Rape in Germany means penetration into any natural opening of the body AND other humiliating sexual practices, done by force against the person or threatening with force. A suspect is everyone who based on police inquiries and adequate factual evidence, is suspected of having committed an unlawful (criminal) act. This also includes accomplices, instigators and abettors. Suspects only are reported with cases “cleared up”. The suspect may have been caught in the act or may only be known by name. It is not necessary to be interviewed or arrested by the police. UNODC comment (due to space limitation): The complete non‐numerical data for 3t2 is: 18 and more. Suspects aged 18, but not yet 21 years, may be prosecuted by the judge under youth court act, that means for instance maximum prison is 10 years instead of a life sentence for adults from 21 years upwards. In regular Prison Statistics there is no differentation between juvenile and adult prisons, so official specific data is not available. Therefore ministry of Justice asked German Laender to estimate the capacity in juvenile prisons: At the end of 2006 there were 28 specific juvenile prisons with a capacity of 7.000 places. At the same time there were accessorily 28 juvenile branches in adult prisons with a capacity of 2.100 places. Please note: The estimated numbers are not as detailed and therefore not fully comparable with official statistics.
