ARRANGEMENT REGARDING INTERNATIONAL TRADE IN TEXTILES
Notification under Article 4
Extension of the bilateral agreement betweenthe United States and Singapore
The Textiles Surveillance Body received a notification from theUnited States of an extension of its bilateral agreement with Singapore forthe period 1 January 1991 to 31 December 1995.
The TSB, pursuant to its procedures regarding notifications made underArticle 4, has examined the relevant documentation and is forwarding thetext of the notification to participating countries for their information.
The bilateral agreement and previous amendment are contained inCOM.TEX/SB/1200 and 1513.

The Embassy of the United States of America presents its complimentsto the Ministry of Foreign Affairs of the Republic of Singapore and hasthe honour to refer to the agreement relating to trade in cotton, wool, andman-made fibre textiles and textile products between the Government of theRepublic of Singapore and the Government of the United States of Americaeffected by exchange of notes dated 30 May and 5 June 1986, as amended (theAgreement) and to the Memorandum of Understanding of 28 November 1990concerning the extension of the Agreement, from 1 January 1991 through31 December 1995.
The Embassy of the United States of America also refers to itsNote No. 087/91 of 6 March 1991 and to the Ministry of Foreign Affairs' Noteof reply dated 1 April 1991 concerning the proposed text of the extendedagreement, with annexes.
The Embassy of the United States of America is pleased to confirm thatthe Government of the United States is prepared to retain in the extendedagreement the pre-existing language on cooperation against fraud andcircumvention. Accordingly, paragraph 17 of the extended agreement willread as follows:
"COOPERATION AGAINST FRAUD AND CIRCUMVENTION
17. In accordance with Article 8 of the arrangement the Government ofSingapore and the Government of the United States agree to cooperatefully in identifying and preventing circumvention of the presentagreement by transhipment, rerouting or whatever other means."
The Government of the United States also confirms that paragraph 5(E)of the Agreement should read as follows:
"(E) In addition to the flexibility provided for in paragraph 5 above,the following shifts are available:

The Ministry of Foreign Affairs of the Republic of Singapore presentsits compliments to the Embassy of the United States of America and has thehonour to refer to the latter's Note No. 087/91 of 6 March 1991 and to thedraft text (with annexes) proposing a five-year extension of the bilateraltextile agreement between the Government of the United States of America andthe Government of the Republic of Singapore.
The Ministry of Foreign Affairs of the Republic of Singapore ispleased to confirm that the proposal to extend the existing bilateraltextile agreement between the United States of America and the Republic ofSingapore, as agreed to at the discussions held in Washington on 27 and28 November 1990 and confirmed in the Memorandum of Understanding of20 November 1990, is acceptable. The meeting had agreed that the text ofthe agreement should follow the Memorandum of Understanding closely exceptfor editorial and grammatical amendments. Following this, the draft textproposed is acceptable, except for a minor change. Paragraph 17 of theproposed draft text should be replaced by paragraph 17 of the agreement of1986, in accordance with the Memorandum of understanding.
There is also a typographical omission of the word "per cent or Z"after all the figures "10" in paragraph 5(E). The revised paragraph 5(E)should read as follows:

The Embassy of the United States of America presents its complimentsto the Ministry of Foreign Affairs of the Republic of Singapore and has thehonour to refer to the the Arrangement Regarding International Trade inTextiles done at Geneva on 20 December 1973, as extended by the Protocol on31 July 1986, (hereinafter referred to as the Arrangement), and to theAgreement relating to trade in cotton, wool, and man-made fibre textilesand textile products between the Government of the Republic of Singaporeand the Government of the United States of America effected by exchange ofnotes dated 30 May and 5 June 1986, as amended (the Agreement).
The Embassy of the United States of America also refers to its note of26 October 1990, to the Department of Foreign Affairs' Note of6 November 1990, and to the Memorandum of Understanding of28 November 1990, following discussion between representatives of theGovernment of Singapore and the Government of the United States of Americain Washington, D.C., 27-28 November 1990, concerning exports of cotton,wool, and man-made fibre textiles and textile products of Singapore to theUnited States.
As a result of the above mentioned discussions and Memorandum ofUnderstanding, the Embassy proposes on behalf of the Government of theUnited States, under Article 4 of, and in conformity with, the Arrangement,an extension of the Agreement between the Government of Singapore and theGovernment of the United States with certain modifications, the text toread as follows:
Agreement Term
1. The term of this extension to the Agreement will be the period from1 January 1991 through 31 December 1995. Each "agreement period' or.agreement year' shall be a twelve-month period from 1 January of a givenyear to 31 December of the same year.
Coverage
2. The textiles and textile products covered by this agreement are thoseset forth in Annex A.
Classification
3. (A) Tops, yarns, piece goods, made-up articles, garments and othertextile manufactured products (being products which derive their chiefcharacteristics from their textile components) of cotton, wool, man-madefibres, or blends thereof, in which any or all of these fibres incombination represent the chief weight of the product, are subject to thisagreement. Components of an article which are not considered relevant tothe classification under the general rules of interpretation or the legalnotes to section XI of the Harmonized System are likewise to be disregardedhere.

(B) For the purposes of this agreement, textile products covered bysub-paragraph (A) above shall be classified as:
(I) Man-made fibre textiles, if the product is in chief weight ofman-made fibres, unless:
(A) The product is knitted or crocheted apparel in which woolequals or exceeds 23 per cent by weight of all fibres, in whichcase the product will be a wool textile; or
(B) The product is apparel, not knitted or crocheted, in whichwool equals or exceeds 36 per cent by weight of all fibres, inwhich case the product will be a wool textile;
(C) The product is a woven fabric in which wool equals orexceeds 36 per cent by weight of all fibres, in which case theproduct will be a wool textile.
(II) Cotton textiles, if not covered by (I) and if the product is inchief weight of cotton, unless the product is a woven fabric in whichwool equals or exceeds 36 per cent by weight of all fibres, in whichcase the product will be a wool textile.
(III) Wool textiles, if neither of the foregoing applies, and theproduct is in chief weight of wool.
(C) The system of categories and the rates of conversion into squaremeters equivalent (SME) listed in Annex A shall apply in implementing thisagreement except as listed in paragraph 3 (G).
(D) For purposes of computing limits and charges to limits therates of conversion for individual categories set out in Annex A shall beapplied.
(E) Coverage under this paragraph is intended to be identical withthe terms of Article 12 of the Arrangement. In the event of a questionregarding whether a product is covered by this agreement by virtue of beingin chief weight of cotton, wool, or man-made fibres, the chief value of thefibres may be considered.
(F) Textiles and textile products covered by this agreement shall beclassified in two groups, as follows:
(I) Group I: Specific limits listed in Annex B;
(II) Group II: All categories and part-categories not subject to aspecific limit at the time this agreement comes into effect.

(G) For the purposes of this agreement, the categories listed beloware merged and treated as single categories and sub-categories:

The rate of conversion into square meters equivalent for mergedcategory 352/552 is 11.3 dozens per square meter.
Specific Limits
4. Commencing with the first agreement period and during each subsequentterm of this agreement, the Government of Singapore shall limit exports tothe United States of cotton, wool, and man-made fibre textiles and textileproducts of Singapore to the specific limits set out in Annex B. Thespecific limits may be adjusted in accordance with paragraph 5.
Flexibility Adjustments
5. (A)(I) The specific limits set out in Annex B do not include anyadjustments permitted under paragraph 5.
(II) During any agreement period, the specific limits set out inAnnex B may be increased by not more than seven (7) per cent swingprovided that an equivalent quantity in square meters equivalent isdeducted from another specific limit. The Government of Singaporeshall notify the Government of the United States of the swing to beapplied under this sub-paragraph.
Carryover and Carry Forward
(B)(I) The extent to which any specific limit set out in Annex Bmay be exceeded in any agreement period by carry forward (borrowing aportion of the corresponding specific limit from the succeedingagreement period) and/or carryover (the use of any unused quantity(shortfall) of the corresponding specific limit from the previousagreement period) is eleven (11) per cent, of which carry forwardshall not constitute more than six (6) per cent.
(II) Carryover shall be available for application in the 1991agreement period. No carry forward shall be available forapplication in the 1995 agreement period.

(C) For the purposes of the agreement, shortfall in a specific limitoccurs when textiles or textile products of Singapore exported to theUnited States during any agreement period are less than the applicablespecific limit as set out in Annex B or, in the case of any limit decreasedpursuant to paragraph 5, when such exports are below the limit asdecreased.
(D) The Government of the United States may apply flexibility underparagraphs 5(B) and 5(C) to specific limits on any category or productwhenever that adjustment appears appropriate to facilitate the flow of tradeand the sound administration of the agreement. To the extend that suchadjustments are actually utilized, they will be implemented by means ofcarryover and carry forward in that order. Any unused flexibility will bere-credited to the donor limit. In applying such adjustments, theGovernment of the United States shall immediately notify the Government ofSingapore. This procedure will not prejudice the outcome of anyconsultations between our governments concerning the amounts of flexibilityavailable.
(E) In addition to the flexibility provided for in paragraph ofabove,the following shifts are available:

Designated Consultation levels
6. (A) The categories listed in Annex C are subject to the annualdesignated consultation levels specified therein. Categories not subjectto a specific limit, or listed in Annex C, shall be subject to an annualdesignated consultation level, equal in dozens or dozen pairs to the levelin dozen or dozen pairs under the previous system of square yardsequivalent conversion; levels in pounds shall be converted to kilogrammesat a rate of .45359237 kilogrammes per pound; levels in square yards shallbe converted to square meters at a rate of .33612736 square meters peryard; and, levels in square feet shall be converted to square meters at arate of .09290304 square meters per square foot. The Group II level listedin Annex D shall be treated as a designated consultation level.
(B) Under the previous system of square yard equivalent conversion,categories not subject to a specific limit, or listed in Annex C. weresubject to a annual designated consultation level of 2,000,000 square yardsequivalent in the case of cotton and man-made fibre, and 150,000 squareyards equivalent in the case of wool.
(C) If the Government of Singapore wishes to export textile productsto the United States in excess of the applicable designated consultationlevels, the Government of Singapore shall request the higher levels. TheGovernment of the United States shall consider such requestssympathetically. The Government of the United States shall respondpromptly and make every effort to resolve the issue within 14 US workingdays of the receipt of the initial request. If the Government of theUnited States is unable to comply fully with the request due to problems ofmarket disruption or the real risk thereof, as described in Annex A of theArrangement, in a category subject to such a request, the Government of theUnited States will so inform the Government of Singapore. The Governmentof the United States will supply data in accordance with paragraphs I and IIof Annex A of the Arrangement to substantiate the position it has taken.The two governments, unless otherwise agreed, shall consult as soon aspossible within 30 days of the United States' denial of the request andshall make every effort to conclude such consultations within 30 days oftheir commencement. Until a mutually satisfactory change in theconsultation level in question is established, shipments shall not exceedthe existing consultation level.
Overshipment Charges
7. (A) Products of Singapore shipped in excess of authorized limits inany agreement period may be denied entry into the United State. Any suchshipment denied entry may be permitted into the United States and chargedto the applicable limit in the succeeding agreement period.
(B) Products of Singapore shipped in excess of applicable limits inany agreement period will, if allowed entry into the United States duringthat agreement period, be charged to the applicable limit in the succeedingagreement period.
(C) Any action taken pursuant to sub-paragraph 7(A) and 7(B) above,will not prejudice the rights of either side regarding consultations.

Spacing Provisions
8. The Government of Singapore shall use its best efforts to spaceexports of its products to the United States within each category,sub-category or part-category evenly throughout each agreement period,taking into consideration normal seasonal factors.
Implementation of the Limitation Provisions
9. The Government of Singapore shall administer its export control systemunder the agreement. The Government of the United States may assist theGovernment of Singapore in implementing the limitation provisions of thisagreement by controlling, by the date of export, imports of textiles andtextile products covered by this agreement.
Exchange of Data
10. (A) The Government of the United States shall promptly supply theGovernment of Singapore with data on monthly imports of cotton, wool, andman-made fibre textiles and textile products from Singapore into theUnited States.
(B) The Government of Singapore shall promptly supply the Governmentof the United states with data on monthly exports of cotton, wool andman-made fibre textiles and textile products from Singapore to theUnited States.
(C) Each Government agrees to promptly supply any other availablestatistical data necessary to the implementation of this agreementrequested by the other government.
Mutually Satisfactory Administrative Arrangement
11. Mutually satisfactory administrative arrangements or adjustments maybe made to resolve minor problems arising in the implementation of thisagreement, including differences in points of procedure or operation.
Consultation of Implementation Questions
12. The Government of the United States and the Government of Singaporeagree to consult upon the request of the other on any question arising inthe implementation of this agreement.
Right to Propose Revisions to the Agreement
13. The Government of the United States and the Government of Singaporemay at any time propose revisions to the terms of this agreement. Eachagrees to consult promptly with the other about such proposals with a viewto making such revisions to this agreement, or taking such otherappropriate action as may be mutually agreed upon.

Consultations in Case of InequityVis-A-Vis a Third Country
14. If the Government of Singapore considers that as a result oflimitations specified in this Agreement, it is being placed in aninequitable position in relation to a third country, the Government ofSingapore may request consultations with the Government of theUnited States with a view to taking appropriate remedial actions, such as areasonable modification of this agreement.
Article 3 Procedures
15. For the duration of this agreement, the Government of theUnited States shall not invoke the procedures of Article 3 of theArrangement to request restraints on the exports of cotton, wool andman-made fibre textiles and textile products to the United States coveredby this Agreement. The Government of the United States and the Governmentof Singapore reserve their rights under the Arrangement with respect totextiles and textile products not subject to this agreement.
Visa System
16. Both Governments agree to maintain the visa system effected byexchange of notes dated 4 October and 8 October 1982.
Cooperation Against Fraud and Circumvention
17. In accordance with Article 8 of the Arrangement and Paragraph 16 ofthe Protocol, the Government of Singapore and the Government of theUnited States agree to cooperate fully in identifying and preventingcircumvention of the agreement by transshipment, rerouting and whatevermeans.
Conforming Clause
18. Either Government may request consultations on any provision of thisbilateral agreement in the event that a new regime for textiles trade isagreed after the scheduled expiration of the 1986 Protocol of Extension tothe Arrangement Regarding International Trade in Textiles.
Right to Terminate the Agreement
19 Either Government may terminate this agreement, effective at the endof an agreement period, by written notice to the other Government, to begiven at least 90 days prior to the end of such agreement period.
If the fore going conforms with the understanding of the Government ofSingapore, this note and your Government's note of conformation shallconstitute an agreement between our two Governments.
