    WES T AFRICAN G AS PIPELINE REGULATIONS, 2005commencement th October, 2005

    In the exercise of the powers conferred y pon me by section 20 of the West African Gas PipelineAct and all other powers enabling me in that behalf, I DR EDMUNDAUKORU MiniSter of State forPetroleum R esources, here by ma ke the folloiving Regulations

    1.-4 1) These Regulations are adopted following agreement in accordanc e withthe International Project Agreement by Nigtrja and the Company on thk content ofthese Regulations, but without prejudice the authority of the Minister to amend theseRegulations in accordance with the -pow eis set out in the West African G as PipelineAct.

    (2) The purpose of these Regulations is to provide a consistent and enforceablecode governing the design, construction, operation and maintenance of the P ipelineSystem which will har~nonisehe regulation of those m atters in each o f the States.

    3) In addition to these Regulations the Operator is required to comply with thesubstantive laws of Nige ria as modified by-the West African Ga s Pipeline Act.

    2.-(1) When ever a survey is required, the Company shall apply to the Authorityfor a permit to survey.

    (2) An appli-ation for a permit to survey under this Regulation shall specify theapproximate route or alternative routes proposed.

    3) The Authority may grant to the Company a permit to survey under thisRegulation.

    (4)Th eA uthori ty may, upon application by the Company, vary the route specifiedin such permit to surve y, but such variation shall not invalidate or make illegal any actdone by the Compa ny or its contractors, agents and e~ npl oye es ursuant o the permitprior to such variation, nor prejudice the rights ofa ny person un der the Act w ith referenceto any act done by the Company pursuant to the permit prior to such variation.

    3.-(1) A permit to survey shall entitle the Com pany and its contra ctors, agentsand elnployees to enter together with any necessary equipment or vehicles, on anyland upon the rou te spec ified in the permit to survey or reasonably cl'ose to suc h routefor the following purposes

    a) to survey and take levels of the land ;(6) to dig and bore into the soil and subsoil ;

    c) to cut and rem ove such trees and other vegetation a s [nay mpede the purposesspecified n this Regulation ; and6)o do all o ther acts necessary to a scertain the suitability of the land for theestablishment of part of the Pipeline System,

    and shall entitle the Com pany, with such persons, equipment or vehicles as aforesaidto p ass over. land adjace nt to such route to the extent that such .may be necessary orcon ven ienj for the purpose o f obtaining access to land upon the route specified.(2) Except with prior consent of the owner or occupier, no person shall underthe authority of paragraph 3 1) of this Regulation enter any building or upon anyenclosed court or garden attached to any building, without previously having giventhe o wner o r occupier at least fourteen days' notice of his intention to do so, nor enterupon any cultivated land without having given such notice to the own ers or occupiqrsthereof or having affixed such notice in some ~rorninenk osition upon such land.(3) No person shall, under the authority of paragraph 3 ( l ) of this Regulation,except with the prior assent of the owners or occupiers or persons in charge thereof,

    en ter an y of the following landa ) any land occupied by any burial ground or cemetery ; orh )any land containing any grave, grotto, are a, tree or thing held to be sacred orthe object of veneration.

    (4) A person acting under the authority of paragraph 3(1) of this Regulationshall take all reaso nable steps to avoid unnecessary damag e to any land entered uponand any buildings, crops or profitable trees thereon, and shall make'c~ni~ensationothe owners or occupiers for any damage done under such authority and not madegood.( 5 ) The pr incip les and procedures for quant i fy ing the amount of suchcom pensa tion (together with procedures for resolving any disputes in respect of suchcom pensa tion) shall be those applicable under the prevailing laws of Nigeria.

    General 4.The design of the Pipeline System shall bea) such that the Pipeline System shall be suitable for the high pressuretransportation of Gas ndb ) as set out in these Regulations

    Design nd 5. Th e design and specification of ipeline sections shall be as followsspecificationof pipeline ( u ) all pipeline sections shall be made of steel, and shall comply with ASMEsections. 3 1.8'and (where applicable) DN V-0s -F-I(b) the selection of all structural materials and pipiris components shall complywith Appendix B o f A S M E B3 1.8 ;c ) pipeline section components shall comply with the following Standards

    i )API 6 D and ASME B 16.34,

    (i i ) ASM E B16.5 or MSS SP-44,(iii) ASM E B 16.9 or MS S SP-75,(iv)ASME B16.11,(v) ASTM A- 193,(vi) AST M A- 194, and(vii) ASM E B 16.49 ;

    4 the pipe shall be manufactured in accordance with the followingStandards :(i) API SL,(i i ) AST M A 53,(i i i) ASTM A 106,

    - (iv) AS TM A 135,(v) ASTM A 333, and(vi) ASTM A 3 8 1 ;

    e)pipelin e design shall include loads for both construction and o peratin gphases ;V each pipeline or segm ent of a pipeline (other than station piping suchas compresso r stations, manifolds, and R&M stations) shall be designed toaccommodate the,passag e of instrumented-internal inspection devices ;g) each mechanical fitting shall be designed for at least the MaximumAllowable Oper ating Pressure of the relevant pipeline section :h) each welded branch con nection made to pipeline sections n the formo f a single connection, or in a header or rnanifdd as a series of connections,shall be designed to ensure that the strength of the pipeline section is not

    k ) field fabricated bull plugs and swages shall not be used on pipelinesect ions ;

    (I) except for flat closures designed in accotdance with ASME BPVC SectionVIII, flat closures and fish tails may not be used on pipeline sections ;

    t n ) each extruded outlzt shall be suitable for the anticipated service conditionsand sh all be dt least equal to the design streng th of the pipe and other fittings in thepipelin e sec tion to w hich it is 'to be attached ;

    (n) all pipeline sections shall be designed wi th,en ou gh flexioility to preventthermal expansion o r contraction from causing.excessive stresses in the pipe orcompo nents, excessive bending or unusual loads at joints, or undesirable forces ormom ents at points of connection to equipment, or at anchorage or gu ide points ;

    0) ach pipel ine or segment o f a pipeline which is not buried in the groundshall be designed s o that i t is raised and maintained abo ve ground on perm anentsupports ;

    p) n relation to all supp orts and anchorsi) each p p l i n e segment and its associated equipment shall have enough

    anchors or ;supports to :a )preverit undue, strain on connected equipmen tb ) esist longitudinal forces caused by a bend or otTset in the pipe andc ) prevent or da mp o ut excessive vibration

    ii) any exposed pipeline segmen t shall have enough sup ports or anchors toprotect the exposed pipe joints from the maximum end fo rce caused by internalpressure and any additional forces caused by temperature variation or by theweight o ft he pipe and its contents,

    iii) any sdpport or;anchor on an exposed pipel ine segment shal l be madeof durable, non-com bustibk material and shal l be designed and instal led asfol lows :a ) ree expansion and contraction of the pipeline segm ent between suppo rts o r

    anchors may not be restricted ;b )provision shall-b e made for the se'rvice cond itions involved ndc)movem ent oft he pipeline segment may not.cause disengagement of the support

    equipment ;i v )each support on an exposed pipeline seg men t oper ated at a stress level of

    50 per-cent or more o f the Specified Minimum Yield Strength shall comply withthe following :a) a structural support may not b e welded directly to the carrier pipe ;b )a suppor: may be wel ed to as lee ve that completely encircles the pipe ;an dc ) fan encircling ~n rm be rs welded to a pipe, the weld shall be continuous and

    shall cover the entire circumference ;v ) ach underground pipelinc segment that s connected to a relatively unyielding

    line or other fixed object shall have enough flexibility to provide for possiblemovement or it shall have an anchor that will limit the movement of the oipelinesegment and

    (vl ) except for offshore portions ofthe pipeline section each underground pipelinethat is being connected to new branches shallhave a firm foundat io~or both theheader and the branch to prevent detrimental lateral and vertical movement ;

    q) mitred joints shall not be used.6. The design and specification of compressor statlons shall be as followsa ) he design factor for compressor station piping shall be 0.50 ;b )a compressor shall comply withAPI 617 ;c) a turbine shall comply with API 616 ;

    6) ach main compressor building of a compressor station shall be located o r ,property under the control of the operator and shall be sufficiently removed ordistanced from adjacent property to minimize the possibility of fire being transmittedto the compressor building from structures on adjacent property or from thecompressor building to adjacent property. There shall be enough open space aroundthe main compressor building to allow the free movement of fighting equipment ;

    e) each operating floor of a main compressor building shall have at least twoseparated and unobstructed exits located so as to provide a means of egress andunobstructed passage to a place of safety. Each door latch on an exit be of a typewhich can be readily opened from the inside without a key. Each swinging doorlocated in an exterior wall shall be mounted to swing outward ;

    u each fence around a compressor station shall have a minimum height of 2metres and haqe at least two gates located so as to provide a means of egress to aplace of safety or have other facilities affording a means of exit from the area.Where applicable the mainentrance shall be wide enough to permit access fqr firefighting equipment. Each gate located within 60 meters. of any compressor plantbuildiag shall ot be locked when occupied and shall be operable from the insidewitbout a key ;

    g)where entrained vapours ir gas may liquefy under the anticipated pressureand temperature conditions the compressor shall be protected against theintroductionof those liquids in quantitiesihat could cause damage ts the PipelineSystem. Each liquid separator used to remove enmined liquids a a compressorstatien shall

    -(h)each compressor station shall have an automatic emergency shutdown systemthat meets the following requirementsi ) t shall be separate from the compressor station process contrul systemir) t shall be able to block gas out ofthe station and depressurize the station

    piping ;iil) t shall discharge gas from the blowdown piping at a locatior~wherehegas will not create a hazard, based on cold stack dispersion ahalysis ; andiv) t shall be designed and installed to operate automatically ;

    a)when the gas pressure n any part of the Pipeline System which.is pressuredby that compressor statiou equals' the Maximum Allowable Operating Pressure ofthat pan of the Pipeline System plus 10 per-cent ;b) when there is a contirmed fire detection ;c )when the concentration of gas in air reaches 60 per-cent ~r more of the lowerexplosive limit in an area that is designated unclassified or safe in terms of HazardousArea Classif~cation rovided that electrical equipment certified for.use in areas

    having a Hazardous Area Clzjssification equal to or exceeding the Hazardous AreaClassification of the area in which it is used, shall not considered as a source ofignition for the purpose of these Regulationf; or6) hen liquid slugs might be carried into the compressors ;

    v) t shall provide means for the shutdown of gas compressor stationequipment and non-essential e ectrical fzcilities in the vicinity ofgas headers orIn the colnpressor building, except thata) lectrical circuits that supply emergency lighting required to assist stationpersonnel n evacuating the compressor building and the area in thk'vicinity ofthegas headers shall remain energized ;b) lectrical circuits needed to protect equipment from damage may remain

    energized ; ndc) Vital Equipment shall remain operational ; ndv i ) it shall be operible from at least two locations each ofwhich is located

    a) near the exit gates, if the station is fenced, or near emergency exits, if thestation is not fenced ; ndb) ot more than 150'meters from the liniits of the compressor station

    1)each compressor station shall have pressure relief or any other suitableprotect~ve evices of sufficient capacity and sensitivity to ensure that theMaximum Allowable Operating Pressure of the compressor station piping andequipment is norexceeded by more than I per-cent.b each line that exhausts gas from the pressure relief valves of a compressor

    station shall extend to a location where the gas may bedischarged without hazard.k ) each compressor shall be equipped with the following safety equipment i

    i) tire detection and protection equipment ;ii) an automatic device to shut down the unit before the speed of either the

    B 7prime mo,ver (other than an electrical induction or synchronous motor) or thedriven t exceeds a m aximum safe speed ;@I) a'shutdown or alarm device that operates in the event of inadequate coolingor lubrication'of the unit safety equipmenti v ) a m eans for shutting off the fuel to any gas engine and venting the enginedistribution manifold nd

    (v) vent slots or holes in.the baffles of each compartment of a m uffler for agas en gine to prevent gas from being trapped in the mufflerI) each compres'sor station building-'shall be ventilated to ensure that theaccumulation of gas in rooms, sumps , attics, pits or other enclosed places does notendanger employees and a11 enclosed work places in each compressor statjonbuilding shall have fire and gas detec tion and protection facilities

    (m) each compressor station shall be designed such that the maximum soundpressure level limits for facility areas areI ) bsolute limit 115 dBA,i i ) general plant, work areas 85 dBA,iir) offices, control rooms 55 dBA, and

    (iv) at the f acility property limit 50 dBA.7. The design and specification of the R M stations shall be as follows Design anda) he design factor for R M station piping shall be 0 50 specificationo R M(b) the R M station and equipment shall be designed in acco rdance with stationsthe standards for measurement set out in paragraphs 26 (1) to 26 (5) of~ e ~ u l a t i b n6c) each pipeline segm ent in an R M station that is connected to a gas source sothat the Maximum Allow able Opera ting Pressure of that pipeline segm ent could beexceeded a s the result of pressure contro l failure (or any other type of failure) shallhave pressure relievipg or pressure limiting devices that meet the followingrequirementsi ) ach pre ssure relief or pres sure limiting device shall

    a) be constructed of m aterials such that the opera tion of the device will notbe impaired by corrosion ;(b) have valves and valve seats that are designed not to stick in a positionthat will make the device inoperative ;c) be designed and installed so that it can be readily operated to de termineifth e valve is free, can be tested to determine the ptessure at which it will ope rateand can be tested for leakage when in the closed position ;d) ave supp ort made of non-combustible material ;e) have discharge stacks, vents, or outlet ports designed to preventaccumulation of liquids and located where gas can be discharged into theatmosphere without undu e hazard ;V be designed and installed s o that the size of the openings, pipe, and fittings

    located between the system to be protected and the Pressure relieving device,and the size oft he vent line, are adequate to prevent hamm ering of th e vaive andto prevent impairment o f relief capacity ;

    (g) -be designed and installed to prevent any sin gle incident such as anexplosion in a vault or damage by a vehicle from affw ting the operation of boththe overpressure protective device and the regulator ; nd

    h )be designed to prevent unauthorized operation o f m y stop o r isolating valvethat will make the pressure relief valve or pressure limifing device in operative(ii) each pressure relief station or pressure limitinghration installed to protect a

    pipeline or a facility' shall have enou gh capacity, arfd shall be set tocoperate, toensure that :

    (a ) in a low pressure system, the pressure will not cause the unsafe operationo f any connected and properly adjusted gas utilization equipm ent ; and

    (b) the pressure does not exceed the lower of (i) the Maximum AllowableOperating Pressure oft ha t pipelihe segm ent plus 1 per-cent and (ii) the pressurethat pro duc es.a hoop stress of 75 per-cent o f the Specified Minimurh YieldStrength of that pipeline segment ;(iii) when more than on e pressure regulating o r comp ressor station feed s into apipeline segment, reliefvalv es or other protective devices shall be installed at eachIstation to ensu re that the failure of the largest capacity regulator o r co mp rq so r, or

    any single run of regulators or com pressor s in that station, will not impose piessureson any part o f the pipeline segment in excess o f the Maximum Allowable OperatingPressure of that pipeline segment ; nd

    (iv) relief valves or other pressure limiting devices shall be installed at or neareach R M station in a low pressure system , with a capacity to limit the maximumpressure in the main to a pressure that will not exceed the safe operating pressurefor any connected and properly adjusted gas utilization equipment ;

    4 ach R M station shall be designed such that the maximum sound pressurelevel limits for fac ili y areas are :i) bsolute limit 1 15 dBA,

    (ii) gener,al plant; wo rk areas 85 dBA,(iii)'ofices, control room s dBA, and(iv) at the facility property limit 50 dBA ;e ) ach R M station shall be designed with,fac ilitiesso that it is well protected

    against lightning strike.Prohibited 8 Th e following materials shall not be used in comppn ents of pipeline sections,Materials. c ompre ssor s ta tions o r R M s ta t io ns wt i i~ hc a r r ~ydrocarbons :

    (a ) cast or ductile iron materials ;b )copper , brass or alloy materials ;c) asbestos' ;4 polychlorinated biphenyls ;and

    e) thermoplastic or thermosetting plastic m aterials.9. -4 1) l he Pipeline System shall be constructed so as to comply with the design C o n s u i ~ c l i o ~ iand sp ecification rccjuircmcnts of tliese Regulations.(2 ) l he proced ures and specific ations for construction o f the Pipelin e Systcm or

    any part thereof shall be as follows :(a) the construction shall meet the specifications of ASM E B? 1.8 and shall be

    carried out in accord ance with existing environment laws :(b) all pipe shall .be transporte d in accord ance with the follow ing Stand ards :

    i ) API RP SLl , and(ii) AI 1 Rl SLW ;

    c) the weldab ility of steel pipe materials shalt be tested in acco rdan ce with API1104 ;d)whe re a type o f construc tion is specified for pipeline in the pro xi~ nit y f main

    roads and railroads and their mode o f crossing is spec ified , the pipeline shall bcconslructed in accordance with those specifications ;

    e ) he minimum underground depth o f the pipeline shall be as follows :i) onshore, 0.9 metres,

    (ii) navigable rivers, 1.5 metres,(iii) roads and railroad c rossings, 1.5 metres below surface of road or railroad

    and 1.2 metres below the bottom of drainage ditch or a s required by the locslauthority or rail operator,( iv) in rocky areas, 0.6 metres, and1,) offshore, 0.9 meter in water depths up to 8 metres ;

    CI there shall be a rnini~ num learance of 0.25 m etres between the pipeline andany other underground structure or other pipeline ;

    g ) he i nspc ct~o n y the Operator of the pipeline construction materials and itsappurtenances. w cl d~ ng , itching, stringing and the general installation shall becarried ou t in accordance with ASM E-B? 1.8 ;

    h ) all buildings shall be made of ndn-combustible materials and shall conformto the requirem ents of these Reg ulations and local building codes ; and

    i) railway and highway crossings shall be constructed in accordance with APIRP 1102.

    (3) l he Opera tor shall m aintain records detailing any significant dcve lopm entsrelating to the construction of the P ipeline System , including major tecllnical problems,seriobs interruptions of construction or serious labour problems and a dcscription o fany steps being taken to. address such developments.

    (4) l he Opera tor shall also maintain records of the following( u ) total number of girth welds ;b ) number of welds non-destructively tcsted including the number rejected and

    disposition of the rejecte d.welds ;

    (3) The Safe Practices and Procedures Manual shall include procedures designedto ensure that operation and maintenance activities in respect of the Pipeline Systernare incident and injury free and that these activities are carried out in such a way thatthe soun dness and fitnes s for purpose for which the Pipeline System has been designedwill not be compromised, and will not present a hazard to pcrsons, environmentaldama ge, or dam age to property. Th e following matters, if applicable, shall be addressedin the Safe P rac t~c es nd Procedures Manual

    a) the start-up, operation, maintenance and repair of thc Pipclinc Systcm naccorda nce.with these Regulations ;

    b ) pigging operations ;c) remotely operated vehicle operations ;4 a formal written procedure used to control types o f work which are potentiallyhazardous, non-routine, or not related to the normal operation ofthe Pipeline System ;e ) procedures to ensure that zero energy is present prior to work colnlnencingon .facilities or equipm ent ;

    corrosion control in accordance with the operation and maintenancerequirements ;g) construction records, maps, and operating history which should be mads.available to appropriate operating personnel.h ) he collection of da ta needed for reporting incidents in a timely and effective

    3) The Operator shall maintain a record of each test, survey, 01 inspectionreq&red by this Regulation in sufficient detail to demonstrate the adequacy of thecorrosion control m easures ort ha t a corrosive condition d oes not exist, and shall retainall such recard s for at leas t5 years, except that records related to Intelligent F'ig Surv eysand repair ofco rro de d pipelines shall be retained for as long as the pipeline rem ains inservice.(4) The Operator shall record cathodic protection readings in trend format andshall retain all such recording s for inspection for the lifetime of the Pipeline System.

    corrosion, (2) Whenever any pipe is removed from the Pipeline System for any reason , theinternal surface shall be inspected for evidence of corrosion.     a hearing to determine whether the circumstances warrant the withdrawal ormodification of a notice given under paragraph 1 ) of Regulation 38 Whcre a requestis received by the Authority under this R egulation, the Authority shall treat the requestwith urgency and shall conduct a hearing within 72 hours of receipt oft he request.     41.-41 Theoperator shail establish procedures for analyzing accidents andfailures, including the selection of samp.ks of the failed facility or equipment forlaboratory examination, where appropriate, for the purpose of determining the causesof the failure and minimizing the possibility of a .recurrence.

    (2 ) The Operator shall :a ) omp ile data on all failures and leaks for use in continuing surveillance nd

    (b) prepare a detailed analysis, especially of repeated occurrences when theanalysis could be useful in minim izing a recurrence of the failure.42 If a detailed analysis is to be made, rapid response will be necessary forgathering information and preservirig the integrity of any specimens collected.43. When a detailed analysis is to be prepared, a person at the scene of theincident should be designated to coordinate the investigation. Such person will beresponsible for :(a) acting as a coordinator for all field investigative personnel ;(b) maintaining a log of the personnel, equipment and witnesses ;(c) recording in chronological order the events as they take place4 nsuring tAat photographs are taken of the incident ai d surrounding areas ;e ) ensu ring the notification of all appro priate governmental authorities ;and nensuring the preservation of evidence.

    44.. When a detailed analysis is to be prepared, the Operator shall designate afully qualified investigation team. The investigation team should be qualitled either by.training or experience in the proper procedures for investigation of an incident. Theinvestigation should include the following :

    (a) determination of the probable cause of the incidentb ) evaluation of the initial response.to the incidentc) the need for system improvements if necek ary ;and

    6) the need for improvements in response, management and investigationofincidents.45;-(I) The Operator will prepare a procedure for the selection, collection,preserv ation, labell ing and handling o f specim ens. . Procedu res f@ collectingmetallurgical specimens should include precautions against changing the granlharstructure in the ar eas of investiga tory interest (e.g., avoid heat effects from cutting andoutside fo rc ei du e to tools and equipment). When corrosion may be involved,procedures may be necessary for proper sampling and handling of soil and groundwater specimens. Procedures controlling the cutting, cleaning, lifting, identitjring andshipping of pipe specimens should be considered f6r pres erva tion.o fval ~ab levidence

    on the pipe surface, and on any tear surfaces, fracture faces, including makingcu ts farenough from the failure to avoid damaging critical areas of the specim en.

    (2) Th e number of specimens that need to be collected at the failure site mayvary dep ending on the type and number of tests anticipated. Ase ries of independent ordestructiv e tests may require multiple specim ens. If there is a need to confirm the pipematerials specifications, then additional pipe specimens sho uld be obtained near thefailure, but in an area of the piping where the physical properties and characteristicsare unaffected by the failure itself. Other investigatory procedures may be utilized toconfirm pipe material specifications.

    46 - I ) Recognized standard destructive and non-destructive techniques arethe preferred means to examine test specimens. The testing methods used should besuited to the particular material being tested, and be pertinent to the failure investigation.

    (2) ~ n a l ~ s i snd data on failures should be com piled and reviewed. T he need-for continu ing surveillance of pipeline facilities should be,detefmined based upon theabove analysis.

    PART II1.-DISCONTINUATION,B A N D O N M E N TN D R E S U M P T I O ~OLOPERATIONF P I P E L I N EYSTEM

    \47.--(I) In the event that the Operator wishes to abando n, or discontinue orresume operation of the Pipeline System or any pa ith er eo f, the Operator shall applyin writing to the Autho rity giving not less than months written notice of its desire,stating the date on which the Operator wishes to abandon or discontinue or resumeoperations o f the Pipeline System or the relevant part thereof. An app lication givenunder this Regulation shall be accompanied with

    (u)the reasons for the discontinuation, abandonment or resumption ofope rationof the Pipeline System or part thereo f;

    (b)in the case o f a partial discontinuation or aband onmen t or resumption ofoperation, two copies of a plan o f the Pipeline System clearly showing thepart thereof to be abandone d or in which the operation is to be discontinued orresumed ;

    (c)the method proposed to be used for the discontinuation, abandonment orresumption of operations ;-and(6)in the event ofthe.abandon ment or discontinuation of th e Pipeline System or.part thereof only

    9i) a costed plan for the abandopment r discontinuation ofthe Pipeline Systemor relevant part thereof at the time'the Operator contemplates the Pipeline Systemor part thereof will be abandoned or discontinued, andii)evidence of the Operator'sor the Company's financial ability to carry out

    the abandonment or discontinuation in accordance with that costed plan.2) The Authority shall approve the application ofthe ~ o r n ~ & ~nder paragraph(I) of this Regulation provided the application and the proposals of the Company areconsistent with internationally recognised industry standards and good practiceapplicable to the abandonment of high pressure Natural Gas pipelines and with theInternational Project Agreement.

    3)Upon discontinuation or abandonment ofthe P~peline ystem or part thereof,the Operator shall ensure that the Pipeline system or the part thereof being discontinuedor abandoned is made safe, a ~ dhe relevant part of the Pipeline System shall unlessotherwise agreed by the Authority be(a)disconnected from all other facilities connected to it, including other pipelines,

    meter stations, ancillary facilities and appurtenances ;and(b)purged of petroleum liquid or gas by using water or inert material, filled withseawater or fresh water or a npn-flammable inert substance and sealed in accordancewith interflationally recognised industry standards and good practice applicable tothe abandonment of high pressure Natural Gas pipelines.4) Until such ti r e as the part of the Pipeline System beneath it is abandoned,tne right of way shall continue to' be maintained and clearly identified.5) lf part ofthe Pipeline System is removed following approval by the Authorityofan application by the Operator under paragraph (I) ofthis Regulation, the Operatorshall cany out remedial work to return the area to its original condition after the relevantpart has been removed including

    ,(a) the Right of Way covering that part of the Pipeline System andb ) any disturbed land area in the yidinity ofthat part of the Pipeline System.

    PARTX.-REPORTING48.--(I) The Operator shall provide to the Authority a report in respect of each Normal

    six month period ending on 3 mJune and 31 December each calendar year duringwhich a pipeline licence granted un dg the West ~ f i i can as Pipeline Act remains inforce, setting outa) the Reservedcapacity during the period in question, and any changes to theReserved Capacity, broken down by delivery point ;b) the names and addresses of all Shippers which held Reserved Capacity duringthe period in question ;c) the date of any new Gas Transportation Agreem nt entered into during theperiod-in question, the name of the Shipper and the d te for combencemenl of

    (k) the total lost time arising ffpm injuries or accid ents for the p eriod in question,including any case s carried over from previous and details of any potentiallyserious accidents or incidents e v e n z n o t involving lost t ime ;

    0 he manner in which the Company has complied with Clauses 28.1 to 28:6inclusive of the International Project Agreement ;

    (2). The following matters shall be considered by thC Authority and shall berelevant in determining the amount of any penalty imposed by the Authority(a) that 811 or part o f the requirement for a hearimg was waived(b) that the person charged ko-operated in the investigation(c) the likelihood of comm'itting the violation again, ,fpcluding whe ther anyindividual involved in the violation remain eplployed by the petson charged and

    CU. Where a violation of t he Regulations is (stablished, the Authority may naddition to. pena ties, impose an order for payment 4rion-bu dgeted costs reasonablyincurred by the Au thority in conducting the hearing, provided that such costSshal1 notexceed ten per cent of the penalty imposed.61 .- (1 ) A person upon whom a penalty is imposed under these Regulationsshall make payment thereof in US dollars into a Penalty Paym ent Accountesta blishe dby the Authority.(2) All amounts paid into the Penalty Payment Account shall follow ing receiptthereof be paid to the consolidated revenue of each of the State s in the ApportionmentPercentages of each State as at the date of the event to w hich the penalty relates.(3) The Authority may make application to a court of comp etentjurisdicti+ in ,any of the States for such orders and oth& relief as are necessary to compel paymentof penalties imposed under these Regulations.62.- 1) Where the Authority imposes an order for payment of costs inaccordance with Regulation 60, the person upon whom the costs order is imposedshall make payment thereof in US dollars into a Costs Account established by the

    Authority.(2) All amounts paid into the Cos ts Account m ay.be retained by the Authorityand used by it for the purposes.of adm inistering these R$gulations.63. A person found by the Authority to be in violation o f these Regulations orupon whom a penalty is imposed under these Regulations shall-have the right to havethe decision of the Authority finding that person to be in violation or to impose apenalty reviewed by the Board of Governors or the WAGP Tribunal in accordancewith the Rules of Procedure.

    64. If the Authority proposes to impose a penalty under Part X of theseRegu lations, or receives a request under Regulation 39, it shal'iconducf a hearing inrespect of that action in accordance with the Rules of Procedure.

    65.- 1 Any person who is aggrieved with any finding or action of the Authorityarising from a hearing conducted under Regulation 64, including the imposition of a

    penalty, may appeal the decision of the person presiding over the hearing to the Boardof Governors or if dissatisfied to the WAGP Tribunal in accordance with the Rules ofProcedure.2) The Company or any of the States may seek a review of a decision of theBoard of Governors by the Committee of ~in is te rsn accordance with Article IV ,ofthe WAGP Treaty and the Rulesof Procedure.

    (3) The Company or any of the States may seek a review of a decision of theCgmmittee of Ministers by the WAGP Tribunal in accordance with Article IV of theWAGP Treaty and the Rules of Procedure.(4) Ifthe determination ofthe Board of Governors (or the Committee ofMinistersif there is an appeal to it from the decision of the Board of Governors) or the WAGPTribunal in any appeal is that the decision of the person presiding over the hearingappealed from is not sustained in whole or in part, the Authority shall comply with andimplement such determination and revise itsdecision consistent wi th~uch etermination.66. The Rules of Procedure shall govern and apply to the conduct of any hearingof the Authority in accordance with Regulation 64 and any apped from a decision ofthe Authority conducted in accordance with Regulation 65.67 Subject to the Constitution, the courts of Nigeria have jurisdiction andpower to compel the compliance by any person with a subpoena issued by the Authorityor the WAGP ~ r i b u n a l hespect of any person or property located within Nigeria.

    PARTX1I.-MISCELLANEOUS68 . -41 All drawings, plans, designs and other technical documents made orprepared by the Operator in connection 4 t h he Pipeline System, and any plans for thefabrication or construction of the Pipeline System, which have been approved bJ theSteering Committee or its delegates prior to the establishment and empowerment ofthe Authority are deemed to have been duly approved by the Authority.(2) All actions taken by the Steering Committee or its delegates prior to theestablishment and empowermen1 of the Authority which are functions of the Authority,

    are deemed to have been duly taken by the Authority.(3) Any drawings, plans, designs and other technical doc,uments made or preparedby the Operator in connection with the Pipeline System,and an y plans for the fabricationor construction ofthe Pipeline System:which have been approved by the Authority orits delegates (or deemed to have been so approved by operation of paragraph 1) ofthis Regulation) prior to the entry into force of these Regulations, the approval ofwhich is provided for in these Regulations, are deemed to have been approved underthese R?gu
