GENERAL DIRECTORATE OF LAND REGISTRY AND CADASTRE

1847, The existence of the imperial registry

organization (Defterhane) was known since the reign of Sultan Mehmet II. It was appointed to issue and maintain the land certificates by the “Regulation on Land Registry” which were recorded on the Book of Law at the Topkapı Palace on 21 May 1847. This date is commemorated as the data of establishment of the modern Land Registry Organization.

1924, In Republican Period, The Organization of the

General Directorate of land Registry was founded in 1924. The Cadastral unit was added to the structure of the Organization in 1925.

2010, The Agency maintains its activities under the

Ministry of the Environment and Urban Planning through the Law No 6083 dated 10 December 2010 on the Organization and Duties of the General Directorate of Land Registry and Cadastre.

History

General Directorate runs under the departments of which are listed below;

in 27.11.2002 MINISTRY OF PUBLIC WORKS AND SETTLEMENT,

ORGANISATION SCHEME OF THE GENERAL DIRECTORATE OF LAND REGISTRY AND CADASTRE

In Turkey, land registry, mapping agency and cadastre combined in a single official organisation. The Organisation structure including 24 regional directorates, 970 land registry offices and 81 cadastre offices in all over the Country.

a) To ensure reliable record of land register which is under the responsibility of the state on a regular basis, to perform all kinds of contractual and non-contractual transactions related to land registry and register of immovable properties, to follow-up, and control changes on the registers, to ensure the protection of archived records and documents. b) To conduct the country's cadastral survey, to follow the changes, to ensure renewal and updating of land plans and to carry out the related control and auditing services. c) To carry out or have carried out services of geodetic infrastructure, aerial photography, 1/5000 and higher scale photogrammetric and geodetic map production, to control, supervise and to identify the basic principles with the aim of large-scale production of cadastral and topographic maps. d) To create spatial information system infrastructure and map production monitoring centre, to ensure real and legal persons and public institutions and organizations benefit from the data, to do the tasks assigned in geographic information systems.

Duties and powers of the General Directorate İdentified by the Law No. 6083 entered into force on 10 December 2010 on the "Organization and Duties of the General Directorate of Land Registry and Cadastre“ are as follows;

e) To carry out transactions of foreign real and legal persons related to registry and cadastre in Turkey, to protect the rights and interests of natural or legal persons of the Republic of Turkey related to real property abroad, to join the interstate real estate negotiations. f) To plan, execute joint projects in cooperation with other countries and international organizations on issues related to the area of responsibility. g) To license topographical and cadastral engineering offices in accordance with the provisions of the Law dated June 16, 2005, No. 5368 on the Licensed Topographical and Cadastral Engineers and Offices, to identify and control operating principles and procedures of these offices. h) To regulate the real estate brokerage activities, to license grant, to identify principles and procedures and control these activities. i) To determine the principles to be followed by other public institutions and organizations and professional organizations in relation to duties, services and activities of Directorate General and to ensure coordination. j) To carry out other duties assigned by laws.

1) To provide an efficient and timely delivery of land registry services, to make necessary arrangements to carry out title deed transactions in accordance with legislation, 2) Conducting activities of Directorates of Land Registry and preparing annual work programs based on work load, collect statistical data and evaluate the results of their operations, 3) To ensure that carrying out transactions on a regular basis and maintain the land registry. 4) Examining any matter related to title deed procedures and reporting the results. 5) Examining the objections made against the decisions taken by the directorates of land registry regarding contractual and registry procedures and rejection of land registration procedures and land registry plans and preparing the opinion of the General Directorate. 6) Examining reports prepared as a result of control of land registry offices, determining and following up the necessary action. g) To regulate the real estate brokerage activities, to grant license, to identify principles and procedures of these activities.

Duties of Land Registry Department

According to Law No. 6083 entered into force on 10 December 2010 on the "Organization and Duties of the General Directorate of Land Registry and Cadastre" identified department of the Land Registry duties and powers in article 5;

Land registry directorates carry out contractual transactions e.g. property sales, donation, mortgage etc. and non-contractual transactions e.g. transition, land use conversion, zoning applications etc. In addition, to satisfy the demands of documents and information by citizens, courts, execution offices, agricultural offices another investor agencies and organizations. The process is starting at local offices. Local offices manage the conveyancing process and the registration process together and provide services directly to the citizens. 9

If there is no question of law about transaction and required documents are completed, carrying out transaction takes by approximately 2 hours (depends on sorting and appointment) including registration process. As an example the applicant has to submit tax payment certificate with application document.

The GDLRC provides direct services to arround 20 million citizens a year. Land Registry Offices were carried out more than 7 million (7.710.000) transaction in 2015. Amount of property sales were approximately 2 million (2.380.000) and mortgages were arround 500.000 (434.388). Although the number of transactions and citizens receiving service increased throughout the years.

GDLRC Information System and The Project of E-Registry According to Strategical Plan for 2015-2019, GDLRC (TKGM) main purpose is transition to E-Registry. In this context, primary goal is realizing registration and cancellation of title deed on electronic enviroment and leave the manual registration.

The GDLRC (TKGM) is aiming that fully electronic archives, also made possible the distraint and the mortgage transactions/cancellations on electronic enviroment, and share data services with stakeholders (company, institute, citizen etc). Within this scope, electronic envoriment process started with the project of TAKBİS (GDLRC Information System) in 2000; all land registry directorates has been integrated to the system in 2012.

The application allows citizens to carry out procedures at any land registry directorate without having to do it at the one where his immovable property is registered. This out of authority area land registry procedure prevents waste of time by removing the requirement for the applicants to visit for land registry procedures the land registry directorate where the immovable property is located and it provides efficiency and effectiveness.
