Privacy Code of Practice for the Disclosure of Personal Information by NSW Councils to nbn co limited for the delivery and ongoing operation of the nbnTM network Overview

1 This Code is made under Part 3 Division 1 of the Privacy and Personal Information Protection Act 1998 (NSW) (the PPIP Act) to permit each Council in New South Wales to disclose personal information to nbn in order to facilitate nbnrsquos efforts to provide written notice to the OwnerOccupier concerning nbnrsquos intention to inspect land install or maintain the nbnTM network

2 nbn is a wholly owned Commonwealth Government Business Enterprise established to deliver and operate the nbnTM network The nbnTM network is a wholesale-only access network and Australia wide project to upgrade existing fixed line phone and internet network infrastructure

3 In the course of delivering or operating the nbnTM network nbn is required to provide the OwnerOccupier with various statutory notices and information about the nbntrade network including but not limited to notices contemplated under

a) Clause 17 of Schedule 3 to the Telecommunications Act 1997 (Cth) which requires nbn to give written notice to the OwnerOccupier of its intention to inspect the land install or maintain the nbnTM network

b) Clause 18 of Schedule 3 to the Telecommunications Act 1997 (Cth) which requires nbn to give written notice to the OwnerOccupier of private land before cutting down or lopping a tree or clearing or removing undergrowth or vegetation

(each a Schedule 3 Notice)

Purpose for disclosure 4 The personal information will be used or disclosed for the sole and lawful purposes of

enabling nbn and nbnrsquos contractors

a) To provide the OwnerOccupier with Schedule 3 Notices as required by the Telecommunications Act 1997 (Cth) and to facilitate nbn obtaining any other approvals consents or permits or giving any other notices in connection with delivering or operating the nbntrade network as required by law and

b) To verify that the OwnerOccupier have received Schedule 3 and other relevant notices and information as required under the Telecommunications Act 1997 (Cth) and other legislation regulations legislative instruments or as otherwise required by law and

c) To provide the OwnerOccupier with information on other matters associated with the rollout and ongoing operation of the nbntrade network including but not limited to upcoming forums and other public consultation reasons not covered under Divisions 2 3 and 4 of Schedule 3 of the Telecommunications Act 1997 (Cth) and

d) To generate mail distribution lists in connection with the above

5 nbn is required to identify whether a premises is tenanted in order to notify non-occupying owners of land of its intention to carry out activities in accordance with Division 2 3 and 4 of Schedule 3 to the Telecommunications Act 1997 (Cth) As each Council holds data that enables nbn to identify whether a premises is tenanted nbn seeks the cooperation of Councils to assist in identifying the address of non-occupying owners of land within the Council area

6 nbn collects and retains the personal information disclosed by each Council in a secure electronic records system with access limited to relevant nbn employees and contractors nbn compares the personal information disclosed by each Council with all addresses in the Council area so as to identify the addresses of non-occupying owners of land

Interpretation 7 This Code should be read in conjunction with the PPIP Act Terms in this Code have

the meaning attributed to them in sections 3 and 4 of the PPIP Act unless otherwise specified in this Code

8 For the purposes of this Code

ldquoCouncilrdquo has the same meaning in the Local Government Act 1993 (NSW) as that term may be amended from time to time

ldquonbnrdquo means nbn co limited (ACN 136 533 741) its successor entities or as the company exists from time to time

ldquonbnrsquos contractorrdquo means an organisation or individual that is engaged by the nbn under contractual arrangement to fulfil the obligations of the nbn

personal information has the same meaning as in section 4 of the PPIP Act except that it is limited to the address of a land owner collected by a Council and

ldquotenantedrdquo means a premise occupied by a person other than the owner of that land

ldquooperationrdquo of the nbntrade network includes network maintenance upgrades and extensions

ldquoOwnerOccupierrdquo includes each of the following

a) the owner and occupier of land and

b) the occupier of land including but not limited to the tenant on that land and

c) the non-occupying owner of land

Application 9 This Code applies to each Council in New South Wales

Health Information 10 This Code does not apply to health information as defined in section 6 of the Health

Records and Information Privacy Act 2002 (NSW)

Review 11 This Code will be reviewed 3 (three) years from the date of gazettal of this Code to

ensure it remains relevant and current to the functions and responsibilities of Councils in New South Wales and nbn It may be reviewed earlier if required on request of the Privacy Commissioner

Provisions 12 Despite section 18 of the PPIP Act a Council may disclose personal information to

a) nbn on condition that i nbn has approached the Council in writing

ii The Council is satisfied that the information is to be used by nbn for its proper and lawful functions in accordance with clauses 17 and 18 of Schedule 3 to the Telecommunications Act 1997 (Cth) and for the purposes set out in this Code and

iii The Council is satisfied that the personal information is reasonably necessary for the exercise of nbnrsquos functions with respect to the delivery and ongoing operation of the nbnTM network

b) nbnrsquos contractors on condition that

i nbnrsquos contractor has approached the Council in writing and

ii nbnrsquos contractor has provided the Council with written confirmation from nbn that it is acting as nbnrsquos contractor and

iii The Council is satisfied that the information is to be used by nbnrsquos contractor for the nbnrsquos proper and lawful functions in accordance with clauses 17 and 18 of Schedule 3 to the Telecommunications Act 1997 (Cth) and for the purposes set out in this Code and

iv The Council is satisfied that the personal information to be provided to nbnrsquos contractor is reasonably necessary for the exercise of nbnrsquos functions with respect to the delivery and ongoing operation of the nbnTM

network and will only be used for this functions and for the purposes set out in this Code

ALTERATION OF CONDITIONS OF WESTERN LAND LEASES

It is hereby notified that in pursuance of the provisions of section 19J Western Lands Act 1901 the conditions set out below attach to any Western Land leases where application has been made by the lessees for the addition of such conditions and where approval has been granted

1 The change of purpose of this lease to include ldquoFarm Tourismrdquo does not confer any greater right to the exclusive occupation of the land than was conferred by the original grant of the lease

2 (a) The lessee shall not use any vehicle for the purpose of ldquofarm tourismrdquo (and shall take all reasonable steps to prevent any other person from using any vehicle for the purpose of ldquofarm tourismrdquo) on any part of the lease identified under the provisions of the Soil Conservation Act 1938 as protected land or as being environmentally sensitive

(b) The lessee shall ensure that any access tracks must be arranged in such a manner as to minimise the disturbance of any land surface

3 The lessee shall undertake any appropriate measures at hisher own expense as ordered by the Commissioner to rehabilitate any degraded or disturbed areas

4 The lessee shall ensure that all traffic is contained to the designated tracks in order to reduce the impact on soil and vegetation including potential wind and water erosion on those tracks

1 The change of purpose of this lease to include ldquoFilm Makingrdquo does not confer any greater right to the exclusive occupation of the land than was conferred by the original grant of the lease

2 No excavation will be undertaken on the lease area for the purpose of film making

3 No building structure or other thing that is a fixture (other than a fence or gate) shall be constructed or placed on the lease area for the purpose of film making

4 No garbage or poisonous toxic or hazardous substance arising from the use of the land for film making shall be stored or disposed of on the lease area

5 The lessee may grant a licence to a person to undertake film making on the lease area provided ndash (a) the licence is in writing and (b) contains conditions in or to the effect of the following (i) the licence does not confer on the licensee

any right to the exclusive possession of the land

(ii) the licensee shall not excavate any land (iii) the licensee shall not construct or place

on the land by building structure or other thing being a fixture (other than a fence or gate)

(iv) the licensee shall not deposit or store on the land any garbage or poisonous toxic or hazardous substances

(v) the licence will expire when an approved determination of native title (within the meaning of section 13 of the Native Title Act 1993 (Cth)) is made in relation to any part of the land where the determination is that native title exists

6 The variation of the purpose of the lease by the addition of the purpose of film making will lapse when an approved determination of native title (within the meaning of section 13 of the Native Title Act 1993 (Cth)) is made in relation to any part of the land where the determination is that native title exists

5 (a) The lessee shall not use the subject land for recreational hunting on more than 100 days in any one calendar year

(b) The lessee shall in using the subject land 9 for recreational hunting take all reasonable precautions to ensure that persons exercising any native title rights and interests on the land are not put at risk or interfered with in the exercise of their rights and interests by reason of the use of the land for that purpose

(c) The lessee shall when using the subject land for recreational hunting (i) take all reasonable precautions to ensure

that hunting is undertaken in a safe manner and that ethical firearm practices are observed when shooting near boundaries

(ii) ensure that all persons entering upon the land for recreational hunting are provided with a map of the property clearly defining the leaseproperty boundaries

(iii) place at the perimeter of the subject land appropriate warning signs stating that the subject land is being used for recreational hunting

(iv) ensure that adequate provision is made for the removal and disposal of animal carcases

(a) The lessee shall not use any vehicle for the purpose of ldquorecreational huntingrdquo (and shall take all reasonable steps to prevent any other person from using any vehicle for the purpose of ldquorecreational huntingrdquo) on any part of the lease identified under the provisions of the Soil Conservation Act 1938 as protected land or as being environmentally sensitive

The lessee will not without the written consent of the Minister by any act matter or deed or by failure or omission cause or permit to be imposed on the Minister any liability of the Holder under or by virtue of this Lease in the use of the land for the purpose of recreational hunting

(a) For the purposes of this clause the term Minister shall include Her Majesty the Queen Her Heirs and Successors the State of New South Wales the Minister and the agents servants employees and contractors of Her Majesty Her Majestyrsquos Heirs and Successors the State of New South Wales and the Minister

(b) The lessee agrees that the lessee will indemnify and keep indemnified the Minister from and against all actions suits claims and demands of whatsoever nature and all costs charges and expenses in respect of any accident or injury to any person or property which may arise out of the use of the subject land for the purpose of recreational hunting

(c) The lessee expressly agrees that the obligations of the lessee under this clause shall continue after the expiration or other determination of this Lease in respect of any act deed matter or thing happening before such expiration or determination

(a) The lessee will forthwith take out and thereafter during the Term keep current a public risk insurance policy for the amount of $10 000 000 for any one claim (or such other reasonable amount as the Minister may from time to time specify in writing to the Holder) in respect of the use of the land for recreational hunting whereby the Minister shall during the continuance of the Lease be indemnified against all actions suits claims demands proceedings losses damages compensation costs charges and expenses

(b) The following provisions apply to all policies of insurance required to be effected by the lessee (i) Where the Minister serves a notice on

the Holder directing the Holder to enter into a policy with an insurer approved by the Minister the policy is to be entered into with an insurer approved by the Minister The Minister shall specify a list of approved insurers in any notice served under this paragraph Where the Minister does not serve a notice as provided for in this paragraph polices of insurance shall

be entered into with an insurer carrying on business in Australia

(ii) All policies are to contain conditions and exclusions commonly effected in relation to the type of activity undertaken on the Premises and the nature of the Premises provided that the Minister may by notice served on the Holder direct the Holder to enter into a policy containing specified 10 provisions or which does not contain specified provisions or exclusions and the Holder shall use his best endeavours to comply with the direction

(iii) All policies are to be taken out in the names of the Minister and the Holder for their respective rights and interests and in the name of such other parties having an insurable interest as the Minister may require

(iv) Duplicate or certified copies of the policies and all renewal certificates and endorsement slips are to be lodged by the Holder with the Minister if required by the Minister

(v) All premiums payable in respect of policies and renewals of policies are to be paid punctually by the Holder and the receipt of each premium payable in respect of each policy (or other proof of payment to the Minister rsquos satisfaction) is to be produced by the Holder to the Minister at the request of the Minister

(vi) Where the Minister has served notice on the Holder under paragraph (I) the Holder will use all reasonable endeavours to ensure that the insurer which issues a policy advises the Minister of any failure by the Holder to renew any policy or pay any premium in respect thereof

(vii) The Holder will not at any time during the Term do or bring upon the Premises anything whereby any insurance relating to the Premises against damage by fire and other risks may be rendered void or voidable If the Holder does or brings anything upon the Premises whereby the premium on the insurance shall be liable to be increased the Holder will obtain insurance cover for the increased risk and pay all additional premiums (if any) required to be paid

(viii)The Holder will use all reasonable 11 endeavours to ensure that full true and particular information is given to the insurer with which the insurances are effected of all matters and things the non-disclosure of which might in any way prejudice or affect any policy of 12 insurance or the payment of all or any moneys thereunder

(c) The Minister in his own name or as the attorney of the Holder in the name of the Holder shall 13 be entitled to institute all proceedings against any insurer which issues a policy of insurance required by the Lease to recover from it any

amount for loss damage or injury or other money payable under any indemnity in favour of the Minister The Holder hereby appoints the Minister the attorney of the Holder for the purpose as aforesaid

(d) The Holder expressly agrees that the provisions of subclause (b) continue in force after the Termination Date

The lessee may grant a licence to a person to use the subject land for recreational hunting provided (a) the licence is in writing and (b) contains conditions in or to the effect of the following (i) the licence does not confer on the licensee

any right to the exclusive possession of the subject land

(ii) the licensee shall not excavate the subject land

(iii) the licensee shall not construct or place on the subject land by building structure or other thing being a fixture (other than a fence or gate)

(iv) the licensee shall not deposit or store on the subject land any garbage or poisonous toxic or hazardous substances

(v) (a) The licensee shall not use the subject land for recreational hunting on more than 100 days in any one calendar year

(b) The licensee shall in using the subject land for recreational hunting take all reasonable precautions to ensure that persons exercising any native title rights and interests on the subject land are not put at risk or interfered with in the exercise of their rights and interests by reason of the use of the subject land for that purpose

(vii) the licence will expire upon an approved determination of native title (within the meaning of section 13 of the Native Title Act 1993 (Cth)) in relation to any part of the land where the determination is that native title exists

The variation of the purpose of this lease by the addition of the purpose of recreational hunting will lapse upon an approved determination of native title (within the meaning of section 13 of the Native Title Act 1993 (Cth)) in relation to the subject land where the determination is that native title exists

The lessee shall undertake any appropriate measures at hisher own expense as ordered by the Commissioner to rehabilitate any degraded or disturbed areas

The lessee shall ensure that all traffic is contained to the designated tracks in order to reduce the impact on soil and vegetation including potential wind and water erosion on those tracks

4 No garbage or poisonous toxic or hazardous substance arising from the use of the subject land for shooting range shall be stored or disposed of on the subject land

5 No clearing of the subject land shall be undertaken for the purpose of a shooting range

6 (a) The lessee shall not use the subject land as a shooting range on more than 100 days in any one calendar year

(b) The lessee shall in using the subject land for a shooting range take all reasonable precautions to ensure that persons exercising any native title rights and interests on the land are not put at risk or interfered with in the exercise of their rights and interests by reason of the use of the land for that purpose

(c) The lessee shall when using the subject land for a shooting range place at the perimeter of the subject land appropriate warning signs stating that the subject land is being used for a shooting range

7 The lessee will not without the written consent of the Minister by any act matter or deed or by failure or omission cause or permit to be imposed on the Minister any liability of the Holder under or by virtue of this Lease in the use of the land for the purpose of shooting range

8 (a) For the purposes of this clause the term Minister shall include Her Majesty the Queen Her Heirs and Successors the State of New South Wales the Minister and the agents servants employees and contractors of Her Majesty Her Majestyrsquos Heirs and Successors the State of New South Wales and the Minister

(vi) (a) The licensee will forthwith take out thereafter during the Term keep current a public risk insurance policy for the amount of $10000000 for any one claim (or such other reasonable amount as the Minister may from time to time specify in writing to the Holder) whereby the Minister shall during the continuance of the Licence be indemnified against all actions suits claims demands proceedings losses damages compensation costs charges and expenses

(b) The following provisions apply to all policies of insurance required to be effected by the licensee (i) Where the Minister serves

Premises against damage by fire and other risks may be rendered void or voidable If the Holder does or brings anything upon the Premises whereby the premium on the insurance shall be liable to be increased the Holder will obtain insurance cover for the increased risk and pay all additional premiums (if any) required to be paid

(viii) The Holder will use all reasonable endeavours to ensure that full true and particular information is given to the insurer with which the insurances are effected of all matters and things the non-disclosure of which might in any way prejudice or affect any policy of insurance or the payment of all or any moneys thereunder

(c) The Minister in his own name or as the attorney of the Holder in the name of the Holder shall be entitled to institute all proceedings against any insurer which issues a policy of insurance required by the Lease to recover from it any amount for loss damage or injury or other money payable under any indemnity in favour of the Minister The Holder hereby appoints the Minister the attorney of the Holder for the purpose as aforesaid

The variation of the purpose of this lease by the addition of the purpose of shooting range will lapse upon an approved determination of native title (within the meaning of section 13 of the Native Title Act 1993 (Cth)) in relation to the subject land where the determination is that native title exists

The lessee shall ensure that any access tracks must be arranged in such a manner as to minimise the disturbance of any land surface

Order Under Section 12 Cy Pregraves Scheme Relating to

the Just Enough Faith Foundation Inc

Section 9 (1) of the Charitable Trusts Act 1993 permits the application of charitable trust property cy-pres where the spirit of the original trust can no longer be implemented

During 2007 an appeal was conducted to raise money to pay the providers of the Just Enough Faith Foundation which was an organisation involved in assisting the homeless primarily through a night food van service This appeal was conducted by way of sponsorship and sales of a cookbook produced by Star Dean-Willcocks formerly a business and insolvency practice

The Just Enough Faith Foundation no longer exists The funds are held in an account named the lsquoSDW Just Enough Faith Appeal Accountrsquo to which Mr Ron Dean-Willcocks is a signatory Mr Dean-Willcocks is the sole trustee of the funds The total amount of the funds is said to be $3137608

The funds are held for a charitable purpose which was originally carried out by the Just Enough Faith Foundation being the relief of poverty The Just Enough Faith Foundationrsquos incorporation was cancelled on 6 November 2009 As the Just Enough Faith Foundation no longer exists it is necessary to implement a cy pregraves scheme for the application of the remaining trust funds

The Exodus Foundation has taken over the night food van service previously conducted by the Just Enough Faith Foundation In these circumstances a scheme whereby the trust funds can be applied towards the Exodus Foundation food van service would be as close as possible to the original purposes of the trust The trustee Mr Dean-Willcocks agrees with the proposed scheme

As delegate of the Attorney General in Charitable Trusts Act 1993 matters I have determined that this is an appropriate matter in which the Attorney General should approve a cy-pres scheme under section 12 (1) (a) of the Charitable Trusts Act 1993 The cy pregraves scheme will allow the funds held in the lsquoSDW Just Enough Faith Appeal Accountrsquo to be applied to the Exodus Foundation for the purposes of running the night food van service at St Maryrsquos Cathedral Sydney

I hereby order the establishment of cy pregraves scheme pursuant to section 12 (1) (b) of the Charitable Trusts Act 1993 for this purpose

This Order will take effect 21 days after its publication in the Government Gazette in accordance with section 16 (2) of the Charitable Trusts Act 1993

2 Commencement

This Notice commences on the day on which it is published in the NSW Government Gazette

3 Returns by operators of service stations

(1) The reporting periods are (i) 1 October 2015 to 31 December 2015 and (ii) 1 January 2016 to 31 March 2016

(2) Data is to be provided to the Secretary by 30 June 2016 using the electronic form Service Station Return published on the NSW Fair Trading website at wwwfairtradingnswgovau

(3) The Service Station Return is to specify the following information for the service station (i) the name of the legal entity operating the service station (ii) the trading name of the service station operator if any (iii) the fuel brand for the site if any (iv) the address of the service station including the number and street name and the town or suburb in which the

service station is located and the postcode (v) name and title of a contact person for the Service Station Return and the contact personrsquos phone number and

email address (vi) a description of the arrangements under which the site is supplied with petrol

(4) The Service Station Return is to indicate whether the following fuels are supplied from the site and if so the total volume sold in litres at the site for each of the reporting periods and the number of bowsers or nozzles at the site from which the fuel type was supplied (i) regular unleaded petrol (RON 91) (ii) E10 (RON 94) (iii) premium unleaded petrol (RON 95) (iv) premium unleaded petrol (RON 98) (v) E85 (RON 105) (vi) regular diesel (vii) fuel labelled as lsquopremium dieselrsquo (viii) liquefied petroleum gas (LPG) (ix) compressed natural gas or natural gas for vehicles (CNGNGV) (x) liquid natural gas (LNG) (xi) B20 (biodiesel and diesel)

Note ndash Failure to provide a return in compliance with this Notice is an offence under clause 6 subclause (1) of Schedule 1 of the Act The prescribed amount of the penalty is $5500 is if the offence if dealt with under section 29 of the Act
