IntroductionThe Cairo Regional Centre for International Commercial Arbitration holds the fifth round of its important international biannual “Sharm El Sheikh” Conference on the role of state courts in international arbitration on the 16th and 17th of November 2014, at Savoy Hotel, in Sharm El Sheikh, Egypt. This round comes after several successive legal and judicial developments in the Arab world that have led to remarkable reforms with respect to the settlement of commercial and investment disputes. Tremendous developments have taken place all over the Arab world from the Gulf to the Ocean aiming to increase the attractiveness of Arab states as a convenient seat for international arbitrations.Whatever the elements of attraction that have been made available, including the establishment of credible arbitration centers, the adoption of modern legislative infrastructure, and the ratification of relevant international conventions, state courts remain the most significant factor for any evaluation of the state’s suitability as a seat for international arbitrations. Over the last couple of years, a number of extremely interesting court decisions have been rendered in most of the Arab states, which are worthy of examination and scrutiny due to their important role in emphasizing the supporting, parallel and supervisory roles of state courts in international arbitration. Hence the importance of the Sharm El Sheikh V Conference to identify the salient judicial trends in the Arab world and to shed light on the latest judicial practices in the most significant seats of arbitration worldwide, including Europe (France, England, Switzerland, Sweden and Italy), Asia (Turkey), Africa (OHADA system), the United States and Latin America. These trends will be studied by tackling the role of state courts during the four basic phases of the arbitration process, namely, the arbitration agreement, the arbitral tribunal, the arbitration proceedings and the arbitral award. Sharm El Sheikh V coincides with the adoption of the new UNCITRAL Rules on Transparency in Treaty-based Investor-State Arbitration, which will be presented in the Conference for the first time in the Arab world. The London Court of International Arbitration has also adopted its new arbitration rules which will enter into force shortly before the Conference’s date. The Conference will also address their salient features, especially the Guidelines for the Parties’ Legal Representatives.The Sharm El Sheikh V conference represents a great opportunity to discuss the most important and recent legislative and institutional developments as well as the judicial practices in the field of international arbitration with a comparative approach in order to cover the Arab, European, Asian, and Latin American countries and the United States of America. These legislative and institutional developments will be exposed and studied not only from counsels, judges and arbitrators’ perspective but also from the perspective of Arab, regional and international arbitral institutions which play a crucial role in the assistance of state courts to perform their duties.
