1. Progress Report

• Demolition of the Existing School

• Notice to Proceed was issued to JR Vinagro on June 01, 2020.

• A kick off meeting was held on June 8th.

• Perimeter fence and erosion control will begin June 15th.

• Building clean out and make safe of electrical and mechanical systems will begin June 15th.

• Building take down will begin July 6th

• 60% Construction Documents submission was submitted to MSBA on June 8th 2020. MSBA will review the

submission. Comments are due back within 21 days from submission.

• The project was presented to the Bridgewater Conservation Commission on June 11th. A second hearing is

scheduled for June 25th

• RDA, DPI and representatives from the School District have been meeting virtually as a working group to solicit

feedback on the current design.

• RDA and their consultants are working on the development of the 90% Construction Documents as noted in the

MSBA design review template.

5. Procuring Building Construction Under M.G.L. c. 149

Public construction projects estimated to cost more than $150,000 require General Contractors to be certified by

DCAMM.

Public construction projects estimated to cost more than $150,000 are also subject to Filed Sub bidding for certain

categories of work. These Filed Sub Contractors must also be certified by DCAMM for the category of work for which they

are bidding on.

Under M.G.L. c. 149 Filed Sub Contractor bids are required in the following trades:

Masonry Miscellaneous Metals Waterproofing, Damp-Proofing & Caulking

Roofing & Flashing Glass & Glazing Metal Windows

Acoustical Tile Resilient Floors Lathing & Plastering

Terrazzo Marble Tile

Painting Elevators Fire Protection

Plumbing HVAC Electrical

DCAMM issues a Certificate of Eligibility to each General Contractor and Filed Sub Contractor who meets the criteria for

certification.

On Public construction projects with an estimated construction value over $10,000,000 there is a additional requirement

for Pre Qualification of General Contractor and Filed Sub Contractors

5. Procuring Building Construction Under M.G.L. c. 149

Pre Qualification

A two step process must be utilized for the pre qualification and selection of General Contractors and Filed Sub

Contractors.

Step 1

A. Establish a General Contractor/Filed Sub Contractor prequalification committee

• At a minimum the prequalification committee must be comprised of a representative of the designer and

three representatives the Awarding Authority (one of which is the OPM)

B. Prepare and advertise the request for qualifications (RFQ) for General Contractors/Filed Sub Contractor

• The RFQ must contain detailed provisions governing the RFQ evaluation criteria, information requirements

and point rating system to be used in prequalifying general contractors

• Notice of the RFQ must be advertised in a local newspaper, in the Central Register and on COMMBUYS

5. Procuring Building Construction Under M.G.L. c. 149

C. Receive Statements of Qualification, evaluate and prequalify GC’s and FSC’s

• The prequalification committee will review and elevate the information in each SOQ based on the criteria and

point rating system set out in the RFQ

• Management Experience (50 points, minimum of 25 required)

• References (30 points, minimum 15 required)

• Capacity to Complete (20 points, minimum 10 required)

• Mandatory Requirements

• Bonding Capacity

• DCAMM Certificate of Eligibility

• DCAMM Update Statement

• Only those GC’s and FSC’s receiving a point score of 70 or higher will be deemed prequalified and invited to

participate in Step 2.

D. Notify applicants; post and publish public notice of prequalified GC’s and FSC’s.

5. Procuring Building Construction Under M.G.L. c. 149

Step 2:

A. Prepare the Invitation to Bid (IFB) and distribute it to all prequalified GC’s and FSC’s.

• The IFB must include details of where prequalified GC’s and FSC’s can obtain copies of the plans and

specifications for the project and must specify the deadlines for submitting bids and filed sub-bids.

B. Receive, open and review Filed Sub Contractors bids

• Pre-qualified Filed Subcontractors submit a lump sum bid

• Bids must be opened publicly

• FSC’s may submit unrestricted sub-bids, meaning that their sub-bids are available for use by any general

contractor, or they may restrict their subbids to or from the use of specific general contractors.

Distribute the filed sub-bidder list to everyone who received the IFB

C. Receive, open and review General Contractors bids

• Pre-qualified General Contractors submit a lump sum bid

• Bids must be opened publicly

The project must be awarded to the lowest responsible and eligible general contractor.

6. Bid Alternates

• Alternates are options for which bidders must submit separate prices from the base bid.

• Under 149 you may include add or deduct alternates in the bid package ranked numerically in order of priority

• The awarding authority reserves the right to select or reject the alternate work

• After evaluating the bids, if alternates are accepted they must be accepted in the order of priority

If bids received exceed the budget there are three options:

1. Redesign and rebid the project

2. Fund bid overage from other line items within the project budget

3. Request additional funding

It is often recommended that add alternates be included as “bid protection” against bid overages. Including add

alternates effectively reduces the construction budget.

If the lowest responsive and eligible bid received is below the “revised” construction budget the alternates may be

added back in order of priority to meet the original construction budget.
