An AcI to provide for the reservation in admission ofthe students belongingto the Scheduled Castes, the Scheduled Tribes and the Other BackwardClasses of citizens, to certain Central Educational Institutionsestablished, maintained or aided by the Central Government, and formatters connected therewith or incidental thereto.

BE it enacted by Parliament in the Fifty-seventh Year of th€ Republic of India as

follows:-

1. 'this Act may be called the Cenral Educational Institutions (ReserYation in short tiue.

Admission) Act, 2006.

2. In this Act, unless the context otherwise requires,- Det-mitions.

(a) "academic session" means the period in a calendar year, or a pan thereoiduring which a Central Educational Institution is open for teaching or instruction in

any branch ofstudy or facul5r;

(6) "annual permited stfength" means the number of seats, in a course orprogramme for teaching or insfuction in each branch ofstudy or hculty authorised

by an appropriate authority for admission of students to a Central Educational

Institution;

(c) "appropriate authority'' means the Univercity Grants Commission, the Bar

Council oflndia tis Medical Council oflndia" theAll India Council for Technical

Education or any other authority or body established by or under a Central Act forthe determination, coordination or mainteDance ofthe standards ofhigher education

in ary Cenrral Educational Institution;

(/) "Ceotral Educational Institution' means-

(r) a university established or incorporated by or under a Ceni-al Act;

(i, all institution ofnational importance set up by an Act ofParliament;

(r'tr) an institution, declared as a deemed University under section 3 ofthe University Grants Commission Act, 1956, and maintained by or receiving 3 of 1956

aid from lhe Ccntral Government;

(rv) an institution maintained by or receiving aid from th€ Central

Govemment, whether dircctly or indirectly, and affiliated to an institution

referred io in clause (r) or clause (lr), or a constitueDl unit of an institutionreferred to in clause (iir);

(v) an educational institution set up bythc CentralCovemment under thc

Societies Registration Act, 1860;

(e) "faculty" means the faculty of a CenEal Educational Institution;

(, "Minority Educational Instilution" means an institution established and

administered by the minoritics under clause (l) ofarticle 30 ofthe Constitution and

so declared by an Act ofParliament or by the Central Government or declared as a

Minority Educational Institutior under the National Commission for MinorityEducalional Inslitutions Act, 2004;

(&l "Other Backward Classes" means the class or classes ofcitizens who are

socially and educationally backward, and are so determined by the CentralGovenunent;

(n) "Schedufed Castes" means the Scheduled Castes notified under article 341

of the Constitution;

(i) "Scheduled Tribes" means thc Scheduled Tribes notificd under article 342

ofthe Constilution;

(/) '"€aching or insEuction in any branch ofstudy' means teaching or instruction

in a branch of sttrdy leading to tfuee principal levels of qualifications at bachelor

(undergraduate) masters (postgraduate) and doctoral levels .

3. The reservation of sea$ ilt admission and its extent in a Central EducationalInstih.rtion shall be provided in the following manner, namely:-

(I) oul ofthe annual permitted strength in each branch ofstudy or faculty, fift€en

per cent. seats shall be reserved for the Scheduled Castes;

(ri) out of the arrnual permitted strength in each branch of study or faculty,seven and one-halfper cent seats shall be reserved for the Scheduled Tribes;

(ri, out of the aaaual permitted strength in each branch of study or faculty,twenty-seyen per cent. seats shall be reserved for the Other Backward Classes.

4, The provisions ofsection 3 ofthis Act shall not apply to-(a) a Central Educational Institution established in the aibal areas refened to

in the Sixth Schedule to the Constitution;

(6) the institutions of excellence, research institutions, institutions ofnationaland strategic importance specified in the Schedule to this Act:

Provided that the Cental Govemment may, as and when considered nec€ssary,

by notilication in the Official Gazette, amend the Schedule;

(c) a Mi ority Educational Institution as defined in this Act;

(d) a course or progriururre at higb levels of specialisation, iucluding at thepost-doctoral level, within any branch ofstudy or faculty, which the CentralGovernment may, in consultatioo with the appropriate authority, speciry.

5. (1) Notwithstanding anything contained in clause (iir) of section 3 and in any Maodarory

other law for the timc being in force, every Central Educational Institution shall, with the increase of

prior approval ofthe appropriate authority, increase the number ofseats in a branch of s6b'

*udy or faculty over and above its annual permittcd strength so that the number ofseats,excluding those rcserved for the persons belongingto the Schedulcd Castes, the ScheduledTribes and the Other Backward Classes, is not less than the number ofsuch seats availablefor thc academic session immediately preceding the date oflhe coming into force ofthisAct.

(2) Where, on a representation by any Central Educational Institution, theCentral Government, in consultation with the appropriate authority, is satisfied thatfor reasons of financial, physical or acadcmic limitations or in order to maintainthe standards of cducation, the annual permitted strength in any branch of study orfaculty of such institution cannot be increased for the academic session follorvinglhc commencemert ofthis Act. it may permit by notification in the Official Gazette,such institulion to increase the annual permitted stre[gth over a maximum periodof three years beginning with the academic session following the commencementof this Act; and then, the extent of reservation for the Other Backward Classes asprovided in clause (iii) of section 3 shall be limited for that academic session insuch manner that the number of seats available to the Other Backward Classes foreach academic session ale commensurate with the increase in the permitted strengthfor each year.

6. T[re Central Educuional lnstitutions shall take all necessary steps, which arerequired in giving effect to the provisions ofsections 3,4 and 5 oflhisAct, for the purposesofreservation ofseats in admissions to its academic sessions commencing on and from thecalendar year, 2007.

7. Every notification made under this Act shall be laid, as soon as may be after it ismade, before each llouse of Parliament while it is in session, for a total period of thirtydays which may be comprised in one session or in two or more successive sessions, and if,before the expiryofthe session immediately following the session or the successive sessions

aforesaid, both Houses agree in making anymodificarion in the notification or both Housesagree that the notification should nol bc made, the notification shall therafter have effectonly in such modified form or be of no effecl, as the case may be; so, however, that anysuch modification or annulment shall be without prejudice to the validity of anyhingpreviously done under that notification.
