    ORDINANCE NO. 2013-__

    AN ORDINANCE TO REPEAL ORDINANCE NOS. 1962-80, 1969-156 AND1974-24, AND TO FURTHER REGULATE THE DISCHARGE OF

    FIREARMS IN THE CITY OF GARDENDALE, ALABAMA

    BE IT ORDAINED by the City Council of the City of Gardendale, Alabama,while in regular session on the ___ day of ________________, 2013, at 7:00 p.m., asfollows:

    SECTION 1. Ordinance No. 1962-80 and Ordinance No. 1969-156, andOrdinance No. 1974-24 be, and they hereby are, repealed in their entirety.

    SECTION 2. Discharge of firearms. Subject to the provisions of thissection, it shall be unlawful for any person to fire, discharge or shoot within the cityany gun, rifle, shotgun, pistol or other similar firearms on or within 500 feet of aresidence, business or other inhabited building or private or public property not theproperty of the person, except as shooting galleries or ranges legally established, inthe discharge of duty by law enforcement officers, pursuant to lawful direction oflaw enforcement officers, or in lawful defense of person or property from feloniousattack. A person may discharge firearms on such person's own property within 500feet of a residence, business or other private or public property not such person's

    property where it is essential for the purpose of disposing of or destroying certaindestructive animals, fowl, birds, reptiles or insects that are a menace to publichealth and have become a nuisance upon the person's premises.

    SECTION 3. The Chief of Police of the City of Gardendale isauthorized to promulgate such rules and regulations under this ordinance as may bedetermined by him to be necessary or appropriate from time to time to carry out thepurposes of this ordinance or to otherwise give it full force and effect.

    SECTION 4. Any person violating this section shall be guilty of a

    misdemeanor, and upon conviction shall be fined not less than one dollar ($1.00)and no more than five hundred dollars ($500.00), and/or up to six (6) months in thecity jail, or both, at the discretion of the court.

    SECTION 5. That this Ordinance shall become effective immediatelyupon its adoption and publication or by otherwise becoming a law.

    SECTION 6. The provisions of this ordinance are severable. If any provisionhereof is held by a court of competent jurisdiction to be invalid, such invalidity shallin no way affect the remaining provisions of this ordinance.
