S.____ Transportation Empowerment Act: Section by Section Section 1 – Short Title Section 2 – Findings and Purposes Findings: The objective of the Federal highway program – to facilitate construction of a modern freeway system – is near completion, and, in many cases, has already been achieved. However, the Federal government continues to use Federal motor fuels taxes to implement one-size-fits-all programs that are not necessarily appropriate for individual states. States should bear the responsibility for and have flexibility in building transportation infrastructure, while not having the federal government apply uniform mandates that fail to acknowledge the unique circumstances of each State. Purpose: The Transportation Empowerment Act (TEA) seeks to provide a new policy blueprint to govern the Federal role in transportation once existing and prior obligations are met, and the Highway Trust Fund (HTF) is solvent. Specifically, this will involve returning to the States maximum discretionary authority and fiscal responsibility for all transportation systems that are not within the direct purview of the Federal government, but preserving and responsibly funding areas where there is a direct Federal role, such as the Dwight D. Eisenhower National System of Interstate and Defense Highways, national programs and transportation research, and emergency assistance, among others. Section 3 – Funding Limitation Notwithstanding any other provision of law, if transportation authorizations under TEA exceed available funds in the HTF, proportional cuts will be made to authorizations to prevent HTF subsidies from being required. Section 4 – Funding for Core Highway Programs Core Highway Programs TEA funds the following Core Highway Programs: • National Highway Performance Program (NHPP)

o Provides funding to States to “preserve and improve” the National Highway System, which includes the Interstate System highways and bridges as well as nearly all other major highways. NHPP includes projects to achieve national performance goals for infrastructure condition, safety, reconstruction, rehabilitation, etc. Eligibility is removed for bicycle transportation and pedestrian walkways, environmental restoration and pollution abatement. States can still use the excess tax receipts provided under the bill to fund these programs if they choose.

• Surface Transportation Program (STP)

o Provides funding for States to repair and maintain any Federal-aid highways and bridges on any public road. Funds can also be used on transit capital projects or on routes for non-motorized transportation. Eligibility is removed for transportation alternatives projects, as

well as environmental mitigation, restoration and pollution abatement. States can still use the excess tax receipts provided under the bill to fund these programs if they choose.

• Highway Safety Improvement Program (HSIP)

o Focused on reducing fatalities and road injuries by correcting hazardous road locations, such as dangerous intersections, or making road improvements such as adding rumble strips. HSIP requires each State to utilize a Strategic Highway Safety Plan to meet reduction goals in fatalities and injuries.

TEA eliminates authorization for the Transportation Alternatives Program (TA), which funds highway beautification, routes for non-motorized transportation and recreational trails. Some of the projects funded under TA, such as bicycle facilities and pedestrian walkways, are eligible to be funded under the National Highway Performance Program, the Surface Transportation Program, and the Highway Safety Improvement Program. TEA still permits states to transfer up to 50% of any apportionment to any other apportionment program, consistent with current law. Funding Formula for Core Highway Programs Section 4 funds the Core Highway Programs by percentage allocation. Specifically, for the years authorized by the bill (2016-2020) not more than 10% of the balance of the HTF at the beginning of the fiscal year, accounting for estimated revenues, may be allocated to fund these core programs. The amounts allocated from the HTF will decrease proportionately as the tax revenues are phased down and certain transportation responsibilities are devolved to the states. Additional Programs Funded • Emergency Relief: $100 million provided for each fiscal year, 2016-2020; consistent with FY15

enacted amounts.

• Federal Lands Programs

o Federal Lands Transportation Program - $300 million provided for each fiscal year, 2016-2020, which is the same as FY15 enacted amounts. Consistent with current law, $240 million shall be for the National Park Service, and $30 million for the Fish and Wildlife Service. The rest will be allocated among the Forest Service, the Corps of Engineers, and the Bureau of Land Management. This program provides funding for these agencies to construct roads, bridges and perform other transportation activities.

o Federal Lands Access Program - $250 million for each fiscal year, 2016-2020, consistent with FY15 enacted amounts. This program funds projects that are on, or adjacent to, or provide access to, federal lands.

Administrative expenses have historically amounted to approximately 1% of the Federal Highway Administration Budget, which totaled approximately $412 million in FY15. TEA maintains the 1% allocation for Administrative expenses, which will reduce proportionally as revenues to the HTF, and subsequently, federal responsibilities, decline. A Point of Order is provided for any measure that would authorize less than 1% of funds for administrative expenses during any fiscal year. Transferability of Funds Full transferability of funds for any surface transportation project (including mass transit/rail) may be made at the discretion of individual States. If a State uses these funds for purposes that are not related to surface transportation, the amount that is improperly transferred will be deducted from any amount the State would otherwise receive from the HTF. Modifications to the Federal-aid System Technical corrections are made, and code citations and dates are updated. Beginning on October 1, 2016, a highway construction/improvement program will not be considered Federal highway construction/improvement unless/until a State expends Federal funds for the construction portion of the project. However, a State can spend Federal dollars before the construction phase for related expenses (environmental documentation or design work) without being considered a Federal highway project. If the State reimburses the Federal government for Federal dollars spent on a highway construction/improvement cost, it will no longer be considered a Federal highway project. As of October 1, 2016, no new reporting requirements shall apply in order to use Federal funds for highway projects by a public-private partnership. Core Programs Financing Rate The amount of federal gasoline taxes available to fund core highway programs is as follows: 2016-2017: 18.3/gallon 2017-2018: 9.6/gallon 2018-2019: 6.4/gallon 2019-2020: 5.0/gallon 2020-beyond: 3.7/gallon The amount of federal diesel fuel tax available to fund core highway programs is as follows: 2016-2017: 24.3/gallon 2017-2018: 12.7/gallon 2018-2019: 8.5/gallon

2019-2020: 6.6/gallon 2020-beyond: 5.0/gallon Mass Transit The Mass Transit account is terminated and remaining revenues are transferred to the Highway Account. However, as detailed above, States will still be allowed to use their excess tax receipts for mass transit, if they choose. Section 5 – Funding for Highway Research & Development Program Changes to the core federal highway programs are made, eligibilities repealed as referenced in the program descriptions in Section 4, laid out above, and conforming amendments are made. The Metropolitan Transportation Planning Program is repealed. The Congestion Mitigation and Air Quality Improvement Program is repealed. Historic Bridges program is repealed. Transportation Alternatives Program is repealed (see Funding for Core Federal Highways section above). The Highway Research and Development Program is funded at $115 million for each fiscal year, 2016-2020, consistent with FY15 enacted amounts. This program funds investment in research activities that address current and emerging highway transportation needs. Consistent with current law, the Federal share of the cost of these activities shall not exceed 80%. Section 6 – Return of Excess Tax Receipts To States Beginning on the first day of each fiscal year, 2016-2019, the Secretary will determine the difference between the fuel taxes used to fund the Core Highway Program (See Section 4) and total fuel taxes collected and allocate the excess revenue to the States, in proportion equal to their HTF contributions, to be used for transportation programs at the discretion of the States. If a State uses these funds for purposes that are not related to surface transportation, the amount that is improperly transferred will be deducted from any amount the State would otherwise receive from the HTF. Section 7: Reduction in Taxes on Gasoline, Diesel Fuel, Kerosene, and Special Fuels Funding Highway Trust Fund The reduction in gas taxes is made permanent on September 30, 2020. Gasoline taxes are brought down from 18.3 cents per gallon to 3.7 cents per gallon. Diesel fuel and kerosene would be taxed at 5 cents per gallon, down from 24.3 cents per gallon. The entireties of the taxes collected are dedicated to financing the Core Highway Programs.

(a) FINDINGS.—Congress finds that— 7

gram has been to facilitate the construction of a 2

modern freeway system that promotes efficient inter-3

state commerce by connecting all States; 4

(2) the objective described in paragraph (1) has 5

been attained, and the Interstate System connecting 6

all States is near completion; 7

(3) each State has the responsibility of pro-8

viding an efficient transportation network for the 9

residents of the State; 10

(4) each State has the means to build and oper-11

ate a network of transportation systems, including 12

highways, that best serves the needs of the State; 13

(5) each State is best capable of determining 14

the needs of the State and acting on those needs; 15

(6) the Federal role in highway transportation 16

has, over time, usurped the role of the States by tax-17

ing motor fuels used in the States and then distrib-18

uting the proceeds to the States based on the per-19

ceptions of the Federal Government on what is best 20

for the States; 21

(7) the Federal Government has used the Fed-22

eral motor fuels tax revenues to force all States to 23

take actions that are not necessarily appropriate for 24

individual States; 25

(8) the Federal distribution, review, and en-1

forcement process wastes billions of dollars on un-2

productive activities; 3

(9) Federal mandates that apply uniformly to 4

all 50 States, regardless of the different cir-5

cumstances of the States, cause the States to waste 6

billions of hard-earned tax dollars on projects, pro-7

grams, and activities that the States would not oth-8

erwise undertake; and 9

(10) Congress has expressed a strong interest 10

in reducing the role of the Federal Government by 11

allowing each State to manage its own affairs. 12

(b) PURPOSES.—The purposes of this Act are— 13

(1) to provide a new policy blueprint to govern 14

the Federal role in transportation once existing and 15

prior financial obligations are met; 16

(2) to return to the individual States maximum 17

discretionary authority and fiscal responsibility for 18

all elements of the national surface transportation 19

systems that are not within the direct purview of the 20

Federal Government; 21

(3) to preserve Federal responsibility for the 22

Dwight D. Eisenhower National System of Inter-23

state and Defense Highways; 24

(C) emergency assistance to the States in 9

response to natural disasters; 10

(5) to eliminate to the maximum extent prac-11

ticable Federal obstacles to the ability of each State 12

to apply innovative solutions to the financing, de-13

sign, construction, operation, and preservation of 14

Federal and State transportation facilities; and 15

(6) with respect to transportation activities car-16

ried out by States, local governments, and the pri-17

vate sector, to encourage— 18

(A) competition among States, local gov-19

ernments, and the private sector; and 20

(B) innovation, energy efficiency, private 21

sector participation, and productivity. 22

SEC. 3. FUNDING LIMITATION. 23

Notwithstanding any other provision of law, if the 24

Secretary of Transportation determines for any of fiscal 25

years 2016 through 2020 that the aggregate amount re-1

quired to carry out transportation programs and projects 2

under this Act and amendments made by this Act exceeds 3

the estimated aggregate amount in the Highway Trust 4

Fund available for those programs and projects for the 5

fiscal year, each amount made available for that program 6

or project shall be reduced by the pro rata percentage re-7

quired to reduce the aggregate amount required to carry 8

out those programs and projects to an amount equal to 9

that available for those programs and projects in the 10

Highway Trust Fund for the fiscal year. 11

SEC. 4. FUNDING FOR CORE HIGHWAY PROGRAMS. 12

(a) IN GENERAL.— 13

(1) AUTHORIZATION OF APPROPRIATIONS.— 14

The following sums are authorized to be appro-15

priated out of the Highway Trust Fund (other than 16

the Mass Transit Account): 17

(A) FEDERAL-AID HIGHWAY PROGRAM, 18

ETC.—For the national highway performance 19

program under section 119 of title 23, United 20

States Code, the surface transportation pro-21

gram under section 133 of that title, the high-22

way safety improvement program under section 23

148 of that title, and the congestion mitigation 24

and air quality improvement program under 25

pended in the Senate only by the affirmative 7

vote of 3⁄5 of the Members, duly chosen and 8

‘‘(II) Debate on appeals in the Senate 10

from the decisions of the Chair relating to sub-11

clause (I) shall be limited to 1 hour, to be 12

equally divided between, and controlled by, the 13

mover and the manager of the measure that 14

would make available for expenditure from the 15

Fund for a fiscal year an amount less than the 16

amount described in subparagraph (A). An af-17

firmative vote of 3⁄5 of the Members, duly cho-18

sen and sworn, shall be required in the Senate 19

to sustain an appeal of the ruling of the Chair 20

on a point of order raised in relation to sub-21

clause (I). 22

‘‘(iii) This subparagraph is enacted by 23

Congress— 24

tion, and it supersedes other rules only to 8

the extent that it is inconsistent with those 9

of title 23, United States Code, is amended by strik-18

ing subsection (f) and inserting the following: 19

‘‘(f) TRANSFERABILITY OF FUNDS.— 20

‘‘(1) IN GENERAL.—To the extent that a State 21

determines that funds made available under this title 22

to the State for a purpose are in excess of the needs 23

of the State for that purpose, the State may transfer 24

the excess funds to, and use the excess funds for, 25

‘‘(2) ENFORCEMENT.—If the Secretary deter-3

mines that a State has transferred funds under 4

paragraph (1) to a purpose that is not a surface 5

transportation purpose as described in paragraph 6

(1), the amount of the improperly transferred funds 7

shall be deducted from any amount the State would 8

otherwise receive from the Highway Trust Fund for 9

the fiscal year that begins after the date of the de-10

termination.’’. 11

(3) FEDERAL-AID SYSTEM.— 12

(A) IN GENERAL.—Section 103(a) of title 13

23, United States Code, is amended by striking 14

‘‘the National Highway System, which in-15

cludes’’. 16

tion phase of the project to pay expenses relat-2

ing to the project, including for any environ-3

mental document or design work required for 4

the project; and 5

(C)(i) a State may, after having used Fed-6

eral funds to pay all or a portion of the costs 7

of a highway construction or improvement 8

project, reimburse the Federal Government in 9

an amount equal to the amount of Federal 10

funds so expended; and 11

(ii) after completion of a reimbursement 12

described in clause (i), a highway construction 13

or improvement project described in that clause 14

shall no longer be considered to be a Federal 15

highway construction or improvement project. 16

(6) REPORTING REQUIREMENTS.—No reporting 17

requirement, other than a reporting requirement in 18

effect as of the date of enactment of this Act, shall 19

apply on or after October 1, 2015, to the use of 20

Federal funds for highway projects by a public-pri-21

vate partnership. 22

Fund (other than the Mass Transit Account) to carry out 9

section 503(b) of title 23, United States Code, 10

$115,000,000 for each of fiscal years 2016 through 2020. 11

(b) APPLICABILITY OF TITLE 23, UNITED STATES 12

CODE.—Funds authorized to be appropriated by sub-13

section (a) shall— 14

(1) be available for obligation in the same man-15

ner as if those funds were apportioned under chap-16

ter 1 of title 23, United States Code, except that the 17

Federal share of the cost of a project or activity car-18

ried out using those funds shall be 80 percent, un-19

less otherwise expressly provided by this Act (includ-20

ing the amendments by this Act) or otherwise deter-21

mined by the Secretary; and 22

(2) remain available until expended and not be 23

transferable. 24

SEC. 7. RETURN OF EXCESS TAX RECEIPTS TO STATES. 1

(a) IN GENERAL.—Section 9503(c) of the Internal 2

Revenue Code of 1986 is amended by adding at the end 3

the following: 4

‘‘(6) RETURN OF EXCESS TAX RECEIPTS TO 5

STATES FOR SURFACE TRANSPORTATION PUR-6

POSES.— 7

‘‘(A) IN GENERAL.—On the first day of 8

each of fiscal years 2016, 2017, 2018, and 9

2019, the Secretary, in consultation with the 10

Secretary of Transportation, shall— 11

‘‘(i) determine the excess (if any) of— 12

‘‘(I) the amounts appropriated in 13

such fiscal year to the Highway Trust 14

Fund under subsection (b) which are 15

attributable to the taxes described in 16

paragraphs (1) and (2) thereof (after 17

the application of paragraph (4) 18

thereof) over the sum of— 19

‘‘(II) the amounts so appro-20

priated which are equivalent to— 21

‘‘(aa) such amounts attrib-22

utable to the core programs fi-23

nancing rate for such year, plus 24

amount determined under clause (i)(I) 14

paid into the Highway Trust Fund in 15

the latest fiscal year for which such 16

data are available which is attrib-17

utable to highway users in the State. 18

‘‘(B) ENFORCEMENT.—If the Secretary 19

determines that a State has used amounts 20

under subparagraph (A) for a purpose which is 21

not a surface transportation purpose as de-22

scribed in subparagraph (A), the improperly 23

used amounts shall be deducted from any 24

amount the State would otherwise receive from 25

there shall be credited or refunded (without interest) 1

to the person who paid such tax (in this subsection 2

referred to as the ‘‘taxpayer’’) an amount equal to 3

the excess of the tax paid by the taxpayer over the 4

amount of such tax which would be imposed on such 5

liquid had the taxable event occurred on such date. 6

(2) TIME FOR FILING CLAIMS.—No credit or re-7

fund shall be allowed or made under this subsection 8

unless— 9

(A) claim therefor is filed with the Sec-10

retary of the Treasury before April 1, 2021; 11

and 12

(B) in any case where liquid is held by a 13

dealer (other than the taxpayer) on October 1, 14

2020— 15

(i) the dealer submits a request for re-16

fund or credit to the taxpayer before Janu-17

ary 1, 2021; and 18

(ii) the taxpayer has repaid or agreed 19

to repay the amount so claimed to such 20

dealer or has obtained the written consent 21

of such dealer to the allowance of the cred-22

it or the making of the refund. 23

(3) EXCEPTION FOR FUEL HELD IN RETAIL 24

STOCKS.—No credit or refund shall be allowed under 25

this subsection with respect to any liquid in retail 1

stocks held at the place where intended to be sold 2

at retail. 3

(4) DEFINITIONS.—For purposes of this sub-4

section, the terms ‘‘dealer’’ and ‘‘held by a dealer’’ 5

have the respective meanings given to such terms by 6

section 6412 of such Code; except that the term 7

‘‘dealer’’ includes a producer. 8

(5) CERTAIN RULES TO APPLY.—Rules similar 9

to the rules of subsections (b) and (c) of section 10

6412 and sections 6206 and 6675 of such Code shall 11

apply for purposes of this subsection. 12

(d) EFFECTIVE DATES.— 13

(1) IN GENERAL.—Except as provided in para-14

graphs (2) and (3), the amendments made by this 15

section shall apply to fuel removed after September 16

30, 2020. 17

(2) CERTAIN CONFORMING AMENDMENTS.— 18

(A) The amendments made by subsection 19

(b)(4) shall apply to fuel removed after Sep-20

tember 30, 2016. 21

(B) The amendments made by subpara-22

graphs (A), (B), and (C) of subsection (b)(6) 23

shall take effect on October 1, 2016. 24

(C) The amendment made by subsection 1

(b)(6)(D) shall take effect on June 1, 2015. 2

SEC. 9. REPORT TO CONGRESS. 3

Not later than 180 days after the date of enactment 4

of this Act, after consultation with the appropriate com-5

mittees of Congress, the Secretary of Transportation shall 6

submit a report to Congress describing such technical and 7

conforming amendments to titles 23 and 49, United States 8

Code, and such technical and conforming amendments to 9

other laws, as are necessary to bring those titles and other 10

laws into conformity with the policy embodied in this Act 11

and the amendments made by this Act. 12

SEC. 10. EFFECTIVE DATE CONTINGENT ON CERTIFI-13

CATION OF DEFICIT NEUTRALITY. 14

(a) PURPOSE.—The purpose of this section is to en-15

sure that— 16

(1) this Act will become effective only if the Di-17

rector of the Office of Management and Budget cer-18

tifies that this Act is deficit neutral; 19

(2) discretionary spending limits are reduced to 20

capture the savings realized in devolving transpor-21

tation functions to the State level pursuant to this 22

Act; and 23

(3) the tax reduction made by this Act is not 1

scored under pay-as-you-go and does not inadvert-2

ently trigger a sequestration. 3

(b) EFFECTIVE DATE CONTINGENCY.—Notwith-4

standing any other provision of this Act, this Act and the 5

amendments made by this Act shall take effect only if— 6

(1) the Director of the Office of Management 7

and Budget (referred to in this section as the ‘‘Di-8

rector’’) submits the report as required in subsection 9

(c); and 10

(2) the report contains a certification by the Di-11

rector that, based on the required estimates, the re-12

duction in discretionary outlays resulting from the 13

reduction in contract authority is at least as great 14

as the reduction in revenues for each fiscal year 15

through fiscal year 2020. 16

(c) OMB ESTIMATES AND REPORT.— 17

(1) REQUIREMENTS.—Not later than 5 cal-18

endar days after the date of enactment of this Act, 19

the Director shall— 20

(A) estimate the net change in revenues re-21

sulting from this Act for each fiscal year 22

through fiscal year 2020; 23

(B) estimate the net change in discre-24

tionary outlays resulting from the reduction in 25

(2) APPLICABLE ASSUMPTIONS AND GUIDE-10

LINES.— 11

(A) REVENUE ESTIMATES.—The revenue 12

estimates required under paragraph (1)(A) 13

shall be predicated on the same economic and 14

technical assumptions and score keeping guide-15

lines that would be used for estimates made 16

pursuant to section 252(d) of the Balanced 17

Budget and Emergency Deficit Control Act of 18

1985 (2 U.S.C. 902(d)). 19

(B) OUTLAY ESTIMATES.—The outlay esti-20

mates required under paragraph (1)(B) shall be 21

determined by comparing the level of discre-22

tionary outlays resulting from this Act with the 23

corresponding level of discretionary outlays pro-24

jected in the baseline under section 257 of the 25

Congressional Budget Act of 1974 (2 U.S.C. 665(a)(2)) 8

by the estimated reductions in discretionary outlays under 9

subsection (c)(1)(B). 10

(e) PAYGO INTERACTION.—On compliance with the 11

requirements specified in subsection (b), no changes in 12

revenues estimated to result from the enactment of this 13

Act shall be counted for the purposes of section 252(d) 14

of the Balanced Budget and Emergency Deficit Control 15

Act of 1985 (2 U.S.C. 902(d)). 16

Washington, DC 20460 Dear Ms. McCarthy: Florida has clean and healthy air to breathe. Therefore, the Environmental Protection Agency should designate Florida in attainment of the 2012 National Ambient Air Quality Standard for fine particulate matter (PM2 5). Florida’s Department of Environmental Protection has provided a range of data, laboratory studies, and technical information that clearly demonstrate Florida is achieving the PM2 5 standard in all areas of the state. In its oversight of states’ air quality monitoring systems, EPA is expected to base its conclusions on sound regulatory requirements and science, and wield its authority responsibly. In this case, however, EPA appears to prefer form over substance. Though EPA has not identified any evidence upon which to base a finding that any area of the state is not achieving the 2012 PM2 5 standard, the agency chose to defer its attainment designation. This is a disservice to the citizens of the state and its many visitors, who deserve to know that Florida is in fact meeting this standard. As you know, tourism is a huge driver of Florida’s economy. The state proudly boasts 171 state parks and trails, 35 state forests, three national parks, and three national forests, along with hundreds of city and county parks, providing recreational opportunities for the 20 million Floridians and over 97 million visitors each year. Ensuring that Florida’s air is healthy is a critical component of our tourism industry and the high quality of life that Floridians enjoy. That is one reason we designed and invested in a very robust air monitoring network, which covers over 92% of the population. Florida is widely recognized for its excellent air quality. In the American Lung Association’s latest “State of the Air” report (May 2015), Florida had 28 cities ranked as the cleanest in the nation. The entire State of Florida was designated in attainment for the 1997 PM2 5 standard and the 2006 PM2 5 standard, and has never had a violation of either of those standards. Attainment of these and the 2012 standards is further supported by records showing that emissions of particulate matter precursors, including sulfur dioxide and nitrogen dioxide, have declined significantly in recent years. EPA’s decision to defer attainment for PM2 5 overlooks the robust information provided by the monitoring network, laboratory studies, and other science-based information. EPA’s deferral decision was based primarily on its rejection of data collected in late 2012, which EPA asserts did not meet the humidity requirements listed in the federal register [40 CFR Part 50, Appendix L, §8.2]. The decision to reject those data ignored specific provisions that allow laboratory managers to consider multiple lines of evidence before rejecting data [40 CFR Part 50, Appendix L, §13 reference 2, EPA Quality Assurance Guidance Document 2:12, Section 7.6]. The verified duplicative quality control data
