ORDER No. 21/36-2011 HRG-I (2) Dated, Panchkula, the 17.01.2015Whereas, Sh. Deva Ram Goel (Retd.), Sr. Lecturer, DIET Iccus, District

Jind vide his representation dated 02.06.2011 had claimed to count his service

w.e.f. 02.07.1973 to 26.09.1985 rendered by him in Privately managed AidedSD Sr. Sec. School Jind toward pay pensionary benefits.

The representation of Sh. Deva Ram Goel was considered in light of the

instructions issued by Finance Department, Haryana vide U.O. No.

60/20/10/2 FD-II/870-A dated 31.05.2011 and U.O. No. 78/16/2010-3FD-

11/2971 dated 28.10.2013. As per above instructions, the benefit of past servicerendered by an employee in Govt. Aided School before taken over or service

rendered in Govt. Aided School before appointment in Govt. institution is

applicable only to those employee who are covered under the Haryana Aided

Schools (Pension and Contributory Provident Fund) Rules, 2001 and entitled to

the benefit of pension. The relevant extract of the rule is reproduced here asunder:-

"Chapter-II Rule 3

3(1) Except as otherwise provided in any rule, application andsubject to the condition that the management of an aided schoolexecutes an agreement in Form I, duly supported by a resolution ofthe management to abide by the provisions of these rules and undertaking of the employee in triplicate in form II and instructionsissued by the Govt. from time to time, these rules shall apply to allthe employees who :-

are appointed to the aided sanctioned post on or after the 11thday of May, 1998;were working on the aided sanctioned posts immediatelybefore 11th day of May, 1998 and continue to work as suchthereafter;

Provided that the employees who were appointed to the aided

sanctioned posts and have attend the age of superannuation on or after

the 11 th day of May, 1998 to the date of publication of these rules shall

have the right to exercise option in triplicate in Form III as to whether tobe governed by these rules or not within a period of three months from

the date of publication of these rules in official Gazette.

(2) These rules shall not apply to :-the employee appointed on part-time basis against aidedsanctioned posts:the employees appointed against the posts not sanctioned bythe Government;

(iii) the employees who retired from the sanctioned posts beforethe 11th day of May, 1998 and the employee who attained theage of superannuation before the said date except those whohave been re-employed by the Department after the age ofsuperannuation on sanctioned posts; and

•

(iv) the employees employed on a leave-gap arrangement or onadhoc basis or on contractual basis."

In FD instruction dated 31.05.2011, it is provided, that the claim of anemployees is maintainable if he fulfill the below mentioned condition:-

(i) That he rendered his service in Aided School w.e.f. 02.07.1973 to26.09.1985 whereas, as per FD instructions dated 31.05.2011,employee must be on Aided Sanctioned post up 11.05.1998.

Moreover, as per FD letter 1/2/ 87-2FR-II dated 22.08.1988 andsubsequent instruction dated 31.05.2011, the petitioner was required to applythrough proper channel with proper permission of the administrativeauthority. Further, as per Punjab Civil Services Rule, 4.19 (a). The benefit ofpension is not admissible to an employee who had resigned from post. Thepetitioner resigned from his post on 26.09.1985, before joining intoGovernment service. Thus, his claim is hereby rejected.
