white water runs within the past two years in rapids of the same class or higher than the run they intend to guide on. They should complete a familiarization run on any new stretch of white water they intend to guide on. Guides should also maintain a log book recording each run and signed by the Trip Leader as proof of experience (e) Special Requirement for Trip Leaders - Trip Leaders should have been qualified guides for at least two years; hold a high level of guide skills and knowledge; have a thorough knowledge of trip planning, white water rescue techniques, emergency procedures and advanced first aid and should have guided a raft as a qualified guide on at least twenty white water runs within the past two years in rapids of the same class or higher than the run they intend to

(f) Single Raft Trips - Some of the worst accidents in river running internationally have occurred where there has been only one raft. There should be at least two rafts on the water i.e. two rafts or kayaks or a raft and a safety kayak. This may be relaxed for float trips (maximum grade II) in the case of rafts. For kayaks a minimum of two or preferably three is always recommended (g) Kit - All trips must carry a well-equipped first aid kit (it must have triangular bandages, sterile pads, gauze roller bandages, first aid adhesive tape, splints, scissors as bare minimum), a repair kit (it must contain approx. half meter of repair material), sufficient amount of fuel and accelerator, sand paper or roughing tool and waterproof repair tape/ duck tape. Oar rafts must carry at least one spare oar. All rafts must have a safety line going all around the raft, a bowline and preferably a stern line as well. All rafts must have a throw bag and a bailing bucket. A flip line is recommended for all big drops. (h) Personal River Equipment - All rafters/ kayakers MUST have a life jacket on at all times while on water. This includes the guides also. The life jackets must have adequate buoyancy (minimum of 6.14 kgs and preferable 9-10 kgs), must be the proper type (US Coast Guard Type III or V) with a provision of ensuring a snug fit by straps etc. and should be worn correctly. Inflatable life jackets and the ‘keyhole’ type jackets are not recommended. Guides must ensure that the life jackets are on in a secure manner before the trip starts and above all major drops. Helmets are mandatory on all rapids and it is recommended that helmets be kept throughout the trip. The helmet should be properly strapped. (i) Age Limit - Fourteen years on all stretches except float trips (grade II and below) where it may be relaxed to ten years. (j) Non-swimmers should not be allowed on any serious rapids (grade III+/ IV) or hard section. (k) Guides/ trip leader must ensure that a thorough safety briefing covering all pertinent details for that particular trip is given before each trip. The trip leader must ensure that clients are in suitable attire (bulky clothes, sarees, neck ties, long skirts and three piece suits should not be permitted). People suffering from any serious ailments, week heart conditions, epilepsy and expecting mothers should not be allowed. Non-swimmers should not be allowed to body surf. Shoes/ appropriate sandals/ booties are a must for rafting. Appropriate clothing must be worn during winter on glacial melt rivers with cold air temperatures. For such rivers, dry suits/ wet suits are recommended. If not, light woolen/ synthetic clothes are a must. Trips must be timed carefully to finish at least an hour before sunset. (l) People who have consumed alcohol in any form or quantity or illicit drugs at least six hours prior to the river trip must not be allowed to participate.

(m) One or two familiarization runs before operating commercially each season or on new rivers is recommended. Rivers should not be run commercially at flood levels. (n) Foreign Guides must be aware of the Indian Safety Regulations before being allowed to operate. They must fulfill the required criteria and should do a few familiarization runs on the river and equipment before being allowed to operate commercially. A valid first aid certificate is a must. (o) A senior guide must have spent at least three consecutive seasons on any river with a minimum of sixty days on the river per season. He must have all requisite First Aid and CPR qualifications and must have a clean safety record. A senior guide must have river-running experience on at least three different rivers. (p) A Safety and Rescue Kayaker must be thoroughly trained and experienced in all safety norms, river rescue and first aid/ CPR. A minimum of thirty days on the river is mandatory before kayaking with commercial trips. 3. AIR BASED ACTIVITIES

Aero sports have the highest skill requirements. They also have the highest risk element and anything that goes wrong hardly gives an opportunity for corrective action. Accordingly, adherence to safety guidelines must be followed meticulously. Generally, the following principles need to be adopted:-

(a) The equipment used in each aero-sport must be defined in terms of its specifications, certifying agency and its life (shelf life and usage life) as defined by the manufacturer who for the purpose must hold a valid authorization for manufacturing the particular aero-sports equipment.

(b) Instructor/ operator qualification is very important. It is not enough to have an initial certificate or qualification. Currency and continued evaluation in terms of safety and skill needs to be carried out.

(i) Paragliding (a) All paragliding activities in the State should have necessary permission / clearance of the DGCA, Government of India. (b) All airborne adventure sports operators must obtain clearance of the DGCA and the local district administration and police stations must be kept informed of their activities. (c) Operators must have access to safe and open take off points in case of hill launches. The take off point should be free from obstructions in the take off path and should not have rock or crops which could injure the participant. Cliff take off points must strictly not to be used.

(d) The operator must have free and clear access to a designated landing ground free of obstructions such as tall trees, buildings, electric wires, etc. (e) First aid must be available at site with Qualified First Aid Instructors (having additional knowledge of related accidents) with arrangements with a nearby hospital for quick emergency services. (f) Wind conditions should be strictly monitored and the activity must be done within the weather conditions stipulated by the equipment manufacturer. (g) Paragliding wings must have APCUL DHV or CEN certification. Such certification should be stitched on the wing and visible for inspection. Harness should be with back protection and harness must be fitted with round type certified rescue parachute. (h) Helmets and ankle shoes are compulsory. (i) Proper log books must be maintained for all equipment. (j) Annual inspection and certification of equipment for air worthiness must be carried out. (k) The pilots engaged for the operation must hold valid certificate from an accredited Paragliding flying Institute certifying the individual for operation of Tandem and other Paragliding flights. (l) Garbage should be suitably disposed at the designated sites failing which suitable punitive action may be taken. (ii) Bunjee Jumping (a) The Leader/ Chief Instructor and as many as possibly of the instructors should be trained and certified by a recognized National Institute. (b) All parts of the jump line must be duplicated. This extends from the connection of the bungee to the jumper and the connection to the structure at the other end of the line. Normally the jumper has an attachment to ankle straps and another to a body or sit harness. (c) Equipment (harnesses, karabiners) should be of sound construction and suitable for this use. Mountaineering equipment from reputable suppliers is appropriate. Karabiners should be of the screw gate type. (d) At least 2 braided ropes should be used and matched to the weight of the jumper; they should be to BS 3F 70 1991: specification for heavy duty braided rubber cord, or to a demonstrably similar standard.

(e) Normally one unbraided rope is adequate because of the in-built redundancy from its structure of approximately one thousand individual strands bound together. Each rope should have an examiners certificate from an independent source and be selected according to the weight of the jumper. (f) Rope log books should be kept describing maximum load and numbers of jumps and drop tests undertaken, and in the case of unbraided ropes, any other conditions required by the examiner (e.g. length of time in sunlight). Ropes have a finite life and operators should be able to demonstrate that this has not been exceeded. (g) The procedure before allowing a jumper should cover at least (i) a medical enquiry; (ii) age verification – if under 18, parental consent should be required and if under 14 the person should not be allowed to jump; (iii) weighing and rope selection; there should be a method of checking that the weight of the jumper has been correctly measured and recorded so as to ensure that the correct rope is selected for each jumper; (iv) attachment of each part of harness and ropes, and the checking of each action by a second trained person; (v) briefing of jumper; (vi) entry into and riding in cage, where cranes are involved; (vii) re-instruction and jump; and (viii) retrieval of jumper. (h) Use of mobile cranes is not recommended. If allowed for a short period, particular attention should be paid to the sitting, selection of crane capacity and safe operation of the crane. The result of a crane overturn could be multiple fatalities. The operators must have contingency plans to deal with such situations and keep the area cordoned to prevent injuries to spectators. (i) Training of personnel is of paramount importance. Each job undertaken requires a different level of training and experience. Those in charge should be able to demonstrate that everyone who is carrying out a task has enough experience to do so, unless under direct supervision by another experienced person. There should be a proper training schedule showing how a person progresses from one level of competence to the next. The schedule of work should clearly state who carries out safety critical action and who checks it. Each person should know the tasks which they are permitted to carry out and those which they are not authorized to do. To date, all known fatal accidents world wide have resulted from human error. (j) The person in overall charge should keep close control of the site. Arrangements should be made to exclude spectators from the jump zone for their own safety and to avoid distraction of the operators. (k) Anyone in cage should be securely attached to it. Spectator riding, especially by children, should be discouraged. (l) There should be a dead-weight drop test of the whole line at the beginning of the day to ensure its integrity.

(m) Spares for all the components in the jump line should be kept onsite so as to be available for immediate replacement of suspect components. (n) An air bag should be used for jumps over land with unbraided ropes. The purpose of the bag is to prevent a jumper striking the ground if an incorrect rope selection is made. It is not to safeguard jumpers who fall due to a failure to properly connect them to the supporting structure. Braided ropes to BS 3F 70 have an outer covering which tightens when stretched. Unbraided ropes do not, so there is more risk of a jumper descending too far if a wrong rope selection is made. If a jump is made over water with an unbraided rope, relying on the water to perform the function of the airbag, steps should be taken to ensure that there are no obstructions under the water surface. In addition, suitable arrangements should be made for rescue from the water. (o) Garbage should be suitably disposed at the designated sites failing which suitable punitive actions may be taken. 4. LIST OF INSTITUTIONS The suggested list of institutions whose certificates would be recognized as qualification for Guide or Trip Leader for the specified activity are as follows: a. Land Based 1. Sonam Gyatso Mountaineering Institute Gangtok 2. Himalayan Mountaineering Institute Darjeeling 3. Nehru Institute of Mountaineering Institute Uttarkashi 4. Directorate of Mountain & Allied Sports Manali 5. Indian Institute of Skiing & Mountaineering Gulmarg 6. Indian Himalayan Centre for Adventure & Eco-Tourism Chemchay, Sikkim 7. Armed Forces Training Establishments (in respect of ex-servicemen) b. Water Based 1. National Institute of Water Sports Goa 2. Regional Water Sports Centre Pong Dam, Himachal Pradesh 3. Armed Forces Training Establishments (in respect of ex-servicemen) c. Air Based 1. Armed Forces Training Establishments (in respect of ex-servicemen) (5) OBLIGATIONS OF OPERATORS AND PERSONS UNDERTAKING

ADVENTURE SPORTS ACTIVITIES (a) It shall be mandatory for all Tour / Trek / Expedition and other adventure sports Operators to be registered with the Tourism Department, Government of Sikkim and have a valid license.

(b) In addition to the royalty prescribed by the State Government for mountaineering expeditions and trekking a fee of Rs.50/- per head will be payable under budget head ‘Tourism 1452-800 other receipts’ for these activities to the Tourism department for the proper upkeep of the expedition/trekking trails and search & rescue efforts in case of any mishap or accident. (c) All trek / expedition members must have Insurance coverage policy of minimum Rs.3.00 lakhs per head for the expedition period and in respect of support staff a coverage of minimum Rs.1.00 lakh per person for the trek / expedition period. (d) The form for application by Tour Operator/ group for permission to undertake mountaineering or trekking expedition in the State, the personal particular form, the permit for expedition/trek, the terms and conditions, code and conduct for eco-tourism and do’s or don’t, particularly in respect of foreign tourists are given collectively at Annexure – II. (e) A detailed itinerary of the expedition or trek shall be furnished while applying for Entry Permit along with the names & address of the entire team of climbers and support staff. (f) Photographs of clients, whether domestic & foreign, visiting areas falling under the RAP/PAP regime are mandatory on the copy of permit. (g) It is mandatory for all Operators to attach licensed and accredited Guides/LO registered with the Tourism department and experienced expedition support team members. A reconnaissance of the expedition area should be carried out by the operator prior to any mountaineering or trekking expedition. (h) All expedition / trek members including their support staff must be registered with the authorities at respective trek / expedition ENTRY POINTS and must carry the ID card of the Expedition Agency. (i) A Liaison Officer (LO) from the approved panel maintained by the Tourism department shall be appointed for all expeditions and trekking in restricted/protected area and will remain attached to the group till their exit from the said area as mentioned in the permit. He will ensure that the group confines themselves to the areas permitted in the permit and do not stray into other areas those are out of bound. (j) The LO will be held accountable for any breach of law, rules and regulation by the team or its members while undertaking the expedition. The LO shall submit a report on the expedition to the Tourism department who will forward the same to the competent authority for necessary action in case of any violation of law or the permit conditions. (k) A person to be appointed as a LO must have the basic qualifications as stipulated by the IMF /State Government/ MHA to undertake the task. He/She should have basic

knowledge of First Aid and be conversant with the local language and have knowledge of map reading. All expenses for the Liaison Officer, i.e. food accommodation, transport and daily honorarium during the expedition will be borne by the operator. (l) The expedition / trekking teams should abstain from using fuel wood and only LPG/Kerosene oil should be used. (m) Members of the expedition/trekking teams should zealously avoid any pollution or damage to the environment and strictly abide by such orders and terms and conditions as may be specified by the State Government in this regard from time to time. A copy of the terms and conditions shall be attached to the permit. (n) All mountain / trekking expeditions shall ensure that the garbage generated is removed by them and is disposed in the manner prescribed by the Tourism department. (o) Possession of Satellite phone sets should be intimated to GSO-I (Int), HQ, 17 Mt. Division C/O, 99 APO and the State Police. (p) Photography of army camps, defense installations and other sensitive areas that are designated and declared out of bound for civilians is prohibited. (q) A mountain Climbing teams will be required to furnish a Bank guarantee of Rs.1.00 lakh for the period of their expedition in case Search & Rescue operations have to be launched in the event of a mishap or accident. The fund is refundable on completion of the expedition. (r) Appropriate permit from the office of the Superintendent of Police, Check posts, Gangtok shall be taken for entry into the protected areas as defined in Schedule I of the Foreigners (Protected Areas) Order, 1958 as amended vide Foreigners (Protected Areas) Amendment Order, 1990 and under State Government Notification No. S/480/HP for all tourists and non residents of these places. (s) For further information on the subject, fees etc. please refer to Sikkim Tourism website www.sikkimtourism.travel. B. SEARCH & RESCUE (1) The ‘Standard Operating Procedure’ (SOP) outlined below contains the general guidelines to be followed by the all concerned during the launch of any Search & Rescue Mission resulting from any tourist related mishap, accident or misadventures in the State of Sikkim. (2) On receipt of information relating to a Tourist Mishap, Accident or Misadventure within the State of Sikkim, a “Search & Rescue Mission” shall be launched under the supervision of the Search & Rescue Nodal Cell in the Tourism department with help from concerned government and non-government agencies. In case of a serious mishap,

accident or misadventure the search & rescue efforts will be coordinated by the State and District level Search & Rescue Committees notified by the State Government for extending necessary help and assistance to the victims and their families and take the mission to its logical end. For immediate search and rescue and for assisting the State and District level Search and Rescue Committees a nodal cell comprising of the following members is established in the Tourism department. TOURISM DEPARTMENT SEARCH & RESCUE NODAL CELL

a. Joint Secretary, Adventure Tourism b. Dy. Director, Adventure Tourism c. Concerned Adventure Cell officer in the district. (3) The role of government agencies shall include the following:

(a) To launch the “Search & Rescue Mission” at short notice. (b) To facilitate first aid from PHC & District Govt. Hospital. (c) To facilitate Emergency Relief measures, this may include evacuation by

helicopter. (d) To facilitate Army Civil liaison, Permit and Permission related matters. (e) To facilitate Certificates from the Government (Deaths & Injuries). (f) To provide Trauma counseling to the victims family. (g) To facilitate hassle free transfer of (dead & injured) to their families or their

representatives who may have reached Sikkim. (h) To represent on behalf of the Government / Department in any of the Search &

Rescue operations. (4) All Expedition and Trekking parties should have their own first aid kits and in the event of any mishap or accident distress signals as prescribed must be sent out for Search & Rescue immediately. (5) SOP Sequence: a. The Operating Agency (Tour / Trek) shall immediately on the occurrence of a mishap or accident send out distress signal to the nearest available District Tourism Officer and the local police station.

b. On receipt of the SOS the District Tourism Office will immediately coordinate with the District Collector (District Committee Chairman) and the District Disaster Management Committee and further relay the information to the Member Secretary, Tourism HQ. c. District Tourism Office will also alert the area Hospital/PHC and Police Station. d. District Tourism Office will consult the District Collector for back up assistance of the District Disaster Management Committee and dispatch the first Rescue team to be followed by a team of professional “Search & Rescue Team”.

e. Tourism HQ Nodal Cell, to alert the Army, CPMF, State Police and STDC for possible assistance of Helicopter Rescue & Evacuation based also on demand made by the client or the operator, (Charges apply) and Hospital authorities for medical assistance. f. The emergency services that would need to be alerted would be (a) Ambulance, (b) Police, (c) Fire & Emergency Services, (d) Hospital/PHC, (e) STDC/IAF for helicopter services (Charges apply), (f) District Disaster Mgt. committee, (g) Organizations, namely; SGMI, IHCAET, SAMA, TAAS, SAATO, (h) Local Panchayat, and (i) Search & Rescue Team, Trained Mountaineers.(Charges apply). f. Tourism Department will activate the State level Committee, if necessary and involve Government and non-Government agencies, including TAAS, SAATO, SAMA, depending on the scale of the accident and the extent of Search & Rescue Operation will be launched. (Charges apply). g. The Tourism Department along with TAAS, SAATO will also extend necessary help and assistance to the family members of the accident victims during the Search & Rescue Operation. h. The department will also facilitate hassle free official formalities in police inquiries, issue of permits, death certificates and medical assistance in government hospital while in Sikkim. (6) The Quantum & Nature of assistance to the victims and their family members shall be as under ;

a. The expenditure on services, wherever charges are applicable, will be borne by the Operator or the Client, as per the agreement drawn/worked out between the Operator and the Client.

b. The Tourism department will facilitate all liaison works with the Government & Private agencies including in respect of certificates & clearances and in arranging suitable transport (charges apply) for the onward journey of the victims and their families to their respective destinations after the “Search & Rescue Operation” is over. The outstation Sikkim Tourism offices will provide appropriate liaison assistance.

C. PENALTY FOR VIOLATION OF BMS/GUIDELINES ETC. It is mandatory for all operators of adventure sports activities/ treks / expeditions in Sikkim to comply, in addition to the laws, rules and orders issued by the government, with the Basic Minimum Standards and Guidelines stated above and the terms and conditions, code and conduct for eco-tourism and do’s or don’t prescribed with the permit. Any violation of the provisions by the operators will attract appropriate punitive action under the “Sikkim Registration of Tourist Trade Act 1998” and the extant laws/rules.

TERMS AND CONDITIONS

1. Scrupulously follow the enclosed Code of Conduct for eco-tourism in Sikkim.

2. State Government will detail a Liaison Officer (LO) for the expedition. The

tour operator shall pay a lump sum fee of Rs. 5,000/- to the LO for the first 12 days and additional Rs. 500/- per day thereafter. The operator shall also bear the cost of his lodging and fooding during the period of expedition.

3. Emphasis should be on employment of local people as cook, porters, guide,

etc.

4. The expedition team shall follow the approved trekking/climbing route only.

5. The expedition team leader and the tour operator shall submit their feedback on the expedition to Home Department, Government of Sikkim within seven days from the date of completion of the expedition.

6. The fees, royalty etc. paid for undertaking the expedition shall not be

refundable unless the expedition is rendered impractical by natural calamity before reaching the base camp or cancellation of the expedition by the State Government.

7. The insurance coverage of expedition team, camp crews, porters and animals

are compulsory.

8. The expedition team shall ensure that no defilement of sacred lakes, caves or rocks enroute is done.

9. The foreign expedition team shall hold valid Inner Line Permit with them.

10. Photography and entry in Army installations enroute is strictly prohibited.

11. The State Government reserves the right to cancel the permit at any time.

CODE OF CONDUCT FOR ECO-TOURISM IN SIKKIM

1. Conserve Sikkim’s natural and cultural heritage

• Do not trample high altitude vegetarian; do not pick any flowers or medical plants.

• Do not disturb wildlife or its habitats. • Do not allow clients to purchase endangered animal parts or antique

cultural artifacts. • Support local conservation efforts and income generation activities.

2. Avoid use of fuel; use alternative fuels

• Use kerosene, LPG (or other non-wood fuel) for all cooking, heating,

lighting including that by staff and porters. • Discourage campfires; encourage camp fun. • Follow safety rules when carrying, storing and suing kerosene and gas.

3. Leave all camps and trials clean

• Separate and properly dispose of litter: burn burnable, bury biodegradable

and carry out all other non-biodegradable materials for deposit at designated trash site or for recycling.

• Use toilet tents on all treks; set up and use toilet tents in an environmentally sound manner so as to avoid pollution of water sources (at least 100m away)

• Use established campsites and kitchen sites; avoid trenching around tents.

4. Practice conservation in the kitchen

• Avoid fuel-conservation menu items, eg. baked foods and large menu selections.

• Re-package foods into reusable plastic containers to reduce waste. • Suggest clients to reduce waste by de- and repackaging also.

5. Practice proper hygiene and sanitation

• Teach all staff about personal hygiene, sanitary kitchen and camp routines. • Properly treat the drinking water and uncooked vegetables for clients. • Dispose of washing and bathing water well away from streams; use

biodegradable soaps.

6. Take responsibility for staff and porter welfare

• Provide adequate warm clothing, sleeping cover, shoes, snow gear, food or

cooking stoves and fuel and take care of hired staff. • Periodically train staff in first aid, guide responsibilities and sanitation,

etc.

7. Properly brief clients before leaving on a trek

• Address cultural “do’s” and “don’ts”; environmentally friendly behavior, safety precautions, proper dress, and respect for local beliefs, peoples and religious sites.

• Plan days for proper altitude acclimatization when ascending; know how to identify and treat high altitude illness and how to provide emergency rescue.

Do’s and Don’ts in respect of foreign teams Instructions for PAP/RAP holders:

1. The permit is valid for group tourists consisting of two or more persons only. 2. Permit is valid for the specific tourist circuit-route and definite entry/exit

points. No area other than the ones indicated in the permit should be visited.

3. Permit holders are requested to keep sufficient number of photocopies of the

permit with them, which may be required for depositing at each point of entry/exit.

4. Permit holders should not stay in the restricted/protected area after the expiry

of the permit.

Instructions for Travel Agents/Tour Operators/Guest Houses: 1. Travel agencies/tour operators should ensure that tourist groups sponsored by

them are in possession of valid Restricted/Protected Area Permit.

2. It will be the responsibility of the travel agents/tour operators to ensure that the tourist groups do not visit places other than the permitted ones and also ensure that they do not stay there after the expiry of the valid period.

3. Owners of guest houses/hotels must ensure that foreigners with valid

Restricted/Protected Area Permits only stay with them. It is mandatory for the guest houses/hotels and also the individuals, if any foreigners stays with them,

to inform the local police about the arrival/departure of foreigners within 24 hours.

4. Action against those who do not follow the above instructions will be taken

under the Foreigners Act, 1946.

NOTIFICATION In supersession to Notification No. 10/TD dated 14.09.2004, this is to announce that henceforth the Government will allow concession on supervision charges levied by Transport Department (SNT Division) for transportation of raw materials such as cement, bricks, etc. only for the purpose of construction of buildings for religious purpose, educational institutions, hospitals, destitute homes (by private parties) or any other benevolent or social activities for the cause of humanity. The concession will also be extended to BPL category certificate holders of Sikkimese origin. To avail the concessional rate, the applicants will have to submit approved Blue Print Plan (BPP) from the UD&HD or a report from the District Collector concerned that his/her house is being constructed for individual personal use other than commercial purpose. The concessional rate of supervision charges will be @ � 0.35 per ton/per km for transportation of material from Siliguri to any destination within the State of Sikkim. The total load permissible is 8 tons and maximum number of transportation allowed to a single individual is 5 trips only. NOTIFICATION

WHEREAS, the Forest Environment & Wildlife Management Department fixes the rates of royalty on different categories of timber and other forest produce levied from persons consuming them for different purposes. AND WHEREAS, there is increase in the rates of all commodities during the past few years and since the Government is trying to raise more resources, it is felt necessary to increase the royalty rates on all categories of timbers/trees and other forest produce like sand, stone etc. Most of the revenue is realized from sand and stones and there is not much scope to increase the number of locations for collection of sand and stones. AND WHEREAS, The royalty rates were last revised in the year 2006 when the minimum wage rate was Rs.85.00 which has been revised twice after that in 2008 and in 2010 to Rs. 100.00 and Rs. 130.00 respectively. The increase in the minimum wage rate in 2010 as compared to 2006 is about 53%. The pay and allowances of the employees have also increased considerably. NOW THEREFORE, to mobilize additional resources the royalty rates of all forest produce available within the State, the import fee of the forest produce brought from outside and all other fees to be levied by Forest, Environment and Wildlife Management Department have been enhanced by minimum of 30% over the existing rates and the enhanced rates are fixed as under with immediate effect. The State Government is hereby pleased to constitute the following committees to oversee the implementation of organic farming programmes in the State of Sikkim with immediate effect.

I. STATE LEVEL APEX COMMITTEE (SLAC) 1. Hon’ble Chief Minister Chairman 2. Hon’ble Minister, FSAD and HCCD Vice Chairman. 3. Hon’ble Ministers, RMDD, AHLF & VS, Members. Science and Technology, FEWM 4. Chief Secretary Member. 5. Additional Chief Secretary-cum- Development Commissioner Member. 6. Secretary-in-charge, FRED Member. 7. Secretary-in-charge, FSADand HCCD Member Secretary. Terms and reference of SLAC.

1. The State Level Apex Committee (SLAC) shall be the policy making body giving overall direction and guidance to State level Steering Committee and the Executing body of Sikkim Organic Mission for effective implementation of Organic farming programmes.

2. The committee shall meet once every year to provide overall guidance, monitor and review the programmes.

III. Sikkim Organic Mission(SOM) Executing body of the mission.

contract. Terms of reference of Sikkim Organic Mission.

1. Sikkim Organic Mission will be the overall Nodal agency for promoting organic farming in the state of Sikkim and to introduce, promote and adopt appropriate technologies for improving the production, arrange , organize and undertake all activities related and necessary for improving all aspects of organic production of various commodities in the state.

2. The mission will endeavour to promote organic farming in all fields of land use under agriculture and allied sectors for promotion of organic farming in the state, network and liaison with various departments of the state.

3. Promote, organize and nurture the institutions outside the Government like Cooperatives, NGO, Voluntary organization, Processing units, Boards etc for facilitation of all necessary inputs required for backward and forward linkages related to organic products so as to provide services within easy reach of the farmers on economically viable basis.

4. Establish the Sikkim Organic brand in the market and secure the interests and identity of Sikkim Organic farmers. Collaborate and network of repute within the country as well as overseas to obtain new technologies and upgrade skills on organic farming and related activities.

5. Establish linkages with National and International research centres, develop, set up and orchestrate a research support programme to ensure improved efficiency and cost reduction.

6. Receive funds from National/State funding agencies and other sources for carrying on the organic farming activities in the state and maintenance of records and accounts and submission of utilization certificate to the concerned agency. Sikkim Organic Mission will work under the guidance of State Level Steering Committee for organic farming for conversion of the state into total organic. Sikkim Organic Mission will oversee and implement all schemes CSS, State Plan(Organic farming), Integrated nutrient Management, Integrated Pest management, Bio-fertilizer and Soil Testing under FSAD and HCCD Departments. The entire fund available under the programme shall be transferred and kept at the disposal of Sikkim Organic Mission for implementation of programmes with immediate effect as per approval of the Cabinet.

7. The mission shall operate in single window system of delivery for effective and faster pace of implementation and all transaction shall be maintained by opening account in the bank authorized by FRED and clearance of Accountant General. N O T I F I C A T I O N The Governor of Sikkim, in supersession of the Home Department Circular No.54(16)Home/88/15 dated 16th June, 1988, is hereby pleased to prescribe the following guidelines for conferment of meritorious service award to the employees of the State Government, namely: -

1. Short title, commencement and application:- (1) These Guidelines may be called the Sikkim Government Employees (Meritorious Service Award) Guidelines, 2010. (2) These shall come into force from the date of their publication in

Official Gazette. (3) These shall apply to the all the regular employees working

under the State Government. 2. Occasion on which meritorious service award is conferred – The

State Government shall confer meritorious service award to its employees on the occasion of the Independence Day and Republic Day only.

3. Eligibility criteria – All regular Government employees who have put fifteen years of regular service or more in the Government shall be eligible to be nominated for the award.

4. Nomination for the Award – The Head of the Department shall forward the nomination of the employees who have performed outstandingly in their assigned sphere of duties duly giving the details in proforma A and Annexures I, II and III appended to these Guidelines to the Home Department at least two months in advance of the Republic Day or the Independence Day, as the case may be, for placing the same before the committee constituted under clause 5.

5. Selection Committee - The selection of employees for the award for

approval of the State Government shall be made by a committee consisting of the following members: -

1. Chief Secretary - Chairman 2. Director General of Police - Member 3. Secretary, Home Department - Member 4. Secretary, Finance, Revenue and Expenditure Department - Member 5. Secretary, Department of Personnel Adm. Reforms and Training - Member 6. Additional Secretary or Joint Secretary (Home Department) - Member Secretary.

6. Entitlement to the Awardee - The award shall carry a citation and such financial incentives to the awardee as the Government may from time to time notify.

North District under National Rural Drinking Water Programme (NRDWP) a Centrally

Sponsored Scheme in the Rural Management and Development Department with

immediate effect, namely:-

Inspector (Photography) in the Pay Band – 2 of ` 9300 – 34800 and Grade Pay of

` 3800 presently held by Shri. Dawa Tamang to that of Inspector (Photography) in the

Pay Band - 2 of ` 9300 – 34800 and Grade Pay of ` 5000 in the CID branch of Sikkim

Police with effect from the date the upgraded post is filled-up through promotion on the

recommendation of Sikkim Public Service Commission.

The above upgraded post shall stand restored as and when the upgraded post is vacated by the incumbent on account of transfer, promotion, resignation and retirement.

NOTIFICATION Whereas the State Government has deemed it expedient to fill up 6 (six) posts of Legal

Officers under the Sikkim State Legal Service Recruitment Rules, 1999 amongst the temporary

employees presently working in the Law Department as Legal Officer under the provision of the

Sikkim State Direct Recruitment (Special Provision) Rules, 2008 read with Office memorandum

No. 1443/GEN/DOP dated: 10/7/2008 after obtaining due clearance from the Sikkim Public

Service Commission; AND WHEREAS normally as a matter of rule, roster points has to be followed while

making direct recruitment; AND WHEREAS adherence to roster point may create administrative difficulty in matter

of the process of consideration for selection/ appointment of temporary employees; AND WHEREAS the age limit for appointment to the post of Legal Officer is 21 to 30

years relaxable by 5 (five) years in the case of BL, ST and SC, 4 (four) years for MBC and 3(three) years for OBC candidates;

AND WHEREAS some of the legal officers has already crossed the prescribed age limit; AND WHEREAS the required Educational and other qualification for appointment to the

post of Legal Officer is Degree in Law with 3 (three) years of practice as an Advocate; AND WHEREAS some of the Legal Officers do not possess the required qualification

namely three years of practice as an Advocate; AND WHEREAS the State Government has deemed it expedient to fill up 6 (six) posts of

Legal Officer by relaxing the provisions of roster points, age limit and educational and other qualifications in terms of clause 2 and 3 of the Officer Memorandum No. 1443/GEN/DOP dated: 10/7/2008;

AND WHEREAS rule 5 of the Sikkim State Legal Service Recruitment Rules, 1999 and rule 3 of the Sikkim State Direct Recruitment (Special Provisions) Rules, 2008 provides for relaxation of any of the provision of the rules. Now, therefore, in exercise of the powers conferred by rule 5 of the Sikkim State Legal Service Recruitment Rules, 1999 read with rule 3 of the Sikkim State Direct Recruitment (Special Provisions) Rules, 2008 and clause 2 and 3 of the Officer Memorandum No. 1443/GEN/DOP dated: 10/7/2008 ,the State Government is hereby pleased to relax the provision relating to roster points, age limit and educational and other qualifications with a view to fill-up 6 (six) posts of Legal Officer from amongst the Legal Officer working in temporary capacity against the posts in the Law Department in consultation with the Sikkim Public Service Commission. And whereas rule 18 of the Sikkim Sub-ordinate Forest Service Rules,

1996 provides for relaxation of rules;

Now, therefore, in exercise of the powers conferred by rule 18 of the Sikkim Sub-ordinate Forest Service Rules, 1996 read with clause 3 of Office Memorandum No. 1443/GEN/DOP dated: 10/7/2008, the State Government is hereby pleased to relax the roster point with a view to fill-up 6 (six) posts of Block Officer from amongst the persons presently working in temporary capacity against the post in Forest, Environment and Wildlife Management Department . In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Sikkim hereby makes the following rules further to amend the Sikkim State Architect Service Recruitment Rules, 2001, namely;- 1. (1) These rules may be called the Sikkim State Architect Service Recruitment (Amendment) Rules, 2010.

(2) They shall come into force at once.

2. In the Sikkim State Architect Service Recruitment Rules, 2001, in the Schedule, -

(i) against serial number 3, , under the column “7 ”, for the existing entries, the following shall be substituted;

“No officer of the Senior Grade shall be considered for promotion to the Selection Grade- II, unless ;-

(a) he / she has put in 6 (six) years of continuous service in the

Senior Grade; or (b) he/ she has put in 14 (fourteen) years of continuous service in the

Service whenever there is no member who fulfils the conditions at (a) above

subject to availability of vacancy . (c) he/she should have worked in the Senior Grade for atleast one year

in the substantive capacity ”; (ii) against serial number 4, under the column “7 ”, for the existing entries, the

following shall be substituted, namely;-

“No officer of the Selection Grade- II shall be considered for promotion to Selection Grade- I, unless;- (a) he / she has put in 4(four) years of continuous service in the

Selection Grade- II, or (b) he/she put in 18 (eighteen) years of continuous service in the Service

when there is no member who fulfils the conditions at (a) above subject to availability of vacancy.

(c) he/she should have worked in the Selection Grade-II for atleast one year in the substantive capacity ”;

(iii) against serial number 5, under the column “7”, for the existing entries, the following shall be substituted, namely;-

“No officer of the Selection Grade- I shall be considered for promotion

to Supertime Grade- II, unless;- (a) he/ she has put in 4 (four) of years continuous service in Selection

Grade I, or

(b) he/she put in 22 (twenty two) years of continuous service in the Service when there is no member who fulfils the conditions at (a) above subject to availability of vacancy.

(c) he/she should have worked in the Selection Grade-I for atleast one year in the substantive capacity ”;

NOTIFICATION In exercise of the powers conferred by the proviso to Article 309 of the

amend the Sikkim State General Service Rules, 1997, namely .-

1. (1) These rules may be called the Sikkim State General Service (Amendment)

Rules, 2010.

(2) They shall come into force at once. 2. In the Sikkim State General Service Rules, 1997, in Schedule-II;-

(i) under the heading “SELECTION GRADE- II: Rs. 11000-350-16250”, for the existing entries, the following shall be substituted, namely:-

This shall be the scale of pay for the post of Joint Director.

No officer of the Senior Grade shall be considered for promotion to the Selection Grade- II unless ;-

(a) he / she has put in 6 (six) years continuous service in the Senior Grade or

(b) he/ she has put in 14 (fourteen) years of continuous service in the service whenever there is no member who fulfils the conditions at (a) above.

(c) he/ she should have worked in the Senior Grade for atleast one year in the substantive capacity

(ii) under the heading “SELECTION GRADE- I: Rs. 12500-375-17000”, for the existing entries, the following shall be substituted, namely:-

This shall be the scale of pay for the post of Additional Director.

No officer of the Selection Grade-II shall be considered for promotion to the Selection Grade- I unless ;-

(a) he / she has put in 4 (four) years continuous service in the Selection Grade-II or

(b) he/ she has put in 18 (eighteen) years of continuous service in the service whenever there is no member who fulfils the conditions at (a) above.

(c) he/ she should have worked in the Selection Grade-II for atleast one

year in the substantive capacity 5. under the heading, “SUPERTIME GRADE-II: (Rs. 14300-400-18300)”, for the

existing entries, the following shall be substituted, namely:-

This shall be the scale of pay for the post of Director.

No officer of the Selection Grade- I shall be considered for promotion to

Supertime Grade- II;-

(a) unless he/ she has put in 4 (four) years continuous service in

Selection Grade I, or

(b) he/she put in 22 (twenty two) years of continuous service in the service

when there is no member who fulfils the conditions at (a) above.

(c) he/ she should have worked in the Selection Grade-I for atleast one year

in the substantive capacity.”

1. (1) These rules may be called the Sikkim State Fisheries Service (Amendment) Rules,

2010. (2) They shall come into force at once. 2. In the Sikkim State Fisheries Service Rules, 2008, in Schedule II, -

(i) against serial number 2 under the column “Eligibility condition”, for the existing entries, the following shall be substituted, namely;-

“No Assistant Director (Fisheries) shall be considered for promotion to the post of Deputy Director unless he / she has put in 6 (Six) years of continuous service in that grade and subject to availability of vacancy.” ;

(ii) against serial number 3, under the column “Eligibility condition ”, for the

existing entries, the following shall be substituted, namely;-

“No Deputy Director (Fisheries) shall be considered for promotion to the post of Joint Director, unless ;-

(a) he / she has put in 6 (six) years of continuous service in the Senior Grade; or (b) he/ she has put in 14 (fourteen) years of continuous service in the Service

whenever there is no member who fulfils the conditions at (a) above subject to availability of vacancy .

(d) he/she should have worked in the post of Deputy Director for atleast one year in the substantive capacity ”;

(iii) against serial number 4, under the column “Eligibility condition ”, for the existing entries,the following shall be substituted, namely;-

“No officer of the Supertime Grade- II shall be considered for promotion to Supertime Grade- I, unless ; -

(a) he / she has put in 2 (two) years of continuous service in the Supertime Grade - II, or

(b) he/she has put in 26 (twenty six) years of continuous service in the Service when there is no member who fulfils the conditions at (a) above subject to availability of vacancy.

(c) he/she should have worked in the Supertime Grade-II for atleast one year in the substantive capacity ”;

(v) against serial number 2, under the column “4”, for the existing entries, the following shall be substituted, namely;-

“No officer of the Selection Grade- I shall be considered for promotion to Supertime Grade- II, unless;- (a) he/ she has put in 4 (four) of years continuous service in Selection

Grade I, or

(b) he/she has put in 22 (twenty two) years of continuous service in the Service when there is no member who fulfils the conditions at (a) above subject to availability of vacancy.

(c) he/she should have worked in the Selection Grade-I for atleast one year in the substantive capacity ”;

1. In pursuance of sub-rule (5) of rule 7 of the Sikkim Sub-ordinate (Ministerial and

Executive) Service Rules, 1984, the rules for Limited Departmental Competitive Examination to be held in 2010 for preparation of panel for the post of Head Assistants and equivalent in the Grade-II of the Sikkim Sub-ordinate (Ministerial and Executive) Service are published for general information.

2. The examination will be conducted by the Promotion Committee constituted in

accordance with the Schedule-II of the Sikkim Sub-ordinate (Ministerial and Executive) Service Rules, 1984 in the manner prescribed in the Appendix to these Rules. The dates on which and the place at which the Examination will be held shall be fixed by the Promotion Committee.

3. Permanent official appointed on regular basis as U.D.C. and equivalent/

Panchayat Supervisor/ Registration Clerk/ Revenue Peshkar/ Confidential Assistant (Grade-III) who as on 31/12/2010 complete not less than 4 years regular service in the Grade shall be eligible to appear at the Examination for promotion to the Grade-II.

The decision of the Promotion Committee as to the eligible or otherwise of a

candidate for admission to the Examination shall be final. 4. No candidate will be admitted to the Examination unless he/she holds certificate

of admission from the Promotion Committee/ Department of Personnel, Adm. Reforms and Training.

5. The minimum qualifying marks in such paper of written examination shall be

30% of the total marks allotted to each paper. The Promotion Committee shall, however, call for interview and or evaluate ACRs/ Service Records of those candidates who secure minimum 40% of grand total marks allotted for written examination.

6. After the examination, candidates will be arranged by the Promotion Committee

in the order of merit as disclosed by the aggregate marks finally awarded to each candidate (i.e.marks allotted on written examination and Interview/ evaluation of service records) and in that order the Promotion Committee shall recommend the candidate for inclusion in the Panel for each Grade.

NOTE : Candidates should clearly understand that this is a competitive and not a qualifying examination. The number of persons to be included in each panel on the result of the examination is entirely within the competence of the Competent Authority to decide. No candidate will therefore have any claim for inclusion the panel on the basis of his performance in this examination as a matter of right.

7. The form and manner of communication of the result of the examination to

individual candidate shall be decided by the Promotion Committee in their discretion and the Committee will not enter into correspondence with them regarding the result.

8. Success in the examination confers no right to selection unless the competent

authority is satisfied, after such enquiry as may be considered necessary, that the candidate having regard to his conduct in service is eligible and suitable in all respect for selection.

9. Candidates are allowed to refer Rules/ Notes and also use calculators. 10. A candidate seeking admission to the examination must apply to the Deputy

Secretary, Department of Personnel, Adm. Reforms and Training, Government of Sikkim in the prescribed form of application. Specimen of the prescribed form of application is given at Appendix-II. Application on other forms other than the one prescribed for this examination will not be entertained.

11. The completed application form must reach the Department of Personnel, Adm.

Reforms and Training, Government of Sikkim, Gangtok and obtained an acknowledgement on or before 31/12/2010. No application received after 3.00 P.M. of the specified date will be considered.

APPENDIX-I

The examination shall be conducted according to the following scheme:-

4. Candidates must write the paper in their own hand. In no circumstances they will be allowed the help of a scribe to write answer for them.

SCHEDULE

NOTIFICATION

The implementation of the High Security Registration Plate Project (HSRP) in the State of Sikkim in respect of all motor vehicles was made initially effective from 14th October, 2008, vide Notification No. 94/MV/T, dated: 01.10.2008. As per Government regulation, all the old and new vehicles including Government and Private Sector Undertakings have to affix new high security registration plates in their vehicles.

Despite repeated reminders to affix the HSRP a large number of Government vehicles have not complied with the directive of Motor Vehicle Division, Transport Department. As per the order of the Hon’ble Supreme Court of India, the deadline set for completion of affixation of HSRP is February 2011. Hence, all the Government vehicles are required to be fitted with High Security Registration Plates within 31st December 2010.

Renewal of Tax will be entertained on affixation of HSRP only, after the dateline of 31st December 2010 if not the Motor Vehicle Division, Transport Department will be compelled to seek the assistance of Police for its effective implementation in accordance with Rule 50 of the Central Motor Vehicles Rules, 1989.
