The attached originals of the NPDES Discharge Monitoring

Report (T-40), have been provided to you as a master,,The

permit establishes specific effluent monitoring and reporting

requirements and these values are repeated on the original

Discharge Monitoring Report provided for .you. The "N/A" placedI

in the permit condition block of the Discharge Monitoring Report

indicates one of two things: (1) that the parameter is moriitored

but no limitations are imposed, and the pertinent value must be

reported, or (2) that the parameter is limited elsewhere on the

Discharge Monitoring Report, and the value should be reported'f

it is available.

Your reports are 'to be submitted by utilizing copies of the

attached forms. Do not write on or'end the attached ori inals,

but rather (1) make copies of them; (2) fillout the copies as

appropriate, (3) make the necessary copies of the completed, (filled

out) form, and (4) submit these copies to the appropriate EPA and

Application for renewal of this permit, or notification of intent to cease discharging. by the expiration date, must be submitted to'the Department at least 180 days priorto the above expiration date (unless permission has been granted by the Departmentfor submission at a later date), using the appropriate NPDES Permit ApplicationForm. In the event that a timely and complete application for renewal has beensubmitted and the Department is unable, through no fault of the permittee, to,reissuethe permit before the above expiration date,,the terms and conditi'ons of this permitwillbe automatically continued and will remain fully effective and enforceable pending

This is to distinguish it from anoverflow v,hich is the systematic discharge of a mixture of partially treated'r untreated, sewage and stormwater from any device or structure ofcombined sewerage facilities which is in excess of the downstream hydrauliccarrying capacity of those facilities.

The term "severe property damage" means substantial physical damageto property, damage to the treatment facilities which causes them tobecome inoperable, or substantial and permanent loss of natural resourceswhich can reasonably be expected to occur in the absence of a bypass.Severe property damage does not mean economic loss caused by delaysin production.

The "average monthly flow".means the arithmetic mean of daDy flowmeasurements taken during a calendar month.

The "average monthly" mass discharge means the total discharge by weightduring a calendar month divided by the number of.days in the month thatthe facility wah operating. Where less than daily sampling is

6. The "maximum daily" mass discharge means the total discharge by weightduring any'calendar day.

The maximurh timeperiod between individual samples shall not exceed two hours.

The term "grab sample" means an individual sample collected in lessthan 15 minutes.

The term "measured flow" means any method of liquid volume measurementthe accuracy of which has been previously demonstrated in engineeringpractice, or for which a relationship to absolute volume has been obtained.

The term'"estimate" means to be based on a technical evaluation of thesources contributing to the discharge including, but not limited to, pumpcapabilities, water meters and batch discharge volumes.

II. MONITORING AND REPORTING

A. Re resentative Sam lin and Test Procedures

1. Samples and measurements taken as reauired herein shall be representa-tive of the volume'and nature of the monitored discharge.

2. Unless other wise specified in this permit, the test procedures for analysisof pollutants shall be those contained in 40 CFR Part 136, or alternatetest procedures approved pursuhnt to that part.'. Self-Monitorin and Re ortin Re uirements

The permittee shall effectively monitor the operation and efficiency of alltreatment and control facilities and the quantity and q'uality of the discharge.Monitoring data required by this permit shall be submitted monthly.

A Discharge Monitoring Report (DMR) properly completed and signed by thetreatment plant operator''in responsible charge, must be submitted within 28days after the end of each monthly report period. Notification of the designationof the responsible operator must be submitted to the permitting agency bythe permittee within 60 days after the effective date of the permit and fromtime.to time thereafter as the operator is replaced. The DMR'must be sentto the Department and the EPA Regional Office at the following addresses:

1. 24-Hour Reporting:

The permittee shall orally report to the Department within 24 hours ofbecoming aware. of the following:

(a) Actual or anticipated non-compliance with any term or conditionof this permit which may endanger health or the environment.

(b) Actual or anticipated non-compliance with any "maximum daily"discharge limitation which is identified in Part Al of this permitas being either:

(i) A toxic pollutant effluent standard established by EPA pursuantto Section 307(a) of the Clean Water Act, or /

(ii) A toxic or hazardous pollutant which, if not adequately treated,could constitute a threat to human health; wel'fare, 'or theenvironment,

(iii) Any pollutant identified as the method to control a toxicpollutant or hazardous substance (i.e., indicator pollutant).

(c) Any unanticipated by'pass which excee'ds any effluent limitationsin the per mit..

(d) Where the permittee orally reports this information within theabove mentioned 24 hour time period, a written submission outlining.the above information must be. submitted to the Department within5 days of becoming awar e of such a condition, unless this requirementis waived by the Department upon receipt of the oral'report.

Other Non-Compliance Reporting.

'(a) The permittee shall give advance notice to the Department of anyplanned changes to the permitted activity or facility which mayresult in non-compliance v ith permit requirements.

(b) Where the permittee knows in advance of the need for a bypasswhich willexceed effluent limitations it shaD submit prior noticeto the Department at least 10 days, if possible, before date of thebypass.

(c) The permittee shall repor t all instances of non-compliance whichare not reported above at the time'of DMR submission.

MANAGEMENTREQUIREMENTS

A. Publicl Owned Treatment Works (POTN)

1. Nhere the permittee is a Publicly Owned Treatment Norks (POTW), thepermittee shall provide adequate notice as discussed in A(2) below tothe Department of the foDowing:

(a) Any new introduction of pollutants into the POTN from an IndustrialUser which would be subject to Sections 301 and 306 of the CleanWater Act if it were otherwise discharging directly into watersof the United States.

(b) Any substantial change in the volume or character of pollutantsbeing introduced into the POTN by an Industrial User which wasdischarging into the POTW at the time of issuance of this permit.

(c) Any change in the quality and quantity of effluent introduc d intothe POTN.

(d) The identity of significant Industrial Users served by the POTNwhich are subject to pretreatment standards adopted under Section307(b) of the Clean Nater Act; the POTN shall also identify the.character and'volume of pollutants discharged into the POTW bythe Industrial User.

2. The submission of the above information in the POTN's annual NasteloadManagement Report, required under the provisions of 25 Pa. Code Chapter 94,willnormally be considered as providing adequate notice to'the

Department.'owever,

if the above changes in industrial pollutant loadings to thePOTW are significant enough to warrant either modification or revocationand reissuance of this permit, then the permittee is required to meetthe provisions of Management Requirements B below.

3. The POTW shall require all Industrial Users to comply with the reportingrequirements of Sections 204(b), 307, and 308 of the Clean Nater Actand any regulations adopted thereunder, and the Clean Streams Law and

any regulations adopted thereunder.

4. This permit shall be modified, or alternatively, revoked and reissued,to incorporate an approved POT'W pretreatment program "or a complianceschedule for the development of such program as required under Section402(b)(8) of the Clean Water Act and regulations adopted thereunderor under the Department's approved pretreatment program.

B. Permit Modification Termination or Revocation and Reissuance

1. This permit may be modified, terminated, or revoked and reissued duringits term for any of the causes specified in 25 Pennsylvania Code, Chapter 92.

2. The filing of a request. by the permittee for a permit modification, revocationand reissuance,'or a notification of planned changes or anticipated non-compliance does not stay any permit condition.

3. Notwithstanding the above, if a toxic effluent standard or prohibition(including any schedule of compliance specified in such effluent standardor prohibition) is established under Section 307(a) of the Act for toxicpollutant which is present in the discharge authorized herein and suchstandard or prohibition is more stringent than any limitation upon suchpollutant in this permit, this permit shaD be modified or revoked andreissued in accordance with the toxic effluent standard or prohibitionand the permittee shall be so notified.

In the absence of a Departmental action to modify or to revoke and reissuethis permit~ any toxic effluent standard or prohibition established underSection 307(a) of the Act is considered to be effective and enforceableagainst the permittee.

C ~ih fEPursuant to Sections 5(b) and 305 of Pennsylvania Clean Streams Law and 25

Pennsylvania Code, Chapter 92, the permittee shall allow the head of the Depart-ment, the EPA Regional Administiator, and/or their authorized representatives,upon the presentation of credentials:

1. To enter upon the permittee's premises where an effluent source is locatedor in which any records are required to be kept under the terms and condi-tions of this permit.

To have access to and copy at reasonable times any records requiredto be kept under the terms and conditions of this permit and.other documentsas may be'required by law.

The issuance of this permit does not convey any property rights in either realor personal property, or any exclusive privileges; nor does it authorize

E. Dut to Provide Information

1. The permittee shall furnish to the Department svithin a reasonable time,any information which,the Department may request to determine whethercause exists for modifying revoking and reissuing, or terminating thispermit, or to determine compliance with thi" permit.

The permittee shall at all times maintain in good working order and properlyoperate all facilities and systems (and related appurtenances) for collectionand 4 eatment which are installed or used by the permittee for water pollutioncontrol and abatement to achieve compliarice with the terms and conditionsof the permit. Proper operation and maintenance includes but is not limitedto effective performance based on designed facility removals;- adequate funding,effective management, adequate operator staffing and training, and.adequatelaboratory and processing controls including appropriate quality assuranceprocedures. This provision includes the operation of backup or auxiliary facDitiesor similar systems'when necessary to achieve compliance with this permit.

1. Bypassing Not Exceeding Permit Limitations: The permittee may allowany bypass to occur which does not cause effluent limitations to be exceeded,but only if the bypass is for essential maintenance to assure efficientoperation. This type of bypassing is not subject to the reporting andnotification requirements of Part A.2.D above.

2. In all other situations, by'passing is prohibited unless the following conditionsare met:

(a) A bypass is unavoidable to prevent loss of life, personal injury or"severe property damage";

(b) There are no feasible alternatives to a bypass, such as the use of~ auxiliary treatment facilities, retention of untreated wastes, or

maintenance during normal periods of equipment down-time; (Thiscondition is not satisfied if the permittee could have installed adequatebackup equipment to prevent a bypass which occurred during normalperiods of equipment downtime or preventive maintenance.);,and

(c) The permittee submitted the necessary reports requir ed under Part A.2.D.above.

The Department may approve an anticipated bypass, after consideringits adverse effects, if the Department oetermines that it willmeet theconditions listed under Part B.I.2. above.

Permittee shall take all reasonable steps to minimize any adverse impact onthe environment resulting'from noncompliance with this permit.

J. Solids Dis 'osal

Collected screenings, slurries, sludges, and other solids shall be disposed ofin such a manner as to prevent entry of those waters (or runoff from the wastes)into waters of the Commonwealth.

K. Penalties and Liabilit

I. Nothing in this permit shall be construed to preclude the institution ofany legal action or relieve the permittee from any responsibilities, liabilities,or penalties to which the permittee is or may be subject under Section311 of the Act. eJ

2. 'Nothing in this permit shall be construed to relieve the permittee fromcivil or criminal penalties for non-compliance pursuant to Section 309of the Clean Water Act or Sections 602 or 605 of the Clean Streams Law.

L. Transfer of Ownershi or Control

1. No permit may be transferred unless approved by the Department.

2. In the event of any pending change in control or ownership of facilities'rom which the authorized discharges emanate, the permittee shall notify

the Department by letter of such pending change at least thirty daysprior to the change in ownership or control.

The letter shall be accompanied by the appropriate Department formsfor'transfer of the permit and a writte'n agreement between the existingpermittee and the new owner or controller stating that the existing dateof permit transfer and that the new owner or controller shall be liablefor permit violations from that date on.

After receipt of the documentation above, the Department shall notifythe existing permittee and the new owner or controller of its decisionconcerning approval of the transfer. In approving a transfer the Depart-ment may modify or revoke and reissue the permit.

5. In the event the Department does not approve transfer of the permit,the new owner or controller must submit a new permit application.

M. ~biUThe provisions of this permit are severable, and if any provision of this permit,or the application of any provision of this permit to any circumstance is heldinvalid, the application of such provision to other circumstances, and the remainderof this permit, shall not be affected thereby.

Other Laws

Nothing herein contained shaQ be construed to be an intent on the part of theDepartment to approve any act made or to be made by the permittee inconsistentv ith the permittee's lawful powers or with existing laws of the Commonwealthregulating sewerage discharge and the practice of professional engineering,nor shaII this permit be construed to sanction any act otherwise forbidden byfederal or state law or regulation, or by local ordinance. Nor'oes it pre-emptany duty to obtain State or local assent required by law for the discharge(s). ~
