Similar disclosures are required to be made in any application for a practising certificate as a barrister or solicitor if the disclosures have not already been made. Within 28 days after the commencement of this Regulation, similar disclosures are also required to be made in respect of incidents referred to in paragraph (a) occurring at any time before the commencement of this Regulation and offences referred to in paragraph (b) committed at any time before that commencement (in the case of indictable offences) or committed within the period of 10 years immediately before that commencement (in any other case). Her Excellency the Governor, with the advice of the Executive Council, and on therecommendation of the Attorney General, has made the following Regulation underthe Legal Profession Act 1987.

Explanatory noteThe object of this Regulation is to require a barrister to notify the Bar Council anda solicitor to notify the Law Society Council if:

(a) he or she becomes bankrupt, is the subject of a bankruptcy petition or appliesto take the benefit of any law for the relief of bankrupt or insolvent debtors,compounds with creditors or makes an assignment of his or her remunerationfor their benefit, or

(b) he or she is found guilty of an offence (other than certain specified traffic andparking offences).

In the case of disclosures relating to an incident referred to in paragraph (a), thebarrister or solicitor concerned is, in addition, to provide a statement as to why,despite the incident, he or she is a fit and proper person to hold a practisingcertificate.

The Bar Council or Law Society Council (as appropriate) may require furtherinformation relating to disclosures.

This Regulation is made under the Legal Profession Act 1987, includingsections 30 and 216 (the general regulation-making power).

(Clause 2)

[1] Clause 3 Interpretation

Insert in alphabetical order in clause 3 (1):

excluded offence means:

(a) any offence under the road transport legislation (withinthe meaning of the Road Transport (General) Act 1999)other than the following:(i) an offence under section 42 (1) of the Road

Transport (Safety and Traffic Management) Act1999 relating to driving a motor vehiclenegligently on a road or road related area if thebarrister or solicitor concerned is, by way ofpenalty, sentenced to imprisonment or fined asum of not less than $200,

(ii) an offence under section 42 (2) of the RoadTransport (Safety and Traffic Management) Act1999 relating to driving a motor vehicle on aroad or road related area furiously, recklessly orat a speed or in a manner dangerous to thepublic,

(iii) any offence under section 19 (2) of the RoadTransport (General) Act 1999 (which relates torefusing to comply with a requirement toproduce a driver licence, or to state name andhome address, or stating a false name and homeaddress),

(iv) any offence under section 12 (1) of the RoadTransport (Safety and Traffic Management) Act1999 (which relates to driving etc while underthe influence of alcohol or any other drug),

(v) any offence under section 25A (1), (2) or (3) ofthe Road Transport (Driver Licensing) Act 1998(which relates to driving while unlicensed andother relevant matters),

(vi) any offence under section 70 of the RoadTransport (Safety and Traffic Management) Act1999 (which relates to failing to stop and giveassistance after an accident),

(vii) any offence under section 9 of the RoadTransport (Safety and Traffic Management) Act1999 (which relates to presence of prescribedconcentration of alcohol in person’s blood),

(viii) an offence under section 43 of the RoadTransport (Safety and Traffic Management) Act1999 (which relates to menacing driving),

(ix) any other offence under the road transportlegislation if the court orders the disqualificationof the barrister or solicitor concerned fromholding a driver licence, or

(b) any offence relating to the parking of motor vehicles.

[2] Clause 3 (1A)

Insert after clause 3 (1):

(1A) A reference in the definition of excluded offence insubclause (1):

(a) to an offence under the road transport legislationincludes a reference to an offence under the Traffic Act1909, or the regulations under that Act, as previously inforce, and

(b) a reference to an offence under a provision of an Actspecified in paragraph (a) of that definition includes areference to an offence under a corresponding provisionof the Traffic Act 1909, or the regulations under thatAct, as previously in force.

[4] Clause 6 (1) (e)

Insert after clause 6 (1) (d):

(e) if the practitioner:(i) is, or has at any time been, bankrupt or the

subject of a creditor’s petition presented to theCourt under section 43 of the Bankruptcy Act1966 of the Commonwealth, or

(ii) has at any time presented (as a debtor) adeclaration to the Official Receiver undersection 54A of the Bankruptcy Act 1966 of theCommonwealth of his or her intention to presenta debtor’s petition or presented (as a debtor)such a petition under section 55 of that Act,

(iii) has at any time applied to take the benefit of anylaw for the relief of bankrupt or insolventdebtors, compounded with creditors or made anassignment of his or her remuneration for theirbenefit,

details of each such incident and a statement as to whythe practitioner considers that, despite the incident, thepractitioner is a fit and proper person to hold apractising certificate.

[9] Clause 6 (1A) (e)–(g)

Omit clause 6 (1A) (e) and (f). Insert instead:

(e) extends to an indictable offence committed before thecommencement of the Legal Profession Amendment(Notification) Regulation 2001 (and so extends whetherthe finding of guilt was made before or after thatcommencement), and

(f) extends to an offence (other than an indictable offence)committed within the period of 10 years occurringimmediately before the commencement of the LegalProfession Amendment (Notification) Regulation 2001(and so extends whether the finding of guilt was madebefore or after that commencement), and

(g) does not apply to a finding of guilt previously disclosedin an application for a practising certificate or underclause 69D.

[10] Clause 6 (1B) and (1C)

Insert after clause 6 (1A):

(1B) Subclause (1) (e) does not require the disclosure of anyinformation previously disclosed in an application for apractising certificate or under clause 69E.

(1C) Subclause (1) (e) applies to incidents whether occurring beforeor after the commencement of that paragraph.

[11] Clause 6 (3)

Insert after clause 6 (2):

(3) Without limiting the generality of subclause (2), the appropriateCouncil may require the legal practitioner to furnish suchfurther information relating to the cause of or circumstancessurrounding an incident referred to in subclause (1) (e) as itconsiders relevant to its determination of the application withinsuch time as it specifies.

Insert after clause 69C:

69D Duty to report offences

(1) If a barrister or solicitor is found guilty of an offence (otherthan an excluded offence), the barrister or solicitor must:

(a) notify the appropriate Council in writing of the findingand the nature of the offence, and

(b) furnish to the appropriate Council, within the timespecified by the appropriate Council, such furtherinformation as it requires relating to the finding or thecommission of the offence.

(2) Subclause (1):

(a) applies to an offence whether or not committed in thecourse of practice as a legal practitioner, and

(b) applies to a finding of guilt of an offence whether or notthe court proceeded to a conviction for the offence, and

(c) applies to an offence committed in New South Wales orto an offence committed outside New South Wales (solong as it would have been an offence, other than anexcluded offence, if committed in New South Wales),and

(d) applies to a finding of guilt even if other persons areprohibited from disclosing the identity of the offender,and

(e) extends to an indictable offence committed before thecommencement of this clause (and so extends whetherthe finding of guilt was made before or after thatcommencement), and

(f) extends to an offence (other than an indictable offence)committed within the period of 10 years occurringimmediately before the commencement of this clause(and so extends whether the finding of guilt was madebefore or after that commencement).

(3) A notification under subclause (2) must be made:

(a) in relation to a finding of guilt that was made before thecommencement of this clause—within 28 days after thatcommencement, or

(b) in relation to a finding of guilt that was made on or afterthe commencement of this clause—within 7 days afterthe finding was made.

69E Duty to report bankruptcy

(1) For the purposes of this clause, the following are notifiableincidents in respect of a barrister or solicitor:

(a) the barrister or solicitor becomes a bankrupt or is thesubject of a creditor’s petition presented to the Courtunder section 43 of the Bankruptcy Act 1966 of theCommonwealth,

(b) the barrister or solicitor presents (as a debtor) adeclaration to the Official Receiver under section 54Aof the Bankruptcy Act 1966 of the Commonwealth ofhis or her intention to present a debtor’s petition orpresents (as a debtor) such a petition under section 55 ofthat Act,

(c) the barrister or solicitor applies to take the benefit of anylaw for the relief of bankrupt or insolvent debtors,compounds with creditors or makes an assignment ofhis or her remuneration for their benefit.

(2) A barrister or solicitor must:

(a) notify the appropriate Council in writing of anynotifiable incident giving details of the incident and astatement as to why the practitioner considers that,despite the incident, the practitioner is a fit and properperson to hold a practising certificate, and

(b) furnish to the appropriate Council, within the timespecified by the appropriate Council, such furtherinformation as it requires relating to the cause of orcircumstances surrounding the incident.

(3) A notification under subclause (2) must be made:

(a) in relation to notifiable incidents that occurred beforethe commencement of this clause—within 28 days afterthat commencement, or

(b) in relation to notifiable incidents that occurred on orafter the commencement of this clause—within 7 daysafter the incident occurred or, in the case of an incidentreferred to in subclause (1) (a), the barrister or solicitorconcerned became aware of the incident.

Explanatory note (not part of this notification): The coordinates in Column 1 to this closure relate to an ocean areagenerally defined as being within the boundaries of a line drawn in a generally easterly direction from the mean high watermark at Lennox Head for 2.6km then in a generally southerly direction for approximately 10km, to approximately 5kmseaward from the northern wall of the Ballina Bar, then in a generally south westerly direction for a distance of approximately16.5km to the northern tip of South Riordan Shoals which is about 3.8km from the shore and then finally west back to meanhigh water mark at the southern end of South Ballina Beach.

SPECIAL CONDITIONS AND RESERVATIONSATTACHED TO WESTERN LANDS LEASE 11340

1. The lessee shall take any measures directed by theCommissioner to rectify or ameliorate any on or offsite natural resource degradation associated with landuse on the lease. The Commissioner’s directions willonly require the lessee’s rectification to becommensurate with the lessee’s contribution to thedegradation issue(s) in question.

2. The lessee shall ensure that all access tracks to thearea to be cultivated must be arranged in such amanner as to minimise the disturbance of any landsurface or native vegetation and ensure direct accessthrough the area.

3. Should any Aboriginal archaeological relics or sitesbe uncovered during the proposed works, the lesseeis to cease work immediately. The lessee mustconsider the requirements of the National Parks andWildlife Act 1974, with regard to Aboriginal relics.Under Section 90 it is an offence to knowinglydamage or destroy relics without prior consent ofthe Director General of the National Parks andWildlife Service. If a site is uncovered the lessee mustcontact an Archaeologist of the National Parks andWildlife Service.

4. Non-irrigated cultivation beyond a single crop orpasture establishment attempt is not authorisedwithout the prior consent of the Commissioner.

5. Irrigation water is not to be transferred from theirrigated site without the prior approval of theCommissioner. This will allow consideration of anyland rehabilitation or stabilisation needs prior tocessation of irrigation.

6. Sandhills and other soils with a surface texture ofloamy sand or coarser shall be left uncultivated unlessspecifically approved by the Commissioner.

7. Stubble shall be retained on the soil surface and shallnot be burnt, except with the approval of theCommissioner or his delegate. Where such approvalis granted and stubble burning is carried out with theapproval as per requirements of the NSW Rural FireServices.

8. Cropping frequency will not be limited when landmanagement actions such as stubble retention andpasture ley maintain soil fertility and prevent the riskof occurrence of soil erosion or other forms of landdegradation.

9. Appropriate pasture species shall be sown at thecompletion of the cropping phase to maintain soilfertility and pastoral productivity. Pastures may beundersown with the final crop, or alternatively sownin the first suitable year following the last crop of thecropping phase. It is strongly recommended that theadvice of the local Agronomist be sought andfollowed on pasture species, fertiliser application andagronomic practices.

10. Livestock may be excluded from cultivated fallowsby direction of the Commissioner or the RangelandManagement Officer.

11. The lessee shall maintain records of cultivation datesand methods; of crop or pasture sowings; of thesuccess or failure and yield (where relevant) of eachsowing attempt and of fertiliser or agriculturalchemicals used. These records are to be madeavailable to the Commissioner or his delegate uponrequest and the Commissioner may retain informationfrom such records.

12. The change of purpose of this lease from “Grazing”to “Grazing and Cultivation” does not confer anygreater right to the exclusive occupation of the landthan was conferred by the original grant of the leasefor “Grazing”.

13. Dryland or rainfed cultivation and crop productionis authorised on the areas shown hatched on thediagram below.

1 What is this plan called?

This plan is Auburn Local Environmental Plan 2000 (AmendmentNo 2).

2 What is the aim of this plan?

(1) The public land described in Schedule 4 is classified, orreclassified, as operational land for the purposes of the LocalGovernment Act 1993, subject to this clause.

(2) Land described in Part 1 of Schedule 4:

(a) to the extent (if any) that the land is a public reserve,does not cease to be a public reserve, and

(b) continues to be affected by any trusts, estates, interests,dedications, conditions, restrictions or covenants bywhich it was affected before its classification, orreclassification, as the case requires, as operational land.

(3) Land described in Columns 1 and 2 of Part 2 of Schedule 4, tothe extent (if any) that it is a public reserve, ceases to be apublic reserve on the commencement of the relevant amendingplan and, by the operation of that plan, is discharged from alltrusts, estates, interests, dedications, conditions, restrictions andcovenants affecting the land or any part of the land exceptthose specified opposite the land in Column 3 of Part 2 ofSchedule 4.

(4) In this clause, the relevant amending plan, in relation to landdescribed in Part 2 of Schedule 4, means the localenvironmental plan cited at the end of the description of theland.

(5) Before the relevant amending plan inserted the description ofland into Part 2 of Schedule 4, the Governor approved ofsubclause (3) applying to the land.

IN August 1999, a number of other people undertook variousfundraising events to raise money to meet the cost of openheart surgery for Krishant Sharma, a nine month old babyfrom Fiji. A total of $17,262.85 was raised and the operation,performed by the Children’s Hospital at Westmead, cost$13,275.20, leaving a surplus of $3,605.08, which is currentlyheld in an account in the name of the Society.

Medical reports have been received from the Fijianmedical practitioners who manage Krishant Sharma’songoing care confirming that he suffers ongoing healthproblems. A report from the Children’s Hospital at Westmeadalso states that Krishant may suffer long term lung damageand other associated problems arising from the conditionof Down’s Syndrome which he also suffers.

The funds held by the Australian Society for the Needyand Poor can no longer be used for their original purposeand may therefore be applied cy-pres to another similarpurpose under the Charitable Trusts Act 1993. As the fundswere originally raised in order to pay for Krishant Sharma’soperation costs, the use of the balance of the funds to payfor his ongoing medical expenses is consistent with theoriginal charitable purpose.

Improvements to the early return of subpoena system inthe Civil Jurisdiction

THE objective of the Court since the introduction of PracticeNote 33 has been to hear 90% of civil actions within 12months of commencement, and the remainder within twoyears of commencement.

The issuing of subpoena and inspecting of documentsis vital to the early preparation of cases by the parties to anaction. The court has always aimed to allocate return dateswithin 6 weeks of issue of subpoena for production,although recently, this time standard has slipped. The Courtrecognises that it must be able to facilitate the earlyproduction of documents if parties are to meet the standardsimposed by Practice Note 33.

To improve the processes surrounding the subpoenaprocess, the Rule Committee has introduced a new return ofsubpoena system through the District Court Amendment(Access to Subpoenaed Material) Rule 2000. The new systemaims to reduce the need for parties to appear at Court aswell as providing more and better information so that partiescan decide on whether to appear and dispute an accessorder.

The Rule Committee expects that in the vast majority ofcases under this system, an appearance at Court will not berequired unless there is an actual dispute over the makingof an access order.

Under the new system, when issuing a subpoena theissuing party will be required to:

• Obtain a return date from the Registry.

• Endorse a “proposed access order” on the subpoena.The suggested order is for the “Plaintiff to have firstaccess for 7 days” from the return date.

• Where a contrary “proposed access order” is sought,the issuing party must state his or her reasons. Usuallythis will be that the plaintiff can have no claim forprivilege on the documents, or that another party shouldhave first access to the documents (such as documentsproduced by the defendant or the defendant’s experts).Issuing parties should carefully consider what accessorder is proposed as a disputed proposed access orderwill require the parties to appear at the return date;

• A copy of the subpoena must be served by the issuingparty on all other parties with an address for servicewithin 7 days of issue. Where the return date is lessthan two weeks away, the copy must be served within 24hours. Parties should therefore ensure that anappearance or a defence is filed and served as soon aspossible;

• Where all parties have not been notified of the issue ofthe subpoena, the issuing party will be obliged to appearand inform the court at the return date of its failure. Acosts penalty may also apply. The requirement for allparties to attend will be waived if the issuing party hasobtained consent to mention the matter for all otherparties. The intention of this is to ensure that all otherparties have notice of the proposed access order.

Any party or the producer may object to the issuingparty about the proposed access order. The issuing partywill have the responsibility for notifying all other parties ofthe objection. Unless there is agreement as to the accessorder, parties who wish to contest the proposed access orderwill be required to appear on the return date and argue thequestion before the presiding Registrar.

In any case on the return date in which there is noappearance, the proposed access order will be madeautomatically by default.

Where documents have not been produced, any partywill be able to obtain a further return date from the Registry.The requesting party must notify the new return date to allother parties.

There will be substantial benefits for the parties, theprofession and the Court under the new rules. Parties willknow in advance what access order will be proposed. Partieswill not need to attend Court unless an access order iscontested. Short return dates can be given because theterms of proposed access orders have already beencommunicated to the other parties.

The new subpoena system will apply to all subpoenaissued on or after 1 May 2001. The existing subpoena systemwill continue to apply to any subpoena issued before thatdate.

The Committee is of the opinion that this population iseligible to be listed as an endangered population becauseits habitat has been so drastically reduced that it is inimmediate danger of extinction and it is not a population ofa species already listed in Schedule 1 and its disjunct and ator near the limit of its geographic range and it is of significantconservation value.
