THE AGREEMENT Under this Policy Insurer agrees to provide the Gadget Protect Insurance to the Insured on the terms, conditions and limitations set out in this Policy based on information offered by the Insured provided the Premium is paid when due. This Policy is effective for a period of one (1) year and is renewable subject to the mutual consent of the Insurer and the Insured, for subsequent periods of one (1) year upon the Policy expiration date or any subsequent renewal date. This Policy includes a Policy, a Certificate of Insurance, all current and future endorsements and any attachments made hereto. SECTION 1 INTRODUCTION

1. PARTIES

This Gadget Protect Insurance (“the Policy”) is entered into between:

2. THE AGREEMENT

Under this Policy Insurer agrees to provide the Gadget Protect Insurance to the Insured on the terms, conditions and limitations set out in this Policy based on information offered by the Insured provided the Premium is paid when due.

SECTION 2 GENERAL DEFENITIONS

Terms with a specific meaning are defined below and shall have the same meaning wherever they appear with an initial capital letter.

Annual Aggregate Limit means the maximum amount for which We are liable during the Policy Period.

Accidental Damage means accidental physical damage to Your Personal Gadget due to an unexpected event including liquid damage and cracks resulting in Your Personal Gadget no longer being able to perform its intended function.

ATM means automatic teller machine.

Bank means any bank in U.A.E. licenced to operate as per the UAE Central Bank.

Bank Account means Your account for personal use, with the Bank, against which You can deposit money, withdraw money, deposit and/or draw checks.

Burglary means the actual or attempted unlawful taking of Your Personal Gadget through the use of force or violence, with visible signs of forced entry.

Covered Content means Your Payment Cards and Personal Papers contained in Your wallet.

Fraudulently Made Calls or Fraudulent Calls means phone calls placed without Your authorization by someone other than You.

Identity Theft means unauthorized and/or illegal use of Your personal information, such as Your name, to open and access a Bank Account that You did not authorize.

Incident means:

(i) Accidental Damage, or Theft, of Your Personal Gadget;

(ii) Your wallet being Lost or Stolen.

Lost means no longer in Your possession due to having been (i) inadvertently misplaced, or, (ii) in an irretrievable place.

Money means currency, coins and bank notes that are in current use and that have a face value.

Mysterious Disappearance means the unexplained disappearance of Your Personal Gadget from a known location.

Natural Catastrophe includes but is not limited to flood, windstorm, lightning, fire, explosion, landslide, volcanic action or earthquake.

Payment Card means Your ATM, credit, charge or debit cards, used to purchase Your Personal Gadget, issued by any financial institution in U.A.E., for personal use only.

Per Occurrence Limit means the maximum amount payable under the Policy for any single covered loss.

Personal Gadget means Your personal mobile phone or tablet purchased by You through Your Payment Card.

Personal Papers means official identification documents including, but not limited to, Your driving license, employment papers and passport(s).

Policy Period means the 12 month period of time that You are covered by this Policy from the policy effective date to the policy expiration date.

Printed Advertisement means an advertisement appearing in a newspaper, magazine or store leaflet which states: (i) the authorized

dealer or store’s name, (ii) item (including model number), (iii) item price, and, (iv) the dates in which the item’s price is effective.

Purchase Price means the price You paid for Your Personal Gadget.

Relative means Your legally married spouse, parent, step-parent, parent in-law, grandparent, child, stepchild, legally adopted child, grandchild, brother, brother in-law, sister, sister in-law, son in-law, daughter in-law, uncle, aunt, niece, nephew or first cousin.

Replacement Cost means the cost or current price of a similar item with similar specifications.

Replacement Product means a product with similar features and specifications to those of your Personal Gadget which will be provided by Us under this Policy when the Personal Gadget can no longer be repaired due to a covered incident.

Robbery means unlawful taking of the Personal Gadget and/or Your wallet, by a person(s), using violence or threat of violence and who has caused or threatened physical harm to You, Your spouse and/or those of your children who are under the age of 21.

SIM Card means Your Identity Module (SIM) card that is part of the Personal Gadget.

Suit means (i) a civil proceeding seeking monetary damages as a result of Identity Theft, or, (ii) a criminal proceeding in which You are charged with illegal acts committed by someone else while engaged in the Theft of Your identity.

Theft or Stolen means the unlawful taking of Your Personal Gadget from Your care and /or custody, without Your consent.

Transportation Ticket means any ticket purchased for any type of public or private transportation.

You means the insured shown in the policy certificate and Your means belonging or pertaining to You.

We, Us, Our or the Insurer means the company providing this insurance, American Home Assurance Company (Dubai Br.).

SECTION 3 SCOPE OF COVER

Coverage benefits are listed in the Table of Benefits subject to per occurrence and Annual Aggregate Limits.

A. YOUR PERSONAL GADGET a. Accidental damage

In cases of Accidental Damage to Your Personal Gadget, We will:

i. repair the Personal Gadget; or

ii. at our sole discretion, pay for the cost, up to an amount not exceeding the Purchase Price or We will provide a Replacement product,

b. Theft

In case Your Personal Gadget is subject to a Theft, We will:

i. at our sole discretion, pay for the cost, up to an amount not exceeding the Policy limits or provide you with a Replacement Product with similar specification which shall not exceed the Purchase Price of the Stolen Gadget; and/or

ii. reimburse You for a replacement of the SIM Card; and/or

iii. reimburse the amount You owe for Fraudulently Made Calls during a 24 hours period immediately following a Theft of the Personal Gadget, up to a limit of AED 75.

Note: We do not guarantee that the Replacement Product will be an exact match of Your Personal Gadget.

Specific Exclusions

We will not cover costs or losses: i. resulting from, or related to a Personal Gadget that

ispurchased by a commercial entity;

ii. caused by the process of cleaning, servicing, maintaining, adjusting, repairing or misusing the Personal Gadget;

iii. Loss or damage caused by scratching or denting which does not prevent the Personal Gadget from performing its intended function.

iv. caused by any Natural Catastrophe, atmospheric or climatic conditions, fire, water, normal wear and tear, manufacturing defects, abuse, vermin or insects, termites, mold, wet or dry rot, bacteria, rust, cleaning or repairs, or similar events;

v. to accessories or any consumable part related to the operation of the Personal Gadget , including, but not limited to, hands-free equipment, chargers, batteries, complementary cards and any accessory that is secondary to the Personal Gadget;

vi. resulting from a failure of the Personal Gadget, or any part thereof, itself caused by an electrical or a mechanical defect;

vii. resulting from leaving the Personal Gadget unattended in any place, motor vehicle, building or public place where it is, or was, visible from the outside;

viii. resulting from Fraudulent Calls, made with the Personal Gadget, after a 24 hour period immediately following the Theft;

ix. resulting from the Mysterious Disappearance of the Personal Gadget.

Coverage Conditions

i. The age of the Personal Gadget should not be more than 3 months when You purchase this Policy. No losses or claims are covered that occur within the fifteen (15) days of the initial Policy Period.

ii. We will decide whether to reimburse the actual purchase price of the Personal Gadget (with cash or credit) provided that You provide the original purchase receipt to Us, or have the Personal Gadget to be repaired or replaced.

iii. In the event that the Personal Gadget which was claimed under cover (b) Theft, above, has been found after payment of claim by us, such Personal Gadget will become Our property and You must handover such Personal Gadget to Us.

iv. In case of an Accidental Damage to the Personal Gadget, You shall not repair the Personal Gadget without Our prior written consent.

v. In case of a Theft of Your personal mobile phone, You must cancel the SIM card within 12 hours of discovery of the Theft.

Duties After a Loss

In the event of a covered loss, You must:

1. Contact Us using the following contact details within forty

eight (48) hours of the discovery of a covered loss, to obtain a claim form and instructions on what to do after a loss.

2. In case of a Theft to Your Personal Gadget:

a. inform your telecom operator and file a complaint with

the police within forty eight (48) hours of discovering a

Theft;

b. confirm that the SIM Card has been blocked and notify Us of the new telephone number, if any, and International Mobile Equipment Identifier (IMEI);

3. In cases of Fraudulent Calls, provide Us with the following documents:

a. written evidence of the request made to the telecommunication company provider to terminate the service, including the date and time of the request; and

b. photocopy of the telephone bill detailing the Fraudulent Calls;

4. Complete, sign and return the claim form to Us within 15 days after the Damage / loss is first reported as indicated above with the following documents:

a. an original purchase receipt showing the Purchase Price, brand and model of the Personal Gadget;

b. in the event of a Theft, the official police report.

5. Cooperate with Us in investigating, evaluating and settling the claim;

B. LOST WALLET

In the event that Your wallet is Stolen or Lost , We will pay: a. Replacement Cost of Your wallet, and its Covered Content; and

b. reasonable and customary application fees for new Covered Content that was in Your wallet at the time the wallet was Stolen or Lost

The covers provided above are limited to two Incident(s) per Policy, regardless of the per Policy limit.

Specific Exclusions

We will not cover costs or losses:

i. resulting from leaving the wallet, unattended in any place, motor vehicle, building or public place where it is, or was, visible from the outside; and

ii. related to Money, checks, Transportation Tickets, or any items, other than the Covered Content, that were in Your wallet when it was either Lost or Stolen; and

iii. related to Accidental Damage to Your wallet and its Covered Contents; and

iv. resulting from any unauthorized withdrawals, and/or bank transfers made on the Payment Card(s) that were in Your wallet when it was either lost or stolen; and

v. resulting from the Mysterious Disappearance of the wallet and its Covered Content.

Duties After a Loss

In the event of a covered loss, You must:

1. Contact Us using the following contact details withinforty

eight (48) hours of the discovery of a covered loss, to obtain a claim form and instructions on what to do after a loss.

2. File a police report within forty eight (48) hours of discovering

that Your wallet was Stolen or Lost;

3. Inform all appropriate entity(ies) (including, but not limited to,

Payment Card company or governmental agency) within forty eight (48) hours of discovering that the wallet, with its

Covered Content, was either Lost or Stolen;

4. For the avoidance of doubt, if You fail to fulfill time frames stipulated above, You shall be required to provide Us with reasonable excuse for the delay, in writing, to avoid invalidation of a claim

5. Complete, sign and return the claim form to Us within 15 days after the loss is first reported as indicated in 1 above with the following documents:

a. an original purchase receipt showing the original price of the wallet that was Lost or Stolen. In the event of no receipt We will reimburse a reasonable amount up to AED

C. PRICE PROTECTION

We will reimburse You for the difference between: (i) the original price You paid for Your Personal Gadget, with Your Payment Card, and, (ii) a lower price, for the same item, identified by the same brand, make, model name and model number, as shown in a Printed Advertisement, from a different retail store in United Arab Emirates.

Specific Exclusions

We will not pay for price differences:

i. other than those that meet the specifications listed above; ii. when an item’s original purchase price is below two hundred

fifty dirham (AED 250); iii. resulting from internet advertisements, mail orders, catalog

purchases and phone orders; iv. for Personal Gadgets advertised as "limited quantity", "going

out-of-business sales", "cash only" or "close out" sales or using words to a similar effect;

v. resulting from package offers, advertised rebate, refund of any sort of , coupons, employees' discounts, or, where the advertised price includes bonus or free offers, special financing, installation, rebate, one-of-a-kind or other limited offers;

vi. for Personal Gadgets You have purchased from an affiliate of the retailer offering the lower price;

vii. for cash, checks, show tickets, securities and other negotiable instruments, bullion, stamps, lottery tickets or tickets to events, admission or entertainment;

viii. for used, recycled, previously owned, rebuilt, or remanufactured Personal Gadgets, whether or not You knew the item was used, previously owned, rebuilt, or remanufactured, at the time of purchase;

ix. for customized/personalized, unique and one-of-a-kind items; x. for any item acquired illegally; xi. for additional services You may purchase, including, but not

limited to, the performance or rendering of labor or maintenance, repair or installation of products, goods or property, or professional advice of any kind;

xii. for items purchased by a person not resident in the United Arab Emirates;

xiii. due to shipping and/or transportation costs, handling costs and sales tax;

xiv. for Personal Gadgets advertised outside of the United Arab Emirates, or, in a duty free zone;

xv. resulting from special deal(s) available only to the members of specific organizations, or, in a place not open to the public, such as clubs and associations;

xvi. for Personal Gadgets purchased for resale or commercial use;

xvii. In addition, We will not pay: 1. for any merchant's credit, discount and/or

manufacturer's rebates; 2. for shipping and handling fees; or 3. more than the actual amount charged for the

purchased item.

Coverage Conditions

i. The Personal Gadgets must be purchased entirely through Your Payment Card.

ii. The lower price must be stated in a Printed Advertisement. iii. The Printed Advertisement must be published within 30 days of

Your original purchase. iv. The Policy cover provided is limited to one (1) incident(s) per

annum. v. Insurer will pay up to the maximum amount per occurrence

and per annual aggregate limits as shown in this Policy

Duties After a Loss

1. Contact Us using the following contact details within forty

eight (48) hours of the discovery of a price difference, to obtain a claim form and instructions on what to do after a loss. For the avoidance of doubt, if You fail to fulfill time frame stipulated herein, You shall be required to provide Us with reasonable excuse for the delay, in writing, to avoid invalidation of a claim.

a. The original receipt with purchase price;

b. The original Payment Card receipt demonstrating that the entire purchase was made through Your Payment Card; and

c. The original Printed Advertisement showing the purchased item, sale date and /or date of the Printed Advertisement, lower advertised price, and advertising retailer’s name;

d. Cooperate with Us in investigating, evaluating and settling the claim; and

3. Provide all other relevant documents We may ask You to provide.

D. IDENTITY THEFT

We will reimburse You for the expenses set out below, up to per occurrence and per Policy Period limits, resulting from Your efforts to resolve Your Identity Theft. All expenses incurred must be submitted to Us within 6 months of the first reporting of the loss. The following expenses are covered:

by You to:

i. Defend any Suit brought against You by a creditor or collection agency, or someone acting on their behalf, as a result of Your Identity Theft; and/or

ii. Appealing against any civil or criminal judgment wrongfully rendered against You, as a result of Your Identity Theft.

b. Lost Wages We will reimburse You for the unpaid time You take from work, solely as a result of Your efforts to correct Your financial records, if the later is altered as a result of Your Identity Theft. Payment of lost wages under this section includes compensation for whole or partial unpaid workdays. To be covered, You must take these unpaid days within 6 months of first reporting a loss.

c. Obligation to pay We will reimburse You for the amount(s) You become legally liable to pay to creditor(s), arising from the unauthorized opening and use of Bank Account(s), under Your name, as a result of Your Identity Theft.

Coverage Exclusions

We will not cover: i. costs other than those listed above;

ii. monetary losses other than the out-of-pocket expenses listed above, related to the resolution of Your Identity Theft outlined in this Policy;

iii. costs associated with any physical injury, sickness, disease, disability, shock, mental anguish and mental injury including required care, loss of services or death;

iv. compensation for time taken from self-employment, or workdays that will be paid by Your employer, in order to correct Your financial records that have been altered due to Your Identity Theft;

Coverage Conditions

i. You must cooperate with Us and help Us enforce any legal rights You, or We, may have in relation to Your Identity Theft.

ii. Evidence of any false charge or withdrawal from the unauthorized opened Bank Account must be submitted by You, or the issuing financial institution, to Us.

iii. The obligation to pay mentioned in c. above is limited to the amount that you are held liable by the Bank up to the coverage limits as mentioned in the Table of Benefits above.

Duties After a Loss

discovering Your Identity Theft;

4. For the avoidance of doubt, if You fail to fulfill time frames stipulated above, You shall be required to provide Us with reasonable excuse for the delay, in writing, to avoid invalidation of a claim

5. Complete, sign and return the claim form to Us within 15 days of making the original claim with the following documents:

a. an authorization for Us to obtain Your records and other information;

b. Your financial reports, including, but not limited to bank statements, as necessary to complete Our investigation;

c. Original receipts of Your expenses incurred to resolve Your Identity Theft, up to 6 months after You report a loss under this section, point a) above;

d. Proof that it was necessary to take time away from Your work if You make a claim for lost wages. We will ask You to submit written proof from Your employer that You took unpaid days off;

e. Copies of any demands, notices, receipts, summonses, complaints, or legal papers in connection with a covered loss; and

f. All other relevant documents We may ask You to provide;

6. Cooperate with Us in investigating, evaluating and settling the claim; and

7. Provide all other relevant documents We may ask You to provide.

E. FRAUDULENT CHARGES

1. If Your Payment Card used in purchasing the Personal Gadget is Lost, or became an object of a Theft, We will reimburse You for Unauthorized Charges, for which You are responsible, on Your card, up to twenty four (24) hours prior to Your first reporting of the event to Your bank.

2. If Your Payment Card used in purchasing the Personal Gadget is still in Your possession and Unauthorized Charges are made on Your Payment Card, through: (i) in-store, (ii) telephone, (iii) ATM withdrawals, and/or (iv) on-line purchase(s), using Your card information, We will reimburse You such Unauthorized Charges, for which You are not responsible, which are incurred up to two (2) months prior to Your first reporting of the event to Your Bank.

Coverage Exclusions

We will not cover:

i. unauthorized Charges made on Your Payment Card that was Lost or became an object of a Theft more than 48 hours prior to You first reporting the event to Your Bank;

ii. Unauthorized ATM withdrawals that were made more than two (2) months prior to You first reporting the event to Your Bank;

iii. Unauthorized Charges made on Your Payment Card if Your card has not been Lost, or become an object of a Theft, more than two (2) months prior to the first reporting of the event to Your Bank;

iv. charges incurred by a resident of Your household, or by a person entrusted with Your Payment Card by You;

v. charges made on Your Lost or Stolen Payment Card after reporting the event to Your Bank; and

vi. cash advances made with Your Lost or StolenPayment Card.

Coverage Conditions

i. We will only pay for unauthorized charges for which You are responsible under the terms and conditions of Your Payment Card.

ii. You must submit evidence of unauthorized charges made to Your Payment card to Us.

iii. Your Payment Card must be valid and in good standing for coverage to apply; benefits will not be paid if, on the date of occurrence, on the date of claim filing, or on the date of would-be claim payment, Your credit card is in delinquency, collection, or cancellation status.

Duties After a Loss

SECTION 4 GENERAL EXCLUSIONS

We will not cover any losses:

1. other than those listed in Section 3, Scope of Coverage;

2. that do not occur within the Policy Period;

3. due to, or related to a nuclear, biological or chemical event(s);

4. caused by You or Your illegal acts or those of a Relative;

5. that You have intentionally caused;

6. that resulted from intentional actions of Your Relative, or actions that a Relative knew of or planned;

7. associated with any physical injury, sickness, disease, disability, shock, mental anguish and mental injury or death;

8. due to war, invasion, act of foreign enemy, hostilities or warlike operations (whether war has been declared or not), civil war, rebellion, revolution, insurrection, civil commotion, uprising, military or usurped power, martial law, terrorism, riot or the act of any lawfully constituted authority or vandalisms of any kind; or

9. due to the order of any government, public authority, or customs official.

SECTION 5 POLICY CONDITIONS

A. Disputes In the event of a dispute under this Policy, the Parties agree to submit to the exclusive jurisdiction of the Courts of the United Arab Emirates, unless a valid arbitration agreement has been entered into between the Parties, in which case, the Parties agree that any dispute or issue arising under or in respect of this Policy, including in relation to the breach, termination or validity of the Policy, shall be referred to arbitration in accordance with the provisions of the arbitration agreement.

B. Excess of Other Insurance Coverage Coverages provided by this Policy are in excess; which means that if, at the time of occurrence, You have other valid and collectible insurance - such as, but not limited to, homeowner's, contents, renter's, health, travel, accident or medical insurance – this Policy will only cover the amount not covered by such other insurance, up to the limits of the specific coverage as shown in the terms and conditions.

C. Governing Law This Policy shall be governed by the laws of the United Arab Emirates.

D. Concealment or Fraud Coverage will be voided, whether before or after a loss, if You willfully concealed or misrepresented any material fact or circumstance concerning this insurance or provided fraudulent information to Us.

E. Loss Prevention You must use all reasonable means to avoid future loss at and after the time of loss.

F. Sanctions If, by virtue of any law or regulation which is applicable to an Insurer, its parent company or its ultimate controlling entity, at the inception of this Policy or at any time thereafter, providing coverage to the Insured is or would be unlawful because it breaches an applicable embargo or sanction, that Insurer shall provide no coverage and have no liability whatsoever nor provide any defense

to the Insured or make any payment of defense costs or provide any form of security on behalf of the Insured, to the extent that it would be in breach of such embargo or sanction.

G. Transfer You may not transfer Your interest in this insurance to anyone.

H. Cancellation You can cancel this Policy at anytime by providing 15 days written notice to Us. We reserve the right to retain pro rata premium provided that there has been no claim under the Policy during the Policy period, in which case no refund of premium shall be allowed. We may cancel this Policy at any time by giving You a thirty (30) days’ prior written notice. This notice will be posted to You at the last known mailing address.

I. Changes You must notify Us within fifteen (15) days of any change in circumstance which will affect this Policy.

If You advise Us of any change in circumstance that will affect this Policy, We reserve the right to amend any of the terms and conditions of this Policy following at least fifteen (15) days’ notice to You by Us.

No change or modification of this policy shall be effective except when made by written endorsement signed by Our authorized representative.

J. Subrogation If We settle any claim or payment or otherwise cover any loss applying under this Policy, We shall be subrogated to all Your rights of recovery against any other person or persons and You shall complete, sign and deliver any documents necessary to secure such rights. You shall not take any action following a loss to prejudice such rights of subrogation.

K. Burden of Proof In any action, suit or other proceedings where We allege that by reason of provision of any exclusion which may be applicable, any loss or damage is not covered by this Policy, the burden of proving such loss or damage shall be on You.

L. Compliance The benefits of the Policy are subject always to Your full compliance with the terms and conditions to each Policy section.

M. Data Disclosure

By entering into this contract of insurance, the Insured consents to

the Insurer processing data relating to the Insured for providing

insurance products and services, legal, administrative and

management purposes and in particular to the processing of any

sensitive personal data relating to the Insured.

The Insured consents to the Insurer making such information

available to third parties including but not limited to any Group

Company, those who provide products or services to the Insurer or

any Group Company, and regulatory authorities, within and outside

the Insured's country of domicile. Group Company means any

company which is under common control of American International

Group (“AIG”) and its subsidiaries.

Information on the Insurer’s internal complaint handling procedure will be provided by the Customer Care manager on request. Your will receive a written acknowledgement within five (5) days of the date of notification of the complaint.
