What is Free Speech?Free speech is a constitutional right guaranteed by the First Amendment:

“Congress shall make no law respectingan establishment of religion, or prohibiting the free exercise thereof: or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

Hate Speech vs Hate CrimeHate Speech

Speech that verbally attacks a group or idea on the basis of attributes such as race, ethnicity, religion, gender, sexual orientation, etc. This IS protected under the First Amendment.

Hate CrimeA criminal offense against a person or property motivated in whole or in part by an offender’s bias against a race, religion, disability, sexual orientation, ethnicity, gender, or gender identity. This IS NOT protected under the First Amendment.
