With one simple application, you can have financialprotection from a range of life events: Disability, JobLoss, Strike or Lockout, Critical Illness or loss of Life. Common Carrier Travel Accident Insurancecoverage is underwritten by American Bankers Life Assurance Company ofFlorida. Travel Emergency Medical Insurance is underwritten by AmericanBankers Life Assurance Company of Florida, except for travel in Cuba which isunderwritten by Zurich Insurance Company Ltd. 2 You will earn 2 points per $1 on the first $50,000 in purchases made on yourScotiabank Passport Visa Infinite account (the “Account”) annually at thefollowing: purchases made at merchants classified in the Visa credit cardnetwork as: Grocery Stores and Supermarkets; Eating Places and Restaurants,Drinking Places, Fast Food Restaurants; Entertainment including Motion PictureTheaters, Theatrical Producers, Ticket Agencies, Bands, Orchestras,Miscellaneous Entertainers; Railroads, Local and Suburban Commuter PassengerTransportation, including Ferries, Passenger Railways, Taxicabs and Limousines,Bus Lines, Transportation Services (Not Elsewhere Classified). Some merchantsmay sell these products/services or are separate merchants who are located onthe premises of these merchants, but are classified by the credit card network inanother manner, in which case this added benefit would not apply. The annualspend calculation for the $50,000 maximum threshold is calculated annuallyfrom January 1st to December 31st each year.

You will earn 1 point per $1 on purchases made on the Account after the 2points per $1 / $50,000 annual spend maximum is reached and on all otherpurchases made on the Account.

Scotia Rewards points are only awarded on purchases. Scotia Rewards pointsare not awarded for cash advances, balance transfers, Scotia Credit CardCheques, payments, returns, refunds or other similar credits, fees or interest orother charges. Scotia Rewards points must be redeemed within 60 days ofAccount closure or they will be deleted permanently. If your Account is not ingood standing, the accumulated Scotia Rewards points are not eligible forredemption.

6 Earn 10,000 bonus Scotia Rewards points when you make at least $40,000 inpurchases annually on your Scotiabank Passport Visa Infinite account (the“Account”) each year (12-months). Annual period starts from the Accountopen date and resets every 12 months thereafter. You will earn 2,000 bonusScotia Rewards points for every additional $10,000 in purchases thereafter inthat same year, after the $40,000 annual spend has been reached. These bonuspoints are only earned on purchases. Bonus Scotia Rewards points are notawarded for cash advances, balance transfers, Scotia Credit Card Cheques,cash-like transactions, payments, returns, refunds or other similar credits, fees,interest or other charges.

Bonus Scotia Rewards points will be applied within two statement cycles afteryou have met the $40,000 annual spend threshold on the Account or withintwo statement cycles after you have met each additional $10,000 annual spendthreshold on the Account, provided your Account is open and in good standing.

7 Scotia Rewards Travel Service booking site is provided by a duly licensed 3rdparty travel agent. Visit scotiarewards.com for full terms and conditions aboutthe Scotia Rewards Program, including the Scotia Rewards Travel Service.

8 You can purchase eligible travel or related travel expenses at a travel providerother than the Scotia Rewards Travel Service (e.g., other travel agencies, touroperators and online travel websites) (the “Other Travel Suppliers”). These typesof purchases at Other Travel Suppliers are called “Post Purchase TravelRedemptions”. Scotia Rewards points are redeemable for Post Purchase TravelRedemptions made through your Program Card. To redeem Scotia Rewardspoints for a Post Purchase Travel Redemption at Other Travel Suppliers, thepurchase must first appear (post) on the Program Card Account. Scotia RewardsCardmembers can then redeem points towards the amount of the Post PurchaseTravel Redemption charged to the Program Account through scotiarewards.comor by calling 1-800-665-2582.The Post Purchase Travel Redemption must becharged on your Program Card Account and recognized by our systems with theMerchant Category Codes or identifiers: airlines & air carriers; airports, flyingfields, and airport terminals; lodgings, hotels, motels and resorts; trailer parksand campgrounds; passenger railways; bus lines; steamship and cruise lines;travel agencies and tour operators; automobile rental agency; motor home and

recreational vehicle rentals. These Merchant codes/identifiers and categories aresubject to change. The Post Purchase Travel Redemption can include relatedtaxes, booking fees, airport fees and travel insurance premiums. You mustredeem Scotia Rewards points within 12 months from the date when the PostPurchase Travel Redemption is posted to the Program Card Account (the postingdate). It may take up to two statement periods for the points redeemed for aPost Purchase Travel Redemption to appear as a credit on your Program CardAccount. Points redeemed cannot be reversed once posted to the Account. Toredeem Scotia Rewards points for a Post Purchase Travel Redemption, theProgram Card Account must be open and in good standing. The value of thepoints redeemed cannot exceed the amount of the Post Purchase TravelRedemption charged to your Program Card Account. The minimum pointredemption is 5,000 points (5,000 points is equivalent to $50 in travel savings)each time a redemption towards a Post Purchase Travel Redemption is made.

10 Scotia Rewards points can be converted into SCENE points and SCENE pointscan be converted into Scotia Rewards points. To do so, you must have aScotiabank card account that earns Scotia Rewards points (the “ScotiabankProgram Card Account”) and is in good standing, and a valid SCENEmembership card. You must convert a minimum of 1,000 points per conversion.You can convert points up to a maximum of 4 times within a 24 hour period.Conversions cannot be reversed or cancelled once completed. These conversionsare subject to the terms of your Points Conversion Terms and Conditions. Seethe Points Conversion Terms and Conditions on scotiarewards.com for fulldetails.

11 Priority Pass™ membership is for the Primary Cardmember on the ScotiabankPassport Visa Infinite account. It includes access to airport lounges participatingin the Priority Pass program. Certain terms, conditions and exclusions apply.Unless cancelled, Priority Pass membership automatically renews on itsanniversary date. Priority Pass membership will be cancelled if your ScotiabankPassport Visa Infinite Card is cancelled. If your Scotiabank Passport Visa InfiniteCard is renewed or replaced, remember to advise Priority Pass by phone (contactdetails included in your welcome kit or at www.prioritypass.com) and providethem with your updated account details. Lounge visits are counted on a perperson per visit basis (e.g. Lounge access by a Cardmember and oneaccompanying guest will count as two (2) visits). The first 6 lounge visits for theprimary Cardmember per 12-month cycle from date of enrolment arecomplimentary. Beginning with the 7th visit for the primary Cardmember,lounge visits are subject to a per person per visit charge of $27 USD (this pervisit fee is subject to change by Priority Pass). For complete Priority Pass termsand conditions, please visit www.prioritypass.com/Conditions-of-use.cfm.Priority Pass membership and services are provided by a third party and offeredthrough Visa Canada. Your privacy is important to Scotiabank. ThisAgreement sets out the information practices forScotiabank† in Canada, including what type ofinformation is collected, how the information is used,and with whom the information is shared.This Agreement may be amended from time to time.(See “Further Information”, below, for an explanationof how we will advise you of any future changes.)In this Agreement, “we”, “our”, “us” and“Scotiabank” mean Scotiabank† and include anyprogram or joint venture any of these partiesparticipates in; “you” and “your” mean an individualwho has made application to us for, enrolled in orsigned an application in respect of any personal orbusiness banking, insurance, brokerage or financialproduct or service offered by us (“Service”), includingany coapplicants, guarantors or personalrepresentatives.

COLLECTING, USING AND DISCLOSING YOURINFORMATION

1. When you apply for, or provide a guarantee inrespect of, or use any Service and while you are ourcustomer, you agree that we may collect personalinformation from you and about you such as:• Your name, address, telephone number, nature of

your principal business or occupation and date ofbirth, which is required by law;

• Identification, such as a valid driver’s license orpassport. We may also ask for documents such asa recent utility bill to verify your name andaddress;

• Your annual income, assets and liabilities andcredit history;

• Information about your transactions, includingpayment history, account activity and how youintend to use the account or Service and thesource of any incoming funds or assets;

• Information we may need in order to provide youwith a Service such as health information if youare applying for certain insurance products. Insome instances, providing this information isoptional;

• Information about third parties such as yourspouse if you are applying for certain Services,where this information is required by law; and

• Information about beneficial owners,intermediaries and other parties, which is requiredby law.

For legal entities such as businesses, partnerships,trusts, estates, clubs or other organizations, we maycollect the information referred to above from eachauthorized person, partner, trustee, executor and clubmember, as appropriate.In addition, when you apply for, enroll in or use aService via a digital channel (such as online or mobilebanking), we may collect information about yourcomputer or device, operating system, internetconnection or telephone account, settings, IP addressand device locational data, and transaction data, aswell as personal information as described above. Wemay collect, use, disclose and retain this informationfor the purposes described below, as well as todetermine which settings are appropriate for yourcomputer system, to provide or enhance digitalfunctionality and banking options, and for securitypurposes, internal analysis and reporting. You maywithhold consent to the collection, use and disclosureof this information, although in some cases this mayprevent you from using the digital channel to apply foror use a Service or to communicate with us, or mayreduce the functionality of that channel.We may collect your personal information, and use it,and disclose it to any person or organization for thefollowing purposes:• To confirm your identity;

• To understand your needs;

• To determine the suitability of our Services for you;

• To determine your eligibility for our Services;

• To set up, manage and offer Services that meet yourneeds;

• To provide you with ongoing Service;

• To provide you with various options for applying forand accessing Services;

• To satisfy legal and regulatory requirements that webelieve are applicable to us, including therequirements of any self-regulatory organizations towhich we belong;

• To help us collect a debt or enforce an obligationowed to us by you;

• To respond to a court order, search warrant or otherdemand or request which we believe to be valid, orto comply with the rules of production of a court;

• To manage and assess our risks;

• To investigate and adjudicate insurance claims, otherclaims or complaints; and

• To prevent or detect fraud or criminal activity or tomanage and settle any actual or potential loss inconnection with fraud or criminal activity.

When we collect your health information for thepurpose of providing an insurance Service, we willuse that information strictly for that purpose. (Seebelow for more information.) We do not providedirectly all the services related to your relationshipwith us. We may use third party service providers toprocess or handle personal information on ourbehalf and to assist us with various services such asprinting, postal and electronic mail distribution andmarketing (including by telephone and electronicmeans), and you acknowledge that we may releaseinformation about you to them. Some of our serviceproviders are located outside of Canada. As a result,your personal information may be accessible toregulatory authorities in accordance with the law ofthese jurisdictions. When personal information isprovided to our service providers, we will requirethem to protect the information in a manner that isconsistent with Scotiabank privacy policies andpractices.

2. We may collect, use and disclose your SocialInsurance Number (SIN), as well as otherinformation, for income tax reporting purposes, asrequired by law. In addition, we may ask you foryour SIN to verify and report credit information tocredit bureaus and credit reporting agencies as wellas to confirm your identity. This allows us to keepyour personal information separate from that ofother customers, particularly those with similarnames, and helps maintain the integrity andaccuracy of your personal information. You mayrefuse to consent to its use or disclosure forpurposes otherthan as required by law.

3. We may verify relevant information you give us withyour employer or your references and you authorizeany person whom we contact in this regard toprovide such information to us. If you apply for orenroll in a Service and during the time you have theService, we may consult various financial serviceindustry databases or private investigative bodiesmaintained in relation to the type of Service youhave applied for, enrolled in or have. You alsoauthorize us to release information about you tothese databases and investigative bodies. In Canada,investigative bodies are designated under theregulations of the Personal Information Protectionand Electronic Documents Act (PIPEDA) and includesuch organizations as the Bank Crime Preventionand Investigation Office of the Canadian BankersAssociation and the Investigative Services Division ofthe Insurance Bureau of Canada.

4. You agree that we may monitor, record, and retainany telephone call or electronic communication wehave with you. This is to establish a record of theinformation you provide, to ensure that yourinstructions are followed properly and to ensurecustomer service levels are maintained. Records ofcalls and electronic communications are destroyedwhen they are no longer required for business orother purposes, and any personal information issafeguarded in accordance with this Agreement.

5. Scotiabank may use video surveillance in and aroundour branches, bank machines and other locationsfor the purpose of safeguarding our clients andemployees and protecting against theft, fraud andvandalism. Any video images recorded are destroyedwhen they are no longer required for business orother purposes, and any personal information issafeguarded in accordance with this Agreement.

6. If you have a Service with us, we may use, discloseto and collect from credit bureaus or financialservice industry databases, credit and otherinformation about you in order to offer youpre-approved credit products or margin facilities.We may also do this after the Service has ended.You may withdraw your consent at any time bygiving us reasonable notice (see below).

7. We may give information (except healthinformation) about you to other members ofScotiabank (where the law allows this) so that thesecompanies may tell you directly about their productsand services. Scotiabank includes companiesengaged in the following services to the public:deposits, loans and other personal financial services;credit, charge, debit and payment card services; fullservice and discount brokerage services; mortgageloans; trust and custodial services; insuranceservices; investment management and financialplanning services; and mutual funds investmentservices. This consent will also apply to anycompanies that form a part of Scotiabank in thefuture. You also agree that we may provide youwith information from third parties we select. Yourconsent to this is not a condition of doing businesswith us and you may withdraw it at any time (seebelow).For a list of Scotiabank’s affiliates and subsidiaries inCanada, please refer to the Public AccountabilityStatement/Corporate Social Responsibility Reportavailable at any Scotiabank branch or on theScotiabank website at www.scotiabank.com.

8. We may ask you for contact information such asyour telephone, mobile or fax number or e-mailaddress, and keep and use this information as wellas disclose it to other members of Scotiabank so

that we or any of these companies may contactyou directly through these channels for thepurpose of marketing, including telemarketing. Thisconsent will also apply to any companies that forma part of Scotiabank in the future. Your consent tothis is not a condition of doing business with usand you may withdraw it at any time (see below).

9. If we sell a company or a portion of the businessof a Scotiabank company, we may release theinformation we hold about you to the prospectivepurchaser. We will require any prospectivepurchaser to protect the information provided andto use it in a manner that is consistent withScotiabank privacy policies and practices.

10. We may keep and use information about you inour records for as long as it is needed for thepurposes described in this Agreement, even if youcease to be a customer.

11. You agree that all information that you give uswill, at any time, be true and complete. If anypersonal information changes or becomesinaccurate or out of date, you are required toadvise us so we can update our records.

REFUSING OR WITHDRAWING CONSENT

Subject to legal, regulatory and contractualrequirements, you can refuse to consent to ourcollection, use or disclosure of information about you,or you may withdraw your consent to our furthercollection, use or disclosure of your information at anytime in the future by giving us reasonable notice.However, depending on the circumstances, withdrawalof your consent may prevent us from providing you, orcontinuing to provide you, with some Services, meansof access to Services, or information that may be ofvalue to you.We will act on your instructions as quickly as possiblebut there may be certain uses of your information thatwe may not be able to stop immediately.You cannot refuse our collection, use and disclosure ofinformation required by third party service providersessential for the provision of the Services or requiredby our regulators, including self-regulatoryorganizations. Some of our service providers arelocated outside of Canada. As a result, your personalinformation may be accessible to regulatory authoritiesin accordance with the law of these jurisdictions.You can tell us at any time to stop using informationabout you to promote our Services or the products andservices of third parties we select, or to stop sharingyour information with other members of Scotiabank. We mayalso give this information in respect of yourparticipation in contests and promotions administeredby the electronic payment service providers, credit orcharge card associations and loyalty program partnerson our behalf.If you have a mortgage account with us, we may giveinformation about you, including credit information, tomortgage insurers for any purpose related tomortgage insurance. Information retained by CanadaMortgage Housing Corporation will be subject tofederal access to information and privacy legislation.During the term of the loan or credit facility, you maynot withdraw your consent to our ongoing collection,use or disclosure of your personal information inconnection with the loan or other credit arrangementyou have with us or have guaranteed. We cancontinue to disclose your personal information to creditbureaus even after the loan or credit facility has beenretired, and you may not withdraw your consent toour doing so. We do this to help maintain theaccuracy, completeness and integrity of the creditreporting system.

IN ADDITION, IF YOU ACCEPT AN INSURANCESERVICE WITH USWhen you apply for, enroll in or sign an application inrespect of or accept an insurance Service from us, wemay use, give to, obtain, verify, share and exchangeinformation about you with others including referencesyou have provided, from hospitals and healthpractitioners, from government health insurance plans,from other insurers, from medical information andinsurance service bureaus, from law enforcementrepresentatives, from private investigators, and fromother groups or companies where collection isnecessary to underwrite or otherwise administer theService requested, including the assessment of claims.You also authorize any person whom we contact inthis regard to provide such information to us.If you accept an insurance Service with us, or if aninsurance Service is issued on your life, you may onlywithdraw your consent as noted above so long as theconsent does not relate to underwriting or claimswhere Scotiabank must collect and report informationto insurance service bureaus after the application hasbeen underwritten or the claim has been adjudicated.This is necessary to maintain the integrity of theunderwriting and claims systems.

FURTHER INFORMATION

You acknowledge that we may amend this Agreementfrom time to time to take into consideration changesin legislation, technology or other issues that mayarise. We will post the revised Agreement on ourwebsite and make it available at our branches or wemay also send it to you by mail. We may also notifyyou of any changes to this Agreement in any of thefollowing ways:• A notice prominently displayed at all Scotiabank

ATMs;

• An announcement through the Voice-Response-Unit(VRU) or a digital channel such as a mobile app;

• A notice on the Scotiabank website or your ScotiaOnLine portal;

• A notice in our branches; or

• A notice in your monthly statement.

Your continued use of the account or Service followingsuch change means that you agree to and accept thenew terms and conditions of the Agreement asamended. If you do not agree with any of the changesmade or with the new terms of the Agreement, youmust immediately stop using the account or Servicesand notify us that you are closing your account orterminating your Service with us.

Scotia Rewards points information for aProgram Card Account is also available to the PrimaryScotia Rewards Cardmember (or Co-Borrower) byregistering and logging into scotiarewards.com wherepoints balances are updated daily based on thetransactions that have been posted to the ProgramCard Account as of that date. Transactions mayrequire several business days to be posted to theAccount and the points balance shown may not alwaysbe up to date.

2. Redeeming PointsScotia Rewards points can only be redeemed as set outin these terms and conditions. Redemptions of ScotiaRewards points can be made for a travel purchase (alsoreferred to as a travel booking), merchandise andother non-travel rewards such as gift cards, pre-paidcards or other items/goods and services as described inthese terms and conditions.Scotia Rewards Cardmembers who redeem ScotiaRewards points are responsible for any taxes associatedwith their redemption and if applicable, must declarethe value of those redemptions to appropriate taxauthorities.

3. Redeeming Points on Closed AccountsIf a Program Card Account is closed (including if youcancel a Program Card), any unredeemed ScotiaRewards points can be redeemed within 60 days ofclosing the Account(s), provided the Account is in goodstanding1, after which time the unredeemed points willbe permanently cancelled.If the Program Card Account is closed, you will not beable to redeem any points for a Post Purchase TravelRedemption.If you have multiple eligible Program Cards, you maytransfer any accumulated Scotia Rewards points toanother Scotiabank Credit Card Account that earnsScotia Rewards points before electing to close theAccount, provided the Account(s) are open and ingood standing1 and the Account(s) are in your name.If the Scotia Rewards Account is closed by Scotiabankbecause it is not in good standing1, the Scotia Rewardspoints associated with that Account cannot beredeemed and will be immediately cancelled.

C. Transferring Points1. When Points can be TransferredScotia Rewards points are non-transferable. However,if you have more than one Program Card Account inyour name, we may allow you to transfer ScotiaRewards points to an open Program Card Account inyour name before electing to close a Program CardAccount, provided the Account(s) are in goodstanding1.For a joint Program Card Account, if you are thePrimary Scotia Rewards Cardmember or Co-Borrower,you may transfer Scotia Rewards points to anotherProgram Card Account, provided each of thoseAccounts are in good standing1 and each Account is inyour name.Supplementary Cardmembers cannot transfer,combine or redeem points on any Program CardAccounts.Scotia Rewards Cardmembers can go toscotiarewards.com to complete a transfer of points. Ifyou have any questions, visit us online or contact theScotia Rewards Centre.

2. Points Transfer on Death or Separation/Divorceor Change in Business Ownership or LegalStructureUpon the death of a Primary Scotia RewardsCardmember and verification by Scotiabank, if there isno Co-Borrower on the Program Card Account, theestate of the Primary Scotia Rewards Cardmember canredeem unused Scotia Rewards points for up to 60days from the date of death provided that Account isin good standing1 after which time, unredeemedScotia Rewards points will be permanently cancelled. Inthe case of a joint Program Card Account, thesurviving Primary Scotia Rewards Cardmember orCo-Borrower, as the case may be, can elect to redeemunused Scotia Rewards points for up to 60 days fromthe date of death or can request to transfer them to anew Program Card Account in their name, providedthe Account(s) are in good standing1. Otherwise, theunredeemed Scotia Rewards points will bepermanently cancelled.Points cannot be divided or otherwise transferred inthe event of separation or divorce.In the event that a change in legal structure (e.g., SoleProprietor to incorporated) or changes in ownership ofa business occurs, transfer of points to the Scotiabankcredit card replacement account that

Remember: If youbook travel by phone, a booking fee will be charged bythe Scotia Rewards Travel Service (disclosed to you atthe time of booking or by visiting scotiarewards.comfor details) for that travel purchase and will be chargedto your Program Card Account. Booking fee is subjectto change.

2. Redeeming Points for Travel Purchases:You can redeem your Scotia Rewards points for atravel purchase made through the Scotia RewardsTravel Service using the following options:

i. Redeeming points (“Points Only”)This payment option allows you to redeem pointsfor the entire amount of your travel purchasemade through the Scotia Rewards Travel Service;

ii. Redeeming points plus a charge to yourProgram Card (“Points Plus Charge”)This payment option allows you to book travelthrough the Scotia Rewards Travel Service andthe value of any Scotia Rewards points redeemedwill be deducted from the total purchase with thedifference in the amount for that travel purchasethen charged to your Program Card.

You will earn points only on the amount of the travelpurchase charged to your Program Card. You will notearn points on the amount of the travel purchasetowards which you redeem points.

The minimum point redemption is 5,000 points (5,000points is equivalent to $50 in travel savings) eachtime a redemption towards a travel purchase is madethrough the Scotia Rewards Travel Service.

3. Cash Back Rebate on Travel Purchases madethrough the Scotia Rewards Travel Service(ScotiaGold Passport Visa Card or ScotiaGoldPassport for business Visa Cards only) ScotiaGoldPassport Visa Card accounts or ScotiaGold Passport forbusiness Visa Card accounts can earn 5% in cash back(the “Cash Back Rebate”) on the amount of travelpurchases made on their Program Card Account if:

i. the travel purchase is made through the ScotiaRewards Travel Service; and

ii. the entire amount of the travel purchase ischarged to the ScotiaGold Passport Visa Card orScotiaGold Passport for business Visa Cardaccount either through (a) using a “Points Only”option to charge entire amount of the travelpurchase (“Points Only”) to the applicableProgram Card Account OR (b) using a “Points PlusCard” option to redeem points towards a partialamount of the travel purchase and applying thebalance of that travel purchase to the ProgramCard.

Eligible purchases that can earn the Cash Back Rebateare limited to: airline tickets, pre-packaged tours andcruises booked through Scotia Rewards Travel Service.Taxes, service charges, insurance, accommodations,car rentals, fully independent tours and personalexpenditures, such as meals, are excluded fromearning the Cash Back Rebate, unless such items arealready included in the pre-packaged tours purchasedthrough the Scotia Rewards Travel Service.When using the “Points Plus Card” option to redeempoints for a travel purchase through the ScotiaRewards Travel Service, the Cash Back Rebate isapplicable only to the portion of the travel purchasethat is charged to the ScotiaGold Passport Visa Card orthe ScotiaGold Passport for business Visa Cardaccounts, not any amount of the travel purchase forwhich a points redemption is applied.The Cash Back Rebate is provided by a third partyprovider. 4. Other Information about Travel Purchasesthrough the Scotia Rewards Travel ServiceAvailability / Pricing: All travel rewards listed in theScotia Rewards Catalogue, Scotia Rewards ProgramSite or any other brochure or notice made available to

you, are subject to availability by the travel supplier,hotel or any other applicable supplier. The ScotiaRewards Travel Service does not commit to pricematching other than the Best Price Guaranteeprogram.

Travel Confirmations: All correspondence and traveldocuments/itinerary provided by Scotia Rewards TravelService will be sent to the Primary Cardmember’s (orCo-Borrower’s) address or email appearing in ourrecords at Scotia Rewards Travel Service or at theaddress instructed by the Primary Cardmember (orCo-Borrower). We are not responsible for any failureto receive these travel documents if we send them tothe address appearing in our records at the ScotiaRewards Travel Service or the instructions we receivefrom the Primary Cardmember or Co-Borrower.

Travel Documents: You and your travel companionsare responsible to ensure that you have in yourpossession, on departure and as otherwise required, allnecessary travel documents. We are not responsible ifyou do not have the necessary travel documents andyou will not be entitled to any compensation from us.It is your responsibility to check with the airlines andother travel suppliers for all estimated departure times,arrival times, and check-in times.

Pay at Destination: While most hotel and car rentalbookings will be prepaid (requiring Cardmembers topay only local tax and incidentals atcheck-out/dropoff), there may be occasions where aprepayment is not possible. In these situations, yourhotel and/or car bookings will be considered a “Pay AtDestination” booking. For these bookings, points areredeemed in the form of a travel credit. The travelcredit is applied to your Program Card Account within14 days of the date of this booking. Full payment iscollected by the hotel and/or car rental agency. Pay atDestination is only applicable to trips reserved throughthe Scotia Rewards Travel Service and paid with aProgram Card.

Travel Cancellation: If you wish to cancel your travelbooking before your travel departure date, or anyportion of it, made through the Scotia Rewards TravelService, we will attempt to assist you but you agreethat any cancellation is subject to the terms andconditions of the third party travel supplier that isproviding that travel purchase and the terms of thetravel purchase itself. In some cases, this means thatfor non-refundable tickets, cancellations are notallowed or are subject to cancellation fees. Anycancellation fees will be charged directly to theProgram Card Account on which the travel purchasewas made.Travel cancellations and/or changes made to travelpurchases outside of Scotia Rewards Travel Service

hours are dependent on the terms set by the thirdparty travel providers and their hours of operation. TheScotia Rewards Travel Service is not responsible forearlier closures or any cancellation of these travelpurchases by the third party travel providers.Point redemptions for travel purchases are final.However, if you are able to cancel a travel purchase forwhich you redeemed Scotia Rewards points, we willcredit the Program Card Account for the pointsredeemed at the value they were redeemed at.

Travel Insurance: Your Program Card may includeinsurance coverages related to travel. Please refer tothe rewards and travel benefits posted online atscotiabank.com or to the Certificates of Insuranceprovided with your Program Card for a full descriptionof any included coverage. For all insurance coverages,certain limitations, restrictions and exclusions apply,including a pre-existing condition exclusion for certainbenefits2.

F. Post Purchase Travel RedemptionYou can purchase eligible travel or related travelexpenses at a travel provider other than the ScotiaRewards Travel Service (e.g., other travel agencies, touroperators and online travel websites) (the “OtherTravel Suppliers”). These types of purchases at OtherTravel Suppliers are called “Post Purchase TravelRedemptions” (also referred to as "Apply Points toTravel").Scotia Rewards points are redeemable for PostPurchase Travel Redemptions made through yourProgram Card. To redeem Scotia Rewards points for aPost Purchase Travel Redemption at Other TravelSuppliers, the purchase must first appear (post) on theProgram Card Account. Scotia Rewards Cardmemberscan then redeem points towards the amount of thePost Purchase Travel Redemption charged to theProgram Account through scotiarewards.com or bycalling 1-800-665-2582.The Post Purchase Travel Redemption must be chargedon your Program Card Account and recognized by oursystems with the Merchant Category Codes oridentifiers: airlines & air carriers, airports, flying fields,and airport terminals; lodgings, hotels, motels andresorts, trailer parks and campgrounds; passengerrailways, bus lines, steamship and cruise lines; travelagencies and tour operators, automobile rentalagency, motor home and recreational vehicle rentals.These Merchant codes/identifiers and categories aresubject to change.The Post Purchase Travel Redemption can includerelated taxes, booking fees, airport fees and travelinsurance premiums.You must redeem Scotia Rewards points within 12

To redeemScotia Rewards points towards your Post PurchaseTravel Redemption, the Program Card Account mustbe open and in good standing1.The value of the points redeemed cannot exceed theamount of the Post Purchase Travel Redemptioncharged to your Program Card Account.

G. Redeem Scotia Rewards Points for CreditA Primary Scotia Rewards Cardmember orCo-Borrower can redeem points online throughscotiarewards.com for a credit that will be applied tothe Program Card Account or we may from time totime send a Primary Scotia Rewards Cardmember orCo-Borrower an offer to redeem points for a credit.Your Program Card Account must be open and ingood standing1 at the time the credit is applied to theProgram Card Account.It may take up to two statement periods, following arequest to redeem points for a credit, for the credit toappear on the Program Card Account. Once therequest to redeem Scotia Rewards Points for a Credithas been submitted, you cannot cancel the requestand no changes can be made. The credit will beapplied towards the balance of the Program CardAccount, not towards a particular transaction.For additional information and instructions on how toredeem Scotia Rewards Points for a Credit, including ifany minimum redemption amounts are required,please visit scotiarewards.com.

H. Points Status when Switching CardsIf you switch your Program Card Account to anotherProgram Card Account, then your accumulated ScotiaRewards points will transfer over to your new ProgramCard Account, so long as both Accounts are in yourname and are in good standing1.If you switch (transfer) your Program Card to aScotiabank credit card that does not offer the ScotiaRewards Program, your Scotia Rewards points will nottransfer over to your new Scotiabank credit card. Inthat case, you may redeem any unused Scotia Rewardspoints for merchandise within 60 days of the switch,provided your Program Card Account and the otherScotiabank credit account are in good standing. After

60 days, unredeemed points will be permanentlycancelled.

I. Cancelled, Lost or Stolen Program CardsCancelled Program Cards on Program Card Accountsare not eligible to earn Scotia Rewards points aftertheir cancellation date. If your Program Card is lost orstolen, we will replace that Program Card and transferyour points to the new Program Card Account openedin your name for the replacement card.

J. Changes to this ProgramScotiabank reserves the right to modify, terminate,suspend or extend or otherwise alter all or any of theterms and conditions of the Scotia Rewards programby giving 30 days’ notice, including the following:

i. The amount of points earned or redeemedthrough the Program;

ii. The value of points;iii. What you can or cannot redeem points for;iv. When you can transfer points and to whom;v. The length of time available to redeem points; orvi. Any fees or charges that apply to this Program

including booking fees.In the event we terminate this Program, the PrimaryCardmember will be notified and can redeem anyunused points within 60 days after the Program’stermination date, provided their Program Account(s) isin good standing1.

K. General Program TermsGood Standing: If the Program Card Account is not ingood standing, Scotia Rewards points are not eligiblefor redemption and the Account will not earn points.Canadian $: All amounts referred to are in Canadiandollars unless otherwise noted.

L. Dependent Child(ren) also includes children 21years of age or over who are permanently mentally orphysically challenged and incapable of self-support.Dollars and $ means Canadian dollars.Essential Items mean the minimum essential clothing andtoiletries, the purchase of which is rendered absolutelynecessary and indispensable due to the delay of YourChecked Luggage.Final Destination means the away-from-home ticketeddestination for any particular day of travel, as shown onyour Ticket.Good Standing means, with respect to an Account, thatthe Primary Cardmember has not advised the Policyholderto close it or the Policyholder has not suspended or revokedcredit privileges or otherwise closed the Account.Hotel/Motel means an establishment located in Canada orthe United States that provides lodging for the generalpublic, and usually meals, entertainment, and variouspersonal services.Immediate Family Member means the Cardmember’sSpouse, Dependent Children and parents residing with theCardmember.Insured Item means a new item (a pair or set being oneitem) of personal property (not purchased by or for use by abusiness or for commercial purposes) for which the fullPurchase Price is charged to an Account and/or paid withScotia Rewards® points.Insured Person means a Cardmember and, wherespecified, certain other eligible persons as outlined underthe applicable benefit.Manufacturer’s Warranty means an express writtenwarranty valid in Canada or the United States and issued bythe original manufacturer of the Insured Item at the time ofpurchase, excluding any extended warranty offered by themanufacturer or any third party.Mysterious Disappearance means the vanishing of anitem which cannot be explained, i.e. there is an absence ofevidence of a wrongful act of another person.

Other Insurance means all other applicable validinsurance, indemnity, warranty or protection available toYou in respect of the item(s) subject to the claim, as furtherdefined in Section 9 of this Certificate.Primary Cardmember means the principal applicant for anAccount who is a natural person resident in Canada towhom a Scotiabank Passport Visa Infinite card is issued bythe Policyholder.Purchase Price means the actual cost of the Insured Item,including any applicable taxes, as shown on the storereceipt.

Scotia Assist means the Insurer in relation to claimpayment and administrative services.Spouse means the person who is legally married to theCardmember or the person who has been living with theCardmember for a continuous period of at least one yearand is publicly represented as the Cardmember’s Spouse.Ticket means evidence of fare paid for travel on aCommon Carrier, which has been charged to Your Accountand/or paid with Scotia Rewards points.Trip means a scheduled period of time during which anInsured Person is away from his or her province or territoryof residence in Canada, as determined by the departureand return dates.2. PURCHASE SECURITYFor this coverage, Insured Person means the Cardmember.No other person or entity shall have any right, remedy orclaim, legal or equitable to the benefits.a) Benefits – Purchase Security coverage automatically,without registration, protects most new Insured Itemspurchased anywhere in the world (provided the fullPurchase Price is charged to the Account and/or paid withScotia Rewards points) by insuring them for 90 days fromthe date of purchase in the event of loss, theft, or damagein excess of Other Insurance. If an Insured Item is lost,stolen or damaged, Scotia Assist will reimburse You thelesser of the repair or replacement cost, not exceeding theoriginal Purchase Price charged to the Account, subject tothe limits of liability and exclusions stated in Section 7 ofthis Certificate of Insurance.b) Excluded Items – Purchase Security does not cover the

following items: travellers cheques, cash, tickets or anyother negotiable instruments; bullion, rare or preciouscoins; art objects (such as but not limited to hand-madeitems, limited editions, original, signature pieces orcollectible plates); pre-owned or used items, includingantiques and demos; animals; living plants; perishablessuch as food and liquor; aircraft and parts andaccessories thereof; automobiles, motorboats,motorcycles or any other motorized vehicles and partsand accessories thereof; items consumed in use;services; ancillary costs incurred in respect of an InsuredItem and not forming part of the Purchase Price; partsand/or labour required as a result of mechanicalbreakdown; items purchased by and/or used for abusiness or commercial purpose and commercial

gain; mail order items until received and accepted bythe Cardmember in new and undamaged condition;jewellery transported/stored in baggage which is notunder the personal supervision of the Cardmember orCardmember’s travelling companion.

c) Gifts – Insured Items the Cardmember gives as giftsare covered by Purchase Security. In the event of aclaim, the Cardmember, not the recipient of thegift, must make the claim for benefits.

d) Termination – Coverage ends the earliest of:(i) the date the Account is cancelled, closed or

ceases to be in Good Standing;(ii) the date the Cardmember ceases to be eligible

for coverage; and(iii) the date the Policy terminates.

No coverage will be provided for items purchased after thePolicy termination date.3. EXTENDED WARRANTYFor this coverage, Insured Person means the Cardmember.No other person or entity shall have any right, remedy orclaim, legal or equitable to the benefits.a) Benefits – Extended Warranty coverage provides

the Cardmember with double the period of repairservices otherwise provided by the originalManufacturer’s Warranty, to a maximum of 1additional year, when the full Purchase Price ischarged to the Account and/or paid with ScotiaRewards points on most Insured Items purchasedanywhere in the world. Extended Warranty benefitsare limited to the lesser of the cost to repair or theoriginal Purchase Price charged to the Account.

b) Registration – Insured Items with a Manufacturer’sWarranty of 5 or more years are ONLY covered ifregistered within the first year of purchase. InsuredItems with a Manufacturer’s Warranty of less than5 years DO NOT require registration. To registeritem(s) with a Manufacturer’s Warranty of morethan 5 years for the Extended Warranty benefit, call1 877-711-8286 between 8:00 am and 8:00 pm,ET, Monday through Friday. You will be required tosend copies of the following items to Scotia Assistwithin 1 year after the Insured Item is purchased:(i) a copy of the original vendor sales receipt;(ii) the customer copy of Your sales receipt;(iii) the serial number of the item; and(iv) a copy of the original Manufacturer’s Warranty.

c) Excluded Items – Extended Warranty does notcover the following items: aircraft and parts andaccessories thereof; automobiles, motorboats,motorcycles and any other motorized vehicles andparts and accessories thereof; used items; livingplants; trim parts; services; items purchased byand/or used for a business or commercial purposeand commercial gain; dealer and assembler

warranties; or any other obligation other than thosespecifically covered under the terms of the originalManufacturer’s Warranty.

d) Gifts – Insured Items the Cardmember gives as giftsare covered under the Extended Warranty coveragesubject to compliance with the terms and conditionsof the coverage offered hereunder.

e) Termination – Coverage ends the earliest of:(i) the date the Account is cancelled, closed or

ceases to be in Good Standing;(ii) the date the Cardmember ceases to be eligible

for coverage; and(iii) the date the Policy terminates.

No coverage will be provided for items purchased after thePolicy termination date.4. LOST LUGGAGEFor this coverage, Insured Person means the Cardmemberand any Immediate Family Member travelling with aCardmember.a) Benefits – Lost Luggage coverage provides

protection from theft or permanent misdirection ofthe Checked Luggage by a Common Carrier up to amaximum of $1,000 per Trip for all Insured Personson the same Trip provided that the full price of theInsured Person’s fare has been charged to anAccount and/or paid with Scotia Rewards points.Payment is based on the actual replacement cost ofany lost or stolen article provided the article isactually replaced. Otherwise, payment is based onthe actual cash value of the article at the time ofloss.

b) Excluded Items – Lost Luggage does not cover:animals; any conveyance or appurtenances exceptbicycles; contact lenses; eyeglasses; hearing aids;artificial teeth; dental bridges; prosthetic limbs;money; securities; credit cards and any othernegotiable instruments; tickets and documents;cameras; sporting equipment; business items; artobjects (such as but not limited to hand-madeitems, limited editions, original, signature pieces orcollectible plates); electronic equipment; luggagenot checked; luggage held, seized, quarantined ordestroyed by a customs or government agency; orwhere a reimbursement or a non-monetary (tickets,coupons, travel vouchers) settlement is made by theCommon Carrier.

5. DELAYED LUGGAGEFor this coverage, Insured Person means the Cardmemberand any Immediate Family Member travelling with aCardmember.a) Benefits – Delayed Luggage coverage reimburses

an Insured Person for the cost of replacing EssentialItems, if the Insured Person’s Checked Luggage isnot delivered within 4 hours from the InsuredPerson’s time of arrival at the Final Destination,

provided the full price of the Insured Person’s farehas been charged to an Account and/or paid withScotia Rewards points. The Essential Items must bepurchased before the Checked Luggage is returnedto the Insured Person and no later than 96 hoursafter the Insured Person’s time of arrival at the FinalDestination. The maximum benefit payable underDelayed Luggage coverage per Trip for all InsuredPersons on the same Trip is $1,000.

b) Excluded Items – The Delayed Luggage coveragedoes not cover: losses occurring when CheckedLuggage is delayed on an Insured Person’s returnhome to their province or territory of residencein Canada; expenses incurred more than 96 hoursafter the Insured Person’s time of arrival at the FinalDestination; expenses incurred after the CheckedLuggage is returned to the Insured Person; lossescaused by or resulting from any criminal act by theInsured Person; baggage not checked; baggageheld, seized, quarantined or destroyed by a customsor government agency; money; securities; creditcards; negotiable instruments; tickets; ordocuments of any nature whatsoever.

6. HOTEL/MOTEL BURGLARYFor this coverage, Insured Person means the Cardmemberand any Immediate Family Member travelling with aCardmember.a) Benefits – The Hotel/Motel Burglary coverage

protects the Insured Person, for the period of timebetween Check In and Check Out, from theft ofmost items of personal property from a Hotel/Motelroom where there is evidence of forceful entry,ONLY within the territorial limits of Canada and theUnited States. Coverage is up to a maximum of$1,000, in excess of Other Insurance and/orpayments made by the Hotel/Motel, provided thefull cost of the Hotel/Motel room has been chargedto the Account and/or paid with Scotia Rewardspoints.

b) Excluded Items – Hotel/Motel Burglary does notcover: cash; travellers cheques; securities; creditcards; or any other negotiable instruments; ticketsand documents.

7. ADDITIONAL LIMITS OF LIABILITY ANDEXCLUSIONS

a) Limits of Liability – There is a maximum lifetimeliability of $60,000 under the Purchase Security andExtended Warranty coverages.In the event that the Insured Item cannot berepaired or replaced, Scotia Assist, at its sole option,may reimburse You up to the Purchase Price of theInsured Item.Claims for items belonging to and purchased as apair or set will be paid for at the full Purchase Priceof the pair or set provided that the parts of the pairor set are unusable individually and cannot be

replaced individually. Where parts of the pair or setare usable individually, liability will be limited topayment equal to the proportionate part of thePurchase Price that the number of damaged orstolen parts bears to the number of parts in thecomplete pair or set.

b) Exclusions – The Policy does NOT provide coveragefor losses resulting from: misuse or abuse; fraud;normal wear and tear; inherent product defects(which means imperfections which impair the use ofthe product); Mysterious Disappearance; theft froma vehicle unless the vehicle is locked and there arevisible signs of forced entry; flood, earthquake orradioactive contamination; hostilities of any kind(including war, invasion, terrorism, rebellion orinsurrection), confiscation by authorities, risks ofcontraband or illegal activity; or incidental andconsequential damages, including bodily injury,property, punitive and exemplary damages and legalfees.

8. CLAIMSa) Filing a Claim – To initiate a claim, the

Cardmember must notify Scotia Assist as soon asreasonably possible and PRIOR to proceeding withany action or repairs and no later than 90 days fromthe date of loss or damage, by calling1 877-711-8286 or 613-634-6980 locally between8:00 a.m. and 8:00 p.m. ET, Monday throughFriday.

b) Validation of a Claim – The Cardmember MUSTmaintain ORIGINAL copies of all documentsrequired. Where a claim is due to fraud, maliciousacts, burglary, robbery, theft or attempt thereat, oris suspected to be so caused, the CardmemberMUST give immediate notice to the police or otherauthorities having jurisdiction. The Cardmembermay be required to send, at the Cardmember’sexpense and risk, the damaged Insured Item onwhich a claim is based, to an address designated byScotia Assist.

c) Claim Form – Upon notifying Scotia Assist of theloss, the Cardmember will be sent a claim form. Thecompleted claim forms together with written proofof loss must be delivered as soon as reasonablypossible, but in all events within 1 year from thedate on which the loss occurred.Failure to provide notice or furnish proof of claimwithin the time prescribed herein does not invalidatethe claim if the notice or proof is given or furnishedas soon as reasonably possible, and in no event laterthan one year from the date a claim ariseshereunder, if it is shown that it was not reasonablypossible to give notice or furnish proof within thetime so prescribed. If the notice or proof is given orfurnished after 1 year, Your claim will not be paid.

d) Payment of Claim – Benefits payable under thePolicy will be paid upon receipt of full written proof,as determined by Scotia Assist.

e) Purchase Security – Under the Purchase Securitycoverage, the Cardmember will be required tocomplete a claim form and MUST include copies ofthe customer copy of the original store receipt,Scotiabank Passport Visa Infinite card charge slip,and Account statement and police report ifobtainable, and if not obtainable, the department,file number, address, contact name on the file andtelephone number, and any other informationreasonably required by Scotia Assist to determinethe Cardmember’s eligibility for benefits under thePolicy.

f) Extended Warranty – Under the ExtendedWarranty coverage, the Cardmember will berequired to complete a claim form PRIOR toproceeding with any repairs, and MUST includecopies of the customer copy of the original storereceipt, Scotiabank Passport Visa Infinite card chargeslip, and Account statement and Manufacturer’sWarranty. Upon receipt of the completeddocumentation, if the claim is eligible for coverageunder the Policy, Scotia Assist will provide a noticeto the Cardmember containing an authorization toproceed with the necessary repairs and theparticulars of the repair facility designated tocomplete the necessary repairs.

g) Lost Luggage – Under the Lost Luggage coverage,the Cardmember will be required to complete theclaim form and MUST include copies of theCommon Carrier ticket, the baggage claim ticket,Scotiabank Passport Visa Infinite card charge slipand Account statement and a written statementfrom the Common Carrier confirming:(i) the date, time and details of loss;(ii) payout documentation from the Common

Carrier including a copy of the cheque, claimform, a list of items lost and their value; and

(iii) any other information reasonably required byScotia Assist to determine coverage eligibility.

h) Delayed Luggage – Under the Delayed Luggagecoverage, the Cardmember will be required tocomplete the claim form and MUST include copiesof the Scotiabank Passport Visa Infinite card chargeslip and Account statement. In addition, theCardmember will be required to submit itemizedreceipts for actual expenses incurred for EssentialItems and a written statement from the CommonCarrier confirming all of the following specifics:(i) date and time of delay;(ii) date and time that the Checked Luggage was

returned to the Insured Person;(iii) reason or circumstances surrounding the delay; and(iv) any other information reasonably required by

Scotia Assist.

i) Hotel/Motel Burglary – Under the Hotel/MotelBurglary coverage, the Cardmember will be requiredto complete a claim form and MUST include copiesof the Scotiabank Passport Visa Infinite card chargeslip and Account statement, a written statementfrom the Hotel/Motel confirming the date, time anddetails of the loss, police report if obtainable, and ifnot obtainable, the department, file number,address, contact name on the file, and telephonenumber, payout documentation from the OtherInsurance carrier, if applicable, and any otherinformation reasonably required by Scotia Assist todetermine coverage eligibility.

9. GENERAL PROVISIONS AND STATUTORYCONDITIONS

Unless otherwise expressly provided herein or in the Policy,the following general provisions apply to the benefitsdescribed in this Certificate of Insurance.a) Coverage Termination – Coverage under the

Policy ends at the earliest of:(i) the date the Account is cancelled or closed or

ceases to be in Good Standing;(ii) the date the Insured Person ceases to be eligible

for coverage; and(iii) the date the Policy terminates.

No benefits will be paid under the Policy for losses incurredafter coverage has terminated, unless otherwise specifiedor agreed.b) Other Insurance – Where an Insured Person has

Other Insurance, the loss or damage MUST bereported to the primary carrier in addition to filingwith Scotia Assist, and copies of the payoutdocuments from the Other Insurance carrier mustbe provided to Scotia Assist. If the loss or damage isnot covered under the Other Insurance, a letterfrom the Other Insurance carrier so indicatingmay be required. The insurance extended under thePolicy by the Insurer is issued strictly as excesscoverage and does not apply as contributinginsurance. The coverage extended under the Policywill reimburse the Cardmember only to the extent apermitted claim exceeds coverage and paymentunder Other Insurance, regardless of whether theOther Insurance contains provisions purporting tomake its coverage non-contributory or excess. ThePolicy also provides coverage for the amount of thedeductible under Other Insurance.

c) Subrogation – As a condition to the payment ofany claim to a Cardmember, the Cardmemberand/or any Insured Person shall, upon request,transfer or assign to the Insurer all legal rightsagainst all other parties for the loss. TheCardmember and/or any Insured Person shall givethe Insurer all such assistance as the Insurer mayreasonably require to secure its rights and remedies,including the execution of all documents necessaryto enable the Insurer to bring suit in the name ofthe Cardmember and/or Insured Person.

d) Due Diligence – The Cardmember shall use diligenceand do all things reasonable to avoid or diminish any lossor damage to property protected by the Policy.

e) False Claim – If a Cardmember makes a claim knowingit to be false or fraudulent in any respect, suchCardmember will not be entitled to the benefit ofcoverage under the Policy nor to the payment of anyclaim made under the Policy.

f) Legal Action – Every action or proceeding against aninsurer for the recovery of insurance money payableunder the contract is absolutely barred unlesscommenced within the time set out in the Insurance Act,Limitations Act or other applicable legislation in Yourprovince or territory.

g) If You Have a Concern or ComplaintIf You have a concern or complaint about Yourcoverage, please call the Insurer at 1-877-711-8286 orthe Policyholder at 1-800-472-6842. The Insurer will doits best to resolve Your concern or complaint. If for somereason the Insurer is unable to do so to Yoursatisfaction, You may pursue the concern or complaintin writing to an independent external organization. h) PrivacyThe Insurer may collect, use, and share personalinformation provided by You to the Insurer, andobtained from others with Your consent, or as requiredor permitted by law. The Insurer may process andstore Your information in another country, which maybe subject to access by government authorities underapplicable laws of that country. Price comparisonswith liquidated merchandise, grey market (internet) itemsand gift card or savings card incentives issued by a retailerare not eligible for Price Protection Service coverage.You are only eligible for the Price Protection Service if theAccount is in Good Standing at the time of Your request.4. GIFTSEligible items that You give as gifts are covered. In theevent a price difference is discovered, You, not therecipient of the gift, must make the request for payment.5. Scotia Assist will send You the applicable request form.Your failure to provide to Scotia Assist the completedrequest form and proof supporting Your request underitems (i) – (iii) below within 90 days from the date ofpurchase may result in non-payment of the related request.

You must complete and sign the request form and includethe following:

(i) the customer copy of the original vendor’s salesreceipt;

(ii) the Account statement showing the charge; and

(iii) a dated advertisement/flyer to prove that theidentical item was offered in Canada at thereduced price within 60 days of the date of Yourpurchase.

A request for payment under the Policy will be paid uponreceipt of full written proof, as determined by Scotia Assist.

6. TERMINATION OF COVERAGE

Coverage ends on the earliest of:

(i) the date the Account is cancelled, closed or ceasesto be in Good Standing;

(ii) the date the Cardmember ceases to be eligible forcoverage; and

(iii) the date the Policy terminates.

No coverage will be provided for items purchased aftercoverage ends.

Cardmember means the Primary Cardmember and anysupplemental Cardmember who is a natural person residentin Canada to whom a Scotiabank Passport Visa Infinite cardis issued and whose name is embossed on the card. TheCardmember may be referred to as “You” or “Your”.

Cause(s) for Cancellation means any one of the medical ornon-medical covered causes for cancellation identified inSection 3 of this Certificate.

Cause(s) for Interruption means any one of the medical ornon-medical covered causes for interruption identified inSection 4 of this Certificate.

Common Carrier means any land, air or water conveyancewhich is licensed to carry passengers without discriminationand for hire, excluding courtesy transportation providedwithout a specific charge.

Dependent Children means Your unmarried natural,adopted or step-children who are dependent on You formaintenance and support and who are either under 21years of age, or under 25 years of age and in full-timeattendance at a recognized institution of higher learning inCanada. Dependent Child(ren) also includes children 21years of age or over who are permanently mentally orphysically challenged and incapable of self-support.

Doctor means a physician or surgeon who is registered orlicensed to practice medicine in the jurisdiction where themedical treatment or service is provided, and who is notrelated by blood or by marriage to the Insured Person towhom the service is rendered.

Dollars and $ means Canadian dollars.

Eligible Expenses mean charges for any of the followingtravel arrangements which have been booked or reservedprior to departure on a Trip and for which at least 75% ofall costs (including deposits and pre-payments, butexcluding the cost of additional insurance You may obtainfrom Your travel supplier) has been charged to YourAccount and/or Your Scotia Rewards®* points:

a) cost of transportation by Common Carrier;

b) cost of hotel or similar accommodation; and

c) cost of a package tour (excluding insurance premiums)which has been sold as a unit and includes at least twoof the following:

• transportation by Common Carrier

• meals

• car rental

• tickets or passes for a sporting event, exhibition orother comparable entertainment event

• hotel or similar accommodation

• lessons or services of a guide

Emergency means an unforeseen event that occurs after aTrip was booked and makes it necessary to receiveimmediate treatment from a Doctor or to be hospitalized.

Good Standing means, with respect to an Account, that thePrimary Cardmember has not advised the Policyholder toclose it and the Policyholder has not suspended or revokedcredit privileges or otherwise closed the Account.

Hospital means an institution which is licensed to provide,on an in-patient basis, medical care and treatment of sickand injured persons through medical, diagnostic and majorsurgical facilities, under the supervision of a staff ofDoctors and with 24-hour-a-day service. Hospital does notinclude any institution or part of an institution which islicensed or used principally as a clinic, a continued care orextended care facility, a convalescent home, a rest home, anursing home or home for the aged, a health spa or atreatment centre for drug addiction or alcoholism.

Hospitalization means a stay of at least 48 hours in aHospital for Emergency and medical treatment whichcannot be postponed.

Immediate Family Member means a spouse, daughter orson (whether natural, adopted or step-child), grandchild,grandparents, mother, father, step-parent, sister,step-sister, brother, step-brother, parent-in-law,daughter-in-law, son-in-law, sister-in-law or brother-in-law.

Insured Person means an eligible Cardmember and/or his orher Spouse, and eligible Dependent Children whentravelling with the Cardmember and/or his or her Spouse.Insured Person also means one (1) Travelling Companionbooked to travel on a Trip with You and/or Your Spouse ifthe full cost of his or her Eligible Expenses for the Trip hasbeen charged to the Account.

Key Employee means an employee whose continuedpresence at the Insured Person’s place of business is criticalto the ongoing affairs of the Insured Person’s businessduring Your Trip.

Legal Business Partner means a person who participateswith the Insured Person in the daily management of ashared business and who shares the financial risk of theoperation.

Medical Condition means any illness, injury or symptom,whether diagnosed or not.

Pre-Existing Condition means any Medical Condition forwhich symptoms appeared or for which an Insured Personor an Insured Person’s Immediate Family Member soughtthe attention of a Doctor, had investigated, diagnosed ortreated, had treatment or further investigationrecommended or for which medication was prescribed oraltered, in the case where the person is under 75 years ofage, in the 180 days prior to the date the Trip was booked,and in the case where the person is 75 years of age orolder, in the 365 days prior to the date the Trip wasbooked.

Primary Cardmember means the principal applicant for anAccount who is a natural person resident in Canada towhom a Scotiabank Passport Visa Infinite card is issued bythe Policyholder.

Rescheduling Expenses means the additional chargesassociated with Eligible Expenses, including administrativeand change fees, which result from rescheduling a Trip,prior to departure, and which have been charged to YourAccount and/or Your Scotia Rewards points.

Scotia Assist means the Insurer in relation to claim paymentand administrative services.

Spouse means the person who is legally married to theCardmember or the person who has been living with theCardmember for a continuous period of at least one yearand is publicly represented as the Cardmember’s Spouse.

Travelling Companion means a person booked to travelwith You and/or Your Spouse on a Trip and who hasprepaid accommodations and/or transportationarrangements for the same Trip.

Trip means a scheduled period of time during which anInsured Person is away from his or her province or territoryof residence in Canada, as determined by the departureand return dates.

2. ELIGIBILITY

Each Cardmember and/or his or her Spouse is eligible forthe Trip Cancellation and the Trip Interruption coveragesummarized under this Certificate if the Eligible Expensesfor the Trip have been charged to Your Account. YourDependent Children, and one Travelling Companion areeligible for this coverage when they are booked to travel ona Trip with You and/or Your Spouse and their EligibleExpenses have been charged to Your Account.

3. TRIP CANCELLATION BENEFITS

You will be reimbursed for any Eligible Expenses which arenot refundable or reimbursable in any manner if, prior toYour scheduled departure, an Insured Person is required tocancel a Trip due to one of the following covered Causesfor Cancellation. The amount payable is subject to amaximum limit of $2,500 per Insured Person and $10,000per Trip for all Insured Persons on the same Trip, and willbe limited to the cancellation penalties in effect on thedate the Cause for Cancellation arises. It is thereforeimportant that You cancel Your travel arrangements withYour travel supplier as soon as the Cause for Cancellationarises. Also, You must immediately advise Scotia Assist assoon as a Cause for Cancellation arises.

You will be reimbursed for any Rescheduling Expenseswhich are not refundable or reimbursable in any manner if,prior to Your scheduled departure, an Insured Personchooses to reschedule a Trip due to one of the followingcovered Causes for Cancellation. The amount payable isthe lesser of the Rescheduling Expenses and the amountthat would have been paid under this Certificate if the Triphad been cancelled outright. Your rescheduled trip will beconsidered a new Trip under this Certificate and the

Pre-existing Condition period will be measured from thedate the new Trip was booked.

Covered Causes for Cancellation (first occurring after YourTrip was booked) mean the following:Medical Covered Causes for Cancellation:a) death of an Insured Person, a Travelling Companion, an

Insured Person’s Immediate Family Member or aTravelling Companion’s Immediate Family Memberoccurring after the Trip is booked and within 31 daysprior to the scheduled Trip departure date;

b) accidental bodily injury or sudden and unexpectedsickness of an Insured Person or Travelling Companion,which did not result from a Pre-existing Condition andwhich prevents the Insured Person or TravellingCompanion from starting the Trip. A Doctor mustsubstantiate in writing that prior to the scheduled Tripdeparture date, he or she advised the Insured Person orTravelling Companion to cancel the Trip or that theaccidental bodily injury or sickness made it impossiblefor the Insured Person or Travelling Companion to startthe Trip;

c) Hospitalization due to an accidental bodily injury or asudden and unexpected sickness of an Insured Person’sImmediate Family Member or a Travelling Companion’sImmediate Family Member scheduled to occur duringthe Trip which did not result from a Pre-Existingcondition and which was not known to the InsuredPerson or Travelling Companion prior to booking theTrip;

d) Hospitalization of an Insured Person’s Immediate FamilyMember or a Travelling Companion’s Immediate FamilyMember, which did not result from a Pre-existingCondition, occurring after the Trip was booked andwithin 31 days prior to the Trip departure date;

e) Hospitalization or death of an Insured Person’s LegalBusiness Partner or Key Employee or of a TravellingCompanion’s Legal Business Partner or Key Employeeoccurring after the Trip was booked; and;

f) Hospitalization or death of an Insured Person’s host or aTravelling Companion’s host at destination occurringafter the Trip was booked.

Non-Medical Covered Causes for Cancellationa) an enforceable call of an Insured Person to jury duty or

sudden and unexpected subpoena of an Insured Personto act as a witness in a court of law requiring theInsured Person’s presence in court during the Trip;

b) a written formal notice issued by the Department ofForeign Affairs and International Trade of the Canadiangovernment after booking Your Trip, advising Canadiansnot to travel to a country, region or city originallyticketed for the Trip for a period that includes an InsuredPerson’s Trip;

c) an employment transfer of the Insured Person by theemployer with whom the Insured Person was employedon the date the Insured Person booked his or her Trip,which transfer requires the relocation of the InsuredPerson’s principal residence within 30 days before theInsured Person’s scheduled Trip departure date;

d) a delay causing an Insured Person to miss a connectionfor a Common Carrier or resulting in the interruption ofan Insured Person’s travel arrangements, including thefollowing:(i) delay of an Insured Person’s Common Carrier

resulting from the mechanical failure of that carrier;(ii) a traffic accident or an emergency police-directed

road closure (either must be substantiated by apolice report);

(iii) weather conditions; or(iv) unexpected or unforeseen earthquake of volcanic

eruption.The outright cancellation of Common Carrier travel isnot considered a delay. The benefit under this Cause forCancellation is the Insured Person’s one-way economyfare via the most cost-effective route to the InsuredPerson’s next destination;

e) a natural disaster that renders an Insured Person’sprincipal residence uninhabitable;

f) an Insured Person’s quarantine or hijacking; andg) a call to service of an Insured Person by government with

respect to reservists, military, police or fire personnel.As soon as a covered Cause for Cancellation occurs, theInsured Person must cancel the Trip and You must notifyScotia Assist at 1 877-711-8286 from within Canada andthe United States, or 613-634-6980 locally or collect fromother countries within 48 hours of the time the coveredCause for Cancellation arose.4. TRIP INTERRUPTION BENEFITSYou will be reimbursed for:a) the lesser of the additional charges paid by You for a

change in ticketing or the cost of a one-way economyfare to return to point of departure; and

b) the amount of the unused portion of any EligibleExpenses which are not refundable or reimbursable,excluding the cost of pre-paid, unused returntransportation if, as a result of one of the followingcovered Causes for Interruption occurring during theTrip, an Insured Person is prevented from continuing theTrip or is unable to return on the original Trip returndate. The amount payable is subject to a maximum limitof $2,500 per Insured Person and $10,000 per Trip for allInsured Persons on the same Trip. You must immediatelyadvise Scotia Assist as soon as a Cause for Interruptionarises.

Covered Causes for Interruption mean the following:Medical Covered Causes for Interruption:a) death of an Insured Person, a Travelling Companion, an

Insured Person’s Immediate Family Member or TravellingCompanion’s Immediate Family Member during the Trip;

b) accidental bodily injury or sudden and unexpectedsickness of an Insured Person or Travelling Companion,which did not result from a Pre-existing Condition andwhich, in the sole opinion of Scotia Assist, based onmedical advice provided by the attending Doctor,

requires immediate medical attention and prevents theInsured Person or Travelling Companion from returningfrom the Trip on the scheduled return date;

c) accidental bodily injury or a sudden and unexpectedsickness requiring Hospitalization of an Insured Person’sImmediate Family Member or a Travelling Companion’sImmediate Family Member during the Trip, which didnot result from a Pre-existing Condition and which wasnot known to the Insured Person or TravellingCompanion prior to the Trip departure date;

d) Hospitalization or death of an Insured Person’s LegalBusiness Partner or Key Employee or a TravellingCompanion’s Legal Business Partner or Key Employeewhich occurred during the Trip; and

e) Hospitalization or death of an Insured Person’s host or aTravelling Companion’s host at destination whichoccurred during the Trip.

Non-Medical Covered Causes for Interruptiona) a written formal notice issued by the Department of

LIMITATIONS AND EXCLUSIONSOnly one (1) Travelling Companion is covered on each Trip.No benefits are payable in respect of any Trip cancellationor Trip interruption resulting directly or indirectly from:

a) cancellation of a Trip for any reason other than aCause for Cancellation;

b) interruption of a Trip for any reason other than aCause for Interruption;

c) a Pre-existing Condition;d) pregnancy, childbirth and/or related complications

occurring within 9 weeks of the expected delivery date;e) neo-natal care;f) intentionally self-inflicted injury, suicide or any attempt

thereat;g) illness or accidental injury sustained while under the

influence of drugs, medication, alcohol or otherintoxicants;

h) participation in a criminal offence;i) acts of terrorism, insurrection or war, whether declared

or undeclared;j) voluntary participation in a riot or civil commotion; ork) participation in professional sports, speed contests,

dangerous sports or events.Please note: The Policy will only cover any excess cost overand above the travel rewards provided by any reward orfrequent flyer plan. This Policy does not cover the value ofthe loss of any rewards or frequent flyer plan points, exceptScotia Rewards points.6. CLAIMS PROCEDURESYou must call Scotia Assist at 1 877-711-8286 from withinCanada and the United States or 613-634-6980 locally orcollect from other countries to obtain a claim form. Youwill be required to submit a completed claim form andprovide documentation to substantiate Your claim,including the following:a) original tickets (including any unused coupons), original

vouchers, original itinerary, invoices, and receipts;b) Scotiabank Passport Visa Infinite card monthly statement

of account and any other documentation necessary toconfirm that the costs of Eligible Expenses were chargedto Your Account;

c) proof satisfactory to Scotia Assist that the cancellationor interruption of the Trip resulted from a covered Causefor Cancellation or Interruption;

d) name, address and phone number of the InsuredPerson’s employer; and

e) name, address and policy numbers for all otherinsurance coverage You and/or the Insured Person mayhave, including health insurance and credit cardcoverage (whether group or individual).

Claims submitted with incomplete or insufficientdocumentation may not be paid.7. GENERAL PROVISIONS AND STATUTORY

CONDITIONSUnless otherwise expressly provided herein or in the Policy,the following general provisions apply to the benefitsdescribed in this Certificate of Insurance.Due Diligence: The Insured Person shall use diligence anddo all things reasonable to avoid or diminish any loss underthe Policy.

Notice and Proof of Claim: Immediately after learning of aloss or an occurrence which may lead to a loss coveredunder the Policy, notify Scotia Assist by calling1 877-711-8286 from within Canada and the United States,or by calling 613-634-6980 locally or collect from othercountries. You will then be sent a claim form.Written notice of claim must be given to Scotia Assist assoon as reasonably possible after a Cause for Cancellationor Interruption occurs, but in no event later than 90 daysfrom the date on which the Cause for Cancellation orInterruption occurred. Written notice given by or on behalfof the claimant or the beneficiary, with informationsufficient to identify the Cardmember, shall be deemednotice of claim.Failure to provide notice or furnish proof of claim within thetime prescribed herein does not invalidate the claim if thenotice or proof is given or furnished as soon as reasonablypossible, and in no event later than 1 year from the date aclaim arises hereunder, if it is shown that it was notreasonably possible to give notice or furnish proof withinthe time so prescribed. If the notice or proof is given orfurnished after 1 year, Your claim will not be paid.Payment of Claim: Benefits payable under the Policy will bepaid upon receipt of full written proof, as determined byScotia Assist.Subrogation: Following payment of an Insured Person’sclaim for loss or damage under the Policy, the Insurer shallbe subrogated to the extent of the amount of suchpayment, to all of the rights and remedies of the InsuredPerson against any party in respect of such loss or damage,and shall be entitled at its own expense to sue in theInsured Person’s name. The Insured Person shall give theInsurer all such assistance as the Insurer may reasonablyrequire to secure its rights and remedies, including theexecution of all documents necessary to enable the Insurerto bring suit in the name of the Insured Person.Termination of Insurance: Coverage in respect of an InsuredPerson ends on the earliest of the following dates:a) the date the Account is cancelled, closed or ceases

to be in Good Standing;b) the date the Insured Person ceases to be eligible for

coverage; andc) the date the Policy terminates.No benefits will be paid under the Policy for losses incurredafter coverage has terminated, unless otherwise specifiedor agreed.Legal Action: Every action or proceeding against an insurerfor the recovery of insurance money payable under thecontract is absolutely barred unless commenced within thetime set out in the Insurance Act, Limitations Act or otherapplicable legislation in Your province or territory.False Claim: If You make a claim knowing it to be false orfraudulent in any respect, You will not be entitled to thebenefit of coverage under the Policy, nor to the payment ofany claim made under the Policy.

b) Make the trip as shown on the Ticket.

c) Travel directly from the point-of-arrival terminal forthe trip shown on the Ticket to the next destination.

d) Coverage is also in force while the Insured Person isat a travel terminal immediately prior to or followingthe trip evidenced by the Ticket.

4. TERMINATION OF INSURANCECoverage in respect of an Insured Person ends on theearliest of the following dates:

a) the date the Account is cancelled, closed, or ceasesto be in Good Standing;

b) the date the Insured Person ceases to be eligible forcoverage; and

c) the date the Policy terminates

No benefits will be paid under the Policy for losses incurredafter coverage has terminated, unless otherwise specifiedor agreed.5. EXPOSURE AND DISAPPEARANCELoss resulting from unavoidable exposure to the elementsand arising out of the hazards described above shall becovered to the extent of the benefits afforded theCardmember.If the body of the Cardmember has not been found withinone year of the disappearance, stranding, sinking orwrecking of any vehicle in which the Cardmember wasinsured hereunder as an occupant, then it shall bepresumed, subject to all other terms of the policy, that theCardmember has suffered loss of life covered under thispolicy.

6. EXCLUSIONS AND LIMITATIONSThe Policy does not cover any loss caused by or resultingfrom:a) Intentionally self-inflicted injuries.b) Suicide or attempted suicide, whether sane or insane.c) Illness or disease.d) Normal pregnancy or resulting childbirth or miscarriages.e) Bacterial infection except bacterial infection of an

Accidental Bodily Injury, or if death results from theaccidental ingestion of a substance contaminated bybacteria.

f) A declared or undeclared war. Declared or undeclaredwar does not include acts of terrorism.

g) Accident occurring while a passenger on, or operating orlearning to operate, or serving as a member of the crewof any aircraft except as provided on this certificate.

7. MAKING A CLAIMIn the event of a claim, notify the Insurer by calling1-877-711-8286. If possible, notice should be given within90 days of the occurrence of a Loss.Notice must include the name of the Insured Person whosustained the Loss, the Account number to which the costof the Ticket was charged, and the name and address ofthe person (acting on behalf of the Insured Person ifnecessary) to whom claim forms should be sent.If claimforms for providing Proof of Loss are not received within 15days of giving notice of the claim, Proof of Loss may beprovided by giving the Insurer a written statement of thenature and extent of the Loss.Proof of Loss, whether it be a complete claim form orotherwise, must be given to the Insurer as soon asreasonably possible. The Insurer, at its expense, has theright to have the Insured Person examined as often asreasonably necessary while a claim is pending. The Insurermay also have an autopsy performed unless prohibited bylaw.8. LEGAL ACTIONEvery action or proceeding against an insurer for therecovery of insurance money payable under the contract isabsolutely barred unless commenced within the time setout in the Insurance Act, Limitations Act or other applicablelegislation in Your province or territory.9. IF YOU HAVE A CONCERN OR COMPLAINTIf You have a concern or complaint about Your coverage,please call the Insurer at 1-877-711-8286 or thePolicyholder at 1-800-472-6842. The Insurer will do its bestto resolve Your concern or complaint. Doctors and with 24-hour-a-day service. Hospital does notinclude any institution or part of an institution which islicensed or used principally as a clinic, a continued care orextended care facility, a convalescent home, a rest home, anursing home or home for the aged, a health spa or atreatment centre for drug addiction or alcoholism.Insured Person means the Primary Cardmember and/or hisor her Spouse, and eligible Dependent Children whentravelling with the Primary Cardmember and/or his or herSpouse.Medical Condition means any illness, injury or symptom,whether diagnosed or not.Medical Emergency means an unforeseen illness oraccidental injury which occurs during a Trip and whichrequires immediate medical care or treatment from aDoctor. A Medical Emergency ends when the illness oraccidental injury has been treated such that the InsuredPerson’s condition has stabilized. Treatment provided whenmedical evidence indicates that an Insured Person coulddelay treatment or return to Canada for such treatment, isnot considered a Medical Emergency and is not covered.Network means the network of Hospitals, Doctors andother medical providers with which Scotia Assist hasentered into an agreement to provide Emergency MedicalTreatment under the Policy.Pre-Existing Condition means any Medical Condition forwhich symptoms appeared or for which an Insured Personsought the attention of a Doctor, had investigated,diagnosed or treated, had treatment or furtherinvestigation recommended, or for which medication wasprescribed or altered, in the 180 days prior to the Tripdeparture date for Insured Persons under 75 years of ageand in the 365 days prior to the Trip departure date forInsured Persons 75 years of age or older. Age will bemeasured as of the date of departure for this purpose.A Pre-existing Condition does not include a MedicalCondition which is controlled by the consistent use ofmedications prescribed by a Doctor, provided that, duringthe 180-day period or 365-day period, as applicable, beforethe Insured Person’s departure, there has been no othertreatment or investigation recommended and there hasbeen no change in medication. A new medication orincrease/decrease in dosage constitutes a change.Primary Cardmember means the principal applicant for anAccount who is a natural person resident in Canada towhom a Scotiabank Passport Visa Infinite card is issued bythe Policyholder. The Primary Cardmember may be referredto as “You” or “Your”.Reasonable and Customary Charges means chargeswhich do not exceed the general level of charges made byother providers of similar standing in the locality orgeographical area where the charges are incurred, whenfurnishing comparable treatment, services or supplies for asimilar Medical Emergency.Spouse means the person who is legally married to thePrimary Cardmember or the person who has been livingwith the Primary Cardmember for a continuous period of at

least one year and is publicly represented as the PrimaryCardmember's Spouse.Trip means travel outside of Your province or territory ofresidence in Canada for a period of 25 consecutive days orless for Insured Persons under 65 years of age and 10consecutive days or less for Insured Persons 65 years of ageor older. In the event of a claim, You will be required tosubmit proof of the date of departure. Only a MedicalEmergency occurring during a Trip will be eligible forconsideration.2. ELIGIBILITYFor this coverage, the Primary Cardmember and/or his orher Spouse who is a resident of Canada and covered by aGHIP, is eligible for Travel Emergency Medical coverage,provided that Your Account is in Good Standing. YourDependent Children are only eligible for benefits whentravelling with You and/or Your Spouse on a Trip.3. COVERAGE PERIODCoverage Period For Insured Persons under age 65(on the Trip departure date)For the Travel Emergency Medical benefit, only the first 25consecutive days of a Trip, as determined by the originallyscheduled departure and return dates, will be covered.There is no coverage for that portion of a Trip whichextends beyond the first 25 consecutive days underthis Certificate of Insurance. In the event of a claim,proof of scheduled Trip duration will be required.Coverage begins at 12:01 a.m. on the date the InsuredPerson leaves his or her province or territory of residence inCanada on a Trip. AUTOMATIC EXTENSION OF COVERAGECoverage will be automatically extended beyond the25-day limit for Insured Persons under 65 years of age orbeyond the 10-day limit for Insured Persons 65 years of ageor older for up to 3 days following the end of a MedicalEmergency.In addition, Travel Emergency Medical Insurance coveragewill also be automatically extended beyond the 25-day limitfor Insured Persons under 65 years of age or beyond the10-day limit for Insured Persons 65 years of age or older forup to 3 days if an Insured Person’s return to his or herprovince or territory of residence in Canada is delayedsolely as the result of:a) the delayed departure of the bus, train, plane or ship on

which he or she is booked; orb) an accident or the mechanical breakdown of an Insured

Person’s personal vehicle.5. BENEFITSIn the event of a Medical Emergency, Reasonable andCustomary Charges for Emergency Medical Treatment willbe paid by Scotia Assist, less any amount payable by orreimbursable under a GHIP, any group or individual healthplans or insurance policies. Benefits are limited to$1,000,000 for each Insured Person, subject to theLimitations and Exclusions. The following expenses areeligible for reimbursement:Hospital Accommodation, Medical Expenses andDoctor Charges for Emergency Medical Treatment.Private Duty Nursing when prescribed by a Doctor.Diagnostic Services including laboratory tests and x-rayswhen prescribed by a Doctor. NOTE: Magnetic resonanceimaging (MRI), computerized axial tomography (CAT scans),sonograms and ultrasound must be authorized in advanceby Scotia Assist.Ambulance Service to the nearest Hospital equipped toprovide the required Emergency Medical Treatment.

Emergency Air Transport to the nearest Hospital, orrepatriation to a Hospital in the Insured Person’s provinceor territory of residence in Canada (when approved andarranged by Scotia Assist) in the event the Insured Person’scondition precludes the use of other means oftransportation.Prescription Drug Reimbursement excluding any drugs ormedications which are commonly available withoutprescription, or which are not legally registered andapproved in Canada or the United States.Accidental Dental Care to a maximum of $2,000 fortreatment of natural or permanently installed teeth,necessitated by an accidental blow to the mouth.Medical Appliances including slings, braces, splints, andlocal rental of crutches, walkers and wheelchairs.Return Airfare to cover any additional cost incurred for aone-way economy fare (less any refunds due on originaltickets) and, if required, the charge for transportation of astretcher and attending medical personnel to return theInsured Person to his or her province or territory ofresidence in Canada if further medical treatment iswarranted and when approved and arranged by ScotiaAssist.Transportation to Bedside from Canada for one of: theInsured Person’s Spouse, parent, child, brother or sisterwhen the Insured Person is hospitalized and expected toremain so for 3 days or more. This benefit must bepre-approved by Scotia Assist. This benefit includes oneround-trip economy airfare, food and accommodationexpenses of $100 per day to a maximum of $1,500. ThisTravel Emergency Medical insurance will be extended, atno charge, for the person required at bedside for theduration of the Medical Emergency.Vehicle Return cost to a maximum of $1,000 to return anInsured Person’s car to his or her province or territory ofresidence in Canada, or in the case of a rented vehicle, tothe nearest appropriate rental location, when the InsuredPerson is unable to return the vehicle as a result of aMedical Emergency.Car Accident Assistance when an Insured Person’s vehicleis disabled as a result of an accident during the Trip. Amaximum of $200 per day will be paid toward the cost ofaccommodation, food, car rental, or commercialtransportation for the time the vehicle is inoperable for amaximum of 3 days immediately following the date of theaccident.Return of Deceased when death results from a MedicalEmergency, to a maximum of $5,000 for the cost ofpreparation (including cremation) and transport of theInsured Person (excluding the cost of a burial coffin or urn)to his or her province or territory of residence in Canada.6. MEDICAL EMERGENCY PROCEDURESWhen a Medical Emergency occurs, You must contactScotia Assist without delay. See Section 7 for coverageLimitations.24-hour assistance is available by calling 1 877-711-8286from within Canada and the United States, or

613-634-6980 locally or collect from other countries. Ifcalling Scotia Assist from somewhere in the world where acollect call is not possible, call direct and You will bereimbursed.Scotia Assist will confirm coverage, provide directions tothe Network facility or the nearest appropriate medicalfacility, provide the necessary authorization of payment ofeligible expenses and manage the Medical Emergency.Scotia Assist will make every effort to pay or authorizepayment of eligible expenses to Hospitals, Doctors, andother medical providers directly. If direct payment orpayment authorization is not possible, an Insured Personmay be required to make payments. In that event, theInsured Person will be reimbursed for eligible expenses onsubmission of a valid claim.7. LIMITATIONSFailure to notify Scotia Assist immediately following aMedical Emergency, or as soon as possible under thecircumstances, will limit the benefits payable under thisCertificate of Insurance as follows:• No benefits will be payable for surgery or invasive

procedures (such as cardiac catheterization) withoutprior approval by Scotia Assist, except in extremecircumstances where a request for prior approvalwould delay surgery needed in a life-threateningmedical crisis.

• Non-surgical eligible expenses for which benefitswould otherwise have been provided will be limitedto 80% of the total, to a maximum of $30,000.

Benefits payable are further limited as follows:

• In consultation with the attending Doctor, Scotia Assistreserves the right to transfer the Insured Person to anappropriate Network facility or to his or her province orterritory of residence in Canada for Emergency MedicalTreatment. Refusal to comply will absolve the Insurer ofany liability for expenses incurred after the proposedtransfer date.

• Once a Medical Emergency ends, no further benefits arepayable for that Medical Emergency or for anyrecurrence of the condition which caused the MedicalEmergency.

8. EXCLUSIONSNo benefits are payable for any expenses incurred directlyor indirectly as a result of:a) any Pre-existing Condition as defined herein;b) any Medical Emergency or Emergency Medical

Treatment that occurs other than during a Trip;c) any elective or non-emergency surgery, treatment

or medication, including ongoing care of a chroniccondition;

d) any Medical Emergency that occurs during a Tripwhere the primary purpose was to work outside ofCanada;

e) pregnancy, childbirth and/or related complicationsoccurring within 9 weeks of the expected deliverydate;

f) neo-natal care;g) participation in a criminal offence;h) intentionally self-inflicted injuries, suicide or any

attempt thereat;i) illness or accidental injury sustained while under the

influence of drugs, medication, alcohol or otherintoxicants;

j) acts of terrorism, insurrection or war, whetherdeclared or undeclared;

k) voluntary participation in a riot or civil commotion;l) treatments that are not prescribed by a Doctor; orm) participation in professional sports, speed contests,

dangerous sports or events including recreationalscuba diving (unless the Insured Person holds abasic scuba designation from a certified school orlicensing body).

9. OPTIONAL EXTENSION OF COVERAGE PROCEDURESFor trips that exceed 25 days for Insured Persons under 65years of age or for trips that exceed 10 days for InsuredPersons 65 years of age or older.Coverage may be extended beyond 25 days for InsuredPersons under 65 years of age or beyond 10 days forInsured Persons 65 years of age or older.For more information or to purchase Travel ExtensionCoverage, please call Scotia Assist at 1 877-711-8286 fromwithin Canada prior to the Insured Person’s departure fromhis or her province or territory of residence in Canada. Youwill receive a separate certificate of insurance for thiscoverage.The premium for the Scotia Travel Extension Coveragemust be charged to Your Account and must be paid in fullby You prior to Your Trip departure date.10. CLAIM PROCEDURESIf Scotia Assist is notified in advance of medical treatment:If Scotia Assist authorizes Hospital or other medicalpayments on an Insured Person’s behalf, the Insured Personmust sign an authorization form allowing Scotia Assist torecover payments from his or her GHIP, other health plansor insurers and return it to Scotia Assist within 30 days. Ifan advance has been made for ineligible expenses, You willbe required to reimburse Scotia Assist.If Scotia Assist is not notified in advance of medicaltreatment:If eligible expenses are incurred for which payment has notbeen pre-authorized by Scotia Assist, they should besubmitted to Scotia Assist with original receipts andpayment statements. Benefits may be excluded or reducedwhere Scotia Assist has not been contacted in advance oftreatment (see Section 7 for Limitations on benefitpayments).In the event of a claim, You will be required to submit acompleted claim form and provide documentation tosubstantiate the claim, including the following:a) the cause and nature of the Medical Condition requiring

treatment;b) original, itemized medical invoices;

c) original prescription receipts;d) Your date of birth and the claimant’s date of birth

(proof of age may be required);e) a photocopy of the Insured Person’s GHIP (Health) card;f) name, address and phone number of the Insured

Person’s employer;g) proof of the Insured Person’s departure and/or return

date (i.e. copy of tickets, receipts, prepaidaccommodation invoice and gas receipts);

h) name, address and policy numbers for all otherinsurance coverage You and other Insured Persons mayhave, including group and individual insurance, creditcard coverage and any other reimbursement plans; and

This Certificate of Insurance contains information about yourinsurance. Please read it carefully and keep it in a safe place.Refer to the Definitions section or to the applicable descriptionof benefits and the paragraph following this one for themeanings of all capitalized terms.The coverage outlined in this Certificate of Insurance is effectiveas of November 27, 2017, and is provided to eligible ScotiabankPassportTM Visa Infinite* Cardmembers by American BankersInsurance Company of Florida (hereinafter referred to as the“Insurer”) under Group Policy No. BNS112017 (hereinafterreferred to as the “Policy”) issued by the Insurer to The Bank ofNova Scotia (hereinafter referred to as the “Policyholder”).The terms, conditions and provisions of the Policy aresummarized in this Certificate of Insurance, which isincorporated into and forms part of the Policy. All benefits aresubject in every respect to the Policy, which alone constitutesthe agreement under which benefits will be provided. 1. DEFINITIONSIn this Certificate of Insurance, the following words or phraseshave the meanings set forth below:

Account means the Primary Cardmember’s ScotiabankPassport Visa Infinite Account, which must be in Good Standingwith the Policyholder.

Cardmember means the Primary Cardmember and anysupplemental Cardmember who is a natural person resident inCanada to whom a Scotiabank Passport Visa Infinite card isissued and whose name is embossed on the card. TheCardmember may also be referred to herein using “You” and“Your”.

Car Sharing means a car rental club that provides its memberswith 24-hour access to its own fleet of cars parked in aconvenient location and does not include online marketplaceservices which facilitate the rental of privately owned cars, orother similar online services.

Dollars and "$" means Canadian dollars.

Good Standing means, with respect to an Account, that thePrimary Cardmember has not advised the Policyholder to closeit or the Policyholder has not suspended or revoked credit

privileges or otherwise closed the Account.

Insured Person means a Cardmember and any other personwho holds a valid driver’s license and has the Cardmember’sexpress permission to operate the rental vehicle. This includesdrivers not listed on Your rental contract, provided they wouldotherwise qualify under the rental contract.

Loss of Use means the amount charged by a rental agency tocompensate it when a rental vehicle is unavailable for rentalwhile undergoing repairs for damage incurred during the rentalperiod.

Primary Cardmember means the principal applicant for anAccount who is a natural person resident in Canada to whom aScotiabank Passport Visa Infinite card is issued by thePolicyholder.

Scotia Assist means the Insurer in relation to claim paymentand administrative services.

2. ELIGIBILITYYou are eligible for Rental Car Collision/Loss Damage (CLD)insurance when You rent most private passenger vehicles for aperiod not to exceed 48 consecutive days, provided that:

a) You initiate the rental transaction with Your ScotiabankPassport Visa Infinite card (if arranged in advance, bybooking or reserving the car rental with Your ScotiabankPassport Visa Infinite card) and by providing an imprintof Your Scotiabank Passport Visa Infinite card at thetime You take possession of the car;

b) You decline the rental agency’s collision damage waiver(CDW) or loss damage waiver (LDW), or similarprovision; and

c) You rent the car in Your name and either:i) charge the entire cost of the car rental to Your

Account; orii) use Your Scotia Rewards®* points to pay for all or

part of the rental provided that, if Your ScotiaRewards points do not pay for the entire cost of thecar rental, the remaining cost is charged to YourAccount.

Coverage is limited to one rental vehicle at a time, i.e. if duringthe same period there is more than one vehicle rental chargedto the Account, only the first rental will be eligible for thesebenefits.The length of time You rent the vehicle must not exceedforty-eight (48) days. If the rental period exceeds 48 days, nocoverage will be provided, even for the first 48 days of therental period. Coverage may not be extended for more than 48days by renewing or taking out a new rental agreement withthe same or another rental agency for the same vehicle oranother vehicle.In some jurisdictions, the law requires the rental agencies toprovide CDW or LDW in the price of the car rental. In theselocations, CLD insurance will provide coverage of anydeductible that may apply, provided all the procedures outlinedin this Certificate have been followed and You have waived therental agency’s deductible waiver. No CDW or LDW premiumscharged by rental agencies will be reimbursed under the Policy.

Notes:• Rental vehicles which are part of pre-paid travel packages

are eligible for CLD insurance if the total package wascharged to Your Account and all other eligibilityrequirements are met.

• Rental vehicles which are part of a Car Sharing program areeligible for CLD insurance if the full cost of each rental of avehicle (per use and mileage charges) was charged to YourAccount and all other eligibility requirements are met. SomeCar Sharing plans will include CDW/LDW in theirmembership fee. If Your Car Sharing membership includesCDW/LDW and there is no option to waive, then CLDinsurance under this Policy will only provide coverage forany deductible You may be held responsible for, provided allthe other requirements outlined in this Certificate ofInsurance have been met.

• “Free rentals” are also eligible for CLD insurance whenreceived as the result of a promotion where You have hadto make previous vehicle rentals, and each such previousrental satisfied the eligibility conditions set out in paragraphsa) through c).

• You are covered if You receive a “free rental” day or daysas a result of an airline point program (or other similarprogram) for the number of days of free rental. If the freerental day(s) are combined with rental days for which Youpay the negotiated rate, You must satisfy the eligibilityconditions set out in paragraphs a) through c).

3. BENEFITSCLD insurance is primary insurance which pays the amount forwhich You are liable to the rental agency up to the actual cashvalue of the damaged or stolen vehicle as well as any valid anddocumented Loss of Use, reasonable and customary towingcharges, and administration charges resulting from damage ortheft occurring while the rental vehicle is rented in Your name.This includes damage resulting from malicious vandalism andtheft. Benefits are limited to one vehicle rental during any oneperiod.This coverage is available on a 24-hour basis anywhere in theworld, except where prohibited by law, or where the coverageis in violation of the terms of the rental contract in thejurisdiction in which it was formed. (See the section “HelpfulHints” for tips on how to avoid having use of this coveragechallenged.)

4. TYPES OF RENTAL VEHICLES COVEREDThe types of rental vehicles covered include cars, sports utilityvehicles and mini-vans (as defined below).Mini-vans are coveredprovided they:a) are for private passenger use with seating for no more

than 8 occupants including the driver; andb) are not to be used for hire by others.

5. TYPES OF RENTAL VEHICLES NOT COVEREDVehicles which belong to the following categories areNOT covered:

a) vans, other than mini-vans as described above;

b) trucks, pick-up trucks or any vehicle that can bespontaneously reconfigured into a pick-up truck;

c) off-road vehicles;

d) motorcycles, mopeds or motorbikes;

e) campers, trailers or recreational vehicles;

f) vehicles not licensed for road use;

g) mini-buses or buses;

h) antique cars (cars which are over 20 years old or have notbeen manufactured for 10 years or more);

i) any vehicle which is either wholly or in part hand-made,

hand finished or has a limited production of under 2,500vehicles per year;

j) any vehicle with a manufacturer’s suggested retail priceexcluding all taxes, over sixty-five thousand dollars($65,000), at the time and place of loss;

k) tax-free cars (a tax-free car package that provides touristswith a short-term (17 days to 6 months), tax-free vehiclelease agreement with a guaranteed buyback);

l) vehicles towing or propelling trailers or any other object;and;

m) expensive or exotic vehicles.

6. LIMITATIONS AND EXCLUSIONSCLD insurance does NOT include coverage for:a) a replacement vehicle for which Your personal automobile

insurance or the repair shop is covering all or part of the costof the rental;

b) loss or theft of personal belongings in the vehicle;

c) third party liability (injury to anyone or anything inside oroutside the vehicle);

d) expenses assumed, paid or payable by the rental agency orits insurers; or

e) damage/loss arising directly or indirectly from:(i) operation of the vehicle by any driver other than an

Insured Person;(ii) operation of the vehicle on other than regularly

maintained roads;

(iii) alcohol intoxication where the driver’s blood alcoholconcentration is equal to or over the blood alcoholconcentration limit for impaired driving under theCriminal Code of Canada or the jurisdiction inwhich the vehicle rental occurred, if lower, orwhere the driver is charged for impaired driving;

(iv) use of narcotic drugs by the driver;(v) any dishonest, fraudulent or criminal act committed

by the Insured Person and/or any authorized driver;(vi) operation of the rental vehicle contrary to the

terms of the rental agreement/contract;

(vii) wear and tear, gradual deterioration, or mechanicalbreakdown of the vehicle;

(viii) road damage to tires unless in conjunction withan insured cause;

(ix) insects or vermin, inherent vice or damage;(x) war, hostile or warlike action, insurrection, rebellion,

revolution, civil war, usurped power, or action taken bygovernment or public authority in hindering,combating, or defending against such action;

(xi) seizure or destruction under quarantine or customerregulations, confiscation by order of anygovernment or public authority;

(xii) transportation of contraband or illegal trade;(xiii) transportation of property or passengers for hire; or(xiv) nuclear reaction, radiation or radioactive

contamination.

7. HELPFUL HINTSImportant: Check with Your personal insurer and the rentalagency to ensure that You and all other drivers have adequatepersonal property, personal injury and third party liabilitycoverages. The Policy only covers loss or damage to the rental

vehicle as stipulated therein.

a) Some rental agencies may resist Your declining theirCDW/LDW coverage. They may try to encourage You totake their coverage. If You refuse, they may insist Youprovide a deposit.

Before booking a car, confirm that the rental agency willaccept CLD insurance without requiring a deposit. If theywon’t, find one that will, and try to get written confirmation.If booking your trip through a travel agency, let them knowyou want to take advantage of CLD Insurance and havethem confirm the rental agency’s willingness to accept it.You will not be compensated for any payment You mayhave to make to obtain the rental agency’s CDW/LDW.

b) Check the rental car carefully for scratches, dents andwindshield chips and point out any damage to theagency representative before You take possession of thecar. Have them note the damage on the rentalagreement, or ask for another vehicle.

c) If the vehicle sustains damage of any kind, immediatelyphone Scotia Assist by calling 1 877-711-8286 from withinCanada and the United States, or by calling 613-634-6980locally or collect from other countries. Advise the rentalagent that You have reported the claim and provide ScotiaAssist’s phone number. Do not sign a blank sales draft tocover the damage and Loss of Use charges.

8. GENERAL PROVISIONS AND STATUTORY CONDITIONSUnless otherwise expressly provided herein or in the Policy, thefollowing general provisions apply to the benefits described inthis Certificate of Insurance.

Due DiligenceThe Insured Person shall use diligence and do all thingsreasonable to avoid or diminish any loss or damage under thePolicy.

Notice and Proof of ClaimImmediately after learning of a loss or an occurrence which maylead to a loss covered under the Policy, You must notify ScotiaAssist by calling 1-877-711-8286 from within Canada and theUnited States, or by calling 613-634-6980 locally or collect fromother countries. You will then be sent a claim form.Written notice of claim must be given to Scotia Assist as soonas reasonably possible after a claim occurs, but in all eventsprovided within 90 days from the date on which loss occurred.Failure to provide notice or furnish proof of claim within thetime prescribed herein does not invalidate the claim if thenotice or proof is given or furnished as soon as reasonablypossible, and in no event later than 1 year from the date a claimarises hereunder, if it is shown that it was not reasonablypossible to give notice or furnish proof within the time soprescribed. If the notice or proof is given or furnished after 1year, Your claim will not be paid.

Payment of ClaimBenefits payable under the Policy will be paid upon receipt offull written proof, as determined by Scotia Assist.

SubrogationFollowing payment of an Insured Person’s claim for loss ordamage under the Policy, the Insurer shall be subrogated to theextent of the amount of such payment, to all of the rights andremedies of the Insured Person against any party in respect ofsuch loss or damage, and shall be entitled at its own expense tosue in the Insured Person’s name. The Insured Person shall give

the Insurer all such assistance as the Insurer may reasonablyrequire to secure its rights and remedies, including theexecution of all documents necessary to enable the Insurer tobring suit in the name of the Insured Person.

Coverage TerminationCoverage under the Policy ends at the earliest of:

a) the date and time the rental agency reassumes control of therental vehicle, whether at its place of business or elsewhere;

b) the date the Insured Person ceases to be eligible forcoverage;

c) the date the Account is cancelled or closed or ceases to be inGood Standing; and

d) the date the Policy terminates.

No benefits will be paid under the Policy for losses incurredafter coverage has terminated, unless otherwise specified oragreed.

False ClaimIf You make any claim knowing it to be false or fraudulent inany respect, You shall no longer be entitled to the benefits ofthis insurance nor to the payment of any claim under the Policy.

Legal ActionEvery action or proceeding against an insurer for the recoveryof insurance money payable under the contract is absolutelybarred unless commenced within the time set out in theInsurance Act, Limitations Act or other applicable legislation inYour province or territory.

and support and who are either under 21 years of age, orunder 25 years of age and in full-time attendance at arecognized institution of higher learning in Canada. DependentChild(ren) also includes children 21 years of age or over whoare permanently mentally or physically challenged andincapable of self-support.

Dollars and $ means Canadian dollars.

Essential Items mean the minimum essential clothing andtoiletries, the purchase of which is rendered absolutelynecessary and indispensable due to the delay of Your CheckedLuggage.

Good Standing means, with respect to an Account, that thePrimary Cardmember has not advised the Policyholder to closeit and the Policyholder has not suspended or revoked creditprivileges or otherwise closed the Account.

Insured Person means an eligible Cardmember and/or his orher Spouse, and eligible Dependent Children when travellingwith the Cardmember and/or his or her Spouse.

Primary Cardmember means the principal applicant for anAccount who is a natural person resident in Canada to whom aScotiabank Passport Visa Infinite card is issued by thePolicyholder.

Scotia Assist means the Insurer in relation to claim paymentand administrative services.

Spouse means the person who is legally married to theCardmember or the person who has been living with theCardmember for a continuous period of at least one year and ispublicly represented as the Cardmember’s Spouse.

Trip means a scheduled period of time during which an InsuredPerson is away from his or her province or territory of residencein Canada, as determined by the departure and return dates.

2. FLIGHT DELAY INSURANCEBenefitsScotia Assist will reimburse the Cardmember for all InsuredPersons travelling on the same Trip if the confirmed scheduledflight departure from any airport is delayed by 4 hours or more,for necessary and reasonable expenses incurred with respect tohotel accommodations, restaurant meals, refreshments,Essential Items and sundry items (such as a magazine,paperback book and other such small items) within 48 hours ofthe delay or denied boarding, to a maximum of $500 perInsured Person on the same Trip, provided that:(i) at least 75% of the full cost of the delayed flight was

charged to Your Account and/or paid with ScotiaRewards® points;

(ii) no alternative transportation is made available to theCardmember within 4 hours of the scheduled departuretime of the original flight;

(iii) delay of the flight was the result of strike by airlinepersonnel, quarantine, civil commotion, hijack, naturaldisaster, inclement weather, mechanical breakdown ordenied boarding due to overbooking; and

(iv) the Cardmember provides the required proof of loss toScotia Assist, including plane ticket(s) or the ScotiabankPassport Visa Infinite card sales receipt for the planeticket(s), a written statement from the airline confirmingand detailing the delay and itemized original receipts withrespect to the necessary and reasonable expenses incurredfor hotel accommodations, restaurant meals, refreshments,Essential Items and sundry items.

This coverage is in excess of all other applicable valid insurance,indemnity, reimbursement or protection available to You inrespect of the claim. The Insurer will be liable only for theamount of loss or damage over the amount covered under suchother insurance, indemnity, reimbursement or protection andfor the amount of any applicable deductible, only if all suchother coverage has been claimed under and exhausted andsubject to the terms, exclusions and limits of liability set out inthis Certificate of Insurance. This coverage will not apply ascontributing insurance, notwithstanding any provision in anyother insurance, indemnity or protection policies or contracts.Limitations and ExclusionsThe Insurer does not cover loss caused by or resulting from:(i) criminal or fraudulent acts of the Insured Person;(ii) war, whether declared or undeclared, civil war,

insurrection, rebellion or revolution; or(iii) any warlike act by any government or military force.How to Claim

GENERAL PROVISIONS AND STATUTORY CONDITIONSUnless otherwise expressly provided herein or in the Policy, thefollowing general provisions apply to the benefits described inthis Certificate of Insurance.Due DiligenceThe Insured Person shall use diligence and do all thingsreasonable to avoid or diminish any loss or damage under thePolicy.Notice and Proof of ClaimImmediately after learning of a loss or an occurrence which maylead to a loss under any of these insurance benefits, You mustnotify Scotia Assist. You will then be sent a claim form.Written notice of claim must be given to Scotia Assist as soonas reasonably possible after the occurrence or commencementof any loss covered by the Policy, but in all events, providedwithin 90 days from the date of such loss. Written notice givenby or on behalf of the claimant or the beneficiary, withinformation sufficient to identify the Cardmember, shall bedeemed notice of claim.Failure to provide notice or furnish proof of claim within thetime prescribed herein does not invalidate the claim if thenotice or proof is given or furnished as soon as reasonablypossible, and in no event later than 1 year from the date a claimarises hereunder, if it is shown that it was not reasonablypossible to give notice or furnish proof within the time soprescribed. If the notice or proof is given or furnished after1 year, Your claim will not be paid.Payment of ClaimBenefits payable under the Policy will be paid upon receipt offull written proof, as determined by Scotia Assist.SubrogationFollowing payment of an Insured Person’s claim for loss, theInsurer shall be subrogated to the extent of the amount of suchpayment, to all of the rights and remedies of the Insured Personagainst any party in respect of such loss, and shall be entitled,at its own expense, to sue in the Insured Person’s name. TheInsured Person shall give the Insurer all such assistance as isreasonably required to secure its rights and remedies, including

the execution of all documents necessary to enable the Insurerto bring suit in the name of the Insured Person.Termination of InsuranceCoverage ends on the earliest of:(i) the date the Account is cancelled, closed or ceases to

be in Good Standing;(ii) the date the Insured Person ceases to be eligible for

coverage; and(iii) the date the Policy terminates.No losses incurred after the Policy termination date will be paid,unless otherwise specified or agreed.False ClaimIf You make any claim knowing it to be false or fraudulent inany respect, You shall no longer be entitled to the benefits ofthis insurance nor to the payment of any claim under the Policy.Legal ActionEvery action or proceeding against an insurer for the recoveryof insurance money payable under the contract is absolutelybarred unless commenced within the time set out in theInsurance Act, Limitations Act or other applicable legislation inYour province or territory.If You Have a Concern or ComplaintIf You have a concern or complaint about Your coverage,please call the Insurer at 1-877-711-8286 or the Policyholder at1-800-472-6842. The Insurer will do its best to resolve Yourconcern or complaint. If for some reason the Insurer is unable todo so to Your satisfaction, You may pursue the concern orcomplaint in writing to an independent external organization.You may also obtain detailed information for the Insurer’sresolution process and the external recourse either by callingthe Insurer at the number listed above or at:www.assurantsolutions.ca/consumer-assistance.PrivacyThe Insurer may collect, use, and share personal informationprovided by You to the Insurer, and obtained from others withYour consent, or as required or permitted by law. The Insurermay use the information to: serve You as a customer andcommunicate with You. The Insurer may process and store Yourinformation in another country, which may be subject to accessby government authorities under applicable laws of thatcountry.
