    A longawaiteddecisionhasbeenreached intheSWEAR (SafeWindEnergy forAll Residents)case,

    whichresultedinJusticeDuncanGracestayingtheproceedinguntilsuchtimeasaRenewableEnergy

    Approval (REA) is granted for the K2Windproject. SWEARwas representedby Julian Falconer, a

    prominenthumanrightsandconstitutionallawyer.

    Thisisnotadismissaloftheproceedings,onlyadelayuntilafteranREAhasbeenissuedexplains

    DaveHemingway,PresidentofSWEAR.

    ThequestionaroseatthehearingastotheabilityoftheEnvironmentalReviewTribunal(ERT)toheara

    questionontheCanadianCharterofRightsandFreedoms(theCharter)andhowtheGreenEnergy

    andEconomyActandlevelofharmapply.

    Thisisveryimportantsaysplaintiff,ShawnDrennan.IftheGreenEnergyActanditslegislationare

    foundtobeinviolationoftheCharter,theburdenofproofshiftsfromhavingtoproveseriousharmto

    humanhealthtothepossibilityofharm,amuchlowerthreshold.

    TheDrennans,membersofSWEAR,steppedforwardin2012tobethenamedpersonsonthelawsuit.

    AlthoughtheDrennansnameiswidelyknowninthiscase,Hemingwayaddsthatthereisabroader

    publicinterestbeingserved. Ithastakentimetoeducatethepublictothefactthatthiscaseisnot

    personalto theDrennans,buttheunderstandingisnowclearly there.This caseis forthepeopleof

    Ontariowhowant safewindenergy intheir communitiesand beyond. The government says that

    massiveindustrialwindturbinesaresafe.We,thepeople,areholdingthemaccountable.

    AccordingtoHemingway,thegreaterissueistheCharterChallenge,specificallyChapterSeven,which

    guaranteesthesecurityoftheindividual.TheCharteristhegovernmentspromisetoeveryman,

    womanandchildinCanada,guaranteeingthatwewillhavesecuritytoconductouraffairsandlives

    inrelativepeace.ThegovernmentofOntariodidnotexerciseduediligencewhencraftingtheGreen

    EnergyandEconomyAct. Averyheavyhandedapproachwasused. RuralOntariodoesnot take

    kindlytothistypeofgovernance.
