PRE-SEASON ORDER PROGRAMPre-Season orders must be received by Freedom Hawk Kayaks from July 15, 2009 through September 30, 2009 in order to qualify for Pre-Season Discounts.

MINIMUM PRE-SEASON ORDER$3,000

IN-SEASON KAYAK RE-ORDERSDealers who complete a Model Year 2010 Pre-Season order for $3000 or more shall qualify for an In-Season Reorder Discount with payment terms of Net 30 days from the shipping date. When you re-order you will be able to get your pre-season volume discount applied, with no minimum quantities, provided orders are shipped by July 31, 2010.

ITEMS NOT ELIGIBLE FOR PRE-SEASON PROGRAMCertain items are priced separately and are not eligible for Pre-Season Kayak Order Discounts or In-Season Reorder Discounts. These include factory blemished kayaks, demo kayaks, Outfitter/Rental kayaks, Employee kayaks, or similar special kayak pricing programs. Parts, accessories, and shipping/handling charges are not subject to Pre-Season Discounts or In-Season Reorder Discounts.

SHIPPING DATES — CHANGES IN PRE-SEASON ORDERSThe Dealer is to specify a “ship date” with respect to each shipment when completing a Pre-Season Order. Orders will then be shipped by Freedom Hawk Kayaks on that date or as soon thereafter as is reasonably pos-sible. Any changes in a Dealer’s Pre-Season Order must be received by Freedom Hawk Kayaks in writing at least 30 days prior to the “ship date” specified. If a Dealer reduces a Pre-Season Order the price discount level will be adjusted accordingly. Any changes to a Dealer’s Pre-Season Order, even if received 30 days prior to the “ship date” may require a new shipping date for the entire order. All Preseason Orders must ship by July 1, 2010.

LOSS OF DISCOUNT(S) FOR LATE PAYMENTAll Pre-Season Order payments must be either received by Freedom Hawk Kayaks, or postmarked, by the pay-ment date due indicated on the Pre-Season Order form or such orders will lose all Pre-Season Order Discounts and become immediately payable at Basic Wholesale Prices plus interest of 1.5% monthly from the original payment due date, plus reimbursement to Freedom Hawk Kayaks for any related legal or collection fees in-curred commencing 90 days from such original payment due date.

CHANGESSpecifications, colors, and product components are subject to change at any time. Likewise, Suggested Retail Prices, Basic Wholesale Prices, and all discount programs are subject to change at any time, not to affect orders already accepted by Freedom Hawk Kayaks

INTERPRETATIONFreedom Hawk Kayaks has attempted to set forth the provisions of its Pre-Season Order program and related procedures clearly and concisely. That said, in any instance where the intent may be either unclear or un-specified, Freedom Hawk Kayaks reserves the sole right to interpret such provisions.

Demo/Rental ProgramFreedom Hawk feels strongly that one of the keys to making a sale is the ability for a customer to test and demo product before purchasing. We encourage you to invest in these economically priced units which will allow you to better service your customers and educate your staff. Pricing: 20% off base wholesale. Terms: 5%pre-pay/Net 60 with approved credit. All boats subject to be factory blemished. Employee Purchase/Guide ProgramThis program is restricted to employees of Freedom Hawk Authorized Dealers. Under this program, pur-chases are limited to 1 boat per season. Pricing 25% off base wholesale. Terms: Prepay. All boats subject to be factory blemished.
