I. GENERAL INFORMATION A. OVERVIEW OF SUPPLEMENTAL EDUCATIONAL SERVICES (SES) A.1 What are Supplemental Educational Services? Supplemental Educational Services (SES) are additional academic instructional services designed to increase the academic achievement of students in schools “in need of improvement.” These services may include academic assistance such as tutoring, remediation and other educational interventions. The services must be consistent with the content and instruction used by Miami-Dade County Public Schools (M-DCPS) and aligned with the Sunshine State Standards (SSS). Supplemental Educational Services must be provided outside of the regular school day. The services must be of high-quality, research-based, and designed to increase the academic achievement of eligible students on the State assessment. The services should be designed to help students attain proficiency in meeting the State’s academic achievement standards. A.2 What is the purpose of Supplemental Educational Services? Parents of eligible students attending Title I schools that have not made Adequate Yearly Progress (AYP) for two or more years, are provided with opportunities to ensure that their children achieve at high levels. SES are a component of the Title I Elementary and Secondary Education Act (ESEA) as reauthorized by the No Child Left Behind Act of 2001 (NCLB) that provide extra academic assistance for eligible children. Under the NCLB, and in accordance with provisions stipulated under the Florida Differentiated Accountability Model, students from low-income families who are attending Title I schools that are in their first year of school improvement (i.e., have not made AYP for two or more years), in Corrective Action, Planning for Restructuring, or in Restructuring status, are eligible to receive these services. The Florida Department of Education (FLDOE) is required to identify organizations, both public and private, that qualify to provide these services. Parents of eligible students are then notified by M-DCPS that SES will be made available. Parents can select any Stated-Approved Provider that they feel will best meet their child’s needs. The District will sign a contract with the Provider selected by the parent, and the Provider will then develop a Student Learning Plan (SLP), deliver services to the child and report on the child’s progress to the parent, the teacher and to the District.

B. LOCAL EDUCATIONAL AGENCY (LEA) AND PROVIDERS RESPONSIBILITIES B.1 What is the responsibility of an LEA in providing Supplemental Educational Services? A Local Educational Agency (LEA) must:

• Notify parents about the availability of services, at least annually; • Help parents choose a Provider, if requested;

• Determine which students should receive services, if not all students can be served;

• Enter into an agreement with a Provider selected by parents of an eligible student;

• Assist the State Educational Agency (SEA) in identifying potential Providers within the LEA; and

• Protect the privacy of students who receive SES. B.2 What is required of Supplemental Educational Service Providers? A Provider is responsible for meeting the terms of its agreement with the LEA, including: • Enabling the student to attain his or her specific achievement goals (as

established by the LEA, in consultation with the student’s parents and the Provider);

• Measuring the student’s progress and regularly informing the student’s parents and teachers of that progress;

• Adhering to the timetable for improving the student’s achievement that is developed by the LEA in consultation with the student’s parents and the Provider;

• Ensuring that it does not disclose to the public the identity of any student eligible for or receiving Supplemental Educational Services without the written permission of the student’s parents;

• Providing SES consistent with applicable health, safety, and civil rights laws; and • Providing SES that are secular, neutral, and non-ideological.

Students with Disabilities: In the case of a student with a disability, the achievement goals, measurement and reporting of progress, and timetable described in bullets 1 through 3 above must be consistent with (although not included in) the student’s individualized education program under Section 614(d) of the Individual with Disabilities Education Act (IDEA). In the case of a student covered by Section 504, they must be consistent with (although not included in) the student’s individualized services under Section 504. English Language Learners: In the case of a student identified as English Language Learners (ELL), the achievement goals, measurement and reporting of progress, and timetable must be consistent with (although not included in) the English Language Learner (ELL) Plan. C. IDENTIFYING SCHOOLS AND ELIGIBLE STUDENTS C.1 Schools in Need of Improvement (SINI) Designation Each year, as required by the Federal NCLB, the FLDOE identifies a group of Title I public schools in the State that are “Schools in Need of Improvement” (SINI). According to the NCLB academic achievement standards, these schools have not made AYP. They have not reached student achievement targets, which are set for every school.

Adequate Yearly Progress measurements target the performance and participation of various subgroups based on race or ethnicity, socioeconomic status, disability, and English proficiency. The goal of NCLB is to have 100 percent of student proficiency by 2013-2014. Under NCLB, a school’s AYP is determined based on:

• Meeting the State’s annual measurable objectives for all students in Reading, Mathematics, Writing Proficiency, and high school graduation rates;

• Performance of all students including economically disadvantage students, students with disabilities, and English Language Learners (ELLs); and

• Ninety-five percent of students participation rate on state assessments. Categories of SINI required to offer SES under NCLB guidelines are as follows:

• In Need of Improvement –Year 1 (failed to make AYP for two years) • In Need of Improvement –Year 2 (failed to make AYP for three years) • In Corrective Action (failed to make AYP for four years) • Planning for Restructuring (failed to make AYP for five years) • Restructuring (failed to make AYP for six years)

C.2 Student Identification Under the No Child Left Behind Act of 2001 (NCLB), and in accordance with provisions stipulated under the Florida Differentiated Accountability Model, eligible students are all students from low-income families who attend Title I schools that are in their first or second year of school improvement, in corrective action, Planning for Restructuring, or in restructuring status. Eligibility is not dependent on whether a student is a member of a subgroup that caused the school to not make AYP, or whether the student is in a grade that takes the Florida Comprehensive Assessment Test (FCAT). Nor is eligibility based on academic needs. M-DCPS identifies eligible students from low-income families using the meal status code in the Integrated Student Information System (ISIS).

• Students enrolled in schools in Need of Improvement, Corrective Action, and Restructuring status who are eligible for free or reduced-price meals, are identified for SES. These students have meal status codes “F”, “R”, “FD”, or “FT” in the District’s Integrated Student Information System.

C.3 Prioritization Process If sufficient funds are not available to serve each eligible student whose parent requests these services, M-DCPS will give priority to the lowest-achieving eligible students by ranking ALL students in the district based on the Free/Reduced Priced Meals and the student’s academic reading score. Students are ranked in ascending order according to their percentile on the Stanford Achievement Test in Reading (SAT-10). Because students in preschool and kindergarten do not take the SAT-10, they are assigned a percentile of “1” if they have an SPP Reading flag. Similarly, students in 11th and 12th grades are assigned a percentile of “1” if they did not pass

the FCAT graduation test in reading. Students with the same percentile are ordered at random within their percentile. D. NOTIFICATION ABOUT SES D.1 Notification to Parents Prior to the start of the school year, the District mails out information to the homes of students attending eligible schools to inform parents about the availability of SES. The information also lets parents know about the Providers who are able to serve the geographical area; and a description of the services and qualifications of each provider. The information is developed in English, Spanish and Haitian-Creole, in order to provide full opportunities for the participation of all eligible students. In addition, the notification includes an explanation of how students become eligible for services; a report on how the school compares in terms of academic achievement to other public schools in the District; a notice that services are free to parents; where and when to return a completed application; when and how the District will notify parents about additional enrollment dates and start dates; and whom to contact in the District with questions. D.2 Notification to the Broader Community

• M-DCPS will implement an aggressive plan in terms of developing marketing strategies regarding SES for the parents of eligible students.

• Information will be disseminated in English, Haitian-Creole and Spanish, via flyers, telephone information line, posters, newspapers, magazines, radio, television ads, and the District’s NCLB Choice website.

• For the 2009-2010 school year, the District will hold three (2) Parent Choice Fairs at very conveniently located school sites throughout the County (Appendix C).

• Additional information will be provided by eligible schools through individual fairs, back-to-school nights and other means.

• Presentations on NCLB choice options will be delivered through classes offered to parents via The Parent Academy, Title I Parent Advisory Council (PAC) and Title I District Advisory Council (DAC) Meetings, Bilingual Outreach Program, and parent conferences.

• Other strategies will be implemented through local employers and business groups, as appropriate.

II. DOING BUSINESS WITH THE M-DCPS

E. BECOMING A STATE-APPROVED SES PROVIDER E.1 Application to the FLDOE

• Interested Providers must annually apply to the FLDOE by submitting an application in response to a “Request for Application” (RFA) during the application period.

• A cadre of state and school district educational administrators, program specialists, and instructors familiar with the review of applications, the NCLB, Title I, Part A provisions, Supplemental Educational Services instruction, and delivery of services, review each application and make recommendations for the approval of Providers.

• Selection is based on the accurate completion of requested information and data, compliance with all Provider eligibility requirements, and agreement with assurances set forth in the RFA document. Once the Providers are approved, the FLDOE posts a list of the State-Approved Providers on the department’s website prior to the beginning of the school year.

E.2 Application for a Contractual Agreement with M-DCPS

• Upon the release of the State-Approved SES Provider Directory, M-DCPS will submit an email to all approved Providers to confirm their email addresses and to request additional contact information.

• Once the directory is updated, a letter of intent to Providers approved to serve in the District will be submitted electronically. The letter of intent provides general information that will assist providers with the implementation of SES for the 2009-2010 school year.

• Providers must complete the letter of intent and submit it to Title I Administration.

• A mandatory Orientation Meeting will be held to provide all Providers with additional information that will assist them in implementing program services.

• At the Orientation Meeting, Providers will be given the final Contract, which will also be sent in a draft form electronically prior to the meeting.

• Providers are required to submit three original signed Contracts (hard copies) with all pertinent documentation, inclusive of ALL appendixes, to Title I Administration by the given deadline. Contracts received after the deadline will not be accepted.

• Providers are required to fill out the Vendor Application Form (Appendix G). Also, this form can be found at http://forms.dadeschools.net/webpdf/3921.pdf. The completed form should be sent by fax or mailed to the number or address listed below:

E.3 M-DCPS Contractual Agreement Processing and Execution

• The District reviews the Contract and all pertinent documentations to ensure it is complete and accurate.

• A Contract is not processed until all required documents are submitted and Certificates of Insurance, evidencing the Provider’s insurance coverage, is furnished and approved by the M-DCPS Office of Risk Management.

• Once the Contract is reviewed, Title I Administration submits it to the School Board’s Attorney Office for approval as to form.

• The attorney’s office returns the approved Contract back to Title I Administration.

• Title I Administration reviews the Contract again and routes it, along with all documentation to the Superintendent’s Office for signatures.

• The District notifies the Provider that the Contract has been approved and therefore is fully executed.

• One of the original signed and approved Contracts is sent to the Provider, via U.S. postal service to the Provider’s address on file.

F. MODIFICATION AND/OR AMENDMENT TO CONTRACT F.1 Modification and Amendment to Contractual Agreement • The Contract may be modified or amended during its initial term or any renewal

term upon the approval of both parties. • Modifications to the contract shall be in writing and executed by both parties. • No change in the Contract shall result in a per student School Board financial

obligation to the Provider in excess of the annual per pupil allocation as determined by the FLDOE.

G. CONTACT INFORMATION • Providers have an ongoing obligation to maintain and update contact information

at all times. • The Provider shall notify the School Board and provide the address to the

location of service, and any change in location, dates and times, along with all required permits, certificates of occupancy, or other approvals as may be required for the intended facility, in which it will provide SES to eligible students at least ten (10) days prior to the commencement of services.

H. MEETINGS

The Provider will attend any and all District conducted mandatory Provider Orientation, Technical Assistance, End of Year, or other meetings as may be required from time to time. The District will notify the Provider of the meeting times and dates at least five (5) days in advance of the scheduled meeting by the District. I. PROVIDER DIRECTORY • Pursuant to the NCLB law, M-DCPS is required to give parents a brief

description of each state-approved provider program in an easy to understand format.

• A Provider Profile is created for each approved Provider that has submitted a letter of intent to provide services to students attending eligible schools.

• Provider information features the most critical information needed by parents to make informed selections.

• Information is taken from the FLDOE website. • After provider information has been confirmed and finalized, the provider

directory is created and is included as part of the SES Notification packet sent home to parents.

• The most up to date SES Provider Directory is also posted on the NCLB Choice website (http://nclbchoice.dadeschools.net) and copies are available at SES eligible schools.

J. PROVIDING SERVICES IN M-DCPS SCHOOLS J.1 Guidelines for Accommodating Approved SES Providers in M-DCPS

Facilities NCLB Supplemental Educational Services Non-Regulatory Guidance (January 14, 2009) on page 37, Section H15, provides: “an LEA should select providers to operate on-site in a manner that is fair, open, and objective. The guidelines below are intended to assist principals in accommodating interested SES providers in school, when the school cannot accommodate all interested providers, due to space limitations. • For Providers that offered SES in a school building during the 2008-2009 school

year, the following guidelines may be considered:

Instructors/Tutors and students were adequately supervised during tutoring sessions, and lead tutors were available and accessible.

Provider supplied enough materials for every student in their program in a timely manner.

Provider took care of the school property and followed school safety and emergency procedures.

There was adequate and ongoing communication with the school and parents regarding the instructional program as well as student progress.

Tutor attendance record and adequate substitute coverage. Adherence to the tutoring schedule. Parent satisfaction

• For new Providers, the following guidelines may be considered:

Consider a variety of SES programs to meet the diverse academic needs and family circumstances of eligible students, at the school: Before school, After-school or Saturday program.

Provider’s program can meet the needs of all students, including students with disabilities and ELLs.

Provider is flexible in scheduling tutoring sessions.

Provider has a track record of demonstrated effectiveness, customer satisfaction, and service delivery.

Provider participation in the School-site SES Fairs as well as other venues designated by the school to market and disseminates information on SES.

J.2 Obtaining Classroom Space in M-DCPS If Providers intend to deliver services to students on M-DCPS school premises, Providers must contact the principal of the school building to apply to use classroom space. • Providers are required to complete an Application for Temporary Use of School

Building Facilities and submit it to the school’s principal for review and consideration.

• The Department of Plant Operations and the Office of Facilities Operations will verify that the agreement is properly executed.

• The Office of Facilities Operations will notify the school, Department of Plant Operations and the Provider that the agreement has been executed and that occupancy is possible.

• Providers are responsible for securing a copy of the rental agreement and the insurance certificate.

• Providers are responsible for compensating the District as stipulated in the Temporary Use of School Building Facilities Agreement.

• Providers are to communicate with the Principal in regards to any changes to the Agreement.

• Providers must remain current with all invoices for the use of facilities or be subject to cancellation of the facilities agreement.

J.3 Insurance Requirements • The Provider shall include the School Board and its members, officers, and

employees as “certificate holder” on all insurance policies. • State-Approved SES Providers shall provide a certificate of insurance showing

evidence of Commercial General Liability Insurance. The minimum limits to be maintained by the Provider(s) (inclusive of any amounts provided by an umbrella or excess policy) shall be $1 million per occurrence/annual aggregate.

• Except with respect to coverage for Property Damage Liability, the Commercial General Liability coverage shall apply on a first dollar basis without any application of a deductible or a self-insured retention. The coverage for Property Damage Liability shall be subject to a maximum deductible of $1,000 per occurrence.

• The Automobile Liability Insurance Coverage shall be included on all owned, non-owned and hired autos used in connection with this agreement. The minimum limits to be maintained by the Provider(s) (inclusive of any amounts provided by an umbrella or excess policy) shall be $1 million per occurrence/an annual aggregate.

• Subject to the restrictions found in the standard Workers’ Compensation Policy, there shall be no maximum limit on the amount of coverage for liability imposed

by the Florida Workers’ Compensation Act or any other coverage customarily insured under Part One of the standard Workers’ Compensation Policy. The minimum amount of coverage for those coverages customarily insured under Part Two of the standard Workers’ Compensation Policy shall be: EL Each Accident: $500,000; EL Disease- Policy Limit: $500,000; EL Disease- Each Employee: $500,000.

• The Professional Liability Insurance provided by the provider shall conform to the following requirements: The insurance shall be subject to a maximum deductible not to exceed $25,000; If on a claims-made basis, the Provider shall maintain without interruption, the Professional Liability Insurance until (3) years after this agreement; and the minimum limits to be maintained by the Provider (inclusive of any amounts provided by an umbrella or excess policy) shall be $1 million per claim/annual aggregate.

• Renewals or changes in the insurance carrier require the completion of a new certificate.

• The insurance certificate must be completed by the insurance company or its authorized agents.

• Any changes in insurance must be reported to M-DCPS with in 24 hours. J.4 ID Badges All Provider employees must wear a photo ID badge which clearly displays the employee’s name, current school year, the Provider’s name, and the employee’s role, i.e. Tutor, Lead Tutor, Area Manager, etc., while that employee is on District grounds and/or engaged in activities on behalf of the Provider. No Provider may issue an ID Badge to an employee for the current school year until such time as that employee has passed the District background check. The Provider shall provide the District with a sample ID badge for its records for the current school year. Failure of a Provider employee to properly display an ID may require that the employee discontinue tutoring and leave the premises until such time as a current valid SES ID can be produced. J. 5 Training Log The Provider must complete the Miami-Dade County Public Schools SES Provider’s Staff/Tutors/Volunteers Training Acknowledgement Form and the SES Provider’s Staff/Tutors/Volunteers Training Assurance Form and shall maintain copies of both forms in addition to all training meeting agendas, sign-in sheets and training materials for District monitoring compliance. The Training Acknowledgement Log will be used to record the completion of all required training by each staff retained by the Provider. The Provider must submit the SES Provider’s Staff/Tutors/Volunteers Training Assurance Form to the District upon request. The Provider shall require that all staff members, including volunteers, have been trained, and are familiar with and agree to adhere to child abuse and/or missing children reporting obligations and procedures under Florida law, including but not limited to, Florida Statutes 39.201. The Provider agrees to provide annual training to all its employees regarding mandated reporting of child abuse and missing children. The Provider agrees that all staff members will abide by such laws in a timely manner. The Provider shall train all personnel in appropriate procedures for handling

and reporting accidents or incidences when a student has suffered an injury, injured another individual or has been involved in an activity requiring notification of law enforcement or emergency personnel.

The Provider and each staff member must sign the Training Acknowledgement Form verifying that they have been trained in the administration of the Provider’s SES program, its curriculum and District SES procedures and guidelines including ethical behavior, and all state mandated training. Such training must occur prior to the commencement of any tutoring session. Also, by signing the Training Assurance Form, the Provider is verifying that the tutors have been provided with all appropriate tutoring materials and supplies necessary to implement the Provider’s SES program as documented on the Provider’s state approved application. J.6 SES Provider/School Board Dual Employment Disclosure (Hiring M-DCPS

Employees)- Appendix E • Any M-DCPS employee who engages in tutoring for a fee or in the provision of

other services for a fee with a State-Approved SES Provider must complete a 2009-2010 SES Provider/School Board Dual Employment Disclosure, incorporated herein as Appendix E. The Provider is required to retain the completed and signed form each employee listed on Appendix D.

• Any employee of the District which holds a position within the ownership structure of the company and listed on the Florida Department of State Division of Corporations (Sunbiz) must either divest themselves of their interest in the Provider organization or resign their position with the District. The District reserves the right to periodically monitor to ensure compliance with this matter.

J.7 Coordination of Work Hours for M-DCPS Employees Contracted by SES Providers State-Approved SES Provider Tutors/employees who are full-time employees of M-DCPS must fulfill their full-time employment obligations as a condition of part-time employment in the SES Program. The coordination of flexible hours is pursuant to the provisions of Article XX Section 3, K, of the Contract between M-DCPS and the United Teachers of Dade. Therefore, an employee who engages in tutoring or any other allowable activity for a fee with a State-Approved SES Provider during their established full-time employment obligations with M-DCPS must complete the Coordination of Work Hours for M-DCPS Employees Contracted by State-Approved Supplemental Educational Services Providers Form. The form can be found at http://forms.dadeschools.net/webpdf/7113.pdf J.8 Who Can Be Hired? • Providers may hire school district employees, as tutors and lead tutors. The SES

Program requires completion of a background check (drug screening and fingerprinting) for each of its tutors. A Background Check Waiver must be requested for current School Board employees only by completing and electronically submitting the 2009-2010 Background Check Waiver Form, incorporated herein as appendix D. Please, be advised that some employees may not have been drug tested. In such cases, these employees will need to be

drug tested prior to having direct contact with students. A positive result will subject the employee to a professional standards review and potential termination.

• Providers must hire tutorial staff that meet the minimum qualifications for Title I paraprofessionals pursuant to the FLDOE’s Request for Application for 2009-2010 (earned a secondary school diploma and have two (2) years of college equivalent to 60 semester hours, or an Associate Degree, or have passed a local professional academic assessment (e.g., Paraprofessional exam in M-DCPS).)

K. FINGERPRINTING/BACKGROUND CHECK Pursuant to Florida Statute 1012.32, it is the intent of the School Board to ensure that only individuals of good moral character be employed by the school system. Therefore, all individuals employed by a State-Approved SES Provider that will have direct contact with students, must undergo a required background check with the Florida Department of Law Enforcement or another entity approved by the School Board. Providers must also request approval of all staff for each contract period by electronically submitting the SES Request for Fingerprinting and Drug Screening of non- M-DCPS SES Staff (Appendix F) to [email protected] , prior to the time they begin working with students. The Provider must request a background check waiver for current School Board employees by completing and electronically submitting the 2009-2010 Background Check Waiver for M-DCPS Employees Form, incorporated herein as Appendix D. Waivers will be approved if the employee has met and cleared all background requirements. Such employment by the Provider of School Board employees must be in accordance with School Board Rule 6Gxl3-4C-l.081, attached herein as Appendix R. K.1 Fingerprinting Procedures

Providers sending five (5) or more individuals to be fingerprinted at the same time must schedule an appointment by calling 305-995-7472. The Fingerprinting Office hours of operations are Monday-Friday from 7:00 a.m. to 4:00 p.m. The office is located at 1500 Biscayne Boulevard, Suite 141 R, Miami, FL 33132.

K.2 Payment for Fingerprinting (Appendix L):

The fingerprinting payment listed below applies to all contracted vendors who are permitted access on school grounds when students are present, who have direct contact with students, or who have access to or control school funds:

A $61.00 processing fee in the form of a money order or company check payable to "School Board Miami-Dade Fingerprinting” must be submitted to the M-DCPS Fingerprinting office.

No personal checks will be accepted. The cost of fingerprinting will be borne by the Provider or the applicant.

All applicants must present a current official picture identification such as a driver's license, passport, or State of Florida identification card AND a valid social security card. In addition, applicants must bring a completed and signed Service

Provider Input Document (Appendix L) on the day of testing. Tutors who do not have this form will be turned away. This form is to be completed by the Provider. The form can be found at http://forms.dadeschools.net/webpdf/6524.pdf.

K.3 Fingerprinting Process for Online Providers: • Providers/tutors who are delivering tutorial services online, and located outside of

the State of Florida, therefore, unable to obtain clearance from the M-DCPS’ Fingerprinting Office, must undergo a background check and fingerprint screening conducted by a law enforcement agency or other entity approved by the District located in their home state.

• All results must list the name of the Provider and be forwarded on the letterhead of the law enforcement agency or other District approved entity that conducted the screening to the Title I Administration office, Attention SES, for review and approval prior to the commencement of tutoring.

K.4 General Drug Screening • Providers must conduct general drug screening on all applicants, in the manner

set forth in School Board Rule 6Gx13- 4-1.05 and the Miami-Dade County Public Schools Drug-Free Work Place Technical Guide.

• Applicants must procure a drug testing authorization form by visiting the M-DCPS Drug Testing Office, located at 1500 Biscayne Blvd., Suite 115; Miami, Florida, 33132.

• Applicants must obtain clearance from the Fingerprinting Office prior to visiting the Drug Testing Office and bring a completed and signed Service Provider Input Document (Appendix L). This form can be found at http://forms.dadeschools.net/webpdf/6524.pdf.

• A negative drug screening result shall be a requirement for employment. K.5 Payment for Drug Screening

• The cost of drug screening will be borne by the Provider or the applicant. • The cost for drug screening is $31.90 (MONEY ORDER ONLY) payable to

Miami-Dade County Public Schools. NO CASH, NO CHECKS. K.6 Drug Screening Process for Online Providers • Providers/tutors who are delivering tutorial services online and located outside of

the State of Florida, therefore, unable to obtain clearance from the M-DCPS’ Drug Testing Office, must have a general drug screening test conducted in the Provider’s/tutor’s home state.

• The results of the drug screening conducted in the Provider’s home state must be submitted directly from the laboratory that has been approved by M-DCPS in an unopened, sealed envelope to Miami-Dade County Public Schools, Title I Administration Office, Attention SES, for review and approval with the name of the provider clearly identified.

L. PROFESSIONAL CODE OF ETHICS • To ensure that SES Providers deliver high quality services to eligible students,

interact with schools, parents, and each other in a professional manner, Providers are required to adhere to the M-DCPS’ Guidelines for Professional Code of Conduct and Ethics for Providers, Providers’ Employees and Contracted Entities (Appendixes I and J) in addition to the Education Industry Association’s (eia) Code of Professional Conduct and Business Ethics (Appendix K).

L.1 Standards Specific to SES SES Providers will consistently implement the NCLB SES provisions. To that end, Providers will NOT: • Compensate school district employees personally in exchange for access to

facilities, to obtain student lists, to assist with marketing or student recruitment, to promote enrollment in a Provider’s program at the exclusion of other providers, to obtain other similar benefits for their SES program, or for any illegal purpose.

• Employ any district employee who currently serves the District in the capacity of principal, district administrator or SES Coordinator.

• Employ any individuals, including teachers, parents or community leaders, who have any governing authority over a school district or school site where the providers deliver services.

• Make payments or in-kind contributions to schools or school personnel, exclusive of customary fees for facility utilization in exchange for access to facilities, to obtain student lists, to increase student enrollment, to obtain other similar benefits for their SES program or for any illegal purpose.

• Misrepresent to anyone, including parents (during student recruitment), the location of a Provider’s program, principal, district or state’s approval of a Provider, or the likelihood of becoming so approved.

• Offer a parent or student any form of incentive for signing-up with a Provider. • Implement a rewards program for attendance and/or achievement that is not part

of the provider’s state-approved program. • Employ an SES enrolled student. • Use a M-DCPS’ SES enrollment form that has the selected Provider’s name pre-

printed as part of the form. • Encourage students/parents to switch Providers once enrolled. A student is

considered enrolled once the District has issued the formal student / Provider selection list.

Providers MAY: • Provide simple door prizes of a nominal value (approximately $5 per prize) and

refreshments to potential students and their families, while attending informational sessions.

• Offer enrolled students performance/attendance rewards up to $50.00 per student per year.

• Employ school district employees for instruction-related services or program coordination purposes as long as the person does not restrict or attend to restrict the marketing or enrollment opportunities of other Providers, subject to District policies governing conflict of interests and other District-imposed requirements.

• Include in tutor compensation, incentives for student achievement consistent with a company’s written policy.

M. ENROLLMENT PROCESS M.1 Parent Selection • Prior to the start of the school year, the District mails out information to the

homes of students attending eligible schools regarding the availability of the program. The package contains a notification letter, the provider directory, SES Applications in three languages, and a flyer that includes information about the program and specific dates for the Districtwide Parental Choice Information Fairs.

• Parents of eligible students are encouraged to contact Providers by phone or email to learn more about the programs and to determine if the program would be the right fit for their child.

• If SES information sessions are held at the schools (open houses, provider fairs, etc.), Providers are strongly encouraged to attend them to meet parents.

M.2 Marketing Your Program • All marketing materials including posted materials used by providers to promote

SES services in Miami-Dade County shall include a disclaimer specifying that “Distribution of this information does not imply endorsement or recommendation by Miami-Dade County Public Schools (M-DCPS)”. Additionally, marketing materials distributed to parents must include a notice advising parents that “In order for your child to be eligible for free tutoring, your child must attend a Title I School that has been designated as a ‘School In Need of Improvement (SINI)’ and must be eligible for Free or Reduced Price Meals for the 2009-2010 school year.”

• All marketing materials must be submitted for review and approval to the District’s Title I Administration Office, prior to distribution.

• The District will notify the Provider of either approval or disapproval of marketing materials no later than ten business days from receipt by District. Any unauthorized marketing materials found by the District on School Board Property and/or at District sponsored events will be seized and disposed of by District personnel. Failure to comply with all marketing requirements will result in this contract becoming null and void.

• Providers may market their program outside of schools, but there is no obligation for the school to allow Providers in the building to recruit students or market to parents, outside of scheduled “fairs” and open houses.

• Providers and their staff must wear an ID displaying the name of the provider and the name of the employee or representative and stay 600 feet away from school grounds when marketing their programs.

• Schools have been instructed to post information about all SES Provider Programs in the Parent Resource Center or an area where parents regularly congregate. Providers may ask the school to include their materials, assuming they have been approved by Title I Administration pursuant to the 2009-2010 SES Contract, for that display.

• Providers may not market directly to students, nor offer any kind of incentive or promise of an incentive to a student, parent or other family member.

M.3 Submission and Processing of the SES Application • Parents will have the opportunity to fill out an electronic version of the SES

Application and submit it through the Parent Portal to Title I Administration. • Parents who fill out a hardcopy of the SES Application may return it to their

child’s school, to one of the SES Parent Choice Fairs, and mail/deliver or fax it to Title I Administration for processing.

• No forms will be acceptable by Title I directly from Providers. • Forms will ONLY be accepted up until the deadline for enrollment.

How the SES Application is processed by Title I Administration: • The application is first date stamped. • The school and student’s eligibility is verified. • Every attempt will be made to place the student with one of the three selected

providers. • If a parent has submitted more than one application for different Providers, Title I

Administration will only process the first application received. • Each Provider will be provided with a list of students assigned to their company. • Providers are encouraged to contact Title I Administration in the event that they

have any questions about this process, at 305-995-3049. M.4. Change of Provider Requests Changing Providers will be done only in cases such as: to correct errors in assigning students, or in the event of a sibling issue, or the failure to develop an SLP, which is agreeable to the parent. A change of Provider may only be requested by the parent and must be submitted to the Title I Administration office for review and consideration. Changing Providers is not permitted once the District approves the Student Learning Plan (SLP). N. STUDENT CONFIDENTIALITY Providers will maintain the confidentiality of all students receiving SES and not disclose the identity of any student who is eligible for or receiving SES without the prior written permission of the student’s parents/guardians, except as authorized by School Board personnel. The Provider understands and agrees that it shall comply with the Family Educational Rights and Privacy Act (“FERPA”) and all state and federal laws relating to the confidentiality of student records.

O. TUTORING SESSIONS O.1 The First Tutoring Session and the Student Learning Plan (SLP) • Providers may use the FCAT and or other District approved assessments results

to determine the areas for improvement for each student. • Providers are required to administer a pre-assessment to those students for

whom the District does not have performance data available. • The electronic Student Learning Plan (Appendix A) must be completed and

submitted via the SES Web-Based System and approved by Title I Administration prior to the start of tutoring services.

• Providers should review a student’s portfolio for information regarding proficiency level, scale scores on state assessments, and ELL and/or Special Student Education status.

• A copy of EACH SLP must be given to the parent and must be SIGNED by the parent.

• The SLP must be signed by the parent of every child receiving services. A copy of the SLP must be given to the student’s school and Providers are required to maintain copies of SLPs at the service site throughout the service period for review by M-DCPS, FLDOE, and/or federal monitors/auditors.

• Once the SLP is completed, a hard-copy of the Parent Signature Page must be signed in blue ink by the parent and the Provider. The original Parent Signature Page must be submitted to Title I Administration upon the completion of the Student Learning Plan (SLP) along with the completed Parent Signature Page Cover Sheet.

• The SLP will not be approved until the original Parent Signature Page has been received by Title I Administration.

• You must submit ONLY the hard copy original Parent Signature Page to Title I Administration to obtain final approval of the student’s SLP.

• Providers are required to access the SES Web-Based System on a daily basis, in order to perform a search to determine the approval status of SLPs submitted to Title I Administration.

• In the event that an SLP is disapproved, providers are required to make the appropriate changes and resubmit the updated SLP online. However, Title I Administration will not review the updated SLP until the Parent Signature Page Cover Sheet is submitted to the Title I Administration Office, listing the names of student(s) and the Resubmitted SLP column check marked. It will not be necessary to resubmit the Parent Signature Page to Title I Administration.

O.2 Control of Students/Student Safety The Provider, while providing services, shall be solely responsible for the control and safety of all students from the time the student arrives until the student is placed under the control of the parent/guardian or other approved caregiver, at the end of the service. The Provider must escort all students to the proper caregiver or approved means of transportation at the end of service. The Provider must check the ID of the person picking-up the child to make sure that it matches an individual allowed to care for that child if the person is unknown to the Provider. The Provider shall not release the student to any individual other than the parent/guardian, unless

the parent/guardian has authorized that individual, in writing, to take custody of the student. The Provider will keep Student Emergency Contact information at hand while providing services to students. An in-home Provider shall only provide services if a parent/guardian is present in the home during tutoring sessions. Additionally, the provider shall maintain a plan of action or substitute provisions, inclusive of tutors, instructional materials, and supplies, in the event a tutor is absent. It is strongly encouraged that providers arrange a meeting with the principals to discuss supervision, safety and security issues as well as review the school’s safety plan; discuss pertinent aspects of the provider emergency procedures and schedule sessions and room assignments. While it is the responsibility of providers to maintain the safety of students from the time the students arrive until the students are placed under the control of the parents/guardians or other approved caregivers, at the end of the services; the overall safety and control of students is ultimately a shared responsibility of the provider and the school. O.3 Incident Reporting The Provider shall notify immediately by facsimile and mail within twenty-four (24) hours of an accident or incident when a student has suffered an injury, or injured another individual, or has been involved in an activity requiring notification of law enforcement or emergency personnel.

The Provider shall further be obligated to report an accident or incident to appropriate authorities with a copy to the District when it is notified or otherwise becomes aware of circumstances including, but not limited to: all allegations of molestation, child abuse, or missing children under the Provider’s supervision. The Provider agrees to submit a written summary report of the occurrence to the School Board within three (3) days of original notification.

The Provider further agrees to notify the District immediately, of any information that may be detrimental to the health or safety of any students or that may inhibit the Provider’s performance of this Contract. O.4 Tutoring Limits As per the FLDOE, the Provider shall limit tutoring to six (6) hours per week or up to two (2) hours per day, with the exception of weekends when the provider is allowed to provide up to three (3) hours of tutoring per day. The District will not compensate any Provider for any tutoring which occurs beyond six (6) hours in a week, provided that a week shall be considered Sunday through Saturday. O.5 Supplies/Materials The Provider shall be solely responsible for the provision of all appropriate supplies, equipment, materials and facilities for each student as required in his/her SLP. O.6 Attendance Daily student attendance must be recorded by the Provider for each student (Appendix N). Whether the student attends a program in the school, a community

center, or the instructor visits the student’s home, students or parents (acceptable for kindergarten students only) must initial the Monthly SES Individual Student Attendance Report form for each tutoring session. In the case of in-home tutoring, students as well as a parent, must initial the form. Providers must submit the form, along with the company invoice and the Title I EOM report to Title I Administration. P. MONTHLY SES INDIVIDUAL STUDENT ATTENDANCE REPORT P.1. Instructions All Providers MUST provide a Monthly SES Individual Student Attendance Report form along with thel company invoice. Information on this form must be entered on a daily basis for each student in attendance, as follows: • Input student’s name, student identification number, Provider name and code,

and reporting month/year on the upper left hand corner of this form for each applicable line.

• Input the current name of the school and current school code the student attends during the regular school day as well as the tutor’s first and last name(s), and the maximum number of annual billable hours that your company will provide for 2009-2010 school year on the upper right hand corner of this form for each applicable line.

• Enter the total number of hours provided for the month on the appropriate line. • Indicate the number of hours of services under each respective day of the

month. The hours listed on this form and invoiced MUST be in 30 minute intervals (i.e. 0.5, 1.0, 1.5, hours etc.).

• Have the student print his/her initials on a daily basis, under each respective day of the month for which he/she is in attendance on the bottom row of the grid. Hours of services will be removed if student’s initials are missing or wrong.

• Each tutor who provided tutoring during the month must print his/her initials in the appropriate box to indicate the date(s) when services were provided by that tutor. Hours of services will be removed if tutor’s initials are missing or wrong.

• Have a parent print his/her initials on a daily basis, under each respective day of the month for which his/her child is in attendance (required for in-home tutoring only). Hours of services will be removed if parents’ initials are missing.

• The tutors whose initials appear in the Tutor’s Initials section must also print their name at the upper right hand corner of the form and underneath the tutor’s certification statement. Each tutor whose initials appear in the grid must also sign and date the form.

• Hours of service will be removed if the provider did not receive official communication from the Title I Administration office verifying that the tutor was cleared prior to the first 2009-2010 tutoring session.

• The original Monthly Supplemental Educational Services Individual Student Attendance Report must be signed and dated in blue ink by the Principal of the Provider Agency, or authorized representative(s) as substantiated by the

SES Provider Authorized Representative Form for Documentation on file with the District (Appendix H) and must be attached to the invoice.

• Whiteout/correction fluid shall not be used under any circumstances to make corrections on student’s dates/hours/initials, parent’s initials (required for in- home tutoring), and/or tutor’s name, initials, and signature. Any attendance sheet which includes whiteout/correction fluid in the afore-mentioned fields will have the hour(s) of service for the day(s) removed and the provider will not be compensated by M-DCPS. If corrections are needed, the instructions on page 20 are to be followed.

Q. INVOICING Q.1. Instructions All Providers MUST submit invoices on the official M-DCPS Invoice Form (Appendix O). • All services MUST be invoiced in 30 minute intervals (i.e. 0.5, 1.0, 1.5, etc.). • An original Title I EOM Report (Appendix M) and all Monthly Supplemental

Educational Services Individual Student Attendance Reports (Appendix N) with original signatures in blue ink by the Principal of the Provider Agency, or authorized representative (as substantiated by the SES Provider Authorized Representative Form for Documentation on file with the District), must be submitted.

• All invoices are due by the 5th each month following the month of attendance in order for processing to be conducted in a timely manner.

• Invoices submitted after the 15th of the month will be assessed a fee of $60.00. For invoices submitted after the 28th of the month, a fee of $10.00 per day shall be assessed. Invoices returned to Providers for corrections must be resubmitted to the District within five (5) business days of notification. Otherwise, a fee of $10.00 per day will be assessed for corrections submitted after the 5th business day of notification. Invoices returned to the Provider for corrections more than one time for the month shall be assessed an administrative fee of 2% of the total invoice amount. The District shall deduct the appropriate fees delineated above from the total invoice amount.

MAKE SURE THAT THE PROVIDER NAME, ADDRESS, AND THE M-DCPS VENDOR NUMBER ON THE INVOICE IS IDENTICAL TO THE NAME AND ADDRESS LISTED ON THE EXECUTED CONTRACT ON FILE. Also, the remit to address on the invoice must be identical to the remit to address on the Vendor Application. In the event that the remit to address changes, the provider must notify the M-DCPS’ Procurement Department in writing and copy the Title I Administration office. In order to expedite the review process of submitted invoices, providers must adhere to the following guidelines:

• Review the most recent and updated Tutor Status Chart provided via email by Title I Administration to verify that tutors are cleared to provide services. As per the contractual agreement, tutors must undergo background checks and drug screening prior to providing services to students.

• The names of all tutors who provided tutoring to students for the month must be entered on the space provided on the Monthly SES Individual Student Attendance Report. Additionally, each tutor who provided tutoring during the month must print their initials in the appropriate box to indicate the date(s) when services were provided by that tutor. Furthermore, all tutors who initialed the report are required to sign and date the Monthly Supplemental Educational Services Individual Student Attendance Report. The date must match the month in which services were provided and the supervisor’s signature cannot be dated prior to the last date of tutoring.

• Original student’s, parent’s (for in home-tutoring), and tutor’s printed initials (first name and last name), are required for each tutoring session. Providers will not be compensated for tutoring sessions that do not have the original student’s, parent’s (for in-home tutoring) and/or tutor’s initials.

• Units entered for each student on specific dates into the SES Web-Based System (Weekly Update) must match the hours entered on the Individual Student Attendance Report.

• This office will not accept Monthly SES Individual Student Attendance Reports if whiteout/correction fluid has been used to make corrections on student’s dates/hours/initials, parent’s initials (for in home-tutoring) and/or on tutor’s name, initials or signature and therefore, providers will not be compensated. If corrections are needed, the following procedures must be followed to indicate such corrections:

1. Hours entered on the wrong date must be corrected by drawing an arrow indicating the appropriate date when the tutoring session was provided.

2. If student’s and/or tutor’s initials were entered on the wrong date, a line must be drawn through the incorrect date and the student and/or tutor must initial on the correct date.

3. If a student completed the maximum number of sessions allowed and services are provided to the student beyond this date, a line must be drawn after the date of the last billable session.

4. The supervisor signing the Individual Student Attendance Report must initial each page containing corrections. A written statement, on company letterhead, detailing each correction made to the forms must be signed and dated by an authorized representative as substantiated on Appendix H.

• An electronic Progress Report for the month must be completed and submitted via the SES Web-based System for each student listed on the Title I SES EOM Report.

• Providers are notified via email of invoice discrepancies. Providers will not be compensated for tutoring sessions that do not have printed/original legible student’s/tutor’s initials or tutor’s name and signature. Once an invoice is submitted to the Title I Administration Office, providers will be prohibited from taking the invoice out of the office. Therefore, if corrections are needed, providers may work from their copies and then, an appointment must be scheduled to come into the Title I Administration Office to transfer the corrections onto the original form. To expedite the review process, please place the Monthly SES Individual Student Attendance Report form in the same order that the student’s name appears on the Certified Report.

Q.2. Payment • The Provider is paid only for the sessions students attend and that have been

initialed by the student and the tutor(s) who provided the services. The District reserves the right to withhold payment if a review reveals that overcharges have been submitted by the Provider. Pre-assessments and post-tests are not billable.

• Invoices will be reviewed in the order they are received. • If applicable, the District will deduct the appropriate fees delineated on

Section III, S of the 2009-2010 SES Contractual Agreement from the total invoice amount. • Invoices submitted more than sixty (60) days after services are rendered are

subject to non-payment. • Title I Administration will verify the accuracy of the following information

before routing the invoice for payment:

R. PROVIDERS REPORTING REQUIREMENTS

R.1 Student Progress Report The Provider shall complete the Student Progress Reports online via the SES Web-based System in order to ensure that parents are provided with information on the student progress at least monthly in an understandable and unified format (Appendix B). The provider shall provide the parents with a printed version of the Student Progress Report. The District and the student’s teacher may be provided with electronic report unless written documentation is specifically requested. It is the provider’s responsibility to maintain a printed copy of each progress report generated for a student in the student’s individual file. In the event that a parent requires translation of the Student Progress Report, the Provider will be responsible for providing such translation services whenever practicable, however, translation of the information contained in the Progress Report into Spanish and/or Haitian-Creole shall always be practicable.

R. 2 Tutoring Schedule Providers are required to maintain in the SES Web-Based System an up-to-date tutoring schedule for each assigned student, in order to ensure continuity of services, the safety of students, and the efficient monitoring of services and program implementation. The Provider shall communicate all changes in the student tutoring schedule to the parent and the student’s school. S. MONITORING/COMPLIANCE M-DCPS, Title I Administration is vested in maintaining the highest standards in the implementation of SES through a two-tier structure comprised of thorough monitoring visits from the school-site SES facilitator and Title I Administration staff. The areas to be monitored have been grouped into the following categories: Program Management, Delivery of Instruction and Student Records. The items of each category reviewed during monitoring are recorded in the respective school-site SES Facilitator and/or the Title I Administration Supplemental Educational Services Monitoring Tool (Appendix Q). Upon completion of theon-site monitoring, Title I Administration conducts a careful evaluation of the results, issue recommendations and contact the provider if a specific area is found to be non-compliant. The providers may be required to develop and implement a corrective action plan. Title I Administration has also implemented written complaints procedures to be used by anyone who in good faith believes that marketing strategies or services are not being delivered in compliance with federal, state, and local regulations, the SES Contractual Agreement between the District and the State-Approved Providers, and the Guidelines for Professional Conduct and/or Ethics regarding SES (Appendix P)

Code of Professional Conduct and Business Ethics For

Supplemental Educational Services Providers

Amended January 8, 2008

This revised code of ethics, as adopted by the EIA Board of Directors, shall become effective January 8, 2008. SES Providers (and other education service providers) operate in an environment that touches communities, school officials, parents, students and other providers. The importance of the activities and complexity of the interactions make it paramount that EIA member organizations adhere to the highest standards of professional conduct and business ethics. In its role of providing critical leadership to the education industry, both public and private, EIA has adopted this voluntary code to describe key organizational behaviors and policies that will guide its member companies and others. High quality educational programs delivered by trained professionals represent the core value that is to be reflected throughout all of our partnerships with schools, parents and students. The following structure represents the collective judgment of what constitutes ethical behavior. EIA members are committed to using it to guide decision-making and performance at all levels of their organizations—from the CEO to the employee in the classroom. Accountability for achieving desired results consistent with these guidelines and standards is the ultimate benchmark upon which EIA member service providers will be judged. We encourage States and Local School Districts to adopt these guidelines into their governance, contractual and oversight systems and apply all appropriate sanctions when the guidelines have been breached. EIA Compliance Procedures:

1. EIA will develop educational materials on these standards for use by providers, States and school district personnel. These materials will be distributed to members and non-members alike for their incorporation into their internal staff development procedures.

2. All EIA members will sign a statement acknowledging their acceptance of these standards. EIA will maintain a list of signers on its website for the public to review.

3. When a State or School District completes an investigation and has a finding that a breach of these guidelines has occurred, EIA may issue its own censure, suspend or terminate the membership status of the Member. Before EIA acts, it will discuss the matter with the party and offer the party the opportunity to present its information to an ad hoc committee of the Board of Directors.

1. Conduct community outreach and student recruitment and to serve students fully consistent with the terms of their state-approved application and all state and local policies.

2. Conduct business honestly, openly, fairly, and with integrity. 3. Comply with applicable laws, statutes, regulations and ordinances. 4. Avoid known conflict of interest situations. 5. Never offer or accept illegal payments for services rendered. 6. Apply these guidelines and standards throughout the company by insuring all employees understand

them and act accordingly. 7. Refrain from publicly criticizing or disparaging other providers. 8. In the case of any conflict, first attempt resolution directly with each other. However, the parties involved

may ask EIA to help mediate potential disputes. 9. Comply with the confidentiality and non-disclosure provisions of all applicable federal, state and local

laws, including those relating to student identity, records, reports, data, scores and other sensitive information.

10. Be factual and forthright in reporting and documenting attendance rates, effectiveness of their programs, and in explaining the theoretical/empirical rationale behind major elements of its program, as well as the link between research and program design.

11. Take appropriate corrective action against provider employees, consultants or contractors who act in a manner detrimental to the letter or spirit of this code. 12. Take immediate steps to correct any actions on its part that willfully or inadvertently violate of the letter or spirit of this code.

Standards Specific to SES

EIA Members will consistently implement the NCLB Supplemental Services provisions and promote full access to SES services. To that end, Providers Shall: 1. Not compensate school district employees personally in exchange for access to facilities, to obtain

student lists, to assist with marketing or student recruitment, to promote enrollment in a provider’s program at the exclusion of other providers, to obtain other similar benefits for their SES program, or for any illegal purpose.

2. Not employ any district employees who currently serve the districts in the capacity of Principal, Assistant Principal, or school or district SES Coordinator.

3. Not employ any individuals, including teachers, parents or community leaders, who have any governing authority over a school district or school site. The sole exception shall be in school districts that are considered rural and where there are few providers.

4. Not hire school-employed personnel for any purpose other than instruction-related services or program coordination, as described in item #3 in the next section below.

5. Not make payments or in-kind contributions to schools or school personnel, exclusive of customary fees for facility utilization in exchange for access to facilities, to obtain student lists, to increase student enrollment, to obtain other similar benefits for their SES program or for any illegal purpose.

6. Not misrepresent to anyone, including parents (during student recruitment), the location of a provider’s program, principal/district or state’s approval of a provider, or the likelihood of becoming so approved.

7. Not offer a student, parent or teacher any form of incentive for signing-up a student with a provider. This includes restricting the promotion of any allowable attendance or performance incentives to the period following student enrollment. Only then may the provider inform the student of any incentives that are directly linked to attendance or performance in SES.

8. Not sponsor promotional events including pizza parties on school grounds for student recruitment that are for the sole benefit of a single provider. The preferred practice is for the school to organize such

recruitment events that are for the benefit of all providers, accepting voluntary sponsorship from providers.

9. Not employ any SES-enrolled student. 10. Not use a district enrollment form that has the selected provider’s name pre-printed as part of the form.

Any facsimile of the enrollment form used to demonstrate how to accurately complete it must be clearly marked as “SAMPLE” and this facsimile shall in no way be used to actually enroll the student.

11. Not encourage students/parents to switch providers once enrolled. A student is considered enrolled once the District has issued the formal student / Provider selection list.

Providers MAY: 1. Provide simple door prizes of a nominal value (approximately $2 per prize) and refreshments to

potential students and their families, while attending informational sessions. 2. Offer enrolled students performance rewards with a maximum value of $50 that are directly linked to

documented meaningful attendance benchmarks and/or the completion of assessment and program objectives. These incentives shall not be advertised in advance of actual enrollment.

3. Employ a parent of an SES-eligible student subject to the following conditions. Each parent of an eligible student who is hired by a provider must have a written job description and must be compensated on the same basis as all other employees of the provider who perform similar work. No parent may receive any commission or other benefit related to the enrollment of his or her child in a provider’s program, nor may a parent be subject to any employment action by the provider on account of the parent’s selection of an SES program for his or her child.

4. Employ school district employees (subject to items #2, #3 and #4 in the previous section above) for instruction-related services or program coordination purposes as long as the person does not restrict the marketing or enrollment opportunities of other providers, subject to District policies governing conflict of interests and other District-imposed requirements. However, tutors who are currently employed by the school district may not recruit students.

5. Include in tutor compensation, incentives for student achievement consistent with a company’s written policy.

Activities

TUTORING

The following rules shall apply to any public school employee who engages in independent tutoring for a fee of any student enrolled in the public schools:

1. The employee shall not arrange to tutor for a fee, nor to solicit for a private school, any student currently enrolled in his/her classes.

2. The employee shall not tutor any student for a fee, during regular

working hours of the employee nor on public school premises.

3. An employee who accepts tutoring engagements shall make arrangements with the parents for the fees to be charged.

Qualifications for Private Tutors

The following information is quoted from Rules of the State Department of Education, 6A-1.951:

"Private tutors. - Any person who tutors a child of compulsory attendance age, when such tutoring is in lieu of school attendance for the child, shall meet the following requirements:

"(1) He shall hold a valid Florida certificate to teach the subjects or grades in which instruction is given. "(2) He shall keep all records and make all reports required by the state and school board and shall make regular reports on the attendance of pupils in accordance with the provisions of Section 232.17, Florida Statutes. "(3) He shall require pupils to be in actual attendance for the minimum time as prescribed in Section 228.041(17), Florida Statutes. "(4) Any person who engages in private tutoring of children of compulsory school age who fails to meet the requirements shall be subject to prosecution under the provisions of the Compulsory Attendance Law."
