The Georgia Association of Groundwater Professionals (GAGwP) continues to work towards protecting and defending the water well drilling profession. In order to

protect the welfare and safety of the public and its natural resources. We endorse efforts by the Water Well Standards and Advisory Council (WWSAC) and the EPD of Georgia in its efforts to address issues of unsavory business practices and improperly drilled wells. These two arms of regulation and enforcement utilize the expertise and experience of several GAGwP members on the WWSAC Council. The efforts and tenacity required to ensure that our profession remains at a high level of competency and integrity is very appreciated by the GAGwP. Do you ever wonder how some people stay in business? Have you ever gone to a repair site and wondered what in the world was someone thinking? Not just as competition, but just witnessing the total lack of care by another contractor. Every industry has its “bad apples” and ours is no different. Who is at fault that poor workmanship and improper work is performed? At some point the public has a duty to be a responsible buyer or contractor. Be diligent when searching for a water well drilling contractor. Is that person in good standing as a member of the GAGwP? Are there any past or current complaints with the WWSAC? Ask for references. Sometimes a client is partially to blame for seeking out the lowest price, regardless of reputation and past performance. Our support of licensing, bonding, and continuing education requirements is to bring the level of

professionalism and respect by the public to a higher level, as well as adequately protecting the environment. In order to ensure the protection of groundwater resources, the EPD recently issued an order, in consultation with the WWSAC, to increase the performance bond for license renewal. This increase was proposed by the WWSAC because of very costly water well drilling code violations by a small number of water well drillers. When a water well drilling standard is violated, the well driller’s performance bond may be used to rectify the infraction. The cost of plugging, re-drilling, or properly sealing a well can easily exceed current bond levels on some, larger agriculture and irrigation wells.

In the twenty plus years of licensing, bond forfeiture has been very rare. In fact less than one percent of licensed drillers have been processed for bond forfeitures. I think that is a testimony to the integrity of our industry. As you can read later in the newsletter on page 4, we strongly suggest that the EPD use other avenues of increasing bonding in the future. Current bond levels are adequate to address most residential and small irrigation wells. The bonafide and conscientious water well and pump installers of Georgia should have no concerns of

performance bond seizure. The 99% of all well contractors who represent themselves in a legal and honest manner are congratulated by the GAGwP. Keep up the good work and God bless the USA. Jim McClain, GAGwP President

As you know, the EPD Director increased the drillers’ bond amount to $30,000 for the next license period. GAGwP President Jim McClain expressed his concerns about this to the Water Well Standards Advisory Council at their meetings on several different occasions. He had hoped for more discussion about this and additional input from our members. Now that this has happened we wrote the letter below to Mr. Rooks and hope this will receive serious consideration. We want to be sure that drillers who drill smaller wells are not unduly burdened by further increases in the bond amount. This idea was developed by Pete Peterson and Jim McClain during a recent GAGwP Board Meeting. Mr. Edward Rooks Georgia DNR Atlanta, GA Dear Mr. Rooks On behalf of the Board of Directors and membership of the Georgia Association of Groundwater Professionals (GAGwP), I would like to advise you and the Council that GAGwP is very much opposed to any further increases in the bond. We do not feel this adequately addresses the problem of improper installation of a limited number of agricultural wells and additionally, it puts an undue burden on a large number smaller drillers throughout the state. Rather than increasing the bond limit on all licensed drillers regardless of the dollar value of the wells they might drill, we would suggest that DNR notify property owners on all DNR “permitted wells” that the maximum amount of the driller’s bond is $30,000 and that they (the property owner) should require the driller to provide a “performance bond” to protect them against any further damages that he may incur. While we very much appreciate your efforts to protect the ground waters of our state and the property owners affected by a very small percentage of unscrupulous drilling contractors, we feel the above suggestion would accomplish your goals while not adversely affecting a very large number smaller drillers needlessly. Correspondence EPD informed the council of the five letters sent out on their behalf. These five letters includ-ed two new violations and three issues discussed at the last meeting. The two new letters of violation were sent to: Mr. Hesterlee a licensed plumber who has been preforming pump installation & repair work with no pump installers certification and Stanley K. Setzer cited by DNR for drilling without a Drillers License. Mr. Setzer has now applied to get a Drillers License (see #4 below). EPD mailed a second copy of a Notice of Violation (NOV) to Mr. Timmy Miller for not providing well data sheets to his customers. The first copy was mailed with improper postage and was not delivered. Mr. Miller provided copies of the well data sheets that were request-ed in the NOV. EPD mailed a notice of license revocation to Mr. Weldon and a 30 day notice of the intent to call a performance bond to Mr. Creasy.

EPD also mailed 245 Water Well Contractor License Renewal letters and 81 reminder letters to “Environmental” Drillers to renew their Bonds or Letter of Credit.

Old Business A.) Allen Weldon - Edward Rooks informed the Council about the ongoing process in regards to holding a license revocation hearing for Mr. Weldon’s license. Mr. Rooks informed the Council that EPD is in the process of contacting the attorney general’s office on the Council’s behalf to find out how and where the license revocation hearing will be held and who can preside over the meeting. B.) Brandon Creasy - Edward Rooks informed the Council that a letter was sent to Brandon Creasy on March 13, 2017 informing him that he has 30 days to fix the violations listed or his bond will pulled. Mr. Creasy has not responded to the letter. The Council made a motion to start the License Revocation process for Brandon Creasy and to begin the pro-cess to pull his Bond to abandon the wells/bore holes mentioned in the violation letter. Motion was made by Milton Thompson and seconded by Greg Grosch. The motion was approved by a unanimous vote yes. C.) Up-date on Bill Anderson- Still no contact from him and no new reports of him drilling. D.) Update on Barron Pee-bles/Jay Smarr- Peebles has not shown any of the requested proof of being in the drilling business for 2 years that the Council request in the previous meeting. Mr. Smarr has passed away.

Current Complaints/Presentations A.) Mr. Stuttes had a well drilled by the Kennedy Brothers the well is pro-ducing sand. The Kennedy Brothers’ licensed expired in 2015 and no renewal paper work has been received. In December of 2016 EPD personnel from the Coastal District office discovered this company drilling a resi-dential well without a license in the Brunswick area and with no intent to drill letter or inspection by the health department. B.) Report on the City of Douglas well abandonment The City of Douglas inquired about proper well abandonment procedures after involvement from a local licensed water well contractor. The city developed an acceptable plan for proper well abandonment and intends to contract with a licensed water well contractor for the abandonment of this well. C.) Twelve (12) complaints received: ten (10) resolved, two (2) open

A motion made by Dan Elder to request that Mr. Redd provide the council with more proof of being employed by/working under Mr. Charlie Barns for 2 years. Examples to be provided include W2’s, 1099 forms, check stubs. This motion was seconded by Greg Grosch.

Public Comments: 1. Anthony Cowart: Mr. Cowart is having trouble passing the 2 drilling related NWGA ex-ams, he has passed Ga. Law exam. He has purchased the study guides and is requesting help from the Coun-cil. Keith Carnley recommended he try using a company that will allow him to take an example test of the 2 drilling related NWGA exams he is trying to pass. Public Comments: 2. Jim McClain discussed the recent change in the Bond. He gave examples of how the drilling company could obtain a “bond for each individual agricultural well project” instead of the increase of the bond on all drillers. He also wanted to know if Triple H Specialty Company was approved to hold continu-ing education classed for credit. He was asked about this company at a recent continuing education class. The Council has not approved of any classes by this company. 3. The Council was reminded that their ap-pointments to the council will be expiring in November and they should take appropriate actions to begin the reappointment process. There is still no information on the requested appointment for the vacant agricultural seat on the Council.

Next Meeting The Council decided that the next meeting will be held on September 28th, 2017 at 2:00 PM at the annual Georgia As-sociation of Groundwater Professionals trade show which will be at the Savannah Marriott, 100 General McIntosh Blvd, Savannah, GA 31401.

Adjournment The meeting was adjourned at 12:36 pm with a motion by Dan Elder.

Well Projects Needed in Georgia

The Water Systems Council has advised us that they have $90,000 in federal funds to pay out for well projects in Georgia and must have these in the next 4 months.

These must be Low Income Households to qualify.

Renew Your License By June 29

June 29 is the DEADLINE for renewing your Georgia Water Well Contractor and/or Pump Installers License without a LATE FEE!

After that date, if you have NOT renewed your license, you will receive a "cease and desist" order from the state AND must pay a LATE FEE to renew!
