Water Well Note #40 - Water Rights Trial

Note #40 Date: February 17, 2019

The trial to decide water rights has started. This trial will determine how much of our water the Bureau of Land Management (BLM) gets to take. Their claim has been reduced from 44,000 acre-feet of water to 33,150 acre-feet of water.

BLM and environimentilist have focused on "enhancing" rather than conservation and protection. The "enhance" provision is a significant problem in the authorizing legislation. Various individuals and groups disagree over what constitutes enhance and what is overreach. There is simply no end point to enhancement. No matter what is done—more can be always be done to enhance the SPRNCA.

BLM could have reduced its water needs with better management. BLM has allowed mesquite to flourish on the SPRNCA lands. The amount of water the trees consume is approximately 13,000 acre feet of water. This is over 1/4 of BLM's original demand and over 1/3 of BLM's reduced demand. While suing to take water, BLM has not removed mesquite to conserve water for the SPRNCA.

Keep Our Wells is an unincorporated group of neighbors in the San Pedro sub-watershed whose wells are at

risk of expropriation by BLM and who are working for adoption of legislation to protect their homes. The

community group operates without funding and has no connection with any developers, governments, or other

organizations.
