Could you please respond to these questions by as early as possible tomorrow please -
1. Is it correct that Downer EDI will perform the retrofitting of the NGR trains (to meet disability discrimination act standards)? If not, who will do the work? 2. Is any of that work included in the Government's announcement in September that Downer EDI was inline for $70 million in projects? 3. If Downer is doing the work, how did that come about (ie is it up to the Government to award the work/Qtectic/Bombardier)? 4. Is it correct that NGR trains had been enroute to Brisbane in July when they were diverted to another port for a couple of months then delivered last month as a result of the Government-Bombardier dispute? If so, were any shipping costs incurred by taxpayers?

Thank you for your letter of 27 October 2017 about the New Generation Rollingstock (NGR) train modification work.
The Department of Transport and Main Roads (TMR) notes that Downer is proposing to enter into an arrangement with Bombardier Transportation to perform modification work on the NGR trains.
Downer will need to negotiate suitable terms for that arrangement with Bombardier Transportation directly. TMR cannot be involved in those negotiations, due to the contractual framework of the Public Private Partnership for the NGR project.
At this stage, TMR has not committed to any dates for the commencement of the modification work.

Dear Neil,
I refer to the correspondence received on the 19th October from Paul Brown of Bombardier Transportation (attached). I confirm that Downer will enter into an in-principle agreement for a subcontracting arrangement with the PPP entity, QTECTIC, or Bombardier Transportation for the purpose of modifying the QNGR vehicles. This will be subject to the following conditions:
1. An agreeable position on the volume and scope of the program is reached between the parties;
2. The nominated location to carry out the works is Downer's facility in Maryborough; 3. A start date of quarter 1, 2018 is targeted for arrival of the first vehicle into Maryborough for
modification; 4. A transparent and open book pricing structure (Alliance) will be developed including full
disclosure of both risk and margin positions. 5. We would recommend the appointment of an independent reputable industry expert to
confirm Downer's proposed risk margin and cost prior to contract award, in order to validate value for money to the state;
6. Upon agreement of suitable further terms and conditions (contract) between the parties all responsibility for delivery of the program and risk associated therein will be borne by Downer;
We are delighted with this outcome and the opportunity to deliver an exceptional product to the PPP and the State.

Dear Andy,
As you are aware, the State has engaged Qtectic to design, manufacture and maintain trains for the New Generation Rollingstock Project. Qtectic has engaged Bombardier as its subcontractor to perform that work.
The State has recently indicated that it may direct Qtectic to perform work to modify the trains. At this stage, the precise scope of that work Is yet to be determined, but it may involve the removal of some of the toilet
modules and/ or the re-design of the toilet module to Improve its functionality.
Downer has Indicated that it is a contractor with the facilities and expertise in Queensland to undertake work of
the nature required by the State in Queensland.
Qtectic and Bombardier are willing to subcontract appropriate work to Downer, provided that Downer can demonstrate value for money to Qtectic, Bombardier and the State. The State has indicated that the value for money solution should include an open book auditable process. We would need Downer's commitment to that
process.

Under a Palaszczuk Labor Government Maryborough is in line for more rail contracts, securing jobs and a steady stream of work into the future.
Premier Annastacia Palaszczuk said that work to undertake the NGR trains would be done in Maryborough
"Tim Nicholls signed a contract for these trains to be built in India and for jobs to go overseas, under Labor these trains will be fixed by Queenslanders.
"We'll require that this work is done in Maryborough because my Government believes that jobs should stay in Queensland not go overseas, that's why we introduced our Buy Queensland policy.

In September the Government announced that modification to the NGR trains would be undertaken to improve their accessibility.
Deputy Premier and Minister for Transport Jackie Trad said the cost of modifications to the trains had been met through the existing program budget
"We've been working hard to resolve the issues with the NGR trains and today is another milestone.
Ms Trad said that following the announcement of the Government's Buy Queensland policy, the train manufacturer Bombardier has already committed to doing modification work here in Queensland.
"Bombardier and Downer have been in discussions on the modifications to the NGR trains and Downer has responded with in principle agreement to conduct the work.
"Downer wants to do this work in Maryborough and a re-elected Palaszczuk Government will make sure that happens."
Ms Trad said that an open book audit would be required so that we ensure value for money for the taxpayers.
Member for Maryborough Bruce Saunders said that the announcement was a fantastic shot in the arm for Maryborough and would boost confidence in the region.

We've been in discussions with Bombardier the manufacturer about how to do the work and they have already agreed to do this work in Queensland as a result of our Buy Queensland Policy and I congratulate them on that.

First, this will ensure we continue to secure the future of Downer's existing workforce in Maryborough — more than 200 workers. Second, you've seen that Downer has also put on 20 new staff in Maryborough because we've delivered certainty to them through our pipeline of Queensland Rail maintenance work. This decision now means Downer will have the confidence to employ more workers and this will be a fantastic boost to confidence to the entire region.

What work needs to be done on the trains?
Tim Nicholls didn't order the right specifications for the trains when he ordered them from India.
We're modifying the toilets on the trains to make them more accessible and we are adding a second toilet to half of the trains and removing the toilet completely from the other half.
This is consistent with current fleet of QR Citytrains, and will ensure trains undertaking longer distance journeys will continue to have toilet facilities available on board.
If you're directing them to do this, why won't you direct that the trains be fully built in Maryborough?
The fact is Tim Nicholls signed a contract for cut price trains to be built overseas in India, and that contract can't be torn up without massive costs to Queensland taxpayers.
Unlike the LNP, our commitment to local jobs is clear in our record: we are directing that these trains get fixed in Maryborough, we have already delivered $70 million of rollingstock maintenance work as part of our $400 million pipeline of future work for Queensland companies. Importantly, our Buy Queensland Policy means Queensland companies are at the front of the queue for government contracts in the future.

Under a Palaszczuk Labor Government Maryborough is in line for more rail contracts, securing jobs and a steady stream of work into the future.

Additional minor modifications include improved accessibility signage and improved grab and hand rails.

The fact is Tim Nicholls signed a contract for cut price trains to be built overseas in India, and that contract can't be torn up without massive costs to Queensland taxpayers.
Unlike the LNP, our commitment to local jobs is clear in our record: we are directing that these trains get fixed in Maryborough, we have already delivered $70 million of rollingstock maintenance work as part of our $400 million pipeline of future work for Queensland companies. Importantly, our Buy Queensland Policy means Queensland companies are at the front of the queue for government contracts in the future.
What does this mean for the Wulkuraka Facility?
Wulkuraka will continue to operate as part of the PPP consortium's day to day operations. The Wulkuraka facility conducts routine maintenance on the NGR trains.
This announcement today is about the significant modification work the State is undertaking and that work happening in Maryborough, it won't affect Wulkuraka.

Fixing the trains in Queensland — Jobs and certainty for Maryborough under Labor
Under a Palaszczuk Labor Government, Maryborough is in line for more rail contracts, securing jobs and a steady stream of work into the future.
Premier Annastacia Palaszczuk said that a re-elected Labor Government would ensure modification work to fix Tim Nicholls overseas-made trains would be done in Maryborough.
"When he was Campbell Newman's Treasurer, Tim Nicholls signed the contract for these new trains to be built in India and for jobs to go overseas, but under Labor these trains will be fixed in Queensland by Queenslanders.
"We'll require that this work is done in Maryborough because my government believes that jobs should stay in Queensland and not go overseas, that's why we introduced our Buy Queensland policy.
"Downer has already hired 20 new local workers because my government has demonstrated confidence in the workers here and provided a steady, reliable pipeline of work into the future, as well as providing a secure future for Downer's existing workforce."
"Since the day he was elected, Bruce Saunders has been fighting to rebuild Maryborough's rail industry, and our decision is a massive win for jobs in Maryborough."
This decisions follows the Palaszczuk Government's announcement in September that modification works to the NGR trains would be undertaken to improve their disability accessibility.
Deputy Premier and Minister for Transport Jackie Trad said the cost of modifications would be met through the existing program budget.
"We've been working hard to resolve the issues with the NGR trains and today is another milestone.
Ms Trad said that following the announcement of the Palaszczuk Government's Buy Queensland policy, the train manufacturer Bombardier has said they are open to doing modification work here in Queensland.
"Bombardier and Downer have been in discussions on the modifications to the NGR trains and Downer has responded with a willingness to undertake the work locally.
"Downer wants to do this work in Maryborough and a re-elected Palaszczuk Government will make sure that happens."
Ms Trad said that an open book audit would be required so that we ensure value for money for the taxpayers.
Member for Maryborough Bruce Saunders said that the announcement was a fantastic shot in the arm for Maryborough and would boost confidence in the region.
"Maryborough is a proud rail town and the Palaszczuk Government is bringing the rail industry back to this region.
Today's announcement is in addition to the Palaszczuk Government's announcement in September that Downer in Maryborough was in line for $70 million worth of projects.

You've said you'll require the work be done in Maryborough. Can you actually do that under the contract?
Tim Nicholls signed the contract when he was Treasurer to have these trains built in India — and he bragged he was getting them for half-price.
This Government has been getting on with the job of fixing the trains. We've had to make modifications to the trains to make them more disability accessible because Tim Nicholls didn't order the right specifications.
We've been in discussions with Bombardier the manufacturer about how to do the work and they have agreed in-principle to do this work in Queensland in line with the Palaszczuk Government's commitment to Queensland jobs.
I understand Bombardier have already been in discussions with Downer about using the Maryborough facility.
This Government will work with Bombardier and Downer to make sure it happens.
The contract itself is commercial in confidence so I can't talk about specific terms.
LNP have said that Downer pulled out of the process to build the new trains under the Labor Government when Annastacia Palaszczuk was the Transport Minister is that true?
