Dear Carol Thank you for your email and I note your comments. I am pleased to hear that you do not expect to need access to my client’s car park. Are you able to provide an absolute assurance that this is the case and a commitment not to access the car park? Access would be needed to the land referred below for maintenance of the water pipe but also for the future use and maintenance of the land in question. I have attached a plan showing the routes that would be used if we need to access this land. I don’t think my clients have had any need to access this land for a number of years. We have been discussing the drainage requirements and design, while detail design has yet to commence, we expect to connect into the existing drainage network upstream of the interceptor and away from Springhead Nurseries. We have obtained copies of recent maintenance inspection reports for the interceptor and the condition appears acceptable, therefore we do not anticipate having to carry out any remedial works to the interceptor as part of this scheme. Balfour Beatty’s contact Chris Kennedy is copied here as he will be responsible for the detailed design stage and the construction works. A baseline visual survey may be carried out to record the existing condition. We therefore do not expect to need access to the car park for carrying out construction work to the interceptor. Please would you confirm in writing if this enables your clients to withdraw their objection. On other matters, thank you for confirming access requirements to the existing plot on the other side of the A2 as shown below. We assume that this is to access the water main in that location. Please would you advise which route your clients currently use to access this plot or how they intended to prior to this scheme. If you have any existing documentation regarding the provisions made for this easement then we would be grateful if you would share that with us.

OBJ-025-001-Hobbs Park-Springhead Nurseries access requirements

Thank you for your letter dated 18 March 2019, regarding the A2 Bean and Ebbsfleet Junction Improvements Orders issued on 14 February 2019, to which you object on the grounds that details for the works or access requirements related to Springhead Nurseries have not been provided. Highways England confirms this issue has been considered during the preliminary design stage and the proposals have been specifically designed to ensure that the major drainage works will be carried out upstream of the network near the access to Springhead Nurseries (Refer to drawings HE543917-ATK-HDG-XX-DR-CD-000208_C02, HE543917-ATK-HDG-XX-DR-CD-000209_C02 enclosed and to the extract below). The proposed drainage works include the installation of oversized carrier drain pipes along the Pepperhill link road kerb line for attenuation and an unlined swale (i.e. grass ditch) along the south side of the slip road (i.e. edge of disused petrol station site) to address water quality concerns. No changes are expected to the pollution control chambers under the Springhead Nurseries car park, but this will need to be confirmed at detailed design.

Highways England and Atkins attended several meetings with DTG Elliott and Hobbs Parker to discuss the main concerns regarding the proposed works near Springhead Nurseries. Minutes of the meetings held on 27 March 2018 and 18 September 2018 are enclosed for quick reference. The drainage works near Springhead Nurseries were explained and drawings have been shared. No requirement for construction traffic along the access road to Springhead Nurseries is anticipated, this will be verified during the detailed design stage.

In terms of traffic management, Balfour Beatty, as Highways England buildability contractor has advised that the entrance to Springhead Nurseries are just outside the limit of the works on Pepperhill Link Road. The works are completed just before the bellmouth. Therefore, the contractor does not foresee any need to close or restrict access into and out of the Nursery. The network condition will be investigated further during the detailed design phase and may require further improvements. Highways England will continue to require occasional access to their assets such as underground storage tanks, oil separators or penstock chambers, for routine maintenance operations as stated in the maintenance plans.

During the works, the appointed contractor will ensure that any disruption will be kept to an absolute minimum and will liaise with your company before commencement. We will keep you informed as the works are progressed. The construction of the adjacent Ebbsfleet Junction will require traffic management using a combination of lane closures, narrow lanes, overnight full carriageway closures and possible traffic light control with convey escorts. We will consult with you during development of the detailed design, including the development of traffic management proposals for this area. Pepperhill Link Road will always be kept open as there is no suitable alternative diversion, works will be carried out by either installing narrow lanes and building the road in two halves or by using traffic lights and convey working (taking traffic through the works at a safe slow speed). Ebbsfleet Roundabout London bound off slip will be closed overnight for works with the diversion taking traffic to the Bean junction and return via the Coast bound slip. The expected number of closures will be around 20 to carry out all the works and most likely be Monday to Thursday nights. Ebbsfleet Roundabout Coast bound off slip will be closed overnight to carry out the works with the diversion via the Wrotham Rd junction and back on the London bound carriageway. The expected number of closures will be around 20 to carry out all the works and most likely be Monday to Thursday nights. At Ebbsfleet Roundabouts, the two gyratory systems and connecting link roads will be kept open to provide access to both the Ebbsfleet development (Ackers Drive), Ebbsfleet International Station and Swanscombe. This will be achieved by both working at night using narrow single lanes and if required convey working, and then during the day at off peak times with traffic light controls. There will be several traffic switches during these works, but access will be maintained to both the Ackers Drive and Pepperhill Link Road. We confirm that we are committed to minimising disruption and taking measures to maintain access to Springhead Nurseries. Due to us currently not having all the information regarding the highway drainage in front of the nurseries we have included all the area in our CPO plan (as coloured blue as a permanent right of access, not as land to be acquired). Until we have completed our drainage surveys we cannot guarantee that there will be no impact from the

drainage works to your business. We are however committed to keeping your business operational throughout the works and do not envisage that your deliveries will be prevented. There may potentially be a temporarily loss of some customer car parking during the works however this is proposed to not be the majority of the parking. Highway England would like to enter into a legal arrangement with your client for the purchase of land and granting of rights required for the construction of this scheme. This would be in advance of the CPO process and we believe this would be a more appropriate way for us to respond to – and address - your client’s concerns, as the mechanisms for ensuring deliveries and customer parking can be managed to your satisfaction and included as items within the legal agreement. Please advise if you agree with this approach and let us know how and when would be the best time to contact you. If you wish us to discuss these issues further with your client this could be either via a face to face meeting on site, or a telephone/ Skype meeting. We hope this correspondence addresses your concerns and you client is therefore able to withdraw their objection. 2 Project update

SB gave an update on the project, outlining the proposed scheme which he confirmed was a preliminary design. He referred to the statutory public consultation that was currently underway. RH added that the closing date for responses was 04 April. SB confirmed that following public consultation further design development would take place with a view to submitting a planning (Development Consent Order) application by the end of the year.

SS questioned how the scheme related to the London Resort development. SB commented that the improvements proposed by Highways England at the Ebbsfleet junction did not account for London Resort traffic due to the two projects being mutually exclusive (i.e. there are no scenarios in which both schemes will go ahead

during the same time period). SB added that Highways England regularly meet with London Resort and the sharing of data has occurred. Should there be a change in the status of the London Resort development Highways England will reassess the scheme as it is currently proposed.

SB highlighted the different options being presented at consultation (1 and 2) for the Ebbsfleet junction improvements (p11 consultation brochure). CT confirmed that in both options the roundabout would be enlarged and signalling installed. SS questioned what the speed limits would be on the slip roads. CT confirmed it would be national speed limit (believed to be 60mph for the single lane link road) as it is currently.

3 Springhead Nursery: overview of scheme impacts; land and property discussion

SS asked whether there would be any change in the access to the nursery. CT stated that there was not expected to be any change. He added that the project had yet to receive the data from the topographical survey (expected 06 April) to enable further development of the highway alignment.

Mr Elliott highlighted the sharp turn off the existing slip road into the entrance to the nursery. Increased traffic generated by the scheme could increase the risk of rear end shunts. SB asked whether there had been any accidents. Mr Elliott confirmed that there had been none to his knowledge. SB stated that the traffic signals on the roundabout may help to calm the traffic but that there was no proposed change to the speed limits. SB encouraged Mr Elliott to put his concerns in his response to the public consultation. Reference was made to the possibility of creating a deceleration lane at point of access to the nursery.

CT highlighted on the plans the location of the underground water storage tanks as being the paved area adjacent to the car park on the south east side. SS confirmed their location. He added that the Secretary of State for Transport has an easement for the tanks and that they are meant to have an interceptor for emptying the tanks via

manholes. SS confirmed that he has the easement document.

CT confirmed that there would be no construction compound on Mr Elliott’s property, but he stated that there may be a need for construction access. CT referred to a new pond (swale) to be located north of the Ebbsfleet Junction roundabouts that would be created for storing additional water runoff. He stated the design team’s intention that this would avoid the need to change the drainage storage on the property, to be confirmed as the design develops.

SS question whether there would be any permanent acquisition of land within the nursery boundary. CT stated that no acquisition was anticipated, subject to the highway alignment being confirmed upon receipt of the topographical survey.

SS stated that it was important to the business not to lose any car parking. He referred to the triangle of land on the other side of the existing slip road as land being owned by Mr Elliott but currently unused. The access road into the nursery was confirmed as being part owned by Department for Transport (DfT) and part owned by Mr Elliott. SS stated that he had a map detailing all land ownership that he would forward. ACTION: SS to forward land ownership map to RH. PMN: Map sent to RH on 28/03/18

A discussion was had regarding busy periods for the nursery so as to avoid impacting access to the nursery during construction at these times. Mr and Mrs Elliott confirmed that March to first 2 weeks of July was their busiest time with deliveries up to 3 times per week and a large number of customers. Christmas was also busy.

4 Land access for surveys

RH referred to the need to undertake surveys in the area of the proposed scheme and that a letter had been sent to Mr Elliott requesting access to land in this respect. SS confirmed that the letter had been received but that they would like more details about the surveys prior to granting access. SS asked PG if the standard consent rates would apply. PG confirmed they would.

Mr Elliott confirmed that the pipe is not accessible for repairs and that they had tried to get the supply adopted by a mains company without any success.

ACTION: SS to see if he can find a plan relating to the location of the water pipe.

Mr Elliott referred to workers who had been seen on site approximately a month ago. He stated that they had been walking on nursery land without prior notification but were believed to be from TerraQuest (TQ). ACTION: RH to investigate. This has been fed back to TQ.

2 Springhead Nursery: overview of scheme impacts; land and property discussion

SB explained how the roundabout adjacent to the nursery had been enlarged since PRA when there were 2 slip roads from the roundabout, but there was now only a single slip road due to concerns about archaeology in the adjacent land. Land take was minimal - for earthworks plus some temporary land take during the works. CT agreed to obtain a land take plan for the nursery.

ACTION: CT to provide a plan showing the land take from the nursery.

are proposing a slight realignment of the cycle path and to make changes to the splitter island in order to provide a 90 degree angled crossing for cyclists.

The main concern for the nursery is that their operations are not affected by the works.

SS queried if a deceleration lane was to be provided on the slip road to provide safe access/egress to/from the nursery. CT confirmed that was not progressing due to the significant earthworks that would be required. Additional signing would be considered to make road users aware of the site entrance.

Post meeting note: Re construction access, the roundabout earthworks are likely to be accessed from the new northern spur of Ebbsfleet West Roundabout, not the Springhead Nurseries access road. Therefore there may be no need for construction traffic along the nursery access road.

SS asked why the red line boundary extended to within the car park. CT thought this was no longer required, as new drainage was to be provided within the highway verge now that the cycle path was to be widened from 2m to 3m.

It was not possible to confirm that the storage tanks within the nursery land would be touched, but seemed unlikely. CT to seek an update from the drainage design team and summarise the anticipated drainage works in the area.

ACTION: CT to confirm if the existing water tanks within the nursery land were to be touched during the works

ACTION: CT to provide the area of land take in the triangle of land south of the A2.

NE asked Highways England to note that they have a private water supply through the triangle of land to the south of the A2 and that it was essential that this supply was maintained. It is assumed that it is ducted beneath the A2, but the exact whereabouts are unknown. It could clash with the swale, so care was needed when the swale is excavated. ACTION: CT to provide utilities drawing showing a water pipe that appeared on the C2 returns. It might be the case that this was the same pipe, and it had been adopted by the water company.

NE asked if arrangements for accessing their land could be done outside of their busy periods.

PG confirmed that compulsory purchase of the land would be enabled by General Vesting Declaration, but that negotiations could begin sooner, once the design fix was in place and there was greater certainty around the land take.

SB explained that there is still the potential that the design proposed for the Ebbsfleet junction for this scheme along with the dates of construction could be change, if the London Report development is demonstrated to become more likely; or a decision is made to delay this scheme to allow the London Resort development team the opportunity to catch up with the Highways England scheme.
