The Georgia Composite Medical Board (GCMB) held its regular meeting on May 4, 2017 at 2 Peachtree Street, 36th Floor, NW, Atlanta, Georgia, to consider Medical Board matters. CALL TO ORDER Dr. Antalis called the meeting of the Georgia Composite Medical Board to order at 7:30 a.m. AGENDA AND MINUTES Dr. Retterbush submitted a motion, seconded by Dr. DeLoach, to approve the agenda of the May 4, 2017 meeting. The motion carried unanimously. Dr. Deloach submitted a motion, seconded by Dr. Retterbush, to approve the minutes of the April 2017 meeting. The motion carried unanimously. CHAIR’S REPORT Dr. Antalis thanked the Board for its enthusiastic participation at the Federation of State Medical Boards Annual Meeting in April 2017, and recognized Briana Fry-Jones, Tara Burks, and Diane Atkinson for their efforts in coordinating the itineraries for the seven Board members who attended the meeting. EXECUTIVE DIRECTOR’S REPORT Mr. Jeffery presented his report. The Board took the following actions: 1. Asked Mr. Jeffery to present a policy providing for administrative approval of licensure

applications at the next meeting. 2. In response to an inquiry from Donald Palmisano, Executive Director and CEO of the Medical

Association of Georgia, expressed its opinion that SB 47 does not appear to provide a categorical exemption from Georgia licensure requirements for physicians licensed in other states who are in Georgia to provide medical care at nonprofit camps.

3. In response to an inquiry from James Colquitt, Ph.D., of the Medical Center of Central Georgia, referred the question, “Is a licensed Respiratory Care Professional with appropriate medical direction and training permitted to insert intravenous catheters?”, and referred the question to the Respiratory Care Advisory Committee for its comments.

4. In response to an inquiry from James Colquitt, Ph.D., of the Medical Center of Central Georgia, expressed its opinion that licensed Respiratory Care Professionals are not permitted to administer normal saline or any other medications intravenously.

5. Reviewed an inquiry from Nate Lacktman of Foley & Lardner LLP, and asked for more information to clarify the questions.

CLOSED SESSION Dr. Retterbush offered a motion to go into closed session to discuss confidential enforcement and investigation matters. The motion was seconded by Dr. DeLoach, and it carried unanimously. Upon conclusion of the confidential matters, Dr. Antalis declared the meeting in open session. LEGAL / ENFORCEMENT ACTION REPORT Mr. Reimers presented the Legal / Enforcement Action Report. Dr. Retterbush submitted a motion, seconded by Mr. Wallace, to accept the report. The motion carried unanimously. The Board took the following actions: 1. Leonid Macheret, MD - Lifted practice restriction 2. 20120297 - Amended private consent order 3. 20151275 - Released copy of investigative file 4. 20161123 - Released copy of investigative file 5. Richard Karsh, MD – Accepted application for inactive status 6. Rahim Gul, MD - Reinstated Schedule II prescribing authority with terms 7. 20171689 – Issued cease &desist letter 8. 20161777 – Accepted private consent order 9. 20140439 – Accepted private consent order 10. 20140882 – Tabled (Dr. Gross recused)

CLOSED SESSION Dr. Gross offered a motion to go into closed session to discuss confidential enforcement and application matters. The motion was seconded by Dr. DeLoach, and it carried unanimously. Upon conclusion of the confidential matters, Dr. Antalis declared the meeting in open session. APPEARANCE BEFORE THE BOARD: CURTIS DENVER EDENS, DO Curtis Denver Edens, DO, appeared before the Board to request reconsideration of its denial of his application for physician licensure. After Dr. Edens presented his statements answered questions from the Board members, Dr. DeLoach offered a motion, seconded by Dr. Gross, to go into closed session to discuss confidential application matters.

Upon conclusion of the Board’s discussion, Dr. Antalis declared the meeting in open session. Dr. Gross offered a motion, seconded by Mr. Wallace, to uphold the Board’s decision to deny Dr. Edens’s application for licensure, unless Dr. Edens voluntarily withdrew his application. The motion carried unanimously. APPEARANCE BEFORE THE BOARD: FRED ERNEST POTTS, IV, MD Fred Ernest Potts, IV, MD, appeared before the Board to petition for termination of the terms and conditions imposed in his public consent order docketed in January 2017. After Dr. Potts presented his statements answered questions from the Board members, Dr. Retterbush offered a motion, seconded by Dr. Gross, to go into closed session to discuss confidential enforcement matters. Upon conclusion of the Board’s discussion, Dr. Antalis declared the meeting in open session. Dr. Retterbush offered a motion, seconded by Mr. Wallace, to amend the public consent order to lift the restriction of Dr. Potts’s controlled substance prescribing authority. The motion carried unanimously. RECESS Dr. Antalis declared the meeting in recess for the purpose of holding committee meetings. RECONVENE Dr. Antalis reconvened the meeting at 2:30 p.m. LICENSURE COMMITTEE Dr. Retterbush presented the Licensure Committee report as a motion. The motion was seconded by Dr. DeLoach. The Board accepted the report by unanimous vote. The Board took the following actions: 1. Bassem Arret – Denied request for sponsorship to retake the USMLE. 2. LaChiquita McCray – In response to a question regarding physician dispensing of surgical

dressings, the Board advised her that it could find no law or regulation regarding dispensing surgical dressings.

3. Margaret Baxter – Approved request for extension of medical license application. 4. Glenn Fleming – Denied request for copies of his resident summative evaluation report. 5. K.K. – Tabled. 6. NURSE PROTOCOL COMMITTEE Dr. Callins presented the Nurse Protocol Committee report as a motion. The motion was seconded by Dr. DeLoach. The Board accepted the report by unanimous vote. The Board took the following actions: Approved the addition of procedures to the following protocols: 1. Kimberly Smith, NP – adding pediatric surgical preparation and application of Allografting,

surgical excisional and non-excisional debridements, surgical preparation and application of autografting, scar reconstruction.

2. Kharisma Huggins, FNP – adding joint injections and trigger point injections to current protocol agreement with Dr. Michael McHenry.

3. Patricia Tarver, NP – dding external ventricular drain, lumbar puncture, and subdural evacuation to current protocol agreement with Dr. Arthur Grigorian.

4. Meggie Gilbert, NP – adding shoulder joint injections, knee joint injections, trigger point injections, arthrocentesis, and arthroconstetis to current protocol agreement with Dr. Kevin Lokkesmoe.

5. Mackenzie King, NP – adding CT bone marrow biopsy, lumber puncture with chemotherapy, and US guided paracentesis to current protocol agreement with Dr. Praveen Reddy.

submitted to the Board for review for compliance with applicable Georgia laws. 5. Approved the following statement concerning inactive and reactivating licenses:

“A licensed acupuncturist who is not actively engaged in the practice of acupuncture, and who does not wish to renew the license, may direct the Board to place the license on inactive status. This request must be made in writing. A license may remain on inactive status for a period not to exceed 5 years from the date the license was placed on inactive status if the licensee is practicing in another state. A license may remain on inactive status for a period not to exceed 3 years from the date the license was placed on inactive status if the licensee is not practicing at all. For renewal of an inactive license, the applicant must have proof of completion of at least 30 hours of appropriate acupuncture-related continuing education units (CEU’s) within the previous 2 years of inactivity, and pay all fees associated with reactivating license. The Board will then consider reactivating the license of the acupuncturist.”
