In exercise of powers conferred under Rule 29 (3) read with Rule 3 of Haryana SchoolEducation Rules-2003 Education Department, Haryana hereby permit to add new proposedclasses for higher stage. However, it is made clear that such permission will not enable such schoolto get recognition automatically for which the applicant shall have to fulfill the requiredconditions.

This letter of permission is based on the undertaking given by the applicant as per detailsgiven overleaf. Any violation of the undertaking automatically nullifies the permission. Thispermission is further subject to 'No Objection' from the 'Competent Authority' regulating theland use of the proposed site.

The permission to add new proposed classes for higher stage is only 'In-principle' approvalof the Education Department to allow applicant to initiate steps and provide infrastructure to thenew proposed classes of higher stage.

Students should not be admitted only on this permission without getting recognition. Therecognition will be granted R.T.E. Rules-12 Appendix-II by the Department on fulfillment ofprescribed norms as provided in Haryana School Education Rules-2003, in the interest of safety,health and welfare of students and other requirements.* The managing committee shall abide by the provisions of Haryana School Education Rules 2003(amended) & R.T.E. Ruels 2011 and amendments it any thereafter. The Managing shall be liable fordisciplinary action in case of violation of any provisions of the rules.

Whereas due to non-availability of data of Associate NCC Officers

(ANO) at the Head Quarter level, some of the TGTs who were working as

ANO in their respective schools got transferred from their schools upon

promotions to the post of PGTs.

And whereas, the policy of the Department is that to ensure

uninterrupted NCC programme in the schools having NCC Units, AN()

will be replaced by the teachers working as AN() only.

Therefore, wheresoever the NCC Units have got disturbed due

transfer of ANOs these teachers are to be restored to their schools so

that they can work as ANO also while getting their promotion as PGTs.

Order No. 13/86-2010 HRME (4) Dated, Panchkula, (yc,

The Hon'ble High Court in CWP No. 11590 of 2009 titled as

DarshanLal and others V/s State of Haryana and others, vide order dated

05.02.2010 issued directions to re-fix the pay of the petitioners by giving the

benefits of step up at par with their juniors of. Reserve Category Employee. The

operative part of the judgement/order is reriroduced as under:-

"Respondents are directed to relix the pay of the petitioners bygiving the benefit of stepping up at par with their juniors of ReserveCategory Candidates. Though, the petitioner will be entitled to onlynotional benefit, however, their pensionctry/retiral benefits shall be re-determined and the benefits be released within a period of four months."

In compliance of the order, the case of the petitioners wasexamined on merits by the office. In view of Govt. instructions no.

- 22/ 132/2008-3GS-3 dated 05.03.09, it was found that the petitionerno. 2 to 9 were eligible for the benefit of -stepping up at par with their junior of

Reserve Category and the benefit was granted to them vide orders No. 22/184-

2010 ME (4) and 22/84-2010 ME (4) dated 04.07.2010, 06.09%2010 and

04.10.2019. The remaining two petitioners i.e. No. 1 and 10 were not granted

benefit of stepping up as they were not found eligible under the Govt.

Instructions dated 05.03.2009.

The petitioner No. 2 to 9 filed the COCP No. 1517 of 2010 in the

Hon'ble Punjab and Hariana Court and the Hon'ble High Court passed the

order dated 27.01.2011 which is reproduced as under:-

" Counsel for the respondents submits that petitioners no. 2 to9 have been granted necessary relief, whereas in the case of petitionersno. 1 and 10, a review petition has been filed..

In this view of the matter, the present petition has beenrendered infructuous and is disposed of, with liberty to petitioner no. 1and 10 to seek revival of the petition, in case the review petition isrejected."

This office had filed the Review Application No. 37 of 2011 in CWPNo. 11590 of 2009 in the Hon'ble High Court which was decided by Hon'ble

Punjab and Haryana High Court vide order dated 26.11.2015 is reproducdd as

"Counsel for the Review Applicant - State states that thepresent Review Application is being pressed only qua petitioner nos. 1and 10.

After hearing counsel for the Review Applicant, as also thenon-applicant/petitioner no. 10, the present application is disposed ofwith a direction to the State of Haryana to implement the order, thereview of which is sought for qua the aforesaid two petitioners, afterscrutinizing the facts of their cases and giving them benefit of steppingup of their pay from the date their juniors belonging to the reservedcategory were promoted to the next promotional post, prior to theirpromotion."

The petitioner no. 1 and 10 requested for step up their pay at par

with their junior of Reserve Categories.

The bribf facts of the case are that "Sh. DarshanLal, petitioner no.

1, was promoted as Assistant on 20-108-1993 whereas Sh. Gomati Lal (Junior)

was promoted as Assistant on 07-09-1983. Hence, the petitioner no 1 Sh.

DarshanLal is senior to Sh. Gomati ,Lal. Further, it is submitted that the

petitioner no. 1 was never promoted as Deputy Superintendent and he got

voluntary retirement on 30.06.1996. Thus, the petitioner is not found entitled

for stepping up, as the petitioner sought the voluntary retirement.

The petitioner no. 10 (Sh. Om Parkash) was promoted as clerk on

29.04.1976 whereas Sh. Arni Lal (Junior) (S.C) was promoted as clerk on

01.05.1976. The petitioner no. 10 retired from services on attaining

superannuation on 30.09.1993, whereas his junior Sh. Ami Lal was promoted

as Assistant on 24.04.1995. Hence,' the benefit of stepping up was not granted

to the petitioner no. 10.

It is pertinent to mention here that, both the petitioners have been

awarded personal hearing vide this office letter no. 13/86-2010 HRME (3) dated

10.02.2016 to attend alongwith relevant record of their junior reserve category

employees give by them as the example of junior reserve category employees

were not clear to dispose of the matter. Sh. DarshanLal has not responded to

the above letter. Whereas Sh. Om Parkash vide his letter dated 11.03.2016 has

informed that all the record is available in the office of DEO Narnaul and take

action at office level or as per decision of Court, his dues may be released.

After considering the case of the petitioners and going through the

record and submission of the branch, the contention of the petitioner no. 1 Sh.
