The Minister of Finance, in exercise of the power conferred by section 2 of theGovernment Fees Act 1965, makes the following Regulations:

CitationThese Regulations, which amend the Government Fees Regulations 1976, may be

cited as the Government Fees Amendment Regulations 2016.

Revokes and replaces ScheduleThe Schedule to the Government Fees Regulations 1976 is revoked and replaced

with the Schedule to these Regulations.

TransitionalNothing in these Regulations affects the validity of a fee that is paid before the

coming into operation of these Regulations.

CommencementThese Regulations come into operation 1 April 2016.

(a) a particular term of work permit is applied for and theDepartment grants a term less than that applied for, thedifference in fees between the two work permit terms will berefunded less an administration fee of $145 (e.g. if a three-yearstandard work permit is applied for and a two-year standardwork permit is granted, the Department will refund thedifferential of one 1 year less the administration fee).

(b) a particular term of work permit is applied for and theDepartment refuses to grant the work permit, the work permitfee will be refunded less an administration fee of $145.

(c) a work permit is cancelled prior to a decision being made, thework permit fee will be refunded less an administration fee of$145.

(d) a work permit application has been submitted incomplete and anew work permit application was submitted in accordance withthe work permit policy service level, the work permit feeapplication will be returned to the employer less an

Head 10Building Act 1988

(a) for the purposes of calculating the building permit fee in accordancewith subparagraphs (a)(i)(A) and (b)(i)(A), the floor space to which thefee applies means the total gross square footage of new construction,including verandas and balconies, but excluding water tanks, outdoorpaved areas, patios and the like;

(b) “accessory structures” includes, but is not limited to, tennis courts,parking areas, driveways, docks, walls, satellite dish receivers, signs,piers, platforms, patios and like structures which do not result in thecreation of additional, enclosed floor space, that are incidental to theprincipal building and located on the same lot; and, for the avoidanceof doubt, a swimming pool is not an accessory structure and anyseparate application for a pool shall be subject to the minimum feeset out in either paragraph (a)(i)(A) or (b)(i)(A), whichever is applicable;

(c) “re-inspection of works” means a re-inspection made because, at aprevious scheduled visit to the works, either—

(i) conditions at the works prevented proper access to the works;

(ii) the works did not meet the requirements of the BermudaBuilding Code Regulations 2014;

(d) In the case of an existing building where the application relates tobuilding works designed specifically to provide access for, orotherwise meet the needs of, the physically handicapped, no fee shallbe charged.

(e) In the case of alterations or extensions to a building listed as abuilding of special architectural or historical interest in accordancewith section 30 of the Development and Planning Act 1974, no feeshall be charged.
