Inspection Note of Shri Vipin Saxena, I.A.S., Hon’ble Member,

Board of Revenue, Odisha, Cuttack on the office of the

Revenue Divisional Commissioner, Northern Division, Sambalpur.

Date of Inspection : 17th November, 2016.

1. Introduction :

The office of the Revenue Divisional Commissioner, Northern Division, Sambalpur

started functioning as per Notification No.NBo.10838, dgt.30.08.1957 of Govt. in Political &

Services Department, Odisha, Bhubaneswar published in Odisha Gazette Extra-Ordinary issue

No.322, dt.30.08.1957 having its Headquarters at SAMBALPUR.

This Revenue Division consists of originally five districts namely Sambalpur,

Sundargarh, Keonjhar, Balangir and Dhenkanal. But, after new organization of District

Administration, these Districts were bifurcated and at present, 10(Ten) Districts as detailed

below are under its administrative control.

Subsequently, the District of Sonepur was renamed as Subarnapur vide Govt. in

Revenue Department Notification No.40878/R, dt.19.10.2014.

2. Accommodation :

This office is functioning in three buildings located in one campus i.e Main

building (erstwhile Political Agents’ Building), Hirakud Land Organisation Building and

Rengali Bhimkund Irrigation Project Building.

The State Administrative Tribunal is also functioning in this complex on last

Monday of every month while in Circuit.

Shri Bhaskar Jyoti Sarma, I.A.S has assumed the charges as Revenue Divisional

Commissioner (Northern Division), Sambalpur on 08.07.2016 A.N. Prior to him Sri N.B.S Rajput,

I.A.S was the Revenue Divisional Commissioner(Northern Division),Sambalpur from 16.01.2015

to 08.07.2016.

4. Inspection :

The then Hon’ble Member Dr. Aurobindo Behera IAS had inspected this office

on 30th –Dec- 2011 and the note was released vide letter no. 419/Ins 1.3.2012 of Deputy

Secretary of Board of Revenue. The compliance report thereof has already been submitted vide

this office letter no. 863/Gen 23.7.2014.

As per instruction issued by Govt. in Revenue& Exercise Department Letter

No. 28594/R dated 19.06.1997, the Revenue Divisional Commissioner is required to inspect the

following offices during a year.

1. Own Office and court Once a year. 2. Office and Court of Collector Once a year excepting one to be inspected by

Member,Board of Revenue. 3 Office of Sub-Collector Any five within the Division Once a year excepting one to

be inspected by Member,Board of Revenue . 4 Tahasil Offices Any five within the Division Once a year excepting one to

be inspected by Member,Board of Revenue. 5 Block Offices Any five selected Blocks within the Division. 6 Muncipalities/NACs Once a year any five Muncipalities/NACs in the

Division.The RDC may however authorize his Secretary/Addl .Secretary to insplect any of the Muncipalities/NAC programmed for inspection provided the Secretary/Addl. Secy. is senior in rank to the Executive Officer Concerned.

Besides this, Govt. in Revenue Department vide their letter no. 40754/R

dated 30.07.1999 have prescribed inspection of District Sub-Registrar Offices by the

Revenue Divisional Commissioner Office once a year. As per instruction of Govt., RDC is

required to inspect 41 offices including his own office. during a Calander year

As per programme of 2015 Calander year ,Out of 31 offices including his

own Office ,RDC had inspected only eight Collectorate offices of his division making a

short fall of 23 offices for inspection.

During the Year 2016, RDC has inspected four Offices (i.e two

Collectorate i.e Keonjhar and Dhenkanal and one Tahasil and one Muncipal

Corporation Rourkela). The Inspection Note of Badbil Tahasil and Collectorate

Dhenkanal are yet pending for release of the Notes.

Half Yearly Inspection of own Office by the Officers-in-Charge for half year ending

The OICs of the concerned sections have not conducted half yearly inspection on

their respective sections.

6(F) of the Explosive Act 1884. Besides R.D.C., Northern Dvision has been vested with the

needs priority for disposal of certificate and O.G.L.S. appeal cases.

The pendency of cases U/s 15(b) of O.S.& S. Act is showing an increasing trend.

As many as 1152 cases U/s 15(b) of OSS Act and 161 cases U/s 37(1) of OCH & PFL Act is

pending as on 01.11.2016. All out efforts should be made for disposal of the cases giving utmost

priority to the year-old cases.

CASE REVIEW :

O.L.R. Revision No.1/2010 :

This is a peculiar case filed U/r 38(2)(bb) of Odisha Land Reforms Rules for cancellation

of patta issued by the Tahsildar, Bheden in respect of land purchased by Kusu Surya Rao in

Registered Sale Deed No.1765 dated 06.03.1966.

The case in a nutshell is that Kusa Surya Rao had purchased an area of Ac.7.12 dec.

of land comprising of four plots in respect of Hamid Settlement Khata No.1 of village

Deshkumbhari from one Jagamohan Hota of the village. The Hamid land corresponds to an area

of Ac.6.98 under Hal Holding No.168 of the village.

The vendor of the sale deed dated 06.03.1966, Jagmohan Hota was a ceiling surplus

land owner and while deciding the O.L.R. Case No.2530 of 1976, the suit land was declared as

ceiling surplus land and vested with Government. When the purchaser came to know about such

vesting of the purchased land as ceiling surplus, he filed a review petition before the Tahasildar,

Bheden to exclude the said land from the ceiling area as the sale was made prior to the

appointed date i.e. 26.09.1970. On reviewing the petition, the Tahasildar vide his order dated

24.07.1990 considered the petition and passed order to exclude the purchased land of Ac.6.98

dec. from the ceiling area. But the order of Tahasildar could not be materialised as correction of

the concerned R.O.R. was not made. Subsequently, the said area was amalgamated in

Government holding of Abadayogya status in the process of Consolidation Operation and

recorded under Government Holding No.231, Plot No.119(p) Ac.1.83, 156(p) Area Ac.1.76, Plot

No.568(p) Ac.1.85 totallig Ac.5.82 dec. as per the Consolidation R.O.R. under Abadayogya

status.Later, Tahasildar, Bheden without making detailed enquiry and status of the land in the

field, settled the land in favour of six allottees i.e. O.P. No.3 to 8 as per O.G.L.S. Act.

Against the aforesaid order of settlement, one of the petitioners, K Suryachandra Rao

filed a petition before the Sub-Collector, Bargarh which was sent to Tahasildar, Bheden for

further action. In turn the Tahasildar, Bheden vide his order dated 06.06.2001 passed in O.L.R.

Case No.2530 of 1976 rejected the application stating that he had no jurisdiction to entertain the

claim of the applicant. Against the said order of Tahsildar, Bheden, the petitioners filed a writ

before the Hon’ble High Court vide W.P.(C) No.9300 of 2009. In Misc. Case No.7388 of 2009

ariseing out of the said writ, the Hon’ble High Court vide order dated 09.07.2009, has directed to

maintain status-quo with regard to possession of the property as mentioned in the writ.

The applicants have assailed that as they have been in possession of the case land

since the date of purchase i.e.06.03.1966 prior to the appointed date i.e. 26.09.1970 and as the

Tahasildar, Bheden passed order on 24.07.1990 to exclude the case land from the ceiling

surplus area of the vendor/land owner while reviewing the O.L.R. Case No.2530/1976, there is

no illegality in cancelling the Pattas issued to the O.Ps No.3 to 8 u/r 38 (2) (bb) of the OLR

Rules. The O.Ps have however denied it on the ground that as the case is subjudice in the High

Court, the present case need not be disposed of.

Since the case is subjudice in the higher forum, further course of action is held up

awaiting the decision of the Hon’ble High Court.

O.G.L.S. Appeal No.3/2015 :

This case has been instituted on the petition filed by the Government Pleader, Sambalpur

on behalf of the District Education Officer, Sambalpur against the order of Collector, Sambalpur

dated 26.09.2012 in O.G.L.S. Case No.4 of 2012 confirming settlement of Ac.4.81 dec. of land

as per Sabik records corresponding to Ac.4.206 dec. of land out of M.S. Khata No.1127 of

Sambalpur Unit No.6.

The case is that an area of Ac.4.81 dec. of government land was sanctioned in favour of

Managing Committee of Hindi Boys’ High School at Sambalpur town vide Revenue Department

G.O. No.5567 dated 03.12.1945 free of premium and rent etc. and leased agreement was

registered on 24.07.1946. The lease agreement was executed between Deputy Commissioner

(now Collector), Sambalpur and Prahalladrai Lath, President of the Managing Committee. In the

year 1974, Onkarmal Poddar claimed to be President of the high school and absolute owner of

the property executed a trust deed bearing No.718 of 1974. During the current settlement

operation the Khata No.1127 of Sambalpur Unit No.6 has been recorded in the name of Hindi

Boys’ High School Trust Board on the basis of the sanction order dated 03.12.1945 in the

Column-6 of the R.O.R. Subsequently, the management of the High School has been taken over

by government vide Resolution No.38522 dated 16.12.1994 and accordingly all assets were

handed over to government through Inspector of School, Sambalpur on 17.05.1995. During

1997, the Trustee cum Secretary namely, Nandalal Agrawal filed a O.J.C. vide 762 of 1997

before the Hon’ble High Court, Orissa on which an order was passed on 12.09.2001 to maintain

status-quo as existed on that day. While the writ is pending, Nandalal Agrawal filed an

application before the Tahasildar, Sambalpur for conferring of rayati status of the Nazul land in

favour of the trust under the provision of O.G.L.S. (Amendment) Act 2009 and Rules 2010.

O.G.L.S. Case No.4 of 2012 was registered and the case was recommended to Collector,

Sambalpur on 18.05.2012 through Sub-Collector, Sambalpur. The Collector, Sambalpur passed

order on 20.06.2012 i.e. within one month from the date of recommendation of the Tahasildar

and Sub-Collector, settled the case land on rayati status in favour of Nandalal Agrawal.

Finding the orders of the then Collector whimsical, illegal, improper, arbitrary and

misconception of law, the District Education Officer, Sambalpur has preferred this appeal before

the R.D.C. through the Government Pleader. The case is heard on the point admission and has

been admitted having condoned the delay. The is kept for hearing on merits.

In the meantime, the O.P. has gone to the Hon’ble High Court vide W.P.(C) No.1315

of 2016 on the maintainability of the appeal. The Hon’ble High Court having disposed of the writ

directed R.D.C. to dispose of the original appeal in accordance with law by giving due

opportunity to the parties and to complete the case by December, 2016.

The case land appears to be a most valuable land in the heart of Sambalpur town. The

R.D.C. is directed to take sincere efforts for disposal before the time fixed by the Hon’ble High

Court.

Consignment status of disposed case records:

All cases records of revisional cases disposed of up to 31.12.2015 have been

consigned to the Record Room.

Computerization of case records:

Installation of equipments for data entry and scanning has been completed by the NIC

personnel in the last week of February, 2016. 1158 case records having approximately 30,108

pages have been scanned during the period from 01.03.2016 to 28.10.2016.There is a balance

of 350 cases having approximately 10,500 pages yet to be scanned. Entry of data has not been

started as the software has not been developed yet.

Utilization of Data Management Assistants:

Both the Data Management Assistants are being engaged in scanning of case records.

Their performance is given in the above Para. Data entry work has not been started due to

non-development of software.

During the year 2015-16, the collection under Part-I is Rs.1969.90 lakhs against the total demand of

Rs.3090.21 lakhs. The collection towards arrear is about 26.76% only. The collection towards arrear is not

satisfactory against the demand. Board has instructed for 100% collection of arrears. The RDC may analyse the

reasons for such low collection of arrear dues.

During the year 2015-16 the collection is Rs.1024.28 lakhs against the demand of Rs.2747.89 lakhs. The collection towards arrear is about 24.54 % against the arrear demand. Hence, the collection towards arrear is not satisfactory. The RDC, ND is requested to ensure for enhancement of collection of arrear dues.

It is observed that collection of arrear during the year 2016-17 (upto 30.09.2016) is Rs.46.47

lakhs against the arrear demand of Rs.6490.47 lakhs and the percentage of collection of arrear is 0.72%

which is very low. Reasons for such poor percentage of collection may be analysed and steps may be

taken for increase of collection of arrears of revenue.

The arrear collection under Part-III is Rs.192.37 lakhs against the demand of Rs.1753.22

lakhs and the percentage collection is 10.97 only. Similarly, the current collection is Rs.298.97

lakhs against the current demand of Rs.1046.52 lakhs which is 28.57 % only. The percentage

of collection in both the cases is very poor.

The RDC is advised to monitor the collection of his Division to ensure cent percent

collection as per the target fixed by the Board of Revenue.

The percentage collection of arrear revenue in all cases is not satisfactory. The

RDC may analyse the reasons for such poor collection of revenue.

The RDC is advised to monitor the collection of his Division to ensure cent percent

collection as per the target fixed by the Board of Revenue.

8. Annual Land Revenue Administration Report:

As per paragraph 147 of the Manual of Tahasil Accounts, the Tahasildars as well as

Collectors are required to submit a special report i.e. Annual Land Revenue Administration

Report only after completion of annual verification of account. Accordingly, this report is to be

submitted by the Collectors to R.D.C. by September of succeeding financial years. The said report

is expected from the R.D.C. by 15th November, every years as per G.O. No.7786/R.,

dt.20.01.1997.

It is reported that the Land Revenue Administration report fro the year 2006-2007, 2007-

2008, 2008-2009, 2009-2010 and 2010-2011 has been sent to Board of Revenue, Odisha, Cuttack.

The Land Revenue Administration report relating to year 2011-2012 and 2012-2013 is said to be

under process. R.D.C., is requested to remind the defaulting Collectors to furnish the Annual Land

Revenue Administration in time.

9. Irrigation:

There are three major irrigation projects, namely,Hirakud Dam Project (which irrigates

Bolangir, Bargarh, Subarnapur, Sambalpur and Jharsuguda District), the Salandi Irrigation

Project (which irrigates Keonjhar district) and Rengali Dam Project (which irrigates Deogarh,

Angul & Dhenkanal district) under this division.

From the above table it is seen that out of total certified area Ac.883061,under this

division, an area of Ac.712144 has been assessed towards CBWR . An Area of Ac.153591 is

found unfit for assessment till 30.10.2016. The area unfit for assessment seems to be quite

large. The inter district variation also has to be closely looked into. The highest pendency for

assessment i.e. Ac.39840 is in Keonjhar district.

From the above table, it seen that an area of Ac.94254 of Govt. land,Ac.55615 of High

land and Ac.3715 of other types of land are unfit for assessment.

Govt. and measuring Ac.94264 is shown as unfit for assessment. The matter has to be

critically examined taking into the account the actual field position through verification by the

revenue authorities. The major part of 94264 acres of Govt. land in the irrigated ayacut could be

under encroachment.

During the last five years substantial allocation of funds was made for command area

development, especially in the Hirakud Command. It needs to be verified if more areas can be

assessed for water rate due to the execution of command area development programmes.

The highest area pending for assessment for Rabi water rate is in Deogarh district i.e.

6880 followed by Subarnapur(Ac.3032) Sambalpur(Ac.1007) and Bolangir (Ac.648).

10. Sairat :

Settlement of Sairat Sources for the financial year 2015-16 in respect of Northern Division.

From the table it is seen that, during the year 2015-16, 17909 sairat sources existed in

the Division. During the year, 15728 sources transferred to Gram Panchayats leaving a balance

of 2181 sources and 212 nos. of sources declared extinct and 10 new sources detected. Out of

total 1979 sources, 701 sairat sources settled during the year leaving a balance of 1278 sources

for settlement.

Settlement of Sairat Sources for the year 2016-2017 up to 30-09-16 in respect of Northern Division.

During the year 2016-17 (up to 30.9.2016), 1121 sources are pending for settlement after

335 nos. of sources are declared extinct. It is seen from the table that, 259 sairat sources in

Keonjhar district could not be settled in the year 2015-16 and 240 nos. of sairat sources during

the year 2016-17. The number of unsettled sairat sources came down to 240 nos. in this

district. The reason for such large number of unsettled sairat sources may be ascertained.

It is observed that, disposal of cases and collections are decreasing gradually. The

Collectors concerned may be instructed to expedite the disposal of cases and collection of

government dues.

Certificate dues of Rs.13324.18 crores have been locked up in 27808 cases is really

matter of concern.

All the Collectors of the Division may subtly be instructed for disposal of the pending

certificate cases as quickly as possible so that an handful amount of money will be acquired to

the State Exchequer.

It is revealed form the above statement that advance possession of Govt. .land has

been given in 212 cases involving in an area of Ac.8241.584 in Northern Division. The highest

pendency in terms of number of cases is in Sambalpur District (107) followed by Angul

district(51) and Dhenkanal district(15). Similarly, in terms of extent of area given as advance

possession, the highest pendency is in Balangir district (Ac.3640.79 in 13 cases) followed by

Settlement of encroached Govt. land in the rural areas for the year 2015 is shown as Nil

in all the districts except Keonjhar, Sambalpur and Subarnapur. It implies that the Tahasildars

are not applying their mind as per the provision of OPLE Act. The encroachment in Rural areas

can be settled with the eligible encroachers as per the provisions laid down in the Act. In the

District Revenue Meeting, this point should be disposed of and examined. Nil report in

It is seen that except Keonjhar district, no settlement of land has been made in other districts. Endeavour

should be made to settle the encroached Govt.land in favor of the genuine and eligible encroachers as per the

provisions of OPLE Act/Rules and Executive instructions issued by Govt. from time to time.

It appears from the above table that out of total cases of 38724 involving in an area of

Ac.118621.748, 35698 cases involving an area of Ac.109913.21 have been disposed of leaving

a balance of 3026 cases with an area of Ac.8668.538.The highest number of pending cases is in

Dhenkanal District (2359 cases) followed by Keonjhar district (430 cases) .Concerned Collectors

may be instructed to dispose of the pending cases within a time bound period.

It is ascertained from the above tables for the year 2015 and 2016 (up to

31.10.2016) that the correction of RoRs in this Division is satisfactory. However, the Collectors

concerned may be instructed to expedite the disposal of pending cases for correction of RoRs.

17. LAND ACQUISITION :

Prior to 31.12.2013, private land acquired for different projects like Industries,

Major Irrigation Projects, Minor Irrigation Projects, Railways, National High Way and State

Highways etc are being dealt as per the provision made in the Land Acquisition Act, 1889. Later

on the Odisha Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation

and Resettlement Act, 2013 came into force with effect from 01.01.2014 .Accordingly, private

land are being acquired for different projects as per the provision of the Act.

As per the provisions under Sub-Section (I) of section 44 of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation & Resettlement Act-2013,

the Revenue Divisional Commissioners have been appointed as “Commissioner for

Rehabilitation and Resettlement” within their respective jurisdiction to exercise the powers and

perform the functions of the Commissioner for Rehabilitation and Resettlement under the Right

to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement

Act, 2013 vide Govt. in R&DM Deptt., Odisha Bhubaneswarr Notification No.19436 /R&DM

dt.25.6.2016. Accordingly 10 Nos. of proposals in respect of Sambalpur-Titilagarh Railway line

have been countersigned by the Revenue Divisional Commissioner as Commissioner (R& R).

It is seen from the table that 35624 Ceiling cases were registered since inception of OLR

Act out of which 30,579 cases were dropped , 4441 cases finally published, and 604 cases are still

pending for disposal. The highest number i.e. 518 cases are pending in Jharsuguda district. The

Collectors concerned should be instructed to dispose of these pending cases as shown in the table.

It is seen from the above table that 153 dropped Ceiling Cases are pending in different districts for

review. The highest No. of 115 cases are pending in Bolangir district. The Collectors should be

impressed upon to undertake the review of balance dropped Ceiling Cases within six months.

number of 1961 cases leaving a balance of 1099 cases. The percentage of disposal is 43.95 of the Division. Field

It is seen that large amounts of Govt. money have been given as advance to the

staff and the same are pending for recovery for years together. The Officer-In-Charge as well

as the RDC, ND, Sambalpur should take immediate steps for adjustment/recovery of the Govt.

money lying with the employees. It must be ensured that the bill/vouchers are submitted

immediately otherwise that amount may be recovered from their salary.

It is also suggested to submit the monthly expenditure statement with T.V. No. to

the controlling authority in time for necessary verification of expenditure with A.G., Odisha,

Bhubaneswar.

22. VEHICLE:

There are 3 (Three) numbers of vehicles used in the office of the RDC, ND,

Sambalpur as per lit given below.

3. OD-15-G-0055- Maruti Swift Dezire (Petrol) (New)

RDC, ND, brought to my notice that one of vehicle of the RDC’s Estt. bearing No.

OR-15-C-2727 Ambassadar (Diesel) car has been auctioned and the auctioned money of the

condemned vehicle has been deposited in the proper head. The new vehicle i.e. Maruti Swift

Dzire (Petrol) car bearing No. OD-15-G-0055 has been purchased on replacement of the old

condemned Ambassador car.

4. Consignment of Files, Register and Records :-

The Consignment of files , registers and records to the Record Room has been

made up to the year 2011 vide office order No 846 (General ) Record Room dated 5.8.2015 in

File No XVII-11/2016. Steps should be taken to consign the records due for consignment .

The provision laid down in the Odisha Records Manual, 1964 relating to

consignment of records may strictly be followed.

5. Quinquennail Revision Register :-

All the ‘A‘ Class files from the year 1956 to 1964 have been sorted out.

Effective steps should be taken for proper destruction of records after observing all

formalities for management of space for preservation of records conveniently.

6. Destruction of ‘B’ Class files :-

The Destruction Register is being maintained by Record Room section wise and

Volume wise in this office. 9,481 nos of ‘B’ class files up to the year 2003 have been

destroyed by fire after following all formalities as proviso under concerned Paras of Orissa

Records Manual, 1964. 3,550 Nos files [Revenue-A Branches (1360), Budget

Branch (976), Development Branch (477) and Establishment-B Branch (737)] are pending due

to non-submission of views from concerned Section Officers as per O.R.M. 1964. After

obtaining views as per O.R.M-1964, these files will be destroyed by fire.

The Revenue Divisional Commissioner is requested to ensure timely submission

of views of the Section Officers concerned for destruction of the said files.

26. Library :

Library Section is accommodated in the defunct H.L.O building having

one big hall and three small rooms. There are two fire extinguishers in the library and

these were refilled on 31.7.2015.

Sri Sanjeeb kumar Sahoo, Senior Asst. is in Additional charge of Library since

2.1.2003 .

Library books have been kept in three rooms with 14 steel almirahs,12 wooden

Almirahs,16 Steel racks and 32 wooden racks. Most of the wooden racks and almirahs have

been damaged. It is necessary to replace the damaged wooden almirahs with steel almirahs or

racks.

There are about 17204 books are now available in the library. The

following registers are maintained in the library:

1. Stock Register 2. Issue Register 3. Catalogues 4. Register for correction slip

The Registers as noted above have been maintained properly. It is seen that 768

numbers of books have been issued to the staff of this Office till date. Out of which 58 library

books have been returned. Due procedure of ORM has been followed while issuing library books

to the concerned officers of this office.

Adequate safety measures should be installed for ensure prevention of any fire

accident in library.

GENERAL REMARKS :

Northern Division is one of the important Divisions of the State. The inhabitants

of all the Districts coming under its administrative control aspect to have the poetic justice,

heavenly administration and all round development of the Division. The Revenue Divisional

Commissioner, Northern Division, Sambalpur being the administrative head of the Division

may look in to the matter personally to ensure the fulfillment of the aspiration of the inhabitants.

The office of the RDC, ND, Odisha is functioning fairly well. However, the RDC may take

required steps and issue effective instructions to the Officers involved in collection of revenue

to make the collection of arrear and current demand satisfactory for growth of financial stability

of the Government.
